Welcome to our exciting new Russia River Cruises and Tours for 2011.We invite you to join us on an incredible adventure. Inaccessible for decades after World War II, many of Russia’s previously hidden treasures are now on show. You can also extend the adventure to combine your Russian river cruise with our 5-star tours of Scandinavia or the Baltic States.

We’ll take you on expertly guided visits to all the places that have long intrigued the West – the Kremlin, Red Square, peterhof palace, the incredible art collection at the Hermitage and a ride on Moscow’s famous Metro. You’ll be treated to magical performances by the Russian Ballet and the incredible Moscow Circus, and you’ll tour the cosmonaut training centre at Moscow’s Star City. We will host you at the National Russian Show and Karelian Folk Show. You’ll meet WW II veterans, and students at a Children’s Music School. For an appreciation of Russia’s rich cultural life, watch craftsmen at work, learn a little of the language, join in history discussions and sample their beloved vodka. You’ll celebrate at a blini (Russian pancake) party and be welcomed into the home of a local family for tea and pastries.

Located between the eastern edge of the Baltic Sea and the western border of the Russian Federation and Belarus are the Baltic States of Estonia, Latvia and Lithuania. These are relatively new destinations for westerners and offer wonderful insights into a region of the world that is not commonly well known.

You’ll visit the new Reichstag and the Brandenburg Gate, and drive ‘Unter den Linden’. Day 4 St. Petersburg Today you’ll tour the19th-century Yusupov palace, where prince Yusupov murdered Grigory Rasputin, the most controversial figure in Russian history. After lunch, visit the Children’s Music School and meet children eager to show you their knowledge of English. Meals: FB,L,D

Day 5 St. Petersburg Your day starts at the peter and paul Fortress where peter the Great and all the Russian emperors and empresses are buried. Afterwards relax and enjoy free time for lunch, it’s then on to the magnificent summer residence of Russian royalty at peterhof. Day 6 Svir Stroi Your ship arrives in the village of Svir Stroi, between Lake Ladoga and Lake Onega. It’s all ashore to visit the home of a local family who will serve authentic Russian tea and piroshky, a specialty of the region. Meals: FB,L,D

Day 7 Petrozavodsk Tour the port city of petrozavodsk and learn about the Soviet era at Kirov Square, Gagarin Square, and Lenin Square, where you’ll stop at the World War II memorial of the eternal flame. Return to the ship for lunch and then attend an Included Karelian Folk Show which celebrates the music and costumes of Russia’s north. Meals: FB,L,D

Day 8 Kizhi Island This morning, your ship docks at Kizhi Island, one of the most ancient inhabited sites in Russia. You’ll visit the museum and its precious collection of wooden churches and chapels. You’ll also view the Church of Transfiguration, with its 22 timbered onion domes. Meals: FB,L,D

Day 9 Goritsy At the medieval village of Goritsy you’ll tour the Kirillo-Belozersky monastery, built in 1397 and home to an impressive collection of Russian Orthodox icons. After we sail this afternoon sample the beverage that has been integral to Russian culture for over 600 years - vodka. Meals: FB,L,D

Day 10 uglich Take an Included walking tour of historic Uglich, part of the Golden Ring of cities around Moscow. The town dates from the 10th century and was used by the legendary Ivan the Terrible in the 16th century as a base for his attacks against the Tatars. Meals: FB,L,D

Day 11 Moscow It’s a leisurely morning as we sail towards Moscow. Arriving after lunch, you’ll set out on an exploration which includes Red Square, the KGB building and a ride on Moscow’s Metro - considered one of the best subway systems in the world. Meals: FB,L,D

Day 12 Moscow After breakfast, you’ll tour the Kremlin, seat of the former Soviet Union’s intrigue. In the State Armory, you’ll see priceless weaponry, jewels, Fabergé eggs and ceremonial robes. After your tour enjoy free time and lunch in one of the nearby local restaurants. This evening you’ll witness a thrilling National Russian Show performed by fifty folk dancers. Meals: FB,L,D

Day 13 Moscow This morning travel to the Cosmonaut Training Centre at Star City. Inside the training facility is a full-size mock-up of the Mir Space Station and you‘ll also see space simulators that prepare cosmonauts for lift-off. Day 14 Moscow Your day starts with expansive views of Moscow from the Sparrow Hills. Then visit Novodevichy Cemetery, where Anton Chekhov and former president Boris Yeltsin are buried. Day 1 Copenhagen Welcome to Copenhagen. On arrival you will be met and transferred to your centrally located hotel by your Scenic Tours Representative. From its humble origins as a fishing village to its heyday as the glittering capital of the Danish Empire, to its current position as one of the world’s premier design capitals, the stories and characters of Copenhagen’s history can be discovered in its sumptuous palaces, copper-roofed town houses and atmospheric cobbled squares. The rest of the day is at leisure, before meeting up this evening with your Tour Director and fellow travellers over a welcome drink. Two Night Special Stay: First Skt. petri.

Day 2 Copenhagen Today we follow the Danish coastline and visit Hans Christian Andersen’s ‘Little Mermaid’, ‘Hamlet’s Castle’ and make our way to Amalienborg palace, home to princess Mary and the Danish Royal Family. Day 5 Bergen This morning we say farewell to Oslo and set off on our drive to Bergen. We drive through the scenic and breathtaking Hardangervidda, Europe’s highest mountain plateau and home to Norway’s largest herd of wild reindeer. We will continue our journey to Norway’s second largest city, the Hanseatic fishing port of Bergen. Our accommodation is located in Bryggen, the most historic part of the city and a UNESCO World Heritage Site. One of the prettiest cities in Norway, Bergen dates back to the 12th century when the port was an important centre of European trade for the all powerful German Hanseatic League. Day 1 Berlin Welcome to Germany. You will be met at the airport and transferred to your centrally located hotel. The rest of the day is at leisure, before meeting up this evening over a welcome drink with your fellow travellers and Tour Director. Three Night Special Stay: The Ritz Carlton.

Day 2 Berlin This morning we journey to potsdam, former residence of the prussian Kings until 1918, ScenicEnrich where our local expert historian on Potsdam shares his knowledge of the town and its history as we visit Cecilienhof Palace where the Potsdam Treaty was signed in 1945. After free time in potsdam we return back to Berlin. Berlin has undergone an exciting transformation since reunification in 1989. ScenicEnrich We have arranged special entry to explore the renovated parliamentary building that was controversially set on fire in 1933. After our tour, we’ll enjoy coffee and cake whilst under the famous glass dome. This afternoon visit the Brandenburg Gate, State Opera House, Alexander platz, drive ‘Unter den Linden’ and visit the former Checkpoint Charlie. Day 7 Vilnius This morning we join our expert local guide for an insightful walking tour around the Old Town, with its many famous examples of

Day 7 St. Petersburg – Tallinn After breakfast we leave Russia behind for Estonia via Ivangood to Narva. The border town is dominated by the 15th-century Hermann Castle which also

Day 8 Tallinn Our tour today takes in the Old Town, famous for its jumble of twisting, cobblestone streets and Gothic spires. The tour includes Toompea Castle fortifications, located nearby the Russian Orthodox Cathedral of Alexander Nevsky and the beautiful Town Hall Square. We also explore the city walls, still largely intact and a great vantage point to observe this striking city. Day 9 Tallinn – Paernu – Riga This morning we depart Tallinn for Riga in Latvia, passing through parnu, Estonia’s summer capital, famous for its mud baths and spa resorts. The Historic Centre of Riga has been declared a UNESCO World Heritage site, and the city is particularly notable for its extensive Art Nouveau architecture, cosy beer cellars and cafés. Our tour includes St peter’s Church with its 123 metre high tower, the city walls and Riga Castle. Overnight Stay: Hotel Reval Ridzene. Meals: FB,D

Day 10 Riga – Rundale – Sauliai – Vilnius This morning we leave Riga and travel to Rundale where we visit Rundale palace. On route to the Lithuanian city of Sauliai we stop at the extraordinary ‘Hill of Crosses’. This symbol of Christian resistance to the Soviets features millions of small Crosses, which were repeatedly bulldozed during the occupation. This evening we arrive in Vilnius for our two night stay. Day 11 Vilnius This morning we join our expert local guide for an insightful walking tour around the Old Town, with its many famous examples of baroque architecture. We’ll get to see all the famous landmarks, including the University, the Gates of Dawn with its remarkable chapel and the famous Vilnius Cathedral. Scenic Enrich visit to the fascinating, if not the haunting, KGB Museum. In the afternoon, we visit the beautiful Trakai Island Castle, located a short drive outside of Vilnius. Day 12 Vilnius – Warsaw After breakfast we depart Vilnius. Our route will take us into the amazing Mazurian region, which encompasses 4,000 lakes in a pristine setting, where a great deal of the landscape remains virgin forest. We cross the border into poland and continue on to the capital Warsaw. Two Night Stay: Westin Warsaw. Meals: FB

Day 13 Warsaw Memories of polanski’s film “The pianist’ come to mind as we visit the Jewish Ghetto with a local guide. We see the monument to the Ghetto heroes, the palace of Culture and the Royal palace. This afternoon we visit Wilanow palace, known as poland’s Versailles. Tonight ScenicEnrich highlights include a concert of Chopin music at Lazienki Palace before dinner in Warsaw’s Old Town. Meals: FB,HD

Day 14 Warsaw – Berlin This morning we will be taken to the main train station where we board our first class carriage for a journey across the heart of poland and into Germany. Day 15 Berlin – Potsdam – Berlin This morning we journey to potsdam, former residence of the prussian Kings until 1918, where ScenicEnrich our local expert historian on Potsdam shares his knowledge of the town and its history as we visit the Cecilienhof where the Potsdam Treaty was signed in 1945. After free time in potsdam we return back to Berlin. Berlin has undergone an exciting transformation since reunification in 1989. ScenicEnrich We have arranged special entry to explore the renovated parliamentary building that was controversially set on fire in 1933. After our tour, we’ll enjoy coffee and cake whilst under the famous glass dome. These terms and conditions are additional to the full terms and conditions contained in Scenic Tours Europe River Cruising and Touring 2011 brochure. All bookings are subject to Scenic Tours full terms and conditions.

1. Introduction Conduct of tours advertised in this brochure is governed by Scenic Tours pty Limited (“Scenic”) in accordance with the following terms and conditions. It is important that you carefully read the terms and conditions as you will be bound by them. payment of the Booking Deposit or tour price represents your acceptance of these terms and conditions.

2. Must Read – Important Information You acknowledge and agree that there are general risks associated with travelling, which are beyond Scenic’s control and therefore Scenic cannot be legally responsible for any loss or damage you may incur as a result of these general risks. Such general risks include: a. tour variations or interruptions caused by road, river or weather

conditions; national or local holidays affecting the closure of public buildings and attractions; strikes, civil disturbances and advices by governments or other Force Majeure Events; high water levels; low water levels; flooding; lock closures; unscheduled vessel or vehicle maintenance or for any other circumstances beyond Scenic’s control;

b. forces of nature; illness; flight schedule changes or cancellations; loss of luggage; epidemics or pandemics; political unrest; accidents; acts of terrorism or other criminal acts; changes to government visa or travel requirements.

It is your sole responsibility to make your own enquires regarding your trip, including relevant government travel safety warnings.

3. noise, Vibration and Odour While Scenic takes reasonable steps to minimise noise, vibration and odours on Scenic ‘Space- Ships’ and the Russian River cruise ships, you acknowledge and accept that some noise, vibration and intermittent odours may be experienced on vessels and that Scenic will not be liable to you in relation to any such noise, vibration or odours.

4. Travel Insurance You are urged to arrange comprehensive travel insurance to cover any unforeseen circumstances that may occur during the tour.

5. Booking Deposit & Tour Payment(a) Booking Deposit• You must pay the Booking Deposit within 7 days of making your

Booking. • please refer to the itinerary of your selected tour, for your

applicable Booking Deposit.• Deposits stated are correct unless otherwise stated in

promotional offers.• Any accommodation, sightseeing or flights booked by you

separately to those stated in your itinerary will not be included in the Booking Deposit and are payable separately.

• Your Booking will be automatically cancelled if your Booking Deposit is not received by Scenic by the due date.

• Booking Deposits are non-refundable and non-transferable (Refer to the “Book with Confidence plan”).

(b) Final payment• The balance of the tour price must be paid no later than 90 days

prior to the tour departure date.• It is your sole responsibility to effect payment of the tour price by

the due date.• You must pay the tour price immediately in full if your reservation

is made within 90 days of the tour departure date.

6. Late Booking Fee A late booking fee of $50.00 per file is payable on all bookings made within 21 days of tour departure.

7. Variation Fee An administration fee of $50.00 is payable for each variation to your booking (except variation to the tour departure date, which will attract cancellation fees, set out below). Scenic may chose to accept or reject your request for variation at its sole discretion.

8. Cancellation Fees You will be liable for cancellation fees, calculated as follows:Days of notice Prior Cancellation ChargeTo Tour Commencement (per person) 91 days and over Loss of deposit 90 to 62 days 50% of tour price61 days or less 100% of tour priceCancellation notices must be issued to Scenic in writing during office hours. A cancellation notice will not be accepted by Scenic until it is received in writing. You may also be liable to pay cancellation fees to airlines and other third parties. Any changes to your tour departure date will be deemed a cancellation and the applicable cancellation fees will apply.

9. Credit Card Fees A surcharge may apply for credit card transactions.

10. Tour Price Scenic reserves the right to vary the tour price at any time, in its absolute discretion, to account for any increase in costs including airfares, fuel, government taxes and charges, exchange rate fluctuations or other tour related costs or tariffs. All tour prices are quoted in Australian dollars.

11. Payments to Travel Agents If you have booked through a travel agent, your travel agent may forward your deposit or final payment to Scenic on your behalf. However, payments to your travel agent should not be taken as payments to Scenic. Scenic will be taken to have been paid when it receives your deposit or final payment from your travel agent.

12. Tour Operation Your booking is conditional on Scenic receiving a minimum number of tour or cruise bookings to operate the tour and ensure an enjoyable group atmosphere. Where sufficient numbers cannot be achieved, Scenic reserves the right to cancel or suspend a scheduled departure of the tour. Scenic will endeavour to make any decision to cancel or suspend a tour or cruise at least 60 days prior to the scheduled departure date.

13. Tour Cancellation Where a tour or cruise is cancelled by Scenic for whatever reason prior to departure, Scenic will use its reasonable endeavours to offer the closest available tour or cruise departure, subject to the refund or payment of any tour price difference. Should the alternative be acceptable to you, you will be bound by these Terms and Conditions with respect to the alternative tour or cruise. Should the alternative arrangement offered not be accepted by you within a period of 7 days, Scenic’s contract with you will terminate and Scenic will refund all monies paid directly to Scenic and Scenic will have no further liability to you. Scenic will not be liable for any third party costs not booked by Scenic.

14. Included in Tour Price Included in your Tour price are all of the following items where indicated in your itinerary. All coach and cruise travel, services of a Scenic Cruise Director (if applicable) and/or Tour Director, airport transfers outside Australia, meals, internal flights, accommodation, sightseeing and admissions where stated, GST, port charges together with all gratuities and tipping on land tours and river cruises operated by Scenic.

15. nOT Included in Tour Price Items not listed in your itinerary are not included in your tour price and include: Airfares (unless specified in your itinerary), airline taxes, additional optional activities, accommodation upgrades, meals not specified in the itinerary, drinks, laundry, passport fees, visas, vaccinations, government taxes and charges (excluding GST), and items of a personal nature. Changes to flight schedules may require additional overnight accommodation, which is at your own expense. Changes to your travel arrangements after departure as a result of illness or other items of a personal nature are at your own expense.

16. Cruise Cabins The tour price is based on the cabin category indicated in the brochure. Upgrades are subject to availability and will be at an additional cost.

17. Airfare Conditions Discounted airfares are subject to availability and conditions apply. Your Scenic reservations consultant will book the most appropriate fare for your tour. please note: Some discounted airfares have conditions which make them unsuitable to be used in conjunction with these tours. Full details and conditions may be obtained from your travel agent. Any changes made after air ticketing will incur amendment fees. Scenic will ticket airfares between receipt of deposit and travel departure at its sole discretion. All airfares are subject to routing restrictions. Airfares and applicable taxes may be subject to increase without notice due to factors outside Scenic’s control. please contact your travel agent for applicable rules and regulations relating to your air travel.

18. Tour Variations Scenic may, in its absolute discretion and without notice, change or vary your tour itinerary. Whilst Scenic will make reasonable efforts to operate the tour as close as possible to your tour itinerary, changes or substitutions may be necessary for reasons outside Scenic’s control. These circumstances may include, but are not limited to: road, river or weather conditions; national or local holidays affecting the closure of public buildings and attractions; strikes, civil disturbances and advices by governments or other Force Majeure Events. Cruise itineraries may be disrupted by high or low water levels, flooding, lock closures, unscheduled vessel maintenance or for any other circumstances beyond Scenic’s control. Scenic reserves the right to substitute (at the nearest reasonable standard) another vessel or motorcoach for all or part of the itinerary and also provide alternative accommodation, where necessary, but will not be liable to you for such variations in the tour itinerary. You acknowledge that you will be charged for any alternative arrangements that may be made as a result of these circumstances.

19. Photography The tour programs operated by Scenic offer some of the most spectacular and beautiful photographic scenery in the world. However, due to possible tour variations, Scenic cannot guarantee that every scene or highlight featured in the tour program will be available on each tour. Consequently, no refund will be available for any resulting missed scene or photographic “opportunity”.

20. Tour Participation Scenic welcomes you if you have a disability or other special needs, provided you are accompanied by a companion capable of providing all assistance you require. You must advise Scenic (or your travel agent) of any disability, medical condition or dietary requirement at the time of booking. It is important to note that:• some cruise ships do not have elevators, and ships that are

equipped with elevators may not have elevator access to all decks;

• wheelchair passengers should be aware that cabin doors and rest rooms are not wide enough to provide access for standard wheelchairs;

• for safety reasons, passengers in wheelchairs cannot be carried on boarding ramps (which may be steep due to water levels) whilst the vessel is tied up or at anchor, or on to motor coaches; and

• wheelchairs and walkers cannot be carried on motorcoaches due to space limitations.

Scenic reserves the right to decline your booking if Scenic deems that: it cannot provide for any or all special needs as identified by you; your health, safety or enjoyment, or that of any other passengers attending the tour may be at risk; or if Scenic deems that you will not abide by these terms and conditions. In addition, Scenic reserves the right to withdraw you from a tour, where Scenic deems that you are affecting your own health, safety or enjoyment or that of other passengers. Scenic will not be liable to you for any loss, cost or damage resulting from your withdrawal from a tour. If you are withdrawn from a tour, you will be under your own arrangements at your own expense. MS Tikhi Don is not equipped with wheelchair access.

21. Sightseeing on Tour Sightseeing in many historic towns and cities can only be undertaken by walking tours as motorcoach access is not possible. Consequently, a reasonable level of fitness is required as the sightseeing tour may involve steps and extensive walking over uneven surfaces.

22. Mountain Excursions Some tours include mountain excursions involving high altitudes. please consult with your doctor to ensure that you have an adequate level of fitness and are in good health before participating in these included excursions.

23. Passports and Visas You must have a valid passport with at least six months validity from your tour return date. Also, it is your sole responsibility to ensure that all required entry visas for countries to be visited are obtained prior to departure. Failure to obtain correct documentation may affect your participation in certain shore excursions and entry to certain countries while on tour.

24. Special Diets You must advise Scenic in writing of any and all special dietary needs at the time of booking. Scenic will make every reasonable effort to accommodate your dietary requests but cannot guarantee that such requests can be met.

25. Solo Passengers and Single Accommodation prices quoted in the brochure are on twin share basis. Dedicated single cabins are available on each Russian River Cruise departure at special single supplement rates payable at the time of booking your tour. A dedicated single cabin is available on each Scenic ‘Space-Ship’ and a limited number of Category E and D cabins are also available on each departure at special single supplement rates payable at the time of booking your tour. Details of prices and availability of single accommodation can be obtained at the time of booking. If requested, Scenic can attempt to match you with a rooming partner. If you remain matched throughout the entire tour, you will be refunded your single supplement rate within 2 weeks of tour completion. Scenic accepts no responsibility for the suitability of the allocated rooming partner. If at any time during the tour, you consider your rooming partner unsuitable, Scenic will endeavour to arrange single accommodation for you for the remainder of the tour, subject to availability. In this event, the single supplement rate will not be refunded to you on tour completion. You acknowledge that if there is no availability of single accommodation for the remainder of the tour, you will be required to continue to share with your nominated rooming partner for the remainder of the tour.

26. Young Passengers passengers under the age of 21 years (as at the departure date) must be accompanied by an adult and share their accommodation with an adult. Children under the age of 12 years are not encouraged and are accepted or rejected at the sole discretion of Scenic.

27. Airport Transfers Are only available on the first and last day of your tour and at times designated by Scenic. Transfers outside these times will be at your expense and must be secured by your own arrangements. passengers who have purchased Scenic’s pre and post tour hotel accommodation and airfares will be provided airport transfers to/from their hotel in tour start or end city only, on the day of the pre or post accommodation booking. If your airline booking is not made by Scenic, you must ensure your flight details are provided to Scenic (this can be entered by Tour personaliser at www.scenictours.com.au). No refund will be given for unused transfers. Transfers cannot be routed to other pick-up points or destinations. If you miss the pre-booked transfer you will be responsible for making your own way, at your own expense. Transfers must be booked and flights advised to Scenic no less than 60 days prior to travel, otherwise transfers cannot be guaranteed. Airport transfers may be group transfers scheduled to coincide with multiple flight arrival times. For those clients purchasing the Russian River Cruise Only, airport transfers are strictly restricted to embarkation and disembarkation days.

28. Hotel Accommodation Scenic reserves the right to substitute hotel accommodation of a similar standard in the place of the advertised hotel, where necessary. Overnight accommodation required to meet tour and/or flight connections is not included in the tour price and is at your own expense. Whilst Scenic has taken

reasonable steps to secure the most suitable hotel accommodation in the area of the tour, it is not liable to you with respect to the quality, size or fitness of hotel rooms.

29. Luggage passengers are entitled to one suitcase per person. Due to limited coach capacity, your suitcase must not exceed 76 x 53 x 28cms (30’’ x 21’’x 11’’) and weight should not exceed 20kg (42lbs). personal items should be carried in a travel bag. Airline passengers should consult with their air carrier as size and weight restrictions may vary from airline to airline and also according to the class booked. In addition, airline and airport luggage safety regulations must be complied with. It is your responsibility to ensure that your luggage complies and you acknowledge that Scenic or contracted carriers may elect not to carry overweight items. You will be responsible for excess baggage charges and otherwise complying with airline regulations and safety requirements.

30. Tour and Cruise Maps Maps or tour depictions contained in this brochure or any other brochures issued by Scenic, are intended as an indication only and should not be relied upon as the actual route taken during the tour. Scenic is not liable to you for any variation to the tour.

31. Pictures, Images and Information All images in this brochure represent typical scenes and descriptive detail for each tour, however it is possible that the particular subject matter may not be seen or experienced on tour. Also, some pictures may have been digitally enhanced.

32. Deckplan The deck plan, cabin sizes, images, inclusions and layout are indicative only and may vary. pictured representations of cabins or rooms in this brochure are not drawn to scale.

33. Internet Service Two stations are available for passengers wishing to use Internet facilities on board the ms Tikhi Don at an additional charge. passengers need to confirm these services and cost with reception once on board. Internet facilities are available in each Scenic ‘Space-Ship’ cabin for an additional charge. Internet availability and quality may vary from country to country and can also be affected by technical issues, weather or unfavourable terrains and other factors outside Scenic’s control. Consequently, Scenic does not guarantee the availability and quality of internet connections and no refund will be paid for any problem which may be experienced with the internet service.

34. Docking Position During port stops, ships may dock side-by-side, obstructing views and requiring you to pass through other ships to embark and disembark.

35. Smoking For the comfort of all passengers, smoking is limited to designated smoking areas on Scenic ‘Space- ships’ (and any other vessels), and is not permitted in cabins or on balconies. You acknowledge that Scenic may restrict smoking to specific times and locations during your cruise for the comfort of all passengers. Smoking is not permitted on coaches or such other places as nominated by Scenic from time to time. Scenic will use its reasonable endeavours to ensure there are opportunities for you to smoke during the tour. However, Scenic cannot guarantee such opportunities will be available.

36. Carriers The carriers (including airlines, rail and sea carriers used in association with the tours) are not responsible for statements in the brochure or any feature contained therein. The conditions of sale of each carrier constitute a separate contract and Scenic assumes no responsibility in relation to contracts between you and the carriers.

37. On Tour Safety passengers must follow crew instructions at all times to ensure on tour safety. You acknowledge that failure to do so will result in restricted access to areas on tour, or if necessary for your own safety and that of other passengers, withdrawal from the tour.

38. Amendments to Terms and Conditions These terms and conditions may be subject to amendment from time to time. Amendments will be posted on Scenic’s website.

39. Warranties To the extent permitted by law, all express or implied warranties, representations, or terms are expressly excluded. Where the law implies any condition or warranty which cannot be excluded, then Scenic’s liability for breach of such an implied condition or warranty is limited, at Scenic’s absolute discretion, to one or more of the following: (1) in the case of goods, the repair of goods, replacement of goods, the supply of equivalent goods or the cost of repair, replacement or supply of equivalent goods; or (2) in the case of services: supplying the services again or payment of the cost of supplying the services again.

40. Trade Practices Act Nothing in these terms and conditions will operate to exclude, restrict or modify the application of any provision of the Trade practices Act 1974 (Cth) or any equivalent State or Territory legislation, the exercise of a right conferred by such a provision, or any liability of Scenic for breach of a condition or warranty implied by such a provision, where it is unlawful to do so.

41. Responsibility You acknowledge and agree that Scenic accepts no responsibility and will not be liable to you or any third party for any loss, cost or damage (including loss of enjoyment) suffered directly or indirectly in connection with: (1) any tour risks or other aspects of the tour notified to you in these terms and conditions; (2) any change to your itinerary or delays in departure or arrival times of aircraft or otherwise during the conduct of the tour; (3) any loss or damage to your baggage; (4) any personal injury or death resulting from the acts or omissions or negligence of any third parties providing goods or services to you during the tour, including air carriers, hotels, shore excursion operators, restaurateurs, transportation providers and medical personnel; or (5) any loss of

enjoyment by you due to circumstances outlined in these terms and conditions or otherwise beyond Scenic’s control.

42. Total liability Despite any other provision of these terms and conditions, and to the extent permitted by law, Scenic’s maximum liability to you or any third party (including any claims of negligence on the part of Scenic) is limited to the tour price actually paid by you.

43. Consequential loss Scenic will not be liable for any loss of enjoyment, opportunity, profit, savings, revenue or interest or any other consequential or indirect, incidental, special or punitive loss, damage or expenses even if Scenic has been advised of their possible existence and even if such loss, damage or expense is caused by Scenic’s negligence.

44. Force Majeure For the purposes of this clause, “Force Majeure Event” means any act of God, war, terrorism, fire, flood or any other extreme weather conditions, loss of power, epidemics or pandemics, industrial disputes, slow-downs or other strike activities, riots or civil disturbances, acts of government, semi government or other authorities, inability to obtain any necessary licence or consent and delays caused by sub-contractors, suppliers or other third parties (including telecommunications carriers), material shortages or other disruption to the tour. You acknowledge and agree that Scenic is not liable for any delay or failure by Scenic to perform its obligation under these terms and conditions, resulting from or as a consequence of a Force Majeure Event. If a delay or failure occurs or is anticipated due to Force Majeure Event, Scenic’s obligations are suspended for the duration of the Force Majeure Event. Scenic may immediately terminate this agreement, if the Force Majeure Event delays performance for a period of 60 days or more, calculated from the date Scenic notifies you of the Force Majeure Event.

45. Dispute resolution If a dispute arises between the parties in connection with these terms and conditions, the parties undertake in good faith to use all reasonable endeavours to settle the dispute by way of good faith negotiation.

46. Entire Agreement These terms and conditions constitute the entire agreement between the parties about its subject matter and any previous agreements (whether oral or in writing), understandings and negotiations on that subject matter have no effect.

47. Waiver and Variation Scenic may only waive a right or remedy created under these terms and conditions in writing. Our delay in exercising a right or remedy does not constitute a waiver of that right or remedy, nor does any waiver by Scenic (either wholly or in part) operate as a subsequent waiver of the same or any other right. We reserve the right to amend these terms and conditions from time to time without prior written notice to you.

48. Governing Law These terms and conditions are governed by the laws in force in the State of New South Wales. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.

49. Survival Any term which is, by its nature, intended to survive termination of these terms and conditions survives termination.

50. Interpretation In these terms and conditions, unless the context otherwise indicates a contrary intention: (1) headings are for convenience only and do not affect interpretation; (2) singular includes the plural and vice versa; (3) a reference to a party includes its successors, permitted assigns, administrators and substitutes; (4) where a word or phrase is defined, its other grammatical forms have the corresponding meaning; (5) the word ‘include’ in any form is not a word of limitation; (6) no rules of construction apply to the disadvantage of Scenic on the basis that these terms and conditions were prepared by Scenic; (7) a reference to a natural person includes their personal representatives; and (8) a reference to a body (including institute, association or authority) which ceases to exist or whose powers or functions are transferred to another body is a reference to the body which replaces it or which substantially succeeds to its powers or functions.

51. Brochure Validity The Tour Brochure and these terms and conditions are valid for the departure dates from 01 January 2011 to 31 December 2011 unless otherwise indicated on the individual itineraries, and supersedes all previous brochures.

uSEFuL InFORMATIOn• Scenic FreeChoice All Scenic FreeChoice activities can be

booked whilst on tour with your Cruise or Tour Director (unless otherwise stated) and are subject to availability, seasonal and operational factors. Some activities require a minimum number of participants to operate.

• Scenic Enrich It may not always be possible to offer every brochured Scenic Enrich activity on tour. Suitable alternatives will be provided to ensure your overall tour enjoyment.

• Scenic Club Loyalty Program The program was launched in 2008 and replaces the previous program. Details of the benefits and qualification for membership etc for Australian and New Zealand residents are available on www.scenictours.com.au. At this stage only residents of Australia, New Zealand and the United Kingdom are eligible for memberships. Each country has their own version of the program which are subject to their own terms and conditions.

• Clothing We recommend smart casual and comfortable clothing. please bring comfortable walking shoes for sightseeing. Dinner attire is casual-open-neck shirts, slacks and dresses. Coats and ties may be worn but are not required. The Captain’s Welcome and Farewell Dinners are dressy but not formal. For winter months we recommend a warm coat, gloves, water-resistant footwear and an umbrella.

• Currency and Credit Cards Most countries visited in Europe will use the Euro although some still have their own local

currency. For small purchases ashore or in small towns, local currency is advantageous. Many locations accept major credit cards. ATM machines are located onshore at some stops. prior to departure passengers should confirm that their ATM card and pIN will work overseas. All purchases on board are charged to the passenger’s shipboard account. The on board currency on the Tikhi Don is the Rouble. Shipboard accounts may be paid in Roubles or by credit card. It is recommended that guests charge all on board expenses to their shipboard account and pay by credit card on departure day. The on board currency on each Scenic ‘Space-Ship’ ship is the Euro. • Traffic Moscow and St. Petersburg Traffic in Moscow and St. petersburg can at times be very heavy resulting in long transfer times.

• Hotel Accommodation Moscow and St. petersburg Scenic tours are unable to provide pre and post tour hotel accommodation in Moscow and St. petersburg.

• Moscow Circus If for any reason the Moscow Circus is not available, another suitable activity will be substituted.

• Ms Tikhi Don is owned and operated by Grand Circle Corporation.

River Cruising• Cruise Director An experienced English-speaking Cruise

Director accompanies every departure on ms Tikhi Don Russian Cruises and Scenic ‘Space-Ships’. They are there to ensure your comfort, answer questions and make your holiday relaxed and memorable. Cruise Directors are employed by Scenic.

• On board Language The language on board Scenic ‘Space-Ships’ is English. All staff, crew and tour guides speak English and all announcements and lectures will be made in English. On board other ships English will be spoken, but it may not be the primary language used.

• Medical Services River Cruise Onboard Ms Tikhi Don has a Doctor onboard. Medical cost are at client’s own expense. Scenic ‘Space-ships’ do not carry a doctor on board, however due to close proximity to land medical services can be called rapidly. Medical costs are at the passenger’s own expense. Due to the large number of passengers on board, Scenic cannot provide a personal escort for medical visits. We strongly recommend travel insurance.

• Dining Dining rooms are single dining sessions, open, unreserved seating - dine at table of your choice.

• Electricity On board Electricity on board ms Tikhi Don is 220V and 110V. Electricity onboard Scenic ‘Space-Ships’ is 220V. A power plug adaptor will be required to use small appliances such as electric shavers, clocks, mobile phone chargers, etc. An Australian power plug is available in each cabin on board Scenic ‘Space-Ships’.

• Hairdryers and Safes Are available on board the Scenic ‘Space-Ships’.

• Group sizes The number of participants will be limited to 40 guests on each coach for land tours over nine days in duration.

• Seat Rotation To ensure all passengers have the opportunity to enjoy front and window seats, a daily seat rotation system is employed on all of our coaches. You are required to adhere to the seat rotation system. If you suffer from travel sickness you should arrange medication or other alternatives to treat symptoms, as we cannot make allowances for this.

• Deposit Protection Plan The “Deposit protection plan” fee is $55 per person (including GST). The fee is non refundable and must be paid at the time of booking your tour. Where you cancel a tour, and the Deposit protection plan applies, Scenic Tours will hold the deposit paid by you for Scenic Tours products only (i.e. not products provided by third parties e.g. air travel) and will credit that portion of the deposit on alternative Scenic Tour products booked within 24 months of the cancellation, after which time the amount will be forfeited. The Deposit protection plan does not replace travel insurance which we strongly advise be obtained at the time of booking.
