This means audit logs and management of copies, faxes and printouts will need to be more detailed and with electronic application support.

Any PHI that is unsecured, the facility needs to disclose the breach to the public. Via news agencies, websites, and any media that the facility uses.

Criminal penalties for breach notification can go up to $1.5 Million Dollars.

-Must notify patients of breach “without unreasonable delay” and no later than 60 days from breach discovery-Must notify Secretary of Health & Human Services (HHS) and prominent media outlets if breach may involve more than 500 patients-Must notify next of kin if patients affected are deceased-Must provide details of the PHI records exposed and what steps are implemented to help mitigate harm to patient-Must provide annual notice to Secretary of HHS 60 days after end of calendar year about breaches that involved less then 500 patients
