SB403..Omibus Election Bill
• Ratified August 1, not yet signed by the Governor….. but signing is expected.
• Will not cause a printed supplement of the Election Law book.
• Once signed, it will be sent to each CBE and the CBE will incorporate the changes within your law book.
Deceased Absentee Voter BillHB 1267
• As of August, 2014, it did not pass. It remains in the Senate Rules Committee where it has been since June 25, 2014.
• It received a lot of publicity and the public may think it is law, but it is NOT.
• Make sure your CBE staff is aware of the situation.
Summary of SB403 …Save for Reference
• Section 1(a) …Clarifies current position that the 90 day affiliation requirement for a candidate to file in a primary is counted from the date they file, not the start or end of the filing period.
• Section 2…CHANGE…Applies the random order used in primaries to the non-partisan Article 25 General Election Judicial races. That is SBE ballot responsibility, but CBE’s need to know.
Summary
• Section 3…Clarifies “cumulative total number of scheduled voting hours” as to one-stop plans. (George McCue)
• Sections 4,5 &6 ….Corrected/removed references.
• Section 7…Photo ID amendment (Brian LiVecchi)
• Section 8..Places in the statutes the termination of the voter guides upon exhaustion of remaining funds.
Summary• Sections 9 &10…technical changes• Section 11….Failure to list zip code on
absentee ballot by voter does not invalidate it.• Section 12(a)…Changes to GS 163-82.15(e)
unreported moves ( Ronni Degraffenreid)• Section 12(b)…Repeals GS 163-166.11(5) that
had allowed CBE to count out-of-precinct voter provisional ballots for ballot items they were eligible to vote for. VIVA has already done this effective 2014.
Summary
• Section 12(c) Rewrites GS 163-182.2(a)(4) as to the counting of provisional ballots.
• Section 13(a) Makes changes to Statement of Economic Interest in GS 138A-22.(Terry Harris)
• Section 14…Makes change in DMV statute as to special ID cards issued to voters.
• Sections 15 (a) (b)(c) and (d) makes technical changes to outdated statutory references.
Summary• Section 16…SBE authority to perform List
maintenance (Ronni Degraffenreid) • Section 17…Limiting times for special
elections. Basically, no odd number county special elections, only municipal allowed in odd years and at time of regular scheduled elections. Effective 1/1/2015.
• Section 18…Minor change as to timing of vote on change of municipal government ordinance under GS 160A-102.
Electronic Filing Changes
• Section 18.5(a) makes the requirement as to electronic filing of campaign finance reports based upon amount of financial activity that has cumulatively occurred in the election cycle.
• Effective 1/1/2017.
