  • ADMINISTRATIVE PROCEEDINGS

    MARTIN HIRSH BARRED

    The Commission announced on February 20 that it ordered that Martin Hirsh (Hirsh) be permanently barred from association with any broker or dealer. Hirsh failed to answer the order which instituted administrative proceedings on December 10, 1991. The Commission found, among other things, that from at least January 1974 to in or about August 1989 Hirsh was the president and owner of Sunrise Capital Corp., a registeredbroker-dealer with the Commission. Further, the Commission found that on August 20,1990, in SEC v. Arnold Kimmes, et a1., 89 C 5942, ND Ill., the district court entered an order of permanent injunction against Hirsh, with his consent, enjoining him from violations of the federal securities laws.

    The Commission also found, among other things, that during a period from in or about 1985 to in or about 1987 Hirsh engaged in a scheme to defraud purchasers of the securities of GSS Venture Capital Corp. (GSS) and Max, Inc. (Max). Max is the successor corporation to Sherwood Financial Ltd. and Green Mountain Venture Corp.It was also found that the scheme involved, among other things, artificially raisingthe public trading price of the common stock of GSS and Max through a variety of manipulative devices.     TRADING SUSPENSIONS

    TRADING SUSPENDED IN THE SECURITIES OF ATRATECH, INC.

    The Commission announced the single ten-day suspension of exchange and over-the-counter trading in the securities of Atratech, Inc. for the period beginning at 11:30 a.m. (EST) on February 27, 1992 and terminating at 11:59 p.m. (EST) on March 11, 1992.

    The Commission suspended trading in Atratech Inc.' s securities because of (1)questions regarding the identity of persons having undisclosed control of the company, (2) questions concerning certain undisclosed related party transactions, and (3)questions concerning the validity of certain contracts with the City of New York which were obtained by persons and entities that had been barred from obtaining such contracts, and the resulting potential impact on the market for Atratech, Inc.' s securities.     APPROVAL OF PROPOSED RULE CHANGES

    The Commission approved a proposed rule change submitted by the Chicago Board OptionsExchange (SR-CBOE-90-l3) to provide listing guidelines for certain unit investment trusts that permit investors to separate securities into distinct trading components. Publication of the order is expected in the Federal Register during the week of February 24. (ReI. 34-30393)

    IMMEDIATE EFFECTIVENESS OF PROPOSED RULE CHANGE

    The Midwest Securities Trust Company filed a proposed rule change (SR-MSTC-92-02) that clarifies the use of MSTC's Participants Fund in situations where a loss occurs due to the fault of MSTC. The proposed rule change became effective upon filing with the Commission. Publication of the proposal is expected in the Federal Register duringthe week of March 2. (ReI. 34-30405)

    SIGNIFICANT NO-ACTION AND INTERPRETATIVE LETTERS

    INTERPRETATION OF NEW RULES UNDER SECTION 16 OF THE EXCHANGE ACT
