RTI Response reveals TN Government is Hastening the Preparation of CZMPs - Is that the Solution?

An RTI response received by the Coastal Resource Centre reveals that the Government of Tamil Nadu, after delaying the preparation of a statutory state Coastal Zone Management Plan, is now attempting to rush through a CZMP that activists fear will regularise CRZ violations and free up coastal wetlands for real estate. The response, which contained minutes of a high-level meeting chaired by Environment Secretary on 6 July, 2017, notes that the draft CZMP will be uploaded for public consultation by 15 August, 2017. The Directorate of Environment is required to work with National Centre for Sustainable Coastal Zone Management (NCSCM) to incorporate public comments by end September and conduct public consultations in all coastal districts by 31.10.2017. The finalised CZMPs are to be processed within a month and sent by the state government to the Ministry of Environment, Forests and Climate Change by 31.12.2017.

A new plan, mandated under the CRZ 2011 was to be completed by 2013 by the addition of Land Use Plans (LUP) of coastal communities, Uniform High Tide Line and Low Tide Line for India’s coast and mapping violations of the plans approved in 1996. Six years hence, all of this remains to be completed.

In April, 2017, the CRC had released a report that used three case studies to highlight how NCSCM's flawed High Tide Line (HTL) demarcation had wrongly identified 900 acres of coastal wetland as land. The same report also highlighted how NCSCM's HTL effectively regularised encroachments built inside the HTL of coastal waterbodies.

CRZ Notification 2011 requires all coastal states to identify and act against CRZ violations, and prepare CZMPs. In July 2011, the Directorate of Environment, which is entrusted with finalising the CZMP, had resolved to identify and publicly report violations, and take action against them. However, till date, not one violation has been identified. Violations identified and reported by citizens have been condoned or complaints ignored.

Between the flawed HTL and the failure to identify offenders encroaching inside water bodies, the entire exercise of drawing up a fresh CZMP will convert an environmental protection regulation into a bonanza for real estate and a disaster for coastal residents.

On 31st July 2017, the Ministry of Environment, Forests and Climate Change extended the validity of the 1996 Government of India-approved state CZMP for the sixth time since the introduction of the CRZ Notification 2011. All states have to have approved CZMPs by July 2018. A copy of the Notification is below.

If the Tamil Nadu government is serious about protecting the environment and fisherfolk, it should first identify structures built in violation of the 1996 approved CZMP, redraw the HTL with careful ground-truthing and prepare a map that clearly identifies fisher's land and ocean-use and areas reserved for long-term housing for fishers.

ारा, कितपय तटीय क्षे को तटीय िविनयमन खंड के रूप म घोिषत िकया था और उक् त खंड म उ ोग की स् थापना करने और उनके िवस् तार, संि या तथा संस् करण पर िनबधन अिधरोिपत िकए थे ;

और उक् त अिधसूचना के पैरा 5 के खंड (viii) के अधीन राज् य सरकार या संघ राज् यके्ष के तटीय खंड बंधन ािधकरण से यह अपेक्षा की जाती ह ैिक वह केन् ीय सरकार को पणधािरय से ाप् त सुझाव और आक्षेप

को समािवष् ट करने के पश् चात् अपनी िसफािरश के साथ ारूप तटीय खंड बंध योजना स् तुत करे ;

और उक् त अिधसूचना के पैरा 5 के खंड (xii) के अधीन, तटीय िविनयमन खंड अिधसूचना, 1991 के अधीन पहले से ही अनुमोिदत तटीय खंड बंध योजना की िविधमान् यता को केन् ीय सरकार ारा अिधसूचना सं. का.आ. 1212(अ), तारीख 22 माचर्, 2016 ारा 31 जनवरी, 2017 तक िवस्तािरत िकया गया था ;

और तटीय क्षे बंध योजना के तैयार िकए जाने की ािस् थित का पुनिवर्लोकन करने के पश् चात्, केन् ीय सरकार का यह समाधान हो गया ह ैिक उसे तटीय राज् य और संघ राज् यके्ष के िलए, अपनी-अपनी ारूप तटीय खंड बंध योजना को अनुमोदन हतुे स् तुत करने हतुे कुछ और अिधक समय की आवश्यकता ह;ै

और पयार्वरण (संरक्षण) िनयमय, 1986 के िनयम 5 के उपिनयम (4) के उपबंध को ध् यान म रखते हुए, केन् ीय सरकार की यह राय ह ैिक यह उक् त अिधसूचना का आगे और संशोधन करने के िलए उक् त िनयम के िनयम 5 के उपिनयम (3) के खंड (क) के अधीन सूचना की अपेक्षा से अिभमु करना लोक िहत म ह ै;

अत:, अब, केन् ीय सरकार पयार्वरण (सरंक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के खंड (घ) और उपिनयम (4) के साथ पिठत पयार्वरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खडं (v) ारा दत् त शिक् तय का योग करते हुए उक् त अिधसूचना म िनम् निलिखत और संशोधन करती ह,ै अथार्त्:-

उक् त अिधसूचना के पैरा 5 के खंड (xii) के स् थान पर िनम् निलिखत खडं रखा जाएगा, अथार्त्:-

S.O. 2444(E).—Whereas, by notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 19(E), dated the 6th January, 2011 (hereinafter referred to as the said notification), the Central Government had declared certain coastal stretches as Coastal Regulation Zone and restrictions were imposed on the setting up and expansion of industries, operations and processes in the said Zone;

And whereas, under clause (viii) of paragraph 5 of the said notification, the Coastal Zone Management Authority of a State Government or of a Union territory is required to submit the draft Coastal Zone Management Plan

along with its recommendations to the Ministry of Environment and Forest, after incorporating the suggestions and objections received from the stakeholders;

And whereas, under clause (xii) of paragraph 5 of the said notification, the validity Coastal Zone Management Plans already approved under the Coastal Regulation Zone notification, 1991, was extended up to the 31st July, 2017 by the Central Government vide notification number S.O. 622(E), dated the 23rd February, 2017;

And whereas after the review of the status of preparation of the Coastal Zone Management Plans, the Central Government is satisfied that it may take some more time for the coastal States and Union territories to submit their respective draft Coastal Zone Management Plans for approval;

And whereas the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for further amending the said notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the said notification, namely:-

In the said notification, in paragraph 5, in clause (xii), for figures “2017”, the figures “2018” shall be substituted.

And whereas, after the review of the status of preparation of Integrated Coastal Regulation Zone and Integrated Islands Management Plan, the Central Government is satisfied that it may take some more time for the Union territories to submit their respective draft Integrated Coastal Regulation Zone and Integrated Islands Management Plan for approval;

And whereas, the Central Government, having regard to provision of sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, is of the opinion that it is in public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rules for further amending the said notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in the said notification, namely:-

In the said notification, in paragraph III, in clause D, under the heading 5 relating to ‘period for which ICRZ and IIMPs shall be valid’, in item (ii), for the words, figures and letters “used till the 31st July, 2017” the words, figures and letters “valid till the 31st July, 2018” shall be substituted.

Coastal Regulation Zone (CRZ) Noti5cations1991 & 2011 – Instructions u/s 5 of Environment(Protection) Act 1986 to the District CoastalZone Management Authorities & CMDA toidentify violations and take action.

Ministry of Environment and Forests (MoEF), Government of India have

issued directions under section 5 of the Environment (Protection) Act 1986, to

all the State Coastal Zone Management Authorities (SCZMA), in Lr. No. 11-

83/2005-IA-III dated 25th January 2011 (copy enclosed), to identify violations

under CRZ Noti�cation 1991 and the approved Coastal Zone Management Plan

there under in a period of four months and initiate action upon the identi�ed

violations within four months thereafter. Government of India have also

instructed to upload the relevant details of the identi�ed violations, including

the action taken on the violations on website every fortnight.

2) The Government of Tamil Nadu have constituted District Coastal Zone

Management Authorities (DCZMA) for all the Coastal districts in G.O.Ms.No.163

Environment and Forests Department dated 09.06.1998 under the provisions of

the above said para 4 of the CRZ Noti�cation 1991 and also a separate DCZMA

for CMDA areas under the Chairmanship of Additional Director of Environment

in GO.(Ms).No.85 E&F Department dated 29.06.2010. Further Government in

Lr. No. 29477/EC-3/2005-1 Environment and Forests Department dated

02.11.2005 has delegated powers to deal CRZ issues in CMDA jurisdiction, upto

the project costs of Rs.5.00 crores, as per CRZ Noti�cation 1991.

3) As per para 6 of the above said Government order dated 09.06.1998,

the District Coastal Zone Management Authority is responsible for monitoring

and enforcement / implementation of the provisions of the Coastal Regulation

Zone Noti�cation and to ensure that the activities within CRZ take place as per

approved Management Plan in their respective jurisdiction. Accordingly, the

complaints have been referred by the Member Secretary, SCZMA to the above

District Coastal Zone Management Authorities / CMDA for immediate action

and report.

4) In view of above facts, Government in lr., 27.04.20211 have requested

all the District Collectors/Chairman, District Coastal Zone Management

Authorities (DCZZMA), Chennai Metropolitan Development Authority and

Chennai Corporation to identify CRZ violations and also to initiate action upon

the said identi�ed violations as instructed by MoEF., GoI in letter dated 25th

January 2011, indicated in para 1 above.

5) In the 21st meeting of the National Coastal Zone Management

Authority (NCZMA) held on 19th April 2011, at New Delhi the NCZMA has

insisted that the directions of the GoI in lr dated 25.01.201, indicated in the

�rst para above, have to be placed before the SCZMA and directions shall be

given u/s 5 of EP Act 1986 from SCZMA, to the DCZMAs/ CMDA for compliance.

6) Hence as suggested by the NCZMA, indicated above, the District

Collectors / Chairman, DCZMAs, CMDA & Corporation of Chennai may be

instructed u/s 5 of EP Act 1986, to identify violations under CRZ Noti�cation

1991 and to initiate action upon the identi�ed violations immediately. Further

they may also be requested to send periodical returns and send the details

once in every fortnight, to the Department of Environment, so as to upload the

said details on website every month and to send a report to Government of

India.

The Authority may consider.
