Ricardo Morales was slapped with a subpena to appear before a federal grand jury as he walked out of aDade County courtroom Saturday where he had justbeen acquitted on charges of marijuana possession.

Morales' attorneys say the subpena - the thirdsince his arrest in April in connection with a 5,000-pound marijuana bust - constitutes harassment of theformer Castro spy, FBI informant, CIA operative an dVenezuelan secret police agent.

He has already testified three times before a feder·l grand jury, twice since he was arrested, said John

Komorowski, one of Morales' attorneys. This is just aform of harassment.

They know wh at his testimony is and his answerswill remain consistent, he said. Komorowski wouldn'tventure a guess at what a grand jury might want withhis client. ''Who the hell knows? he said.

Komorowski said the latest subpena was issued lateFriday, but no immediate attempt wss made to serve it.Instead, he said the law enforcement agent who handed the court order to Morales Saturday sat through thehearing, waiting until the jury delivered its verdict.

Komorowski said he and partner Ed O'Donnell willtry to quash the u b p ~ n in federal court.

In addition to the latest subpena, Morales has also

been called to testify Aug. 10 before a Congressionalcommittee investigating the assassination of PresidentJohn F. Kennedy.

For Morales, the time he spent In jail prior to his ac·quittal was the first time the controversial figure hadbeen arrested. They kept him in jail 105 days andwhile he was in jail there were so many law enforcement agents who wanted him to talk and so many whodidn't want him to t lk it was just crazy, Komo·rowski said.

The interest o f various law enforcement agencies inMorales' recent activities are part of the mystery sur•rounding the man.

Komorowski speculated the fall from grace be·tween his client and law enforcement agencies reflectsa change in government attitudes towards Cuba.

It's because of his (Morales) background, his ac·cess to highly sensitive information, Komorowski

. said. He is a consummate professional. tter all, hewas trained by the CIA and he Is not going to breakconfidentiality, but it is his business whether he will dl·vulge anything.

However, Morales' actions and reactions defy pre··diction, even among those who are familiar with the39-year-old exile, whose risky life as an undercoveragent for several governments has taken him from

He has been described by a former assistantstaf41

rttorney as a trustworthy witness whose t e s t i m o ~

helped convict Dr. Orlando Bosch on terrorism charges. IConversely, he's been described as a totally u n r e l i b ~informant who failed to appear before a federal gran4; ;jury to testify on bombing charges against R o l a o d ~ I.Otero.

That failure to appear prompted a magistrate •place a $367,000 bond on Morales in connection with

the marijuana charges. Metro detectives believed i

low bond was placed on Morales he would skip -country as soon as he walked out of jail. ./

He did just the opposite, after a bonding g e n ~posted the bond July 18 - one of the highest bondSmade here in years - he showed up in court for triaL .

Morales attorney's called no witnesses and aske4 1

for a directed acquital, based on the fact tqere was notenough evidence to show possession. , ,

Judge Wilkie Ferguson ordered a trial by jury.jury decided that although Morales had led two men fa .Ia truck to a South Dade home and watched them un. fload several bales, his mere presence was not enouaa; ito convict him of possession. ·

That's the law. Evidence of possession must b\\proven, it cannot be inferred , said Komorowski. · ·
