    THE UNION OF UEA STUDENTS

    TERMS AND CONDITIONS AND CONTRACT OF EMPLOYMENTFULL TIME OFFICERS

    The Terms and Conditions of Employment set out below are in accordance withcurrent legislation and the contents of the Union of UEA Students Constitution(where applicable). They are correct as at 16 February 2011

    2 : JOB TITLE AND DURATION OF THE CONTRACT

    The candidate elected to the position of _______________________________ is a full-time officer of the Union for a period commencing on 18 July 2011 and expiringon 31 July 2012.

    3: JOB LOCATION

    The job is based at Union House, UEA, Norwich, Norfolk NR4 7TJ

    The job involves travelling for the proper performance of your duties and you willbe expected to attend training events, conferences and meetings at other locations.

    4 DUTIES OF THE EMPLOYEE

    Officers shall carry out the duties of the office to which they have been electedas described in the Unions Constitution dated 23 March 2011. A copy of theduties and responsibilities is attached.

    5. REMUNERATION

    You will be paid an annual gross salary linked to Spinal Point 10 of the Unions payscale. The monthly salary due will be paid in arrears, directly into your bank account on the 28 th day of each month. Approved expenses will also be paid for

    attending conferences and other meetings as part of your job.

    No further salary payments will be made.

    6. HOURS OF WORK

    Hours of work for Full Time Officers are not precisely specified but are governedby the demands made on the individual by the duties and responsibilities of thepost. It is, however, expected that a minimum of 36 hours are worked per week and, that core hours between 10.00 a.m. and 4.00 p.m. are worked every day.Officers will also be expected to attend such Union meetings as required and,also to work in the evenings and at weekends when necessary.

    You will be allowed to attend National Conferences of the NUS (if elected toattend) and, also other conferences which may be considered a reasonablerequirement of your job, as part of the normal hours.

    7. HOLIDAY

    You will be entitled to 20 days holiday during your period of the office (pro-rata ifterminated early). Leave may only be taken during a semester with the consentof the Management Committee.

    You will also be entitled to bank (b) public (p) and customary (c) holidays(subject to your term of office continuing):

    August Bank Holiday (b) Christmas Eve (c) Christmas Day (p) Boxing Day (b) NewYears Day (b) Thursday before Good Friday (c) Good Friday (p) Easter Monday(b) and Tuesday (c) May Day Monday (b) Spring Bank Holiday (b), plus threeother customary days on dates to be declared by the University.

    Payment in lieu of any holiday not taken by the end of the term of office will notbe made. If, at the early termination of the Contract, you have taken more thanthe full pro-rata holiday entitlement, a deduction will be made from your salary

    equivalent to a days salary for each day taken over the pro-rata entitlement. Ifyou have not taken the pro-rata entitlement by the early termination thepayment will be made in Lieu Days taken as Annual, Bank, Public or Customaryholiday will be paid at your full basic rate of pay subject to the other conditionsspecified above being complied with.

    8. SICKNESS AND ABSENCES

    Full Time Officers will sign a permission slip allowing the Union to obtain a medicalassessment from their Doctors should the serving Full Time Officer become illduring their term of office (Signing this copy of the terms and conditions ofemployment will act as the permission slip)

    8.1 Notification - Any absence from work through illness or incapacity must benotified to the Unions Chief Executive or his/her deputy as soon as possible.

    8.1 Certification - Absence from work through illness or incapacity for any periodof up to seven days (including Saturdays, Sundays and public holidays) must be

    supported by the completion and submission of an approved Personal SicknessCertificats.

    Absences of more than seven days must be supported by the production of aStatement of Fitness For Work (Doctors Statement or Medical Certificate)

    8.3 Long Term Illness or Incapacity

    a) Where the illness or incapacity is such that in all probability (following theconsideration of a medical assessment ) the Full Time Officer will be unableto return either to work or full time education within the remainder ofhis/her term of office and he or she does not wish to resign their post then,he/she will continue to be paid until the end of their term in office.

    NB: This is subject to the Unions memberships right to No Confidence theserving Officer. In this instance the Constitutions regulations andprocedures regarding votes of No Confidence shall apply.

    Where the Full Time Officer does resign the Board of Trustees shallconsider whether to award an ex-gratia sum which may not exceed theremainder of their contract salary.

    The Chief Executive must obtain a written medical assessment before the

    Union agrees to any payment, so that an assessment can be made of thelikelihood of return to work during the term in office.

    b) Where the illness or incapacity is such that in all probability the Full TimeOfficer is unable to return either to work or full-time education within theremainder of his/her contract and due to illness he or she is unable tocommunicate their wishes effectively, e.g. coma.

    The Management Committee shall decide whether to terminate the FullTime Officers contract and consider whether to award an ex-gratia sumwhich may not exceed the remainder of their contract salary.

    If the decision is taken not to terminate the contract then s/he willcontinue to receive pay until the end of their term in office.

    There must be written medical evidence to support this long termprognosis, which must be supplied to the Unions Chief Executive.

    9. PENSION RIGHTS

    You are eligible to join the Students Union Superannuation Scheme. However asyou are on a fixed term contract, you should be aware that unless you remain inthe employment of the Union for at least 2 years you would not be able to

    transfer your pension but would have to accept a refund of your contributionsplus interest and less tax.

    You may wish to seek advice from an independent financial adviser about your options in these circumstances

    10. NOTICE

    The Contract may be terminated early by:

    i) The Officer giving one-weeks notice in writing to ManagementCommittee.

    ii) The Officer's failure to attend sufficient meetings as defined inclause 81 of the Union's Constitution.

    iii) A resolution of no confidence being passed by the Union Council inaccordance with clause 78 of the Unions Constitution.

    iv) Virtue of long term sickness - see section 8.3 of these terms.

    If you cease to hold office, your salary shall terminate on the day you cease tohold office, unless the Executive Committee decide otherwise.

    If the contract is not terminated early by any of the above clauses, the date oftermination of the fixed term of employment will be 31 July at the end of the year

    of office.

    11. DISCIPLINARY AND GRIEVANCE PROCEDURE

    a) DISCIPLINE

    There is no disciplinary procedure in effect with regard to Full Time Officers exceptfor the Constitutional Clauses relating to dismissal (78 and 81).

    As you are a registered student at the University of East Anglia during your term ofoffice, the UEAs General Regulations in respect of General Conduct - GeneralRegulation 11, the Universitys Code of Discipline incorporating an appealsprocedure and the Universitys Code of Practice relating to Student Unions allapply to you. All of these documents can be found in the Universitys Calendar acopy of which can be viewed in the Student Advice Centre or the UniversityLibrary on request.

    b) GRIEVANCE

    If you have a grievance in respect of your employment this should first bediscussed with the Unions Chief Executive. If grievances exist with regard to anyother matter or if you are dissatisfied with your discussions with the Chief Executivethen the matter should be raised as a Confidential Item at a Management

    Committee meeting. If you are not satisfied with the outcome, then the matter should be raised at a Board of Trustees Meeting.

    12. TRADE UNION MEMBERSHIP

    You are free to join a Trade Union. The Union recognises UNISON for collectivebargaining purposes.

    13. COLLECTIVE AGREEMENTYour Terms and Conditions of Employment are not governed by a collectiveagreement.

    I have read and fully understand the above Terms and Conditions ofemployment. I also agree for the Union of Students to obtain medicalassessment(s) from my Doctor/Medical Practitioner should it be required if Ibecome ill during my term in office.
