Market News On Real estateProperty prices have increased by an average 15 per cent in the Delhi-NCR during Apri-June quarter of this fiscal against the year-ago period, according to a report.

In Delhi-NCR, Gurgaon Sector-54 saw the highest appreciation in property prices of about 87 per cent during April-June 2013 over April-June 2012, the company said in a statement.

“Delhi-NCR region continues to witness an increase in property prices with 15 per cent year-on-year property appreciation seen in Q2-13 when compared to Q2-12,” it said.

The appreciation is however lower than the previous quarter, which saw 20 per cent rise in property prices.

Housing rentals in the Delhi-NCR region have also gone up

by an average of 5 per cent in April-June period of 2013 when compared to the same period a year ago.

The property prices and rental rates have been progressing in Delhi-NCR over the year with Gurgaon specifically keeping up with the momentum. Noida and Faridabad are also realising the benefit in price and rentals owing to increased connectivity with Delhi and affordable housing projects.

In Delhi, the portal said that Narela & Mahavir enclave have

emerged with strong price appreciation by 44 per cent and 39 per cent, respectively.

A few localities in South Delhi continue to see a price correction in property price.

Saket in particular has seen a dip of 14 per cent in this quarter from 6 per cent decline in last quarter, followed by Defence colony and C R Park also witnessing the decline by 9 per cent and 6 per cent, respectively.

Are there enough professional takers for realty jobs?By Ravi Sinha

The biggest dampener for any realtycompanies’ brand building is the project getting delayed. However, it is not always the developers’ fault. even beyond the chain of repetitive regulatory clearances and fundinggap, lies the fact that projects often get into a logjam in the absence of skilled manpower. Though many of the leading realty companies, in their endeavour to be seen as professionally managed, are poaching on professionals from other sectors and even hiring bureaucrats and technocrats in their management teams, such make shift arrangements only indicate that the sector lacks the vision to cure the disease and is focusing on mere symptoms.

Facts are alarming. By 2020, Indian realty is all set to face a shortage of skilled manpower as staggering as over 85 per cent across various professional categories. The cumulative figure is about 44 million and what makes matters worse is the dearth of educational and vocational institutions in the country. The shortage of skilled professionals is to the tune of 80 per cent today and it is expected to remain so for over a decade, says a recent study by the Royal Institution of Chartered Surveyors (RICS).

Real estate is expected to see a wide demand-supply gap of 44 million for core qualified professionals like civil engineers, architects and planners. By

2020, the sector will require five million civil engineers, architects and planners but the country is expected to produce less than a million of these professionals. This shortage, say real estate analysts and developers, is resulting in higher costs for them along with delays in deliveries of their projects, denting their profitability.

This is a staggering shortfall, especially in light of India’s population which is estimated to increase to 1.38 billion, with 500 million (36 per cent) comprising of urban population and an unprecedented demand for quality real estate and infrastructure expected in the years to come. Approximately, 123 million of additional urban

population by 2020 will require professional assistance for the construction of houses, with a whopping 95 billion sq ft of potential demand for real estate space across residential, retail, commercial, industrial and civil amenities over 2010-20 . In light of this, the RICS, known as the world’s leading professional qualification and standard setting body in land, property and construction sector, has now established the RICS School of Built environment in collaboration with Amity university to address the shortage of skilled professionals in the sector. This industry led academic initiative is supported by the Ministry of urban Development, where the school aims to bridge the professional skills gap in real estate, construction, infrastructure and associated services - collectively termed as ‘built environment’ , by delivering ‘industry ready’ professionals from the day students complete their education and step into the industry.

Globally, the built environment sector accounts for 10 per cent of the work force, 70 per cent of wealth, 60 per cent of all utilised materials, 40 per cent of carbon emissions and 60 per cent of energy utilisation. In India, the sector

accounts for nearly 17.5 per cent of the GDP, second only to agriculture and is the second largest employer, with over 50 million people working in built environment.

Inaugurating the RICS School of Built environment, Kamal Nath, union Minister of urban Development says, “The challenges of urbanisation in India are already immense. India has a very young demographic profile that’s extremely mobile and we are already seeing small towns becoming the hub of economic activity. This is probably the largest aspirational society on the planet with growing disposable incomes - moving from the economics of sustenance to the economics of gratification and we see this reflected in the built environment domain as well. One of the biggest challenges that the real-estate , construction and infrastructure sectors are facing, is that of good human resources. I look forward to the School of Built environment creating ‘next practices’ which in turn, will lead to ‘best practices’ for the industry. The government will be happy to assist this partnership in any way possible.”

practitioners involved throughout the real estate development process to stay abreast of the knowledge curve and strengthen their ability to survive the paradigm shift taking place in global realty markets. Shortage of skilled manpower is an accepted fact of Indian realty. The question is whether young talent is ready to join a sector with perception issues.

“The youth today is well aware about the possibilities and the

oppo r tun i t i e s of any curriculum. Information that is available on the Internet and through other means are making them aware about the sector. The shortage of skilled professionals should not be seen as one and similar with the thought that the youth of the country have some concerns regarding the perception of the sector. As the sector is getting organised and companies are bringing best

practices, youth will continue to join the sector,” predicts Sandhir.

The dearth of professionals is affecting the sector in terms of

making real estate companies

introducing best practices from other sectors into realty. The stigma of working for a builder (with known unprofessional ways and means in the sector) is also gradually getting eroded with more educated people joining the sector and almost all leading corporates in the country including Tata, Godrej, Piramal. etc., entering the sector.

Harmit Chawla, managing director of HCorp Realty, adds that it is easy to paint the entire sector with a black brush but that won’t lead to a solution. According to him, the solution lies in more professionals coming into the sector with groomed skill sets, which will in turn, reflect in greater

transparency, t i m e l y delivery and

delivery one can trust.

There is a general consensus within the built environment that the government, private sector and academic institutions will

have to join hands to bridge this deficit of

skilled professionals, which in turn, will

bridge the overall trust deficit in

the sector and g i v e it a much-n e e d e d facelift. With the R I C S - A m i t y school, the ball has been set rolling and the industry is optimistic to have professionals with the desired skill sets to take the business to the next level, where ‘Brand Realty’ will not have perception issues.

Sec- 10(48)

Any income received in india in Indian Currency by a foreign company on account of sale of crude oil to any person in India shall not be included in computing the total income of a previous year of any person . Provided that-i. Receipt of such income in India by the foreign company is

pursuant to an agreement or an arrangement entered into by the Central Government or approved by the Central Government.

ii. Having regard to the national interest, the foreign company and the agreement or the arrangement are notified by the Central Government in this behalf; and

iii. The foreign company is not engaged in any activity , other than receipt of such income , in India.

After words fly in acrimonious debate, Lok Sabha passes key land acquisition Bill

Land Acquisition, Rehabilitation and Resettlement Bill[1] in India was a bill passed that was passed on August 29, 2013. As per the bill the much-awaited land acquisition and rehabilitation bill that aims to provide fair compensation to those whose land is taken away, brings transparency to the process of acquisition of land to set up factories or buildings and assures rehabilitation of those affected. This legislation has been eagerly sought by both industry and those who live off the land.Out of the 235 members who voted on the bill, 216 backed it while 19 voted against it. The bill aims to replace a nearly 120-year-old law enacted during British rule in 1894.

The bill establishes meaningful regulations for land acquisition as a part of India’s massive industrialisation drive driven by public-private partnership. The bill was introduced in Lok Sabha in India on 7 September 2011. The bill will be central legislation in India for the rehabilitation and resettlement of families affected by land acquisitions.

The Land Acquisition, Rehabilitation and Resettlement, 2011 Bill is also known as LARR Bill 2011 and LARR 2011. The Bill

has 107 clauses. It was in public domain and India’s parliament for review, as Bill number 77 of 2011.Purpose of the Bill

LARR 2011 seeks to repeal and replace India’s Land Acquisition Act, 1894. The Bill seeks to enact a law that will apply when:[4]

Government acquires land for its own use, hold and control.Government acquires land with the ultimate purpose to transfer it for the use of private companies for stated public purpose. The purpose of LARR 2011 includes public-private-partnership projects, but excludes land acquired for state or national highway projects. Government acquires land for immediate and declared use by private companies for public purpose.

LARR Bill 2011 aims to establish

the law on land acquisition, as well as the rehabilitation and resettlement of those directly

affected by the land acquisition in India.

The scope of LARR 2011 includes all land acquisition whether it is

done by the central government of India, or any state government of India, except the state of

Jammu & Kashmir.

Need for the Bill

The Government of India claims there is heightened public concern on land acquisition

issues in India. Of particular concern is that despite many amendments, over the years, to India’s Land Acquisition Act of 1894, there is an absence of a cohesive national law that addresses:

fair compensation when private land is acquired for public use, and fair rehabilitation of land owners and those directly affected from loss of livelihoods.

The Government of India believes that a combined law is necessary, one that legally requires rehabilitation and resettlement necessarily and simultaneously follow government acquisition of land for public purposes.

Forty-Fourth Amendment Act of 1978 omitted Art

19(1) (f) with the net result being:-

1. The right not to be deprived

of one’s property save by authority of law has since been no longer a fundamental right.

Thus, if government issues a fiat to take away the property of a person, that person has no right to move the Supreme Court under Art 32.

2. Moreover, no one can challenge the reasonableness of the restriction imposed by any law the legislature made to deprive the person of his property.

Art 31(2) in the original Constitution embodied the principle that if the Government makes a compulsory acquisition or requisitioning of private property, then it must take following actions:-

a) make a law

b) such law must be for public purpose

c) compensation must be paid to the owner of the property

First, the 25th Amendment Act, 1971 replaced the requirement of ‘compensation’ by ‘an

amount’, the adequacy of which cannot be challenged in any court. Then the real killer 44th Amendment Act, 1978 came and omitted the Art 31 along with Art 19(1) (f). Thus individual’s right to compensation for loss of property was also lost.

In recent times, there have been multiple incidents where farmers were protesting against the Government as it took away the land from them without paying the adequate compensation and against the wishes of many farmers. The whole debate about Right to Property needs to be re-initiated under this background. The Right to Property, which was enshrined in the original Constitution of India, as Fundamental Right should be re-instated by voiding the changes made by 44th Amendment Act of 1978 in this respect.

Benefits and Effects of the Bill

The 2011 LARR Bill, if enacted into law, is expected to affect rural families in India whose primary livelihood is derived from farms. The Bill will also affect urban households in India whose land or property is acquired.

Per an April 2010 report, over 50% of Indian population (about 600 million people) derived its

livelihood from farm lands. With an average rural household size of 5.5,[11] LARR Bill 2011 R&R entitlement benefits may apply to about 109 million rural households in India.

According to Government of India, the contribution of agriculture to Indian economy’s gross domestic product has been steadily dropping with every decade since its independence. As of 2009, about 15.7% of India’s GDP is derived from agriculture. LARR Bill 2011 will mandate higher payments for land as well as guaranteed entitlements from

India’s non-agriculture-derived GDP to the people supported by agriculture-derived GDP. It is expected that the Bill will directly affect 132 million hectares (326 million acres) of rural land in India, over 100 million land owners, with an average land holding of about 3 acres per land owner.[10] Families whose livelihood depends on farming land, the number of livelihood-dependent families per acre varies widely from season to season, demands of the land, and the nature of crop.

LARR Bill 2011 proposes to compensate rural households

– both land owners and livelihood losers. The Bill goes beyond compensation, it mandates guaranteed series of entitlements to rural households affected. According to a July 2011 report from the Government of India, the average rural household per capita expenditure/income in 2010, was Rs.928 per month (uS$ 252 per year).[12]

For a typical rural household that owns the average of 3 acres of land, the LARR 2011 Bill will replace the loss of annual average per capita income of Rs.11,136 for the rural

household, with:[4]

four times the market value of the land, and an upfront payment of Rs.136,000 (uS$ 3,000) for subsistence, transportation and resettlement allowances, and an additional entitlement of a job to the family member, or a payment of Rs.500,000 (uS$ 11,000) up front, or a monthly annuity totaling Rs.24,000 (uS$ 550) per year for 20 years with adjustment for inflation – the option from these three choices shall be the legal right of the affected land owner family, not the land acquirer, and a house with no less than 50 square

m e t e r s in plinth area, and a d d i t i o n a l benefits may apply if the land is resold w i t h o u t

development, used for urbanization, or if the land owner belongs to SC/ST or other protected groups per rules of the Government of India If the affected families on the above rural land demand 100% upfront compensation from the land acquirer, and the market value of land is Rs.100,000 per acre, the 2011 LARR Bill will mandate the land acquirer to offset the loss of an average per capita 2010 income of Rs.11,136 per year created by this 3 acre of rural land, with the following:

Rs.1,836,000 (uS$ 41,727) to the rural land owner; which is the total of R&R allowances of Rs.636,000 plus Rs.1,200,000 – which is four times the market value of the land, plus a house with no less than 50 square meters in plinth area and benefits from Schedule III-VI as applicable to the rural land owner, plus additional payments of Rs.636,000 each to any additional families claiming to have lost its livelihood because of the acquisition, even if they do not own the land

The effects of LARR Bill 2011, in certain cases, will apply retroactively to pending and incomplete projects. The Bill exempts land acquisition for all linear projects such as highways, irrigation canals, railways, ports and others.
