Please find enclosed herewith a copy of my letter and enclosures to CNA. The events leading up to the enclosed Brief and reply letter are explained in the copy of my letter to CNA. If you have any questions with regard to these documents, please feel free to contact me.

With regard to the outstanding balance due and owing from CNA, my letters and telephone calls have gone unanswered. I would appreciate it if you would contact Mark RagansatCNA to ascertain their delay in paying the outstanding balance owing my office and the reason they have not responded to my requestsJor reimbursement to Odd Fellowsfor the monies paid in legal fees and costs in this matter. In fact, they do not even return my telephone calls and letters. Mr. Ragans direct telephone number is: 212-440-2481. Mr. Ragans took the place ofa former adjuster who left the company this summer. The file had languished in a pile of un worked cases until Mr. Ragans took over. However, now he is ignoring us and we do not know what to do.

The last time the insured, Odd Fellows, complained to the insurance company about the law firm hired to defend Odd F eUows, they took the complaint seriously, fired the firm and hired me to represent you. It is possible that CNA takes customer complaints more seriously than they do attorney demands for payment.

We are still holding your check for $20,000 paid to us two months ago pending receipt of funds from CNA. We may be required to cash this check if CNA continues to ignore our calls and letters. We would appreciate whatever additional pressure you may be able to put on them. If you cannot get any response from Mr. Ragans, then perhaps you could get some additional contacts information from Caldwell Insurance from whom you purchased the policy.
