To name one example, Trump hasrefused to release his tax returns show-ing what businesses he owns, howmuch money he owes and to whom,and so on. The public needs such in-formation to monitor whether anelected official is using his or her of-fice for personal gain. Former presi-dents Barack Obama and George W.Bush, along with nearly all presiden-tial candidates from the last severaldecades, have released their tax re-turns.

In addition to bringing a change oftone on ethics, the president has set adifferent tone on civil rights and free-doms. He has proposed actions thatreflect his attitudes. For example, hehas asked for deep cuts to the U.S.Equal Employment Opportunity Com-mission, federal civil rights enforce-ment offices, the Minority Business De-velopment Corp. and the Office of Fed-eral Contract Compliance Programs,which polices discrimination in federalcontracting.

The ethics and attitudes on dis-play in the highest office of governmentmay be contributing to public percep-tions of increased corruption. Accord-ing to surveys by Transparency Inter-national, in November 2017, 44% ofAmericans said corruption is pervasivein the White House, compared to 36%who said the same in January 2016.

Just as a corporate CEO’s ethicsand attitudes tend to influence all lev-els, so Trump’s attitudes may be hav-ing an impact in broad areas, includ-ing federal contracting: Is federal con-tracting still generally viewed as fair andnondiscriminatory? Do people believefavored contractors are more likely toget a pass than before? Are small busi-ness owners, especially minority andwomen owners, encouraged or dis-couraged about the ethics and equalrights protections in the current federalmarket? Set-Aside Alert will continueto explore these important questionsin 2018.

#2 Federal Budget ShiftsThe dramatic shifts in presiden-

tial and legislative priorities that oc-curred in 2017 are likely to have big

effects on small business federal con-tractors in the next several years.

In 2017, the GOP majority in Con-gress, which previously had beenhighly critical of increasing the deficit,reversed itself and authorized up to a$1.5 trillion increase in the deficit to payfor tax reductions. With the deficit onthe rise, there will be political pressureto reduce federal spending, includingcontract spending.

But GOP lawmakers also want toexpand defense spending. Congressauthorized a fiscal 2018 defense bud-get of $700 billion, which far exceedsthe $549 billion caps mandated by thebipartisan Budget Control Act of 2011.

Lawmakers would need to legis-late separately to overrule the caps inorder to carry out the defense spend-ing hike. If they succeed, there poten-tially would be more opportunities forsmall businesses in defense contract-ing.

The fiscal 2018 spending bills arenot yet completed, and House GOPMajority Leader Paul Ryan has said theRepublicans intend to pay for the addi-tional military costs by cutting Medi-care, Medicaid and Social Security. Thatwould hit small business contractorsin those programs.

Spending in other programsviewed as low priorities by the TrumpAdministration--including environmen-tal, scientific and medical research, andinternational trade and diplomacy pro-grams--also are likely to see reduc-tions, which would negatively impactsmall business vendors in those ar-eas.

#3 The NDAAThe National Defense Authoriza-

tion Act for Fiscal 2018 had a large num-ber of provisions affecting small busi-ness federal contractors. Here is aquick rundown of the major changes:• HUBZone maps will remain thesame until 2020, and then change ev-ery five years. There are new rules al-lowing governors to nominate zones,and a new requirement that decisionson HUBZone applications be madewithin 60 days.• Under Section 805, the SimplifiedAcquisition Procedures threshold

The value of small business pro-curement rose from $100.1 billion infiscal 2016 to $105.3 billion in fiscal2017.

The number of prime vendors win-ning contracts at the Defense Dept.shrunk by 21% from 2011 to 2015, dur-ing the period of defense cuts and se-questration, according to a new report.

The study by the Center for Strate-gic and International Studies and theAerospace Industries Associationfound that the number of prime con-tractors decreased from 78,500 to61,700 during the period, a drop of16,800.

Obligations to DOD’s small ven-dors fell consistently, while those tomedium-sized businesses initiallyrose, then fell, during the period.

The decreases were blamed onreductions in defense contract spend-ing, especially in research and devel-opment. “The enactment of seques-tration and budget caps marked a se-vere market shock,” the study said.Read the study at http://goo.gl/xu7ocw.

Minority- and women-owned fell12% vs. 27% for all DOD awards

Defense Dept. obligations to mi-nority-owned and women-owned con-tractors fell by 12% from fiscal 2010 tofiscal 2016, while total DOD contractspending fell by 27% during the period,according to a Government Account-ability Office report.

In total, the minority- and women-owned firms--both small and not-small-- earned $230 billion in DODcontracts during the period.

Awards to such firms decreasedfrom $36 billion in fiscal 2010 to $32billion in fiscal 2016. Awards to minor-ity owners fell from $23 billion to $20billion; to women, $8 billion to $7.2 bil-lion; and to minority women, $5.8 bil-lion to $5.1 billion.

The difference is that PresidentTrump and several of his Cabinetmembers have been criticized for notfilling vacant senior positions quicklyenough, or not filling them at all.

of the General Services Administration;Linda McMahon as administrator of theSBA; Althea Coetzee Leslie as deputyadministrator of the SBA; and RobbWong as SBA’s associate administra-tor for government contracting and busi-ness development.

Jackie Robinson-Burnette, a long-time career executive at the SBA whomanaged the 8(a) portfolio, amongother duties, recently left the SBA for ajob at a Maryland bank.

#5 Disasters hit hardHurricanes Harvey, Irma and Marie

blasted through Texas, Florida andPuerto Rico, and wildfires have rav-aged California, causing tens of bil-lions of dollars in destruction. Federalrelief and recovery efforts have totaledmore than $50 billion to date in 2017,with a number of contracts awarded tosmall business contractors. It is notclear whether a full tally of the smallbusiness share will be available. An-other relief package is in the works.

#6 2016 Small Business Goal MetIn mid-2017 it was announced by

the SBA that former President Obama’sadministration exceeded the 23%statutory goal for small business pro-curement for the fourth year in a row,for fiscal 2016. The total value of smallbusiness federal contracts rose to$100 billion, up from $91 billion.

Small vendors won 24.34% of eli-gible contracts, down from a high of25.75% the year before. The SBA forthe first time included overseas con-tracts in the pool of eligible contracts,increasing the pool to $411 billion, from$352 billion the year before. As the poolexpanded, the percentage going tosmall businesses was expected toshrink.

In addition, it was the fifth year in arow that federal agencies reached the3% goal for contracting with small firmsowned by service-disabled veterans.The 5% goal for small and disadvan-taged businesses also was met.Goals for HUBZone and women-owned small firms were not met.

#7 All Small Mentor-ProtegeThe SBA’s new All Small Mentor-

Protege Program got off to a fast startwhen it launched in October 2016, andit never slowed down. The program al-lows small businesses to partner withlarger mentor companies to win smallbusiness set-asides.

The program is open to all smallbusinesses. As of Dec. 1, 2017 the SBAhad approved 362 agreements be-tween mentors and proteges under theprogram.

#9 Big set-aside contracts awardedThe most talked-about federal

small business contract of 2017 wasthe $300 million awarded by a PuertoRican power authority to tiny WhitefishHoldings in Montana. It was canceledafter an uproar.

Other large contracts awarded tosmall firms included:• GSA named the 80 small busi-nesses that have won spots on the $15billion Alliant 2 Small Business con-tract for IT and professional services;• GSA awarded positions on the Vet-erans Technology Services 2 (VETS 2)governmentwide acquisition vehicle to70 firms. The contract was set asidefor service-disabled veteran-ownedsmall businesses (SDVOSBs).• GSA added 502 new 8(a) compa-nies to the STARS II governmentwideacquisition contract for computer-re-lated services. The contract is set asidefor 8(a) Business Development Pro-gram participants.

Republican House lawmakers ledthe effort in recent years to raise thegovernment’s small business goal to25%, from 23%.

But in 2017, when Republicansdominated Congress and a GOPPresident took office, nothing hap-pened. Is the effort dead or will it berevived?

Recent historyThe GOP-led House most recently

voted to raise the goal in 2014 in a billsponsored by Rep. Sam Graves, R-MO, then-chair of the House Small

Business Committee.The year before, the Republican

majority in the House spearheaded thedrive to raise the goal to 25% in its ver-sion of the National Defense Authori-zation Act of Fiscal 2013, but it was notin the Senate version.

2017 inactionIn 2017, when GOP President

Donald Trump took office and Repub-licans dominated the House and Sen-ate, there appeared to be an opportu-nity for the GOP to achieve its aim ofraising the goal. But nothing happened.

In May 2017, Democratic Rep.Suzanne Bonamici of Oregon submit-ted legislation to raise the goal to 25%to the House Small Business Commit-tee, but the committee took no action.The bill, HR 2362, has three Demo-cratic cosponsors.

Partisan disagreementsPartisan squabbling over the goal

has been a factor in interpreting goalachievement in recent years.

President Obama’s administra-tion achieved the 23% goal for smallbusiness procurement for four yearsin a row, starting in fiscal 2014. At thetime, Rep. Steve Chabot, R-OH, chairof the House Small Business Commit-tee, responded by suggesting the SBAwas “robbing small businesses” bydramatically inflating the numbers.Chabot objected to SBA’s accountingmethods.

Studies by Set-Aside Alert haveshown that inflation is possible in goalachievement, primarily due to the legalability of companies to remain as“small” for a time after being purchasedby large firms. The 2018 NDAA attemptsto address that (see story on page 1).

The small business goal may beprone to being manipulated by parti-sans on both sides. When a Demo-cratic president was in office, GOPleaders continuously drew attention tothe goal. Now that a GOP president isoffice, Democrats appear to be takingover the effort.

Will Chabot support efforts to in-crease the goal in 2018? His office didnot respond to a request by press time.
