The Road Safety Authority (RSA) hascalled for nominations in their annual“Leading Lights in Road Safety”Awards. Now in its eighth year, theawards recognise and honour thecontribution made by people nationwideto reducing deaths and serious injurieson our roads. The RSA is calling oncommunities all over Ireland to onceagain nominate their “Leading Lights”in road safety – whether it be a group oran individual who campaigns, educatesand is committed to improving roadsafety in their community.

Nominations are now open for the RoadSafety Authority Leading Lights awardsto recognise the work of committedvolunteers, businesses and organisations.

Road Safety Authority “Leading Lights in Road Safety” Awards

NISO expresses concern at the increase inpersonal injuries claims in 2015National Irish Safety Organisation(NISO) has expressed its concern overfigures recently published by the injuriesBoard in its mid-year review. TheInjuries Board reports that 17,132 newclaims have been made in the first sixmonths of 2015 representing a 7%increase on the 15,987 new claimsreceived in the same six-month period in2014. The mid-year review also revealsthat workplace claims are up 8.5%,accidents in public places are up byalmost 9% and motor claims are up6%. The average compensation awardfor the first six months of 2015 is€22,375, compared to an average awardof €22,082 in the same period last year.

Commenting on the six month figures,Mr. Maurice Priestley, Interim CEO atthe Injuries Board, stated: “It is notsurprising that there has been a modestincrease in claims volumes year to dategiven the general economic upturn withmore people at work and a lot morevehicles on the road. Greater economicactivity would be expected to generate

greater numbers of policies andpremium income for insurers.”

In response, NISO President, PauricCorrigan, has stated that “WhileNational Irish Safety Organisationwelcomes the recent upturn in theeconomy and the volumes returning towork, it is now more important thanever for employers and employees tokeep health and safety awareness at theforefront. With more and more peoplejoining the workforce, health and safetymust be the top priority to help preventthe continuation of this upward trend inaccidents and claims.”

Key Statistics:New claims (applications to theBoard): • New claim applications to the Injuries

Board during the six months to Juneincreased by 7% year-on-year to17,132.

• Accidents in public places andworkplace accidents are the maindrivers of the 7% increase in new

claims. During the first six months of2015, public liability claims are up byalmost 9%, employer liability claimsare up by 8.5% while new motorclaims are up 6%.

Awards for compensation (completedclaims): • The Board made 5,741 awards for

compensation to the value of €128.45million.

• The average award of €22,375 wasmarginally ahead of the average awardof €22,082 for the same six-monthperiod in 2014.

• Road traffic accidents represented overthree quarters (75.3%) of awards while16.9% of awards were for accidents inpublic places with the remaining 7.8%relating to workplace accidents.

• Administrative costs to process awardsthrough the Board’s model havereduced to 6.6% compared to anaverage of 58% for cases dealt withthrough litigation.

• At an administrative cost of 6.6%, thecost of processing a claim through theInjuries Board is at historically lowlevels; €600 for those responding to aclaim (typically insurers) and arefundable application fee of €45 forclaimants.

• Awards were processed in an averagetime of 7 months in the period.

• Direct savings of €35.48 million tothe end of June 2014 were achieved.Annual savings are in the region of€100 million.

SAFETY ALERT Small Tipper Trucks

The Health and Safety Authorityhas issued an urgent warning toowners and operators of Tippertrucks used for transportation ofconstruction materials, followingan incident involving the failure ofthe pivot bar for the tipper section.

The pivot bar at the back of thetruck that allows the body to lift asthe hydraulic ram extends upwardsto create the tipping movement,sheared at the left bracket, whilethe right bracket casing shearedcompletely allowing the body toslip off the chassis while in theraised position. The body slippedonto a worker nearby causingsevere crush injuries.

It appears that the bar and bracketsfailed due to fatigue arising frominadequate inspection and greasingof safety critical moving partsduring the lifetime of the vehicle.

Owners and operators of thesevehicles are advised to include thesaid brackets and pivot bar in theirroutine servicing and inspection ofthese vehicles. As part of themaintenance process, the pivot barand brackets should be inspectedand greased on a regular basis andreplaced where there is evidence offatigue/failure.

Teagasc to hold Farm SafetyCode of Practice TrainingCourses

Teagasc plan to hold a series of half-day Farm Safety Code of PracticeTraining Courses over the wintermonths.

Teagasc health and safety officer,John McNamara, said that a Teagascstudy had shown the farmers whocompleted half-day safety trainingfound the course highly motivating.Those who attend training identified40% more controls forimplementation. Also, the majority offarmers implement the controls theyspecified, and had a higher level offarms with satisfactory occupationalhealth and safety standards.

John McNamara reminded farmersthat safety training is now mandatoryunder the recently announced TAMS2 schemes. To obtain payment underthese schemes farmers must havecompleted the half-day Farm Safetycourse or the “Green Cert” within theprevious five years.

He also called for continuing highfarm safety vigilance, as the winterapproaches and light fades, to cut thetoll of farm deaths and serious injury.

He stated that 11 farm deathsoccurred in the last four months of2014. So far in 2015, fatal farmaccident levels are 40% lower than2014, but that one accident is one toomany.

Sixty per cent of deaths in 2014 wereassociated with getting struck orcrushed by a farm vehicle ormachines, mainly in, or around thefarmyard. Other major causes ofaccidents include livestock attacks,collapsing objects such as bales, andslurry incidents, including drowningand gassing.

Carriage of Asbestos-ContainingMaterials by Road

The Carriage of Dangerous Goodsby Road and Transportable PressureEquipment Regulations and theEuropean Agreement Concerning theInternational Carriage of DangerousGoods by Road (ADR) provide thelegal framework under which alldangerous goods, including asbestos,may be transported by road. This HSAdocument provides guidance andinformation to participants who areinvolved in the carriage of asbestos,mixtures containing asbestos andasbestos waste, which are generallyreferred to as “Asbestos-ContainingMaterials (ACMs)”.

Report - EU-OSHA review ofsuccessful Occupational Safety andHealth benchmarking initiatives

This report documents the collectiveoutput of research activitiesundertaken by the Institute forEmployment Studies in response to arequest from EU-OSHA to undertake areview of successful OSHbenchmarking initiatives. Theoverarching aim was to review OSHbenchmarking schemes that have beenset up at sector, Member State orEuropean level in order to assess thebenefits that such schemes can deliver,as well as their limitations, and toidentify the key factors of and mainobstacles to their success.

European Safety Week19 - 25 October 2015

This year’s European Safety Week takesplace week beginning 19 October.

Workplace health and safety is good forbusiness, for workers and for society as awhole. Every year more than 5,000people lose their lives in the EU as aresult of accidents in the workplaceaccording to Eurostat. A great many ofthese lives could be saved and manythousands of other injuries prevented ifrisks were anticipated and sensible safetymeasures implemented.

The theme for 2015 is "HealthyWorkplaces Manage Stress".

A positive psychosocial workenvironment can enhance the health andwell-being of workers and stimulateincreased productivity. Good businessperformance with low absenteeism andstaff turnover rates can be achieved as aresult. This campaign emphasises thatmanaging stress and psychosocial risksat work has significant benefits forworkers, employers and the exchequer.

The words, which captured the themeof the conference, were delivered byTony Sheridan, director of HSEQS(health, safety, environment, qualityand sustainability) at Sisk. Posing thequestion, where should safety fit inany enterprise, Mr Sheridan said thatin Sisk, ‘safety is seen as being at thecore of what we do”.

Mentioning the business benefits ofsafety, he said where safety is good,quality and productivity is good.HSEQS is at the core of Sisk’sconstruction strategies with arelentless drive towards zero accidentsthrough behavioural change.Introducing a telling phrase into thelanguage of health and safety, he said“each business must ask itself aboutthe true safety costs”.

Saying that good safety is not justgood business, it is everyone’sbusiness, Ruairi Connor, director ofgroup operational risk with Rexam,talked about professionals and theirmanagement teams spending toomuch time nose down in the tactics

and not enough on developing a clearstrategy to ensure all stakeholders arefully engaged. He urged delegates tolift their heads up from the tactics toensure the strategy is in place that isgoing to deliver the right environmentfor all stakeholders.

Speaking about the importance ofcreating the right environment andconditions, Mr Connor saidengagement, personal ownership andcreativity is vital for the success ofsafety professionals. He saidcommunications strategy is important.Safety must not be seen as a “showstopper”, it should be seen as an“enabler”. Leaders, he said, set theenvironment.

Mark Paradies, the president of US-based company, Systems Improvements,presented a history of the invention ofprocess safety by Admiral Rickover ofthe American Navy.

With Sheridan and Connor addressingthe theme of good safety is goodbusiness directly, the elements that

make for good safety – a healthyworkplace, managing beyondcompliance, process safety, road safetyand ergonomics – were addressed by apanel of expert speakers.

Healthy workplacesThree aspects of a healthy workplacewere explored.

Delivering the first presentation of theday, Joe Doddy, EAP Manager withVhi Corporate Solutions, presented apicture of what the work environmenttoday looks like. He spoke about 24x7global connectivity, constantinterruptions by mobile phones andworkers availability outside coreworking hours. “The overwhelmedemployee is a concern”. Saying we aresuffering from information overload,he said “we check out mobile devicesup to 150 times a day”. Employees aremore fatigued, more forgetful, affectedby mood contagion and are absentmore.

CONFERENCE FEATURECorporate Solutions, spoke aboutbuilding a more resilient workforce.There are, she said, five key steps to ahealthier workplace: the physicalworkplace; personal health resources;involvement; the psychosocial workenvironment and leadership, withleadership being “the most important”.

Dr Kate O’Flaherty, director of theDepartment of Health’s health andwellbeing programme, spoke about theGovernment’s Healthy IrelandFramework. The vision is of an Ireland“where wellbeing is valued andsupported at every level of society andis everyone’s responsibility”.Explaining that the workplace isimportant, Dr O’Flaherty said WorldHealth Organisation studies showworkplaces are a “best buy” forprevention and control of chronicdisease and mental health issues.

Healthy Ireland has, she said set up across-sectoral group to oversee thedevelopment of a healthy workplaceframework. Before the end of the year,Healthy Ireland will be holding apublic consultation on the concept of ahealthy workplace.

Speaking about good ergonomicprinciples for health and safety,Katherine Metters, a charteredphysiotherapist and a senior consultantwith Posturite, said the hot topics ofoffice ergonomics are agile work, hotdesking and the sit-stand debate. Sheadded “Work is changing”.

When you are carrying out DSEassessments “You have to understandthe full range of the person’sactivities”. You have to watch theperson work. She has, she said, noticeda shift from repetitive strain injuries topostural injuries. Stressing theimportance of good seating, MsMetters cited a study which showsgood seating increases productivity by8%.

Beyond compliance Speaking about taking health andsafety performance beyond compliance,Dr Peter J Claffey explained whatcompliance means to the Health andSafety Authority. It means complying

with the general duties of employers,providing information and training,having plans for emergencies, takingcare for persons who are notemployees, persons in control of placesof work complying with their duties,identifying hazards and carrying outrisk assessments and consulting withemployees. For us, he said, it meanscomplying with section 8, 10, 12, 15,19, 20, 25 and 26 of the SHWW Act2005. He stressed that compliance withthese requirements is mandatory and isoften just done to the minimumstandard.

We are, he said, best known forchecking compliance with the law. Theresults of inspections are that in only10% of cases do we take enforcementaction and serve notices. In 90% ofcases we help organisations to improveand go beyond minimum standards.

Driving for work safely Speaking about driving for work safety,Moyagh Murdock, the chief executiveof the Road Safety Authority (RSA),citing provisional figures from the RSACollision Database for 2014, said 12%of drivers who suffered injuries and 9%of those killed were driving for work.Nine percent of those injured werecommuting to or from work, while 8%of those killed were commuting. Ms

Murdock said a study of pre-crashbehaviour over the five-year period,2008–2012, found that one in six ofdrivers involved in fatal collisions weredriving for work.

When questioned about employers’driving for work policies for a surveycarried out for the RSA, Ms Murdocksaid 57% of drivers said their employerhad a policy, while 37% said theemployer did not have a policy. Thesurvey found that drivers who weredriving for work were more likely toadmit exceeding the speed limit. Sheadded that the survey also found thosewho drove for work were more likely tofall asleep at the wheel: 18% comparedto 11% for all drivers.

Communications Bringing the conference to a close,Eddie Shaw, a legendary figure in thebroader safety world and now PRdirector at Carr Communications,highlighted some of the dangers ofsocial media. He said:• We no longer have time to think• We are losing touch with people• Our brains can no longer cope with

the scale of technology• We no longer know what are the

facts• We no longer go back to primary

sources.

Using the road for business is theleading cause of work-related deathsand injuries in Ireland. Therefore,Work-Related Road Risk Management(WRRRM) should also be a priorityfor businesses and organisations forlegal, ethical, moral, societal,reputational and financial reasons.

Work-Related Road Safety (WRRS) isa priority program area for the Healthand Safety Authority (HSA). The HSAworks closely with An Garda Siochánaand the Road Safety Authority toinfluence improvements in work-related road safety in Ireland. TheWork-Related Road Safety programaims to influence improvements inwork-related road risk management,particularly in the areas of:• driving for work,• working on or near the road, and• load securing for road transport.

To date, a range of resources havebeen jointly developed to helpemployers understand and managework-related road risk including:Guidelines for Employers onManaging Driving for Work; SafeDriving for Work Driver Handbook;Driver Health Guidelines; Driving forWork Risk Assessment Checklist;Driving for Work Company CaseStudies; Daily Vehicle Pre-Checkinstructional videos and fact sheets.These resources and many others canbe downloaded for free fromwww.vehiclesatwork.ie.

The management of work-related roadrisk is not just for organisations withlarge fleets and lots of drivers, itapplies to small businesses with one ortwo drivers. Regardless of the size oforganisation or number of drivers, keyrisk factors to manage include speed,driving under the influence of alcoholor drugs, fatigue, stress anddistraction.

Business Case for Managing RoadRiskThe management of work-related roadrisk is centred on preventing harm topeople and protecting property andthe environment. It involves managingroad safety in a proactive way forfinancial, moral and legal reasons withthe aim of achieving safe drivers,journeys and vehicles. Effectivemanagement of road safety providesan opportunity to reduce costs in lotsof ways. For example:

• Reduced running costs such as fuel

consumption and vehiclemaintenance/repairs through betterdriving standards.

• Fewer working days lost to injuries.• Less time needed for investigations

and paperwork.• Fewer missed orders and business

opportunities.• Lower insurance premiums.

Managing Young Drivers at WorkYoung people continue to face adisproportionately high risk on theroad, especially young males. Evidenceshows that young people have thehighest collision involvement of anyroad user group. Young drivers are notjust a danger to themselves; they alsopose a greater risk to their passengersand other road users.

Organisations are becomingincreasingly aware of the business casefor introducing road safetymanagement programmes tailored foryounger drivers. If your organisationemploys younger drivers you need toconsider their particular needs. Thekey risk factors highlighted above areeven more relevant because of theirage and lack of experience.

IOSH branches join forces topromote farm safety across Irelandand Northern Ireland Agriculture continues to be one of themost hazardous industries in which towork.

In Ireland alone, 41 people have diedworking in the agricultural sectorsince the start of 2014, while a further33 farm workers were also killedacross the UK in 2014−15.

In most instances, the tragedies wereas a result of incidents which involvedtractors or other farm vehicles andmachinery. Other cases involvedhandling livestock or were caused by aworker becoming trapped or crushed,drowning, suffocating or falling fromheight.

There have been other incidents inwhich people have been seriously hurtwhile working on farms – in manycases suffering life-altering injuries.

All of the regulators and otherrelevant organisations are working topromote farm safety across the UKand Ireland to make the sector saferfor all.

One of the key focuses has been toencourage farm workers to try newworking routines, techniques andbehaviours. In many cases farmworkers have been found to beemploying practices which may havebeen used by many generations offarming families, but that are nowoutdated for modern-day farming.

It is against this backdrop that theInstitution of Occupational Safety andHealth (IOSH) prepare to host a farmand farmer safety event for workersthroughout Ireland and NorthernIreland.

IOSH Ireland and Northern Irelandbranches, supported by the IrelandBranch’s Rural Industries Section, areto explore six scenarios which havebeen found to be the most common

causes of injuries or fatalities in UKand Irish agriculture – chainsaws,tractors, use of chemicals, animalmanagement, farm buildingconstruction and electricity, and slurrymanagement.

Each will be focussed on in-depthduring a series of workshops due totake place at Teagasc’s BallyhaiseAgricultural College in Co Cavan on11 November.

Instructors from the college will joinexperts from Coillte and farm buildingmanagement company KilmoonTrading in leading the demonstrations,with representatives from the Healthand Safety Executive Northern Ireland(HSENI) also highlighting new andemerging trends in farm safety.

Liam Howe, Chair of IOSH IrelandBranch, said: “All six are issuesregularly faced by farm workers but itis not just farmers who are gettinginjured and killed. Their wives andchildren, as well as members of thegeneral public, are also at risk.

“Agriculture currently has the highestnumber of accident and deaths peryear in Ireland. Education aroundimproving farm and farmer safety istherefore a major priority.

“Through this event we want tosupport and build on the good work ofthe HSA, HSENI and other healthservices and organisations that arepromoting initiatives to improve farmsafety. We also recognise that IOSH,with nearly 2,000 members in Ireland,has a role to play in supportingfarmers to work safely in an ever-changing and demanding profession.

“We thank Ballyhaise AgriculturalCollege for their kind permission toutilise their facilities and expertise inorder to stage this important event.”

IOSH Northern Ireland has beenactively supporting HSENI and itsFarm Safety Action Plan. The strategy,which runs until March 2017, outlinesthe regulator’s plans to support thelocal farming community promotesafe working and good practice.

There were 67 work-related fatalitiesin Northern Ireland’s farming sectorbetween 2004 and 2013. Among thosekilled were five children aged under 11.

Richard McIvor, Chair of IOSHNorthern Ireland Branch, saidmembers will continue to work withand support the HSENI’s initiative tohelp reduce injuries and deaths in thefarming industry.

He said: “Farm safety is an issue withrelevance in both Northern Irelandand Ireland. We hope this joint eventand the safety demonstrations willdrive home simple and easy steps thatall people involved in agriculture cantake in order to make it a safer andhealthier profession for all.”

Áine English, Chair of IOSH IrelandBranch’s Rural Industries Section, alsourged farmers and anyone whopromotes safety and health in the

agriculture sector in Ireland orNorthern Ireland, to attend.

“It is an opportunity to see highlytrained specialists using safe workingpractices at first-hand, and to alsodiscuss with them any challengesworkers may be experiencing,” shesaid.

The free-to-attend session will be thefirst that the IOSH Ireland andNorthern Ireland branches have jointlyheld on the issue of farm safety.

Its staging also follows a number ofother events that IOSH branches anddistricts throughout Ireland have heldthis year on the topic.

The IOSH Ireland Branch’s Westernand North Western Districts and RuralIndustries Section combined to host anevent in March to highlight ways ofimproving safety on and around farms

in the west of Ireland.

Members of IOSH Ireland’s NorthWestern District also discussed thedangers of farm machinery at ameeting in July.

QUESTION (a) What are the duties of a fire

warden?(b) How many fire wardens do I

need in a building?

ANSWER (a) What are the duties of a firewarden?Fire wardens can have as broad or asnarrow a role as you see fit, dependingon various factors, such as yourorganisation, your fire risk, your fireprevention programme, the number ofemployees or even the number offloors in the building. So the role theyundertake will vary from organisationto organisation. Generally they havethe following role: In a non-emergency situation, they could beinvolved in carrying out safety checksof fire exits, fire evacuation routes,visual inspections of fire extinguishers(to ensure that they are in place andhave not been tampered with etc.),water hoses, fire hydrants outside,training of other employees in firesafety awareness etc.

They will also need to be de-briefedafter any emergency. In an emergencysituation/fire drill they aregenerally assigned to a floor,department or small building andtheir key role is to sweep that floor/department/building and “sweep allpersons, employees and others,towards the relevant exits” so that

they can declare that thatfloor/department/building is entirelyempty. They will accompany theirpeople to their final Assembly Pointoutside and check in with theevacuation co-ordinator to declarethat their area is empty.

A Fire Warden should always beclearly identified and may be requiredto wear a hi-viz jacket with “FireWarden” on the back, so that they areclearly seen by everyone else. Whenthey begin their sweep they shouldstart at the point of greatest dangerand sweep away from that point. Theyshould not enter smoky areas, as theymay be overcome by smoke. Theyshould also close all doors after themonce the area is empty. They shouldnever endanger themselves, shouldnever open doors that are hot to thetouch or spend time arguing withpersons who refuse to leave – theyshould note who and where they areand move on.

They should then pass thisinformation on the evacuation co-ordinator. One of the key issues to betaken into account during their“sweep” is that they must check allrooms in their area, toilets, showers,store rooms, stationery stores,chemical stores etc., not just openoffices or factory floors. If they comeacross injured persons, they shouldmake contact with the evacuation co-ordinator to get medical help.

Generally they do not have firefighting roles, this is undertaken bythe separate but linked emergencyresponse team. Companies mayappoint fire wardens to carry outspecific duties, such as a stair firewarden.

If you are planning to appoint firewardens, they will need specifictraining, which would includeawareness of key fire safety duties

under the law (Fire Services Act 1981and Regulation 13 within Chapter 1of Part 2 of the General ApplicationRegulations 2007 – dealing withWorkplace).

A training programme wouldtypically equip them to do thefollowing:

• Understand the emergency plan forthe organisation

• Understand their own role and becompetent to carry it out

• Understand and recognise habitualhuman behaviour in a fire situation

• Understand the basic principles offire risk assessment

• Be aware of how to prevent fires orlimit their impact

• Be aware of specific evacuationroutes, exits, those with specialneeds who may need specificassistance in any evacuation,buddying arrangements etc. fortheir area

• Become familiar with areas ofrefuge available on their floor, ifthey exist

• Recognise the need for fire drills andpre-planning for fire and their rolein them

• Recognise active and passive firesafety measures and facilities

• Offer assistance to anyone who mayneed it.

(b) How many fire wardens arerequired? It all depends on your organisation,your fire risk, your fire preventionprogramme, the number ofemployees, the number of floors in thebuilding etc. There are no hard andfast rules about the number required.

In trying to determine how many youneed, your fire risk assessments willbe a major determining factor andyou should try to appoint and train updeputy fire wardens to cover duringholiday and sickness absences.

LegislationEuropean Union (System for theIdentification and Traceability ofExplosives for Civil SES) (Amendment)Regulations [S.I. No. 201 of 2015]This Regulation amends the EuropeanCommunities (System for Identification andTraceability of Explosives for Civil Uses)Regulations 2009 (S.I. No. 133 of 2009). Itclarifies the offence of persons acquiring orsupplying explosives manufactured inanother Member State which are notmarked with a unique identification inaccordance with the Commission Directive,and the enforcement measures available toan authorised officer in relation to suchexplosives. It also includes some minortechnical amendments.

European Union (Properties of Wastewhich Render it Hazardous) Regulations2015 [S.I. No. 233/2015]These Regulations provide for measures toprotect the environment and human healthby preventing or reducing the adverseimpacts of the generation and managementof waste and by reducing overall impacts ofresource use and improving the efficiency ofsuch use and transpose Directive2008/98/EC of the European Parliament andof the Council of 19 November 2008 onwaste and repealing certain directives. Inparticular, these Regulations provide for thetransposition of Commission Regulation(EU) No. 1357/2014 of 18 December 2014replacing Annex III to Directive 2008/98/ECof the European Parliament and of theCouncil on waste and repealing certaindirectives.

Building Control (Amendment)Regulations 2015 [S.I. No. 243/2015]The above Regulations provide for a revisionin certain cases of the fee specified in Part Aof the Fifth Schedule to the PrincipalRegulations in respect of an application for aDisability Access Certificate or a RevisedDisability Access Certificate.

While the standard fee for an application fora Disability Access Certificate or a RevisedDisability Access Certificate shall continueto be €800, a reduced fee of €500 shallapply where the application is made prior tothe commencement of works and coincideswith an application for a fire safetycertificate, where relevant.

Clause 2(e) of Part B of the Fifth Scheduleto the Principal Regulations has also beenrevised to clarify that where a buildingcontrol authority makes a refund in respectof an application for a Disability AccessCertificate or a Revised Disability AccessCertificate the refund shall not reduce thebalance of the fee paid in respect of suchapplication to less than €500.

European Union (Railway Safety)Regulations 2013 (Amendment)Regulations 2015 [S.I. No. 280/2015]The purpose of these Regulations is totranspose Commission Directive2014/88/EU of 9 July 2014 which amendsDirective 2004/49/EC as regards commonsafety indicators and common methods ofcalculating accident costs by replacingAnnex I (Common safety indicators) in full.Directive 2004/49/EC is the principal EURailway Safety Directive and it is transposedinto Irish law by the European Union(Railway Safety) Regulations 2013 (SI No.444 of 2013). These Regulations amend SINo. 444 of 2013 to incorporate amendingDirective 2014/88/EU and new Annex I.

S.I. No. 288/2015 - European Communities(Carriage of Dangerous Goods by Roadand Use of Transportable PressureEquipment) (Amendment) (No. 2)Regulations 2015.These Regulations transpose into Irish lawCommission Directive 2014/103/EU of 21November 2014 adapting for the third timethe Annexes to Directive 2008/68/EC of theEuropean Parliament and of the Council onthe inland transport of dangerous goods toscientific and technical progress (insofar asthat Directive relates to the transport ofdangerous goods by road). CommissionDirective 2014/103/EU gives effect to thechanges to the ADR agreement that cameinto force on 1 January 2015.

The Regulations also give further effect toDirective 2008/68/EC of the EuropeanParliament and of the Council of 24September 2008.These Regulations amend for the third timethe European Communities (Carriage ofDangerous Goods by Road and Use ofTransportable Pressure Equipment)Regulations 2011 (S.I. No. 349 of 2011).These Regulations may be cited as theEuropean Communities (Carriage ofDangerous Goods by Road and Use ofTransportable Pressure Equipment)(Amendment) (No. 2) Regulations 2015.

European Communities (EnvironmentalLiability) (Amendment) Regulations 2015[S.I. No. 293/2015]These Regulations transpose Article 38 ofDirective 2013/30/EU of the EuropeanParliament and of the Council of 12 June2013 on safety of offshore oil and gasoperations and amending Directive2004/35/EC (Text with EEA relevance).Article 38 of Directive 2013/30/EU requiresthat the definition of water damage inDirective 2004/35/EC be replaced so that thedefinition is extended to include damagethat significantly adversely affects theenvironmental status of marine waters asdefined in Directive 2008/56/EC establishinga framework for community action in thefield of marine environmental policy (theMarine Strategy Framework Directive).
