A. PROJECT BACKGROUND

With the national economic and social development of Chongqing municipality in steadyprogress, Chongqing Municipal Government has fully realized the importance of increasing theratio of urbanization and speeding up the construction of urban infrastructure and improvementof the environment. In order to spur the development of national economy in Chongqing in asustainable manner and, while increasing the economic growth rate, improve the livingenvironment of the people and enlarge the extent to which the various groups of the wholesociety can benefit from the improvement, Chongqing Municipal Government has selected aseries of specific environment improvement and infrastructure construction projects in a numberof districts, cities and counties within its territory and has input a huge amount of funds to them.In 2001, the municipal govermment obtained a loan of US$200 million from the World Bank forurban environment construction in a move to perfect Chongqing's infrastructure function andsocial livelihood facilities in urban and rural townships and promote the urbanization process.In building a good small town, the most important thing is to build good infrastructure for it.The infrastructure serves as the runway for the economic takeoff of the west region now undermassive construction and is also the basic condition for attracting domestic and internationalinvestments and economic development. The more investment in the construction ofinfrastructure, the greater the role it will play in pushing the economy forward. Therefore goodinfrastructure not only is conducive in stimulating domestic demand and economic growth butalso constitutes a strong driving force for the development of related industries and businesses.For this reason, Chongqing Municipal Government has decided in 2004 to continue using theWorld Bank loan to support the construction of infrastructure in small towns of Chongqing.The present small cities project in Chongqing consists of 14 components in three majorcategories, i.e. 5 water supply components, 4 road components, 4 river embankmentcomponents and I public toilet reconstruction subcomponent. See TABLEI for a list of theseprojects. The location of these 14 projects is as shown in Fig. 1. The total investment for theseprojects is RMB2, 694.25 million including US$135.71 million of loan obtained from the WorldBank. The project package is planned to be completed in 36 months from around July 2005 toaround July 2008.The reports on the Resettlement Action Plan (RAP) for Chongqing Small Cities Project (CSCP)are made up of individual RAP reports for 14 components and one consolidated report.The consolidated report is prepared, under the guidance of SOGREAH resettlement experts, byChongqing Technology and Business University (CTBU) from the RAP reports for 14components submitted by their respective owners. The respective component RAPs furtherdetail the consolidated report and serve as the basis for implementation.

B. IMPACT OF THE PROJECT

Of 89 villages in 39 rural (or urban) townships of 19 counties (cities or districts) affected byland acquisition and house demolition of the project, 61 villages in 32 rural (or urban)townships of 12 counties (cities or districts) are affected only by land acquisition, 59 villages in29 rural (or urban) townships of 17 counties (cities or districts) are affected only by housedemolition, 31 villages in 22 rural (or urban) townships of 18 counties (cities or districts) areaffected by both land acquisition and house demolition.Of 13,744 persons in 3295 households affected by land acquisition and house demolition of theproject, 1841 persons in 480 households are affected by both land acquisition and housedemolition. Moreover, the affected groups include 304 persons in 117 households categorizedas the vulnerable group. See Table2 for a list of affected population, households, institutes,enterprises, and shops.Of the 4,050.2mu of land permanently acquired, 3916mu is collective-owned land (including2,580mu of farmnland and 123.5mu of house sites), 74.4mu is state-owned land and 46.2mu ofland used by enterprises for construction. Of the 3,468mu of land temporarily taken, 2,561mu isfarmland. The permanent acquisition of land will affect 8,366 persons in 2, 266 households andthe temporary occupation of land will affect 3,287 people in 887 households. See Table3 for thescope of permanent land acquisition.By house demolition and resettlement, the project will affect 603 rural households and 25 urbanhouseholds, 27 enterprises and institutions and 19 shops. A total of 129,031 m2 of houses will bedemolished, and 3,820 persons affected. This includes 90,063m2 of rural residences accountingfor 70% of the total, 1,525m2 of urban residences, accounting for 1%, 35,655m2 of enterpriseor institution premises, accounting for 28%, 1,212m2 of shops, accounting for 1% of the total,421m2 of overdue temporary and illegal buildings, accounting for 0.3%, and 155 m2 of othertypes of building, accounting for 0.1%. See Table4 for the impact of house demolition inconstructing the subcomponents.In addition, the project components will affect 58 types of ground attachments and publicfacilities.

C. POLICIES ON COMPENSATION FOR RESETTLEMENT

The policies applied to resident resettlement for these subcomponents are based on the LandAdministration Law of the PRC, Guideline for perfecting the regulations regardingcompensation for land acquisition and resettlement (effective as of November 3, 2004),Regulations on Urban Residence Demolition and Relocation (effective as of November 1,2001), Guideline for evaluating of urban houses to be demolished (effective as of January 1,2004), Regulations on Urban Residence Demolition and Relocation in Chongqing Municipality(effective as of December, 2002), Regulations on Land Administration in ChongqingMunicipality (issued in Ordinance No. 53 by Chongqing Municipal People's Government onMarch 1999) and Measures for Compensation for Land Acquisition in Chongqing (issued inOrdinance No. 55 by Chongqing Municipal People's Government on September 1999) laws andregulations promulgated by the local district, county or city governments and World Bankpolicies regarding involuntary resettlement.The major policy principles are: I) Measures are acquired to reduce the negative impact ofresettlement to a minimum; 2) Compensation and resettlement plans made can improve thedisplaced persons' living standards or at least restore them to the previous level; 3) Thedisplaced persons are adequately consulted to give them chance to fully participate in themaking and implementation of the resettlement plan; 4) All the affected properties arecompensated for at the replacement cost; 5) The displaced persons are paid all the compensationfor the losses before land acquisition and house demolition. In particular, taking of land andrelated assets may take place only after compensation has been paid and, where applicable,resettlement sites and moving allowances have been provided to the displaced persons.6) Criteria for Eligibility. The cut-off date is the notice issuing date of house demolition andland acquisition. After the cut-off date, the displaced persons cannot build, rebuild houses,change the usage of house and land and rent land or trade houses. People inflowing after thecut-off date are ineligible for assistanceThe following polices are to be implemented.

a. Compensation for Permanent Acquisition of Land

When the rural collective-owned land is acquired, all the losses shall be reasonablycompensated for according to the relevant laws. The compensation for acquiring farmland shallinclude the land compensation, resettlement subsidy and compensation for ground attachmentsand crops. In the case of acquiring farmland, land and resettlement compensation shall be paidat the rate of 10 to 30 times as much as the average annual yield of the farmland in the past threeyears; in the case of acquiring garden land, the land and resettlement compensation shall be paidat the rate of I to 1.2 times as much as the compensation rate for farmland; in the case ofacquiring fishponds, the land and resettlement compensation shall be paid at the rate of 1.2 to1.5 times as much as the compensation rate for farmland; in the case of acquiring wasteland andriverside shallow land, the land compensation shall be paid at the rate of 1/3 to 1/2 of the rate ofcompensation for farmland. See Table5 for the rate of compensation for permanent acquisitionof land.

Notes: In the case of acquiring garden land, the land and resettlement compensation shall be paid at the rate of 1 to 1.5 times as much asthe compensation rate for farmland; in the case of acquiring fishponds, the land and resettlement compensation shall be paid at the rate of1.2 to 1.5 times as much as the compensation rate for farmland; in the case of acquiring public-owned rural land other than farmland (suchas wasteland and riverside shallow land), the land compensaton shall be paid at the rate of 1/3 or 1/2 of the rate of compensation forfarmland.

b. Policies regarding compensation for temporary occupationof land

Compensation for temporary land occupation shall be made in the following manner: onegrowing season's crop compensation is made if the temporary land occupation lasts lessthan one growing season, or 2.5 growing seasons' crop compensation is made if thetemporary land occupation lasts for one year or compensation for the loss of one year'syield of land is paid if the temporary land occupation lasts for half a year. Thecompensation shall be paid directly to the farmers affected by the temporary occupationof land and shall be not less than the loss incurred to the farmers. The rehabilitation ofland temporally taken shall be carried out in two ways: Firstly, the project constructionunit re-cultivates the farmland temporarily taken and then handed it back to the affectedvillages or resident groups which authorize the related agencies to perform acceptance;secondly, the construction team smoothens the land or loosen the land compacted byengineering machinery and the project executing agency allocates the re-cultivation fundto the affected villages, and the villages receiving the fund carry out improvement of theirown water conservation facilities and fertilization of the soil.

c. Policies regarding compensation for demolition of urbanresidential houses

The urban residents' families shall receive house demolition compensation at theestimated market price (including land price), which shall be equivalent to thereplacement price. They shall at the same time receive the compensation for demolishedhouse attachments and transition allowance, movement allowance, bounty andresettlement subsidy. See Table6 for a list of compensation rates implemented in theaffected localities.

Note: Toilet Reconstruction subcomponent affects several distrcts of the proper city. The compensation rate vanes among the differentplaces. They are also different from those in Shizhu and Rongchang. Actually, the compensation fee can make the affected persons buynew houses or second-hand houses.

d. Policies regarding compensation for demolition of ruralresidential houses

The rural residents' families shall receive house demolition compensation at the marketprice assessed by a specialized evaluation agency, which shall be equivalent to thereplacement price. The compensation ways of house sites are based on the resettlementmeans. If the affected persons choose to rebuild houses by themselves, they will gainhouse sites for free provided by the project owner, or they can buy house sites after getthe house site compensation corresponded by the townships. If the affected personschoose to buy preferential house or choose money compensation, they will get the housesite compensation.They shall at the same time receive the compensation for demolished house attachmentsand transition allowance, movement allowance and bounty. See Table8 for a list ofcompensation rates implemented in the affected localities.

e. Policies regarding compensation for affected enterprisesand institutions

The affected enterprises and institutions shall receive compensation for demolishedpremises at the replacement price and at the same time receive facility compensation,financial subsides (for loss due to discontinuation of operation) and relocationallowances. After receiving the monetary compensation, the affected enterprises orinstitutions may choose to rebuild their premises at the original location, at anotherlocation, renovate existing houses not used, or rebuild no premises. See Table8 andTable9 for a list of compensation rates.

f. Policies regarding compensation for affected shops

The shop owners shall receive compensations for loss of land and houses at thereplacement price and at the same time receive facility compensation, financial subsidesand resettlement allowances. After receiving the monetary compensations, they maychoose to build or purchase shops.

Note: All the shops to be affected by the Nanchuan and Rongchang components are in the form of shop + backyard or shop +upstairs' home. Some of the affected shop owners in Nanchuan will be compensated for in the shop-for-shop format (that is theycan purchase new shops provided by the project owner at the compensation rate, or based on their willingness, they can buythe first floor of the preferential houses to run shops), and the affected persons in Rongchang will be compensated for in theway of providing house sites for building shops like their residences by themselves. They may build multi-story houses with theground floor used as shops.

g. Illegal and overdue Temporary building

Illegal buildings and overdue temporary buildings shall be compensated for at the cost ofbuilding materials. If such buildings are run as shops, the users will gain compensationfor running loss.

h. Other types of building

Such buildings are shops and employee's housing changed from part of public toilet, theyare not working offices of institute and formal employee housing either. Thecompensation rates of such buildings are decided according to the consultation of twoinstitutions of Chongqing environmental sanitation system.

i. Public facilities, ground attachments and sparsely grownfruit trees

Compensation for affected public facilities, ground attachments and sparsely grown fruittrees shall be made at the replacement price.

D. HOUSE REBUILDING PLAN

The house-rebuilding plan will involve 25 urban households, 603 rural households, 30enterprises and institutions, and 19 shops.

a. Rehabilitation of urban residential houses

These subcomponents will cause the demolition and relocation of 1,525m2 of urban residences,affecting 72 persons in 25 households. After receiving the compensation at the replacementprice, the affected persons may choose to purchase cheap preferential houses, build houses bythemselves, replace houses with houses provided by the project owners and receive moneycompensation.

i. Purchasing preferential housesUrban residents to be affected by the Shizhu RE component can purchase preferential houses atthe preferential price for the part of area of their demolished houses equivalent to the area of theresettlement houses. Urban residents to be affected by the Toilet Reconstruction component canchoose to purchase preferential houses provided by the project owner. The owner will provide atleast two houses. The houses lie in city proper, and the quality is higher than the demolishedhouses.

ii. Building houses by themselvesUrban residents to be affected by the Shizhu RE can choose to build houses by themselves.After receiving the compensation, they can build houses on sites appointed by county landbureau and programming departments.

iii. House replacementUrban residents to be affected by the Toilet Reconstruction component can replace houses forthe part of area of their demolished houses equivalent to the area of the resettlement houses, andfor the part of area of their demolished houses in excess of the area of the resettlement housesthey can buy at the preferential price.

iv. Money compensation

For those displaced rural residents who choose to get monetary compensation and buycommercial or second-hand houses, the project owner and local government will provide them

with information about the availability of commercial houses so as to make it easier for them tofind what they want. The monetary compensation shall be made at the replacement price of thehouses demolished plus the land price. With this compensation money, the displaced personscan purchase houses of similar structures in similar locations.

b. Rehabilitation of rural residential houses

These subcomponents will cause the demolition and relocation of 90,063m2 of rural residences,affecting 2,480 persons in 603 households. After receiving the compensation at the replacementprice, the affected persons may choose to purchase cheap uniformly constructed resettlementhouses, build their own houses or receive money compensation.

i. Purchasing preferential resettlement houses

Rural residents to be affected by the Shizhu RE component, if they choose to purchasepreferential resettlement houses, can purchase them at the reduced price for brick + concretestructures for the part of area of their demolished houses equivalent to the area of theresettlement houses and at the market price for the part of area of their demolished houses inexcess of the area of the resettlement houses. Those who choose to get cash compensation forhousing will be given full resettlement compensation in one payment.The rural residents to be affected by the Rongchang and Wansheng component can purchaseresettlement houses at the price equivalent to the compensation rate and at the space standard of18m 2 and 20m2 per person. For limitation of design, the excessive space is to be purchased at arate 50% as much as the construction cost if it is not more than 5m2 and if the space is in excessof 5m2, it may be purchased at the combination price (market price).Rural residents to be affected by the Nanchuan component can purchase brick + concreteresettlement houses at 240 type. Those who choose to purchase such preferential resettlementhouses can buy the part of the space of the resentment house equivalent to the space of thedemolished house at the 240 type brick + concrete structures. The part of space in excess of thespace of the demolished house is to be purchased at the construction cost if it is not more than10m2 and at the combination price of the resettlement house (which is to be approved and

published jointly by the municipal construction bureau and price administration bureau) if it ismore than lOM2.

ii. Self-construction of housesThe affected rural residents who choose to build houses by themselves can get resettled in twoways: In the first case, the local govemment will provide the residents with free land at the per-capita space level so that they can build houses according to the plan of the village or township.In the second case, the affected villagers purchase land for building houses with thecoordination and participation of the village govemment officials who will help securing allnecessary approving procedures for house construction.In addition, the houses to be affected by the Tongnan WS component are pigsties and toiletsonly. The affected villagers can rebuild their houses on the temporarily taken land that will beretumed to them after the underground pipeline work is completed.

iii. Money compensation

For those displaced rural residents who choose to get monetary compensation and buycommercial or second-hand houses, the project owner and local govemment will provide themwith information about the availability of commercial houses so as to make it easier for them tofind what they want.

c. Affected enterprises

These 8 subcomponents will affect 22 enterprises, of which three have gone bankrupt, four areno longer in production or operate on and off, seven are to be relocated and the rest will beaffected partly with some of the houses or clearing space. Enterprises whose land will beacquired will receive land compensation at the estimated land price. The resettlement of theaffected enterprises will be arranged in the following ways (See TABLE13):

f. Affected overdue temporary and illegal building

Altogether 421m2 of overdue temporary and illegal building will be demolished. 3subcomponents affect 41 1m2 overdue temporary buildings in Yubei, Rongchang and Yuzhongdistricts and counties. Toilet Reconstruction subcomponent affects lOM2 illegal building. Theoverdue temporary buildings affected by Rongchang and Toilet Reconstruction subcomponentsare sundries house and unused houses, and that affected by Tongjin subcomponent is built byvillage collectively and now rent to a villager as a hennery. The illegal building affected byToilet Reconstruction subcomponent is privately built as a shop without business license.Above buildings will get compensation at the price of the cost of building materials.

To the hennery, the villager will get allowance for economic losses and equipment. The villagecommittee will help the villager to find out a site to build a new hennery. The house site will bepaid by the villager.

To the shop, the demolisher should notify it in advance and provide shops renting informationso as to make it easier for them to find new places to maintain business.

g. Affected other types of building

2 other buildings will be affected by Toilet Reconstruction subcomponent. Such buildings areshops and employee's housing changed from part of public toilet, they are not working officesof institute and formal employee housing. The compensation rates of such buildings are decidedaccording to the consultation of two institutions of Chongqing environmental sanitation system.The demolisher should notify lessees in advance and provide them with shops rentinginformation so as to make it easier for them to find new places to maintain business. Lesseeswho have business license will get compensation for economic losses and movement.Families living *in the toilet building will move to other places provided by ChongqingEnvironmental Sanitation Bureau or the demolisher. The affected families will getcompensation for moving and transition.

E. INCOME REHABILITATION PLAN

The project will permanently acquire 3,930mu of rural collective land involving 61 villages of32 townships and affecting 8,366 persons in 2,226 households. The farmers affected bypermanent land acquisition will receive reasonable compensation. As the yield level of differenttypes of farmland is different in different affected areas and so is the per-capita space offarmland, the compensation rate will vary within the range of RMB 10,140 to 48,000/mu.The socioeconomic survey shows that, for the affected farmers, the income from farmlandaccounts for not yet half of their total income and the majority of their income comes from non-agricultural activities, accounting for more than 60%. Wages earned by working as migrantlaborers in the city constitute the major source of non-agricultural income, accounting for morethan 45% of the total amount. As the urban environment projects are mostly built on narrowstrips of land, most of the farmers will not have their land completely acquired. The average rateof impact caused by land acquisition is 8.29% and 67 resident groups has an impact rate ofbelow 5%, accounting for 47% of the total, while 18 of them have an impact rate of above 20%,accounting for 13%, the highest impact rate being 35%. Therefore, land acquisition will bringabout no major impact on the income of the affected persons.Farmers will be reasonably compensated for their land permanently acquired. Depending on thelocation and type of land taken, the compensation rate will vary within the range of RMB10,140to 48,000/mu. The compensation rate for garden land will be 11.5 times and fishponds 1.2-1.5times as much as for farmland and other rural public land rather than farmland (such aswasteland and riverside shallow land) will be as much as 1/3 or 1/2 of the compensation rate forfarmland.Through intensive consultation with the affected persons, they may choose from the followingthree alternatives for production resettlement: 1) Reallocation of farmland, by which thefarmland is reallocated among the villages and the land compensation and resettlement subsidyreceived after reallocation are divided equally among villagers; 2) Monetary compensation: bywhich farmers in villages where the per-capita space of farmland after land acquisition is morethan 0.5mu are resettled by monetary compensation, that is, the land compensation andresettlement subsidy are paid to the affected persons depending on the space of land taken. 3)Change of status: by which farmers in villages where the per-capita space of farmland is lessthan 0.5mu are resettled by having their status as agricultural population changed into non-agricultural population. These people will thus receive a sum of RMB12,000 to 21,000 as landcompensation and resettlement subsidy. After the number of status-changed persons is decided,the farmland given up by them may be reallocated among villagers remaining in the villagedepending on their willingness.See next Table for the resettlement alternatives for persons to be affected by land acquisition inexecution of subcomponents.

The status-changed farmers affected by land acquisition may be resettled by providing themwith monetary compensation, insurance, social security support, etc. 1) Monetary compensation,by which the land compensation and resettlement subsidy are paid to the status-changed personsto allow them to make a living; 2) Resettlement by giving social security support, by whichthose status-changed persons may apply for the bottom-line subsistence allowance for urbanresidents if the average income of them and their family members living together is lower thanthe minimum local subsistence level of urban residents. The level of the allowance isdetermined according to the cost of clothing, food and shelter necessary to maintain a decentlife for a local urban resident and in consideration of the cost of water and fuel (coal or gas) andcompulsory schooling of their young children. The prevailing standards of urban bottom-linesubsistence allowance in the affected localities are respectively: RMB160/person/month inTongnan, RMB I 95/person/month in Tongjing, RMB 195/person/month in Wansheng,RMB 140/person/month in Nanchuan and RMB 160/person/month in Rongchang.For those farmers losing farmland, the local govemment will provide free vocational training tothe status-changed persons and help them get employed.For villagers choosing to continue to work as farmers, in order to prevent their income fromdecreasing due to the reduction of farmland space after land acquisition, the rural townshipgovemment will take some incentive measures such as restructuring the farming industry andencouraging farmers to grow cash crops to increase agricultural output value and the productionteam will help farmers to improve basic farming facilities.Since those villagers willing to change status are those either doing business away from home orliving fairly close to the city, the change of status will have no major impact on their income orexpense.

F. REHABILITATION OF VULNERABLE GROUP

The vulnerable group refers to the group of people most easily harmed by these subcomponentsas well as those to whom the environment in which they live makes them unable to adjustthemselves to the changes brought about by the construction of these subcomponents. Thevulnerable group includes mainly impoverished families, families consisting of handicappedpersons, families consisting mainly of women, and families consisting of alone-living oldpeople (single and aged more than 65 years and having no legal supporters).The project will affect 304 persons in 117 families of the vulnerable group including 109families to be affected by land acquisition, 30 families by house demolition and 22 families byboth land acquisition and house demolition. Of these families, 36 are impoverished families,accounting for 31% of the total number, 53 families having handicapped members, accountingfor 45%, 16 families consisting mainly of women, accounting for 14% and 12 familiesconsisting of old people living alone, accounting for 10% of the total number. Some families ofthe affected vulnerable group are receiving special government allowance and after landacquisition the government will continue to pay such allowances to them monthly, exempt themfrom the agricultural tax and provide them with free fertilizer.Except the policies described above, the vulnerable groups will enjoy the following preferentialpolicies.

* The land compensation and resettlement subsidy may be paid, at their will, to the countycivil welfare bureau or county (village) rest house or their children who will take care of themin their remaining years of life.

* Those vulnerable groups affected by house demolition and having difficulty gettingadequately sheltered shall be provided with assistance according to the situation such as byproviding cheap-rent houses, offering vocational training to the labourers in their families andproviding them with job information and guidance to increase their chance of gettingemployed.

* For those vulnerable groups who choose to build their own houses, the demolisher shallassist them in building the houses and offer free agricultural technical training to their childrenand help them develop agricultural production to increase their income from farming.

* Land will be restored first for those families of the vulnerable group affected by landacquisition.

* During construction of the project, prior consideration will be given to employing thechildren of families of the vulnerable group to do jobs requiring no special skill.

* The government of Qianjiang District has made some preferential polices in favour of thevulnerable group there. Such policies include setting up a fund for aiding impoverishedfamilies of those farmers who lose land by returning the farmland taking tax levied to thetownship government. The fund will be used for their designated purposes only, i.e. firstly, topay the bottom-line urban subsistence allowance and special poverty-relief fund borne byZhengyang township government; secondly, to pay as special relief money to the land losingfarmers who have practical difficulties such as having no money to send their children toschool or being stricken by unexpected disasters; thirdly, to finance skill training programs toencourage the land losing farmers to run their own business. The government will giveassistance by providing information, skill training and financial aid.

G. TOTAL BUDGET AND IMPLEMENTATION PLAN

The total budget for resettlement of residents to be affected by the project is RMB263 millionincluding RMB74.026 million for making compensation for permanent land acquisition(accounting for 28%), RMB28.626 million for paying resettlement subsidy for relocating thedisplaced urban and rural residents (accounting for 11%), RMB22.623 million for makingcompensation to the affected enterprises and institutions (accounting for 9%), and 1.49millionfor making compensation for the affected shops (accounting for 0.6%). The total cost ofresettlement is included in the total cost of the project and the money comes mainly from eachproject owner's own fund. The total estimated cost for each component is shown in

TABLE17.

The project owner pays the compensation for land acquisition and house demolition to theresettlement agency. The resettlement agency then pays the land compensation and resettlementsubsidy to the affected villages or households. The crop compensation is paid directly to theaffected households. The village leadership divides the land compensation and resettlementsubsidy in different ways. The house compensation is paid to the owner of the house by theresettlement implementation agency in instalments as stipulated in the house demolition andrelocation contract, the compensation for affected enterprises, institutions and shops is paiddirectly to their owners, and the compensation for infrastructure directly to its property rightowner. Those copies of compensation contracts and payment receipts must be kept in the projectowner and county PMOs at the same time.The land acquisition and resettlement activities for the project will begin in May 2005 and endin May 2008.

H. ORGANIZATIONAL ARRANGEMENT

Chongqing Municipal Leading Group for Projects Utilizing World Bank Loans and ChongqingPMO act as the managing and coordinating agency for land acquisition and house demolition,direct the county, city and district offices in preparing their respective resettlement action plansaccording to the World Bank policies on social security, supervise and monitor theimplementation of the compensation and resettlement plan, and furnish periodic internalmonitoring reports on the implementation of the resettlement plan and submit them to the WorldBank.The district, county and city PMOs are headed by the responsible leaders of the district, countyand city governments and staffed by leaders of the national land and housing administrationbureau, environment protection bureau, water conservation bureau and other agencies. Theseoffices are mainly responsible for preparing the resettlement action plan of the district, countyand city or entrusting it to a dedicated design institute, coordinate work of the agencies for landacquisition and resettlement, supervise work on land acquisition and resettlement and furnishperiodical internal monitoring reports on the implementation of the district, city and countyresettlement action plan and submit them to Chongqing PMO.The owner of each subcomponent in the respective districts, cities and counties is the executiveagency for constructing the project and shall, in resettlement activities, designate special-dutypersonnel to supervise and manage the process. Its major responsibility includes authorizing thedesigner to prepare the resettlement action plan, participating in resettlement surveys,confirming the resettlement action plan, consigning or organizing resettlement action,supervising and managing the resettlement implementation, paying money, reporting theprogress of resettlement to the district, city or county PMOs and furnishing internal monitoringreports.

The resettlement-executing agency performs the resettlement work in three ways: firstly, theowner entrusts the resettlement work to the district, city or county land administration bureauand demolisher; secondly, the owners carry out the resettlement plan by themselves; thirdly,resettlement faculty organized by project owners and county land administration bureaus carryout the resettlement plan. Of the fourteen subcomponents, eight of them including Songji WS,Tongguanyi WS, Dianjiang WS, Qianjiang Road, Shizhu road, Shizhu RE, Wansheng RE andRongchang RE are to be carried out using the first option. The other 5 subcomponents includingYongchuan road, Tongnan WS, Tongnan Road, Nanchuan RE and Toilet Reconstruction are tobe carried out using the second option. Yubei Road is to be carried out using the third option.The urban or rural township resettlement work group, village committee and villager groupparticipate in the project survey and assist in the preparation of the Resettlement Action Plan,take part in the engineering survey, organize public participation, publicize policies regardingresettlement, carry out, inspect, monitor and record the resettlement activities within thetownship, help secure formalities necessary for effecting house demolition and resettlement,participate in and supervise the acquisition of land, demolition of houses and attached buildingsand resettlement and reconstruction of houses, allocate funds, coordinate and handlecontradictions and issues in the work, organize production, development and other resettlementactivities, report the resettled persons' complaints and suggestions to the superior agency, andprovide assistance for the resettled families in difficulty.

Founded in 1993, Chongqing PMO is highly experienced in managing and implementing WB-assisted projects. However it is the first time for the WB-assisted project offices of the affecteddistricts, cities and counties to handle such projects and they lack experience in resettlementimplementation and management. To ensure the smooth implementation of this resettlementaction plan, municipal office will strengthen organizational capability in the following aspects:

* Staff reinforcement: the organization at each level will be made up of specializedtechnical personnel and managerial personnel who must be adequately qualified intechnology and management;

* Intensified training: since March 2003, experts have been invited several times to trainmajor staff members of each organization on such subjects as World Bank's operationpolicy (OP4.12) regarding involuntary resettlement, laws and regulations on landacquisition and house demolition, conduction of socioeconomic surveys, andproduction and livelihood rehabilitation for resettled persons and further training willbe provided for workers involved in the work on land acquisition and resettlement forconstructing the proposed projects, including resettlement polices, implementation andmanagement of resettlement, resettlement monitoring and evaluation, etc.;

* Providing sufficient support in finance and equipment to improve work efficiency;* Strengthening the reporting system and intensifying internal supervision and

monitoring to solve any problem found;* Establishing an external supervision and evaluation mechanism and an early warning

system.

1. PUBLIC CONSULTATION AND DISCLOSURE

In compliance with the resettlement policies, laws and regulations issued by the centralgovernment, Chongqing municipal government and local governments of districts, cities andcounties involved, in order to protect the legal rights and interests of the resettled persons andentities, and minimize dissatisfactions and disputes, great importance will be attached to theparticipation of the resettled people in the whole process of policy making and plandevelopment and implementation to widely hear their suggestions and views.While the settlement plan is being prepared, the plan maker, project owner, each district, city orcounty project office, land administration bureau, resettlement office, township government andvillage committee have held several discussions with the affected persons before fixing thecompensation rates and resettlement alternatives.Before the project is executed, the resettlement office will distribute the resettlement bookletsamong the affected villages. The affected residents will then obtain the booklets from theresidential committee, village committee, which contains detail on project profile, projectimpacts, polices on compensation, project executing institution, channel to lodge complaintsand grievances, etc.Up to March 2005, the resettlement plan reviewed and approved by the World Bank have beenplaced in each district, city or county resettlement office and library and public notices issuedon major local newspapers or cable TV so that the affected persons can get a full understandingof the resettlement plan and be aware of their own rights.

J. COMPLAINTS AND GRIEVANCES

If the affected person objects the resettlement plan during implementation, he or she may appeal.The channels of appealing have two ways. Except Yongchuan and Dianjiang Water Supplysubcomponents, the affected persons of other subcomponents may file his or her complaintorally or in writing to the leaders of the neighbourhood committee, township government andvillage committee. The latter shall take written record of the complaint and give a responsewithin one week. If the affected person is unsatisfied with the result, he or she may, uponreceiving the resolution, appeal to the district, and county or city PMOs or Chongqing PMO orproject owners, which shall resolve the case within one week. If the affected person is stillunsatisfied with the result, he or she may, upon receiving the resolution, appeal to the district,county or city land administration agency (monitoring and arbitration agency for landacquisition) or house demolition and resettlement office for administrative arbitration, whichshould arbitrate the case within ten days. If the affected person is still unsatisfied with the resultof administrative arbitration, he or she may, upon receiving the arbitration result, bring a lawsuitto a civil law court in case of objection to any aspect of the resettlement plan.The affected persons of Yongchuan and Dianjiang Water Supply subcomponents may file his orher complaint orally or in writing to the leaders of the neighbourhood committee. K. MONITORING AND EVALUATING

According to the World Bank's guide for monitoring and evaluating, an internal and externalmonitoring mechanism will be established during planning and implementing the proposedenvironment projects in Chongqing. The municipality and each district, city or County PMOswill carry out internal monitoring, while external monitoring will be carried out by anindependent supervision and evaluation agency chosen by competitive bidding. The supervisionand evaluation group shall be made up of highly experienced resettlement and socioeconomicexperts.The subject for internal monitoring includes mainly: progress of resettlement, compensation forand rebuilding of resettlement houses, space of land acquisition, compensation for landacquisition, labor force resettlement, rehabilitation and reconstruction of infrastructure,allocation and use of resettlement funds, handling of complaints and grievances, staffing of eachresettlement agency and personnel training, working schedule, function performance andefficiency of each resettlement agency, etc.The emphasis of external supervision and evaluation is placed on the rehabilitation ofproduction and living standards of the affected persons, which includes:

* Monitoring of typical resettled resident households (10%): payment of urban residentcompensation fund, availability of resettlement houses, and income rehabilitation;availability of house sites for resettlement of rural residents, progress of houseconstruction, payment of compensation fund, quality of houses constructed, etc.;

* Monitoring of typical shops (20%): payment of shop compensation fund, availability ofresettlement houses, progress of relocation, rehabilitation of production, andrehabilitation of employees' income;

* Monitoring of enterprises and institutions (20%): payment of compensation fund, landacquisition for new sites, houses construction, progress of relocation, productionrehabilitation, rehabilitation of employees' income.

In addition, it is necessary to monitor resettlement progress, compensation rates and allocationof fund, capability of executing agencies, depth and effect of public participation by resettledpersons, operation and efficiency of mechanisms handling complaints and grievances, etc.Each district, city or county PMOs will prepare one internal monitoring report every threemonths and submit it to Chongqing PMO, which will prepare a year-end summary statement tobe submitted to the World Bank. The independent external monitoring agency will produce onemonitoring report every half a year. The basic survey will be conducted in July 2005 and thefirst issue of the monitoring report will be produced in December 2005 and the second issue inJune 2006. Monitoring and assessment reports (Issue 3 to Issue 6) will be submitted fromDecember 2006 to June 2008.
