RULES/ CRITERIA FOR ENLISTMENT/UPGRADATION OF CONTRACTORS IN BRO
1. FRESH ENLISTMENT
(a) Fresh enlistment in the BRO shall be done in respect of the contractors who have satisfactorily completed at least one work in BRO and fulfill the criteria laid down in
Appendix „B‟. (b) No other firm shall be enlisted on the basis of having worked on Power of Attorney. The work should have been completed by the firm in their name. (c) Reputed firm, who have not executed any BRO work but are performing exceptionally well in other Govt Deptts/undertakings and their enlistment is considered in the interest of BRO, may also be enlisted. (d) Enrolment/Application form for fresh enlistment is given in appendix „C‟. The list of documents and details required to be submitted by the contractor for enlistment in BRO is given at Appendix “D”. (e) To facilitate smooth procedure of enlistment and transparency, fresh enlistment of contractors shall be done twice in a year ie in Jun and December of every year for which following actions shall be taken :-

P/2 2. UPGRADATION:-
a) Criteria for upgradation to any class shall be same as given for fresh enlistment in that class. b) Upgradation of a contractor from the class in which he is initially registered shall normally be done in gradual stage, keeping in the mind the performance of the contractor in the Department. The Contractor shall be upgraded only one next higher class at a time. However if perfornace of any particular contractor is found to be of high order and enlisting authority considers upgradation of such contractor by more than one class justified, the same shall be done with prior approval of this Dte. 3. Renewal of Enlistment :- (a) The format for application for renewal of enlistment will be as per Appendix A to this letter along with the documents stated therein to be submitted. (b) Contractors shall be asked to apply for renewal of enlistment up to 30-4-2011. (c) The contractors falling under the following categories shall not be re-enlisted:-
aa) Contractors whose contracts have been cancelled and unrealized recoveries exist there to. Cases, where cancellation of contracts has been declared invalid/illegal in arbitration/court of law, shall be decided after submitting the recommendation and statement of case and obtaining approval of this HQ.
bb) Contractors in whose completed works during the last 5 years, serious defects were noticed which are subsequently attributed solely to the performance of contractors and has been established through Court of Inquiry of Tech Boards and in arbitration.
cc) Contractors who could not secure any work in the last 5 years either in
BRO or any Govt Deptt/Public sector under taking/AWHO/DGs NP; or in case they could not secure any work, they have not participated in tendering in BRO or have participated in tendering but have not been in first three lowest.
dd) Contractors who are habitual litigants. Contd…. P/3

ee) Contractors who are already removed on account of any default on their part, or ban period is not yet over. However, the enlistment may be renewed after expiry of the ban period.
ff) Contractors not found fit for renewal for reasons other than (aa) to (ee) above ie unethical conduct.
Some of the criteria listed above and action to be taken are elaborated as under:- (i) Regarding (aa) above, action needs to be taken to obtain the explanation of the contractors allowing 4 weeks time to furnish replies and the issue decided taking into account the replies of the contractor. ii) In respect of (dd) above, a contractor will be considered a habitual litigant if he moves the court more than once ignoring arbitration clause and the court does not uphold his view. (iii) Regarding (ff) above, the registering authority will intimate the specific reasons to the next higher Engineer Authority along with the contractor‟s explanation and his views on the same by one taking final decision. (d) The contractors who do not apply/submit the requisite documents for renewal up to 30-04-2011, may be considered for re enlistment after satisfying with the reasons of delay. (e) Any case of unusual nature may be referred to this Dte for advice. (f) Keeping the above guidelines in view, all Enlisting authorities are requested to initiate action as indicated below:-
(aa) Issue letters to enlisted contractors asking them to submit applications by 30 Apr 2011 on the format at Appendix “A”.
(bb) Collect information from lower formations to ascertain if any contractor falls in the categories mentioned in para 3 (c) here-in-before.
(cc) Issue renewal letters to all contractors in appropriate class, who do not fall
in the categories mentioned in para 3 (c) on or before 30 Jun 2011.
(dd) Exercise extreme care in refusing renewal on grounds mentioned in para 3
(c) here-in-before. In all such cases contractors views be obtained and examined and if required case be referred to next higher authority along with recommendation of CE (P) before taking final decision.

5. A contractor, who is not enlisted with the BRO/ who is enlisted but has not executed the standing security bond, while submitting a tender shall be required to furnish earnest money along with the tender. However, if the tender submitted by such a contractor is
accepted, he will be required to lodge with the Controller of Defence Accounts (BR), Individual Security Deposit (ISD for the specific work) within thirty days of the receipt by the contractor of notification of acceptance of his tender, failing which this sum shall be recovered from the first RAR payment or from the first final bill. However, in cases, where any payment is made to the contractor within thirty days of the receipt by him of notification of acceptance of tender, the amount of security deposit shall be recovered from payments. The Earnest Money will be refunded to the contractor after the security deposit is lodged by the contractor or recovered from payments due to him.
6. In the case of a contractor who is enlisted and who has lodged standing security deposit and executed a standing security bond, if the tendered cost of works exceeds the tendering limits of the contractor (ie his class of enlistment) and the Accepting Officer decides to accept his tender such a contractor shall be required to lodge with the Accepting Officer concerned, „Addition Security Deposit‟ (ASD), equal to the difference between the individual security Deposit and Standing Security Deposit already lodged by him, within 30 days of the receipt by him of notification of acceptance of his tender, failing which this sum will be recovered in the same manner as stipulated in para 7 herein before.
7. Any contractor, borne on the approved list of contractors of any BRO formation and who has executed a standing security bond, may be permitted to tender for works under any other BRO formation without furnishing earnest money along with his tender. If the tender submitted by such a contractor is accepted, the contractor will be required to lodge with the Controller of Defence Accounts (BR), the amount of individual Security Deposit within thirty days of the receipt by him of notification of acceptance of his tender, failing which this sum will be recovered in the same manner as stipulated in para 7 herein before. Appendix „A‟
APPLICATION FOR RENEWAL AS CONTRACTOR FOR THE NEXT CYCLIC PERIOD 01 Jul 2011 TO 30 Jun 2016
1. I/We ___________________________________________________________presently enlisted with Index No.________________am/are desirous of being re-enlisted on the BRO list of contractor for the same class & category of works. Following particulars are submitted :- (a) List of works executed and completed and/or in hand during the preceding 5 years at Annexure-I. (b) Solvency certificate and working capital certificate from Bank as per Annexure II (c) Affidavit for minimum reserve (immovable and movable property) alongwith valuation report from regd valuer. Notes : (aa) Valuation report shall clearly indicate ownership details (bb) The following endorsement shall be made on affidavit for minimum reserve : (i) That the immovable/movable property is free from mortgage, hypothetication or any other disputes and encumbrances and clearly belongs to the contractor. Or That the immovable/movable property is free from any disputes and encumbrances and clearly belongs to the contractor. The immovable/movable property has been mortgaged/hypotheticated for Rs._________. Market value of immovable/movable property as per valuation report No.___________given by Regd valuer__________is Rs.______________. Therefore balance market value of property i.e. Rs.______________(Market value minus mortgaged value) is free from any mortgage/hypothetication. (ii) That the said immovable/movable property has not been shown for seeking enlistment of a sister concern in BRO. (iii) That the said immovable/movable property will not be sold, transferred, gifted or otherwise disposed off without prior intimation to the registering authority in BRO. While giving such prior intimation, new affidavit for alternate immovable/movable property of value at least equal to minimum requirement as per scales along with valuation report from Regd valuer shall also be submitted; failing which the Registering Authority may declare the contractor unenlisted or may take action as deemed fit till acquiring alternate immovable/movable property. In case of partnership firm, the partner having immovable property in his name shall also endorse following in addition to above:- (iv) Irrespective of my share in partnership firm, my whole property may be utilized by the Government for realizing their dues/recovery, if the firm fails to deposit the same.

Notes: - 1. The categories for enlistment shall be decided on basis of nature of works executed by contractor and T&P/machinery possessed by him as per Annexure I to Appendix B.
2. To meet out the criteria of past experience and deciding the class & categories, the value and nature of works done in the other Govt. Deptts/Public Sector Undertakings/ AWHO/DGsNP may also be considered.
3. Working capital with the contractor shall be judged from balance sheet/bank‟s certificate (as per Annexure I to Appendix D)/bank statement for last 6 months/ overdraft facility from bank/fixed deposit receipts with banks.
4. Immovable/movable property (minimum reserve) shall be exclusively in the name of contractor and not in the name of family members/relatives/others. In case of Limited Companies, the immovable /movable property (considered for minimum reserve) shall be exclusively in the name of company and shall be reflected in the Balance Sheet of the Company.
5. Requirement of Engineering establishment shall not be insisted upon if enlistment is to be done for following categories only :-
(c) Provision of building/road materials and stores.
(d) Handling and conveyance of stores
6. The criteria laid down for enlistment/ up gradation may be relaxed in the case of contractors whose performance has been found to be of a very high order. Such relaxation may, however be given only with the prior approval of this Dte.
(b) Firm should possess minimum T & P as per annexure I to Appendix B.
(c) There should not be any Govt dues/recovery outstanding against firm.
(d) Contractor should not be habitual litigant.
(e)There should not be any adverse remarks in the police record against proprietor/ partners/directors of firm which are considered against nation security.

(Every contractor and corporation wishing to be registered as an approved contractor shall
submit a list of those persons who are working with it in any capacity and who are near relative of any
commissioned/GREF Officers in the Border roads or any Gazetted Officer of the Ministry of
defence/Ministry of Surface Transport. Contractor/Corporation shall also intimate names of such
persons if they are subsequently employed by him/it. The contractor/corporation is no enlisted to
tender for any work which near relative will deal with or with which he may be connected in any way
and that any breach of this condition may be considered sufficient to debar him/it from registration or
t0 remove him/it from the approved list.
(Notes :- By the term ‘near relative is meant wife/husband, parents, children, brothers, sisters,
brother/sister-in-law, son/daughter-in-law, first cousin and father-in-law.)
12. We agree to notify the Officer accepting this application and registering our names on the list of
contractors of any changes in the foregoing particulars as they occur and to verify and confirm these
particulars annually on 1st January.
13. We agree to execute a BOND in favour of the President of India in the form and to the amount
prescribed as security against proper performance of work entrusted to me is for execution in
accordance with the applicable conditions of contract, as a condition receded to our name being
registered in the BRO list of contractors.
14. We understand and agree that the appropriate Border Roads authority has the right as he may
decide, not to issue tender forms in any particular case and also to suspend, remove black list our name
from the BRO list of contractors in the event of our submission of non bonafide tenders or for technical
or other delinquency in regard to which the decision of the appropriate BRO Authority shall be final and
conclusive.
15. We certify that the above particulars are correct and that should it be found that we have given
a false certificate or that if we fail to notify the fact of our subsequent amalgamation with another
contractor or firm, our name will be removed from the BRO list of contractors and any contract that we
may be holding at that time is liable to be rescinded.
16. We undertake not to employ directly or indirectly any Army Personnel* dismissed from service
in our business.
17. We note that registration as BRO Contractor does not carry with it the right to tender for BRO
works.

Appendix „D‟
LIST OF DOCUMENTS & DETAILS REQUIRED TO BE SUBMITTED FOR
ENLISTMENT
(I) Application (IAFW-2190) form duly completed and signed by Proprietors / all
Partners or the Directors as authorised.
(II) A copy of the registration certificate alongwith memorandum and Article of
Association, if your firm is registered with Registrar of Companies under Company Act
1956.
(III) Copy of partnership deed in case of partnership firm and affidavit to the effect
that whether the firm is proprietor ship or partnership firm or a company. In the affidavit
they will state that the constitution of firm or company shall not be changed without prior
approval of the Registering authority.
(IV) Details of experience of executing similar type of works for which registration is
sought for. The details must include clear postal address of the clients, value of works
done with date of commencement and completion. The details are required for minimum
last three years.
(V) Name and residential address of the Proprietor/Directors/Partners of your firm
alongwith address of Police Station and Senior Supdt/Supdt of Police under whom the
residential address of these Partners/Directors falls. Latest photographs of the
Proprietor/ Directors/Partners duly signed and attested should be affixed on enrolment
application and two photographs struppled on the form.
(VI) PAN of the Proprietor/Partners of the firm.
(VII) Copy of Balance Sheet for the last three years duly audited by the Charted
Accountant and attested by a Class I Gazetted Officer.
(VIII) Details of movable/immovable properties to be given in the form of an affidavit on
non judicial stamp paper of appropriate value duly attested by the Notary Public or 1st
Class Magistrate.
(IX) Valuation certificate for immovable property from a registered Valuer in original
alongwith copy of licence of Valuer.
(X) Details of Veh/Eqpt/Plant showing make, model and type alongwith their present
value should be given in the form of an affidavit. If these are to be considered for
minimum reserve then Valuation certificate shall also be obtained from the registered
valuer and submitted alongwith copy of valid licence of registered valuer.
(XI) In the affidavit of holding movable/immovable property the following affirmation
should be endorsed and signed:-
(i) That the immovable/movable property is free from mortgage, hypothetication or any other disputes and encumbrances and clearly belongs to the contractor. Or That the immovable/movable property is free from any disputes and encumbrances and clearly belongs to the contractor. The immovable/movable property has been mortgaged/hypotheticated for Rs._________. Market value of immovable/movable property as per valuation report No.___________given by Regd valuer__________is Rs.______________. Therefore balance market value of property i.e. Rs.______________(Market value minus mortgaged value) is free from any mortgage/hypothetication. (ii) That the said immovable/movable property has not been shown for seeking enlistment of a sister concern in BRO. (iii) That the said immovable/movable property will not be sold, transferred, gifted or otherwise disposed off without prior intimation to the registering authority in BRO. While giving such prior intimation, new affidavit for alternate immovable/movable property of value at least equal to minimum requirement as per scales along with valuation report from Regd valuer shall also be submitted; failing which the Registering Authority may declare the contractor unenlisted or may take action as deemed fit till acquiring alternate immovable/movable property. In case of partnership firm, the partner having immovable property in his name, shall also endorse following in addition to above:- (iv) Irrespective of my share in partnership firm, my whole property may be utilized by the Government for realizing their dues/recovery, if the firm fails to deposit the same.

(XII) Details of Engineers employed with your firm (with the date of employment)
should be given in the form of an affidavit. Affidavit from each Engineer stating that they
are employed with your firm is also required. Copies of their Degree/Diploma
Certificates duly attested by Notary Public or Class I Gazetted Officer must also be
submitted.
(XIII) Solvency certificate from your Banker indicating satisfactory maintenance of
account and amount upto which your firm can be treated as solvent. This certificate
should be on Banker‟s letter head indicating Branch Code and Personal Code numbers
of the person signing it. Working capital certificate from your banker indicating working
capital, overdraft facility etc.( For specimen refer annexure I to appendix D)
(XIV) Declaration from the Partners/Directors of the firm in the form of an affidavit of
appropriate value that no recovery is pending to be made against the firm by BRO or
MOD or MORT&H
(XV) Declaration from the Partners/Proprietor/Directors of the firm in the form of an
Affidavit that the firm is not involved in any Court case, Litigation etc with BRO or
MORT&H or MOD and the firm or any Partners/Directors are not banned for enlistment
/tendering by any Govt Organisation.
(XVI) Affidavit affirming that no Govt recovery is due against the firm and the Co. / firm
is not black listed by any of the Government Department.
(XVII) Affidavit to the effect that no near relative of any of the Partners/ Directors of the
firm are working as Gazetted Officer in BRO or Ministry of Defence If such near relative
is (are) working as stated, the details of post held and place of posting be indicated in
affidavit.
(XVIII) Copy of enlistment and valid registration certificate issued by Govt/ Semi Govt
Department, if any, duly attested by a Class I Gazetted Officer.
(XIX) Copy of power of Attorney, if any.
Note: - All affidavits should be submitted on Non Judicial Stamp Paper of appropriate
value duly attested by Notary Public or 1st Class Magistrate.

1. Border Roads Organisation constructs and maintains Roads, tunnels, Bridges
etc. in border areas of India.
2. In order to cope up with the huge targets, BRO outsource works on larger
scales. Contractors constructing Roads, bridges and tunnels will have a major role in
sharing the works entrusted to the BRO.
3. BRO enlists the Contractors in different classes and categories depending
upon their financial and technical capabilities. Details of various Classes & Categories
of enlistment, enlistment criteria and application form along with list of documents
required for enlistment are available on website www.bro.gov.in (Link : “Tender”).
4. Contractors interested for enlistment may send applications on prescribed
appliaction form along with requisite documents to HQ DGBR (E8 Section), Seema
Sadak Bhawan, Ring Road Delhi Cantt, New Delhi-110010 (for enlistment in classes
„SS‟ „S‟ „A‟ & „B‟), to respective CE Projects ( for enlistment in classes „C‟ & „D‟) and
respective Commander task force (for enlistment in class „E‟). Last date of receipt of
