The posts of Librarian, Junior Scale Stenographers and Clerks are to be filled-up by direct recruitment as per the Govt. instructions. These posts cannot be filled without the prior approval of the Finance Department, which is still awaited. However, requisition has been sent to the H.P. Subordinate Services Selection Board, Hamirpur, for filling up the posts of Steno typist and Clerks, but so far no name has been sponsored.
(C) JUDICIAL WORK 1. CRIMINAL CASES:
During the year 2017-18 in the beginning as on 1.4.2017 there were 41957 cases under Indian Penal Code and Special/other laws in various courts in the State of H.P. were pending. 10186 new cases were instituted during the year 2017-18 and in 1706 cases accused were convicted and in 4887 cases accused were acquitted. 101 cases were discharged. 410 cases were withdrawn. In 307 cases proceedings have been abated /stopped due to the death of the accused persons and in 173 cases accused were declared as proclaimed offenders. 628 cases were transferred to different courts. 1193 cases were compromised & compounded. Hence, at the end of the year 2017-18 as on 31.3.2018, 42507cases were pending in the different courts. The rate of conviction during the year 2017-18 is 36%., which is quite satisfactory. Detailed statement of criminal cases is given in Annexure, A-I. (i) Murder cases: During the year 2017-18 in the beginning as on 1.4.2017 there were 248 murder cases under Indian Penal Code in various courts in the State of H.P., were pending. 91 new cases were instituted during the year 2017-18 and in 24 cases accused were convicted and in 25 cases accused were acquitted. . In one case accused was declared as proclaimed offender and in one case proceeding were dropped. One case was compromised. Hence, at the end of the year 2017-18 as on 31.3.2018, 277 cases were pending in the different courts. The rate of conviction during the year 2017-18 is 49%. (ii) Rape cases: During the year 2017-18 in the beginning as on 1.4.2017 there were 639 rape cases under Indian Penal Code in various courts in the State of H.P., were pending .256 new cases were instituted during the year 2017-18 and in 32 cases accused were convicted and in 84 cases accused were acquitted. In one case accused was declared as proclaimed offender. In 3 cases proceedings were dropped. Hence, at the end of the year 2017-18 as on 31.3.2018, 751 cases were pending in the different courts. The rate of conviction during the year 2017-18 is 28%. (iii) N.D.P.S. Cases: During the year 2017-18 in the beginning there were 2282; ND & PS Act cases in various courts in the State of H.P. were pending. 954 new cases were instituted during the year 2017-18 and in 153 cases accused were convicted and in 219 cases accused were acquitted. In 20 cases proceedings were dropped. In 07 cases accused were declared as proclaimed offenders. One case was compromised. No case was withdrawn and 4 cases were discharged. Hence, at the end of the year, 2017-18 as on 31.3.2018, 2825 cases were pending in the different courts. The rate of conviction during the year 2017-18 is 41%. (iv) Forest cases:

During the year 2017-18 in the beginning as on 1.4.2017 there were 1647 Forest cases under Forest Act in various courts in the State of H.P., were pending. 138 new cases were instituted during the year 2017-18 and in 11 cases accused were convicted and in 476 cases accused were acquitted. In one case accused was declared as proclaimed offender. In 10 cases proceedings were dropped. Hence, at the end of the year 2017-18 as on 31.3.2018, 1284 cases were pending in the different courts. The rate of conviction during the year 2017-18 is 02%. (v) Excise Cases: During the year 2017-18 in the beginning as on 1.4.2017, there were 3025 cases under Excise Act in various courts in the State of H.P. were pending. 1480 new cases were instituted during the year 2017-18 and in 290 cases accused were convicted and in 440 cases accused were acquitted. 599 cases were compounded. In 60 cases proceedings were dropped. In 31 cases accused persons were declared as proclaimed offender. An amount of Rupees 47, 73,900 /- of fine has been imposed thereon during the period under reference. Hence, at the end of the year 2017-18 as on 31.3.2018, 3081 cases were pending in the different courts. The rate of conviction during the year 2017-18 is 69%. 2. DETAIL RELATING TO CRIMINAL APPEALS/REVISIONS:
During the year, 2017-18 in the beginning there were 1760 Criminal appeals/ revision pending in different courts of the State. 608 Criminal Appeals/revisions were instituted during the year 2017-18, 274 Cr. Appeals/revisions were decided against the State and in 218 Cr. Appeals/revisions convictions of the accused persons were maintained and as such they were decided in favour of the State. 126 Cases of appeals/revisions were withdrawn /transferred. 21 cases were compromised and as such percentage of success to the State during the year 2017-18 is 44%, which is quite good. Thus the number of appeals/revisions at the end of the year 2017-18 is 1729. Detailed statement of Criminal Appeals/revisions is attached as Annexure A- 2. 3. JUDICIAL WORK OF CIVIL CASES
During the year, 2017-18 in the beginning as on 1.4.2017, there were 5009 civil cases pending in various courts of the State. 1438 new cases were instituted during the year, 2017-18. . 912 cases were decided in favour of the State. 247 cases were decided against the State and 43 cases were compromised. 77 cases were withdrawn from the courts. 200 cases were transferred to other courts. Hence, at the close of the year as on 31.3.2018, number of cases pending is 4968. The percentage of success in civil cases during the year under reference is 79% which is quite encouraging. The detailed statement of civil cases during the year under reference is given in Annexure A-3. 4. PROCEEDINGS UNDER PREVENTIVE SECTIONS OF CR.P.C. At the beginning of the year 2017-18, 3257 cases under the preventive sections of Cr. PC were pending. 3498 cases were instituted during the year 2017-18 in the courts of different Executive Magistrates. In 34 cases persons were bounded down. 3009 cases were discharged and 188 cases were compromised. 29 cases were transferred. Hence, at the end of the year 2017-18 , 3495 cases were pending in different preventive sections of Cr. PC. Detailed Statement of security cases is attached as Annexure A-4. Proceedings under sections 107/109/145 Cr. PC were instituted directly by the Police before the Executive Magistrates as preventive measure to maintain the law and order. 5. REVENUE CASES:- At the beginning of the year 2017-18 (1.4.2017), 169 cases were pending. 63 new cases were instituted during the year, 2017-18. 30 cases were decided in favour of the State and 13 cases were decided against the State. 04 cases were withdrawn. 11 cases were remanded back. Hence, at the end of year 2017-18 (31.03.2018), 174 cases were remained pending. The success rate in favour of the State comes to 67%. 6. FOREST CASES AT SHIMLA At the beginning of the year, 2017-18, 21cases were pending before the Special Judge (Forest) Shimla. 04 cases were instituted during the year. 07 cases were convicted and 07 cases were acquitted during the year. In one case proceedings have been dropped. 3 cases have been transferred. Hence, 07 cases were pending at the close of the year 2017-18. Conviction rate comes to 50%

8. (i) Labour Court, Shimla. At the beginning of the year, 2017-18, 50 cases were pending before Industrial Tribunal- cum- Labour court, Shimla. 36 cases were instituted during the year 2017-18. 31 cases were decided in favour of the state and 2 cases were decided against the state of H.P. One case was withdrawn. 3 cases were transferred. Hence, 49 cases were remained pending at the end of the year 2017-18. The success rate comes to 94%.
(ii) Labour Court, Kangra at Dharamshala.
There were 1071 cases pending at the beginning of the year 2017-18. 178 new cases were instituted during the year. 33 cases were decided in favour of the State and 247 cases were decided against the State. 11 cases were withdrawn.13 cases were transferred. 945 cases were remained pending at the end of the year 2017-18 as on 31.03.2018. The success rate comes to 12 % in favour of the State. 9. Consumer Court Cases. (i) State Commission:- At the beginning of the year 2017-18, 06 cases were pending before H.P. State Consumer Redressal Commission, Shimla. 14 new cases were instituted during the year 2017-18. 10 cases were decided in favour of the State and no case was decided against the State. Hence, 10 cases were pending at the end of the year 2017-18. The success rate comes to 100% in favour of the State. (ii) District Consumer Forum:- At the beginning of the year 2017-18, 17 cases were pending before District Consumer Forum, Shimla. 02 cases were instituted during the year 2017-18. 18 cases were decided in favour of the State and one case was decided against the State. One case was withdrawn. Hence, 09 cases were remained pending at the end of the year 2017-18. The success rate comes to 89% in favour of the State. 10. Litigation Cell, Directorate of Prosecution, H.P. The annual report of cases examined in the Litigation Cell of Directorate of Prosecution in the year 2017-18 is as under:-

(D) OTHER WORK
1. TRAINING PROGRAMME:
As regards training programmes are concerned the Law Officers were sent for refresher courses on criminal law in the National Institute of Criminology and Forensic Science at Delhi, SVP, National Police Academy, Hyderabad H.P. Institute of Public Administration Fairlawn’s, Shimla and training in respect of office procedure and Financial Management
and basic computer course/ Advance computer Course was provided to officers/ officials at HIPA, Shimla. Besides it, a Workshop on Training Needs Analysis for providing training to Prosecutors was conducted at Fairlawn’s, HIPA during the
current financial year for smooth and effective functioning of the Department. 2. PUBLIC ACCOUNTS COMMITTEE/AUDIT PARAS/INSPECTIONS At the opening of the financial year 2017-18 as on 1.4.2017, there was no PAC matter was pending. 21 audit reports and 85 audit paras were pending pertaining to this Department. 07 audit reports and 25 audit paras were instituted during the year 2017-18. 11 audit paras were settled during the year 2017-18. 28 audit reports and 99 audit paras were pending at the end as on 31.03.2018. 3. REGARDING RULES AND REGULATIONS:
The recruitment and promotion rules for all the categories of employees have been finalised. 4. MEETING OF DEPARTMENTAL PROMOTION COMMITTEE:
During the year 2017-18, 12 meeting of Departmental Promotion Committee were held for giving promotion to Class III employees i.e. 3 Supdt. Grade –II, 5 Senior Assistants, regularization of 5 Contractual Clerks, appointment of one daily wage peon, regularization of 13 daily waged workers/Sweepers and for grant of higher/next pay scale on placement in the ratio of 50:50 in Clerical Cadre after completion of 5 years in the grade vide which 8 Clerks are placed as Junior Assistant.
5. SENIORITY LISTS:
(i) This department has released the seniority lists of Peons up-to 31.07.2018. (ii) The seniority list of Senior Assistants has also been released as on 31.07.2018. (iii) The seniority lists of Clerk has been released as on 30.06.2018. 6. CONFIDENTIAL REPORTS:
The confidential reports for the year 2016-17 of Class III employees of this department have been completed.
7. USE OF HINDI Almost all the work of this department except legal work is being done in Hindi. However, some legal work was
also done in Hindi. 8. BUDGET
The detail of the amount, which is received from the Government on different sub Heads for the year 2017-18 under demand No. 3 and 31 is attached as Annexure A-5 for perusal. Under this department, except Directorate other 38 offices are included under demand No. 3 and 3 offices fall under demand No. 31.
9. DIFFICULTIES:
This department is not having sufficient Prosecutors and ministerial staff to cope up with the day to day work. At the
Head quarter level only one Sr. Asstt. 2 Clerks, one Junior Scale Stenographer, 2 peons are posted with the Distt. Attorneys,
whereas at Dharamshala, Chamba, Hamirpur, Una, Bilaspur, Solan, Nahan, Shimla, Kullu and Mandi, the number of Law
Officers are more than 5 and 6 and require more supporting staff. 15 posts of Assistant District Attorneys are lying vacant.
The private advocates always have sufficient staff to assist them, but as compared to the private advocates, the law officers of
this department do not have sufficient manpower to assist them. In this department one post of Junior Scale Stenographer had
been sanctioned for each district head quarter level. However, at the sub divisional level, there is no post of stenographer and
as such the work of this department is also suffering at sub divisional level in the absence of Stenos. The post of Steno is very
much essential for the smooth and effective functioning of the offices at the sub divisional level.
It is, therefore, necessary that for the proper functioning of the work of this department, one post of clerk with each
law officer at District Level and one post of Steno at each Sub Divisional level is required to be sanctioned. At the District HQ level the District Attorney is the office-in-charge. He looks after the work of
establishment/financial matters etc. in addition to legal works, and he mostly remains busy in the courts. Hence, the post of

Superintendent Grade II is very essential for the smooth working of office of District Attorneys at the District Level. At the District level, law officers have been attached with the judicial courts and they remained busy in the judicial work for whole day and as such the cases before the Revenue courts/Executive Magistrate are not attended to. It is essential that in each district HQ and sub divisional level additional post of Asstt. District Attorney is created so that work may not suffer. This department has taken steps for the creation of above posts, many times with the Government and the matter is still under consideration with the Govt.
In addition to this, it is pointed out that at present law officers/officials at the District level/sub divisional level have
not been provided suitable official/residential accommodation. This matter also requires urgent attention. 10. ACHIEVEMENTS OF THE DEPARTMENT (i) This Department has provided computers at Distt. Hqrs. and Sub Divisional Level which will help in monitoring of court cases and will increase the efficiency of Law Officers as computers have become most indispensable in the modern offices. FAX machines have also been provided to DAs. (ii) The department has also provided Lap tops along-with Law Software to all the Public Prosecutors under the 13th Finance Commission grant. The Public Prosecutor can easily locate the latest law settled by the Hon’ble Supreme Court of
India and as well as by the High Courts in their day to day functioning in the Courts. (iii) During the period under report w.e.f. 1.4.2017 to 31.03.2018 an amount of Rs.1,00,00,000/- have been sanctioned for the constructions of office/ residential accommodation of this department. 11. PROSPECTIVE PLAN OF THE DEPARTMENT.
The Department has provided Law Officers in the office of Superintendent of Police to tender legal advice at the
stage of investigation which will improve the quality of investigation and increase the rate of conviction in criminal cases.
Efforts are afoot to increase the rate of conviction by applying latest technology i.e. Forensic science etc., in the prosecution of criminal cases.
12. INSPECTION: Periodic inspections of the offices of District Prosecution agency and sub divisional level prosecution agency are carried out by the Director of Prosecution & Joint Director of Prosecution. The heads of the District Prosecution Agency have been instructed to inspect the office of Prosecution agencies in the Sub Division level within their jurisdiction.
13 RIGHT TO INFORMATION ACT.
During the year 2017-18, 33 applications under the Right to Information Act have been received in the department, and were disposed off accordingly well in time, in accordance with the Act and Rules. 14. CONVICTION RATE
a. IN TRIAL COURTS:
Conviction rate in criminal cases conducted before different Trial Courts in H.P. w.e.f. 1.4.2017 to 31.3.2018 figured at 36%, which is quite satisfactory and further steps are being taken to enhance the same by issuing directions to the prosecutors of this Directorate to increase their performance and efficiency accordingly.

In criminal appeals/revisions preferred/instituted by the State of H.P. before the different appellate Courts of Ld. Sessions Judge/Additional Sessions Judge/Fast Track Courts respectively against the judgment of acquittals/orders passed by the Judicial Magistrates, the success rate of acceptance of appeal/revision in favour of State of H.P., comes to 44% which is quite encouraging and shows the effective performance by the Prosecution agency. 15. GENERAL
On the whole, the work of the prosecution agency in the State during the year 2017-18 has been found satisfactory. Efforts are being made to streamline the functioning of the Prosecution Department with a view to achieve a higher level of conviction rate so that HP becomes number one State in the field.
