Call to order Vice President Kerry Sheahan called the RMGPA General Membership Business Meeting to Order on 12/8/2017 at 11:25 a.m. at Philip S. Miller Building, Board of County Commissioners Hearing Room at Castle Rock, Colorado. 2. Cross Chapter Opportunities We are working on: • coordinating a conference with the NM and/or UT Chapters in 2019 • inviting the AK/HI Chapter to any of our meetings via Google Hangouts • inviting the Presidents of the NM and UT Chapters to Winter Conference

3. NIGP We are working with NIGP on a pilot program to increase membership in both organizations which should roll out by the end of the year.

Senate Bills Senate Bill SB18-062 - Snow Removal Service Liability Limitation Bill Summary The bill makes void some provisions of snow removal agreements that require one party to indemnify the other party for damages, hold the other party harmless for damages, and provide for the defense of the other party in a liability lawsuit. However, the Act specifically excludes contracts for snow removal or ice control services on public roads or with public bodies. Status 04/23/2018 | Senate Considered House Amendments - Result was to Concur – Repass Senate Bill SB18-086 - Cyber Coding Cryptology For State Records Bill Summary The bill requires certain actions to protect state records containing trusted sensitive and confidential information from criminal, unauthorized, or inadvertent manipulation or theft. The chief information security officer is required to, among other things: Identify, assess, and mitigate cyber threats to state government; in coordination and partnership with specified agencies, boards, and councils, annually assess the data systems of each public agency for the benefits and costs of adopting and applying distributed ledger technologies such as blockchains; consider developing public-private partnerships and contracts to allow capitalization of encryption technologies while protecting intellectual property rights. The department of state is required to consider research, development, and implementation for encryption and data integrity techniques, including distributed ledger technologies such as blockchains. Status 05/16/2018 | Sent to the Governor Senate Bill SB18-145 – Implement Employment First Recommendation Bill Summary The bill requires the department of labor and employment and the state medical services board in the department of health care policy and financing to promulgate rules that require all providers of supported employment services for persons with disabilities to obtain a nationally recognized supported employment training certificate or earn a nationally recognized supported employment certification relating to supported employment services. The rules must specify time frames for completion of the training or certification. The time frames must provide for training to be completed over a 5-year period, subject to appropriations for reimbursement of vendors. Status 05/16/2018 | Sent to the Governor

Senate Bill SB18-158 – School Access to Interoperative Communication Technology Bill Summary The bill creates the school access for emergency response grant program (grant program) in the division of homeland security and emergency management (division) in the department of public safety (department). The purpose of the grant program is to provide funding for interoperable communication hardware, software, equipment maintenance, and training to allow for seamless communications between existing school communications systems and first responder communications systems. Grant recipients may use the money received through the grant program to deliver training programs to teach effective communications with first responders in an emergency, to implement an interoperable technology solution to provide or upgrade a system for effective communication with first responders in an emergency, to maintain, improve, or provide interoperable communications hardware or software, and for any necessary radio system capacity expansions where school loading has been determined to have a significant impact on public safety system loading. Status 05/11/2018 | Sent to the Governor Senate Bill SB18-200 – Modifications to PERA to Eliminate Unfunded Liability Bill Summary Concerning modifications to the public employees' retirement association hybrid defined benefit plan necessary to eliminate with a high probability the unfunded liability of the plan within the next thirty years, and, in connection therewith, making an appropriation. PERA’s summarization of the new bill is at this link: https://www.copera.org/sites/default/files/documents/proposalcomparison3-18.pdf Status 05/9/2018 | Senate Consideration of First Conference Committee Report result was to Adopt Committee Report - Repass Senate Bill SB18-268 – Design Bid Build Highway Project Contract Awards Bill Summary Concerning the scope of the authority of the department of transportation to award a design bid build highway project contract in an amount that exceeds the estimate of the department on the project. Amends C.R.S. section 43-1-113 to authorized CDOT executive to award to low responsible bidder regardless of estimate of the department if director determines that is in the financial, economic or other interest of the state to do so. Requires posting of transportation projects regardless of size or method of procurement. Status 05/17/2018 | Sent to Governor

House Bills House Bill - HB18-1073 - Water District Ability Contract Water Assets Bill Summary The bill authorizes water districts, including water activity enterprises, to enter into contracts for water and the capacity in works and allows the contracts to be based on municipalities' authority to contract for water and sewer facilities. It also specifies that water conservancy districts' contracts can be for municipal and industrial use by the recipient of the water. Status 03/22/2018 | Governor Signed

House Bill HB18-1128 - Protections For Consumer Data Privacy Bill Summary Except for conduct in compliance with applicable federal, state, or local law, the bill requires covered and governmental entities in Colorado that maintain paper or electronic documents (documents) that contain personal identifying information (personal information) to develop and maintain a written policy for the destruction and proper disposal of those documents. Entities that maintain, own, or license personal information, including those that use a nonaffiliated third party as a service provider, shall implement and maintain reasonable security procedures for the personal information. The notification laws governing disclosure of unauthorized acquisitions of unencrypted and encrypted computerized data are expanded to specify who must be notified following such unauthorized acquisition and what must be included in such notification. Status 05/18/2018 | Sent to the Governor House Bill - HB18-1252 – Unlawful Sale of Academic Assignments Bill Summary Under existing law, a person is not permitted to prepare, offer to prepare, cause to be prepared, sell, or distribute any term paper, thesis, dissertation, or other written material for another person for compensation if he or she knows or should reasonably have known, that it is to be submitted by any other person for academic credit at a public or private college, university, or other institution of higher education, or to advertise the same. A court may issue an injunction to prevent these practices. The bill defines 'assignment' to include any specific written, recorded, pictorial, artistic, or other academic task; maintains the existing offenses related to preparing or selling assignments, or advertising the same; and prohibits a person from preparing, selling, or offering to sell a document or service that provides answers for, or completes on behalf of a student, an online exam that is administered pursuant to a course of study at any institution of higher education, or advertising the same. The bill authorizes the attorney general to bring a civil action against a person who commits a violation related to the sale of academic assignments or online exam answers, and creates a civil penalty of up to $750 for each violation. House Bill - HB18-1323 – Pay for Success Contracts Pilot Program Funding Bill Summary The bill requires the state treasurer to transfer specified amounts to a newly created office of state planning and budgeting youth pay for success initiatives account within the pay for success contracts fund for state fiscal years 2018-19 through 2021-22. The office of state planning and budgeting may expend the money transferred to the account for its use to fund 3 specified pay for success contracts for pilot programs designed to reduce juvenile involvement in the justice system, reduce out-of-home placements of juveniles, and improve on-time high school graduation rates, but the department of human services may expend any money appropriated to it from the account for expenses related to the administration of any pay for success contract. House Bill - HB18-1373 – Private Entities Use of State Telecommunications Network Bill Summary Concerning the use of the state telecommunications network by private entities through public-private partnerships, and, in connection therewith, relocating laws related to the state telecommunications network from the department of public safety's statutes to the statutes regarding telecommunications coordination within state government. Bill moves authority to the state’s Chief Information Officer. Status 05/18/2018 | Bill sent to Governor

Senate Bill SB18-029 - Development of Marijuana Tracking Technology Bill Summary The bill requires the institute of cannabis research at Colorado state university - Pueblo (institute) to develop marijuana tracking technology (technology). The technology must include an agent that is applied to a marijuana plant, marijuana product, industrial hemp, or industrial hemp product and then scanned by a device. The scan, at a minimum, would indicate whether the marijuana or hemp was cultivated, manufactured, or sold by a licensed marijuana business or registered hemp cultivator. The institute shall select a vendor to develop the technology. After the technology is developed, the state licensing authority must be satisfied that the technology provides an effective means of tracking marijuana. After the state licensing authority determines the technology is an effective means of tracking marijuana, it shall promulgate rules that require the technology to be used by licensed marijuana businesses, and the commissioner of the department of agriculture shall promulgate rules that require registered industrial hemp cultivators to use the technology. The technology that scans the marijuana must be made available to law enforcement and the department of revenue. Status 2/7/2018 Postpone Indefinitely (Senate Committee on Business, Labor, & Technology) Senate Bill - SB18-040 - Substance Use Disorder Harm Reduction Bill Summary Concerning measures to address the opioid crisis in Colorado, and, in connection therewith, providing immunity for individuals who provide clean syringes through a clean syringe exchange program, creating a supervised injection facility pilot program, allowing school districts to develop policies for the supply and administration of opiate antagonists, and requiring the commission on criminal and juvenile justice to study certain topics related to sentencing for opioid-related offenses. Status 2/14/2018 Postpone Indefinitely Senate Bill SB18-061 – Reduce the State Income Tax Rate Bill Summary For income tax years commencing on and after January 1, 2018, the bill reduces both the individual and the corporate state income tax rate from 4.63% to 4.43%. Status 05/2/2018 Postpone Indefinitely

Senate Bill SB18-128 – Legislative Approval for State Agency Fee Increase Bill Summary Beginning September 1, 2018, the bill requires all state agency fee increases to start on July 1 of a given year, with the exception of an emergency fee increase. The bill prescribes procedural requirements for fee increases. Status 03/14/2018 | House Committee on State, Veterans, & Military Affairs Postpone Indefinitely Senate Bill SB18-152 - Prohibit Price Gouging On Prescription Drugs Bill Summary The bill:

Prohibits a pharmaceutical manufacturer or wholesaler from price gouging on sales of essential off-patent or generic drugs;

Makes the practice of price gouging a deceptive trade practice under the "Colorado Consumer Protection Act"; and

Requires the state board of pharmacy and the executive director of the department of health care policy and financing to report suspected price gouging to the attorney general. The attorney general is authorized to seek subpoenas and file lawsuits with the appropriate district courts.

Status 01/29/18 - 02/14/2018 – Senate Committee on State, Veterans, & Military Affairs Postpone Indefinitely House Bill HB18-1043 - Beef Country Of Origin Recognition System Bill Summary The bill amends the 'Colorado Food and Drug Act' to require a retailer to indicate the country of origin for beef sold to the public. The bill only applies to retailers who sell beef that has not been manufactured, cured, smoked, cooked, or processed. The bill authorizes the department of public health and environment to promulgate rules to implement the bill. Status 01/29/2018 - House Committee on Agriculture, Livestock, & Natural Resources Postpone Indefinitely House Bill - HB18-1119 – Highway Building and Maintenance Funding Bill Summary Concerning sustainable rural highway building and maintenance funding, and, in connection therewith, requiring a specified percentage of net revenue generated by the existing state sales and use tax to be credited to the state highway fund; requiring the transportation commission to submit to the voters of the state at the November 2018 general election a ballot question, which, if approved, will, without raising taxes, authorize the state to issue transportation revenue anticipation notes for the purpose of funding the construction of specified high-priority highway projects. Status 2/21/2018 – House Committee on Transportation & Energy Postpone Indefinitely House Bill - HB18-1203 – Reduce State Income Tax Bill Summary For income tax years commencing on and after January 1, 2018, the bill reduces both the individual and the corporate state income tax rate from 4.63% to 4%. The bill also reduces the state alternative minimum tax by 0.63% for income tax years commencing on and after January 1, 2018. Status

03/8/2018 | House Committee on State, Veterans, & Military Affairs Postpone Indefinitely House Bill - HB18-1230 – Creation of Work Status for Immigrants Bill Summary The bill creates in the department of labor and employment a purple card program that would allow certain persons who came to the United States without legal documentation to apply for a purple card allowing them to work legally in Colorado. Status 05/7/2018 | Senate Committee on State, Veterans, & Military Affairs Postpone Indefinitely House Bill - HB18-1278 – Apprentice Utilization in Public Projects Bill Summary Concerning a requirement that contractors for public projects over five hundred thousand dollars that are not funded using federal money use apprentices for the parts of the project that are performed by workers in an apprenticeable occupation. Status 04/16/2018 Postpone Indefinitely
