2. Invitation for Bid
F.M.University, Balasore, Odisha invites technical cum financial proposal from eligible
bidders to supply install and maintain Campus WI-FI (both old and new campus), Smart Class &
Video Conferencing Unit at F.M.University, Balasore, Odisha. Interested bidders are expected to
examine the tender document carefully and apply separately for Campus WI-FI (both old and
new campus), Smart Class & Video Conferencing Unit but preference will be given to the bidder
that applies for all three. Failure to furnish all information required as per the Tender
Document may result in the rejection of the Bids. F.M.University, Balasore, Odisha reserves
the right to reject/cancel any (bid) or all bids or the RFP without assigning any reason
thereof.
N.B: The bidders are to bid separately for Campus WI-FI (both old and new campus), Smart Class & Video Conferencing Unit with EMD & tender document fees separately as mentioned in fact sheet.

2.1 Amendment of Bids:
∑ Bids once submitted cannot be amended. However, in case of some administrative
exigencies, F.M.University, Balasore, Odisha may decide to take fresh bids from all
the Bidders before actually opening of the Technical and Commercial Bids.
∑ In order to provide prospective Bidders reasonable time to make amendment in their
bids, F.M.University, Balasore, Odisha may, at his discretion, extend the deadline for
the submission of bids. However, no such request in this regard shall be binding on
F.M.University, Balasore, Odisha.
2.2 Language of Bid & Correspondence:
The Bid will be prepared by the Bidder in English language only. All the documents relating
to the Bids (including brochures) supplied by the Bidder should also be in English, and the
correspondence between the Bidder & F.M.University, Balasore will be in English language
only.
2.3 Bid Currencies:
Prices shall be quoted in Indian Rupees (INR).
2.4 Period of validity of Bids:
For the purpose of placing the order, the Bids shall remain valid for at least 90 days after
the date of bid opening. A bid valid for a shorter period may be rejected by F.M.University
as being non-responsive. During the period of validity of Bids, the rates quoted shall not
change. In exceptional circumstances, F.M.University may ask for extension of the period of
validity and such a request shall be binding on the Bidder. F.M.University’s request and the
response to such a request by various Bidders shall be in writing. A Bidder agreeing to such
an extension will not be permitted to increase its rates.
2.5 Submission of the Bid:
The Bid shall be submitted in two Bid format (separate for campus wi-fi /smart class/video
conferencing unit)
BID - Part A: TECHNICAL (Form D)
BID -Part B: COMMERCIAL (Form E)
∑ The bid shall be submitted in Two Bid System (Part A “TECHNICAL BID” and Part B“
COMMERICAL BID”) indicating the name of the Bidder.

∑ The bid should be signed by an authorized signatory (having power of attorney) on
each page of the bid document including enclosures. Copy of board resolution and /
or power of attorney shall be submitted along with technical bid
∑ The bids along with enclosures, tender fees & Bid Security / EMD must be received
by the F.M. University at the specified address not later than 07.12.2015, 1.00 PM.
∑ F.M. University may, at its discretion, extend this deadline. F.M. University may also
extend this deadline for any other administrative reason.
∑ The Bid shall contain no interlineations, erasures or overwriting, in order to correct
error made by the Bidder. All corrections shall be done & initialed by the authorized
signatory after striking out the original words / figures completely.
∑ The Hard copy of the Technical Bid shall be sealed in a covering envelop super
scribed with words "Technical Bid for Tender for “supply install and maintain Campus
WI-FI /Smart Class/ Video Conferencing Unit at F.M.University, Balasore” This
envelope will also contain Bid Security/EMD & Tender fees in another small sealed
envelope.
∑ Commercial Bid shall be sealed in a covering envelop super scribed with words
“Commercial Bid for Tender for “supply install and maintain Campus WI-FI / Smart
Class /Video Conferencing Unit at F.M.University, Balasore”
∑ Every envelope and forwarding letter of various parts of the Bids shall be addressed
as follows:

∑ If the envelopes are not sealed and marked as required above F.M.University will
assume no responsibility for the Bid's misplacement or premature opening.
∑ Bids sent through Telex /Telegrams/ Fax/ Email shall not be acceptable.
∑ The envelope shall be sealed by signing across all joints & pasting good quality
transparent adhesive tape on top of such joints & signatures.
Note: Preference shall be given to the bidder who bids for all 3 i.e supply install and maintain Campus WI-FI / Smart Class /Video Conferencing Unit.

2.6 Deadline for Submission of Bids:
The Bids will be received by F.M. University at the specified address not later than
07.12.2015, 1.00 PM. F.M. University may, at its discretion, extend this deadline. F.M.
University may also extend this deadline for any other administrative reason.
2.7 Late Bids:
Any bid received by F.M.University after the deadline for submission of bids prescribed by
F.M.University, will be rejected.
2.8 Withdrawal of Bids:
Bids cannot be withdrawn in the interval after its submission of bids and before the
expiry of Bid's validity specified by F.M. University.
2.9Opening of Bids by F.M. University:
∑ The Bids shall be opened at 07.12.2015, 2.30 PM or on any other later day and time as
notified through mentioned websites, in F.M. University office in the presence of
representatives of the Bidders who may choose to attend the proceedings. The
representatives of Bidders will sign a register in evidence of their presence.
∑ In order to assist in the examination, evaluation and comparison of Bids, F.M.
University may at its discretion ask the Bidder for a clarification regarding its Bid. The
clarification shall be given in writing, but no change in the price or substance of the
Bid shall be sought, offered or permitted.
∑ The Commercial Bids of only those Bidders will be opened who fulfill all the eligibility
criteria, in the Technical Bids, successful presentation and who also have deposited
Tender Cost and Bid Security as required under. The Bidders who have submitted the
Single Point Registration Certificate under NSIC for exemption from tender cost and
EMD shall be considered for exemption only if the particular service is clearly listed in
the certificate as well as in the NSIC website. Any other clarification obtained from
local NSIC w.r.t any particular terminology in the certificate shall only be considered
if the same is updated in the NSIC website. However, while determining the technical
qualification of various Bidders, F.M. University may waive off any minor infirmity,
which does not constitute a material deviation. The decision of F.M. University in this
regard shall be final.
2.10 Evaluation and Comparison of Commercial Bids:
The comparison of the commercial bids will only be done on price only and the L1 vendor will be selected for award of contract.

Note 1: The Bidder shall not quote prices subject to certain conditions. Bids containing any conditionalprices may be rejected or F.M. University may take a final decision in its discretion about such conditionality.
2.11 Negotiations:
F.M. University shall finalize the Tender & award the Work without any negotiations.
2.12 F.M. University’s Right to accept any Bid and to reject any or all Bids:Notwithstanding anything else contained to contrary in this Tender Document,
F.M.University reserves the right to accept or reject any Bid or to annul the bidding
process fully or partially or modifying the same and to reject all Bids at any time prior to
the award of work, without incurring any liabilities in this regard.
2.13Notification of Award:
∑ Prior to the expiry of the period of Bid validity, F.M.University will notify the successful
Bidder in writing by speed post or Fax or email that his Bid has been accepted.
∑ The liability of the Consultant(s) to perform the services will commence from the
date of notification of Award.
∑ The Completion Period shall be counted from the date of 'Notification of Award of
Work'.
2.14 Corrupt or fraudulent Practices
F.M.University requires that the Bidders under this tender observe the highest standards
of ethics during the tender and execution of such contracts. In pursuance of this policy,
F.M.University defines the terms set forth as follows:
“Corrupt practice” means the offering, giving, receiving or soliciting of anything of value
to influence the action of the public official in the procurement process or in contract
execution;
“fraudulent practice” means a misrepresentation of facts in order to influence a tender
process or a execution of a contract to the detriment of F.M.University, and includes
collusive practice among Bidders (prior to or after bid submission) designed to establish
bid prices at artificial non-competitive levels and to deprive the Purchaser of the benefits
of the free and open competition;
F.M.University will reject a proposal for award if it determines that the Bidder
recommended for award has engaged in corrupt or fraudulent practices in competing for
the contract in question.

F.M.University will declare a Bidder ineligible, either indefinitely or for a stated period of
time, to be awarded a contract if it at any time determines that the Bidder has engaged
in corrupt and fraudulent practices in competing for, or in executing, a contract.
2.15 Delays in the Successful Bidder's Performance:
∑ Delivery and installation of materials and shall be made by the successful bidder in
accordance with the time schedule specified by F.M. University.
∑ The successful bidder will strictly adhere to the time-schedule for the performance of
Work.
∑ In case of delay in performance for reasons attributable to the Consultant, such
liquidated damages shall be imposed @ 1% per week with a ceiling of 10% of the
total value of work.
2.16 Performance Security:
Within 07 days of Notification of “Award of the contract” the bidder shall furnish
Performance Security to F.M. University @ 10% of the total value of quoted bid by way of
irrevocable and unconditional Bank Guarantee from a reputed Nationalized Bank in favour
of F.M. University This Bank Guarantee must be validity of minimum three months after of
3 years of warranty and maintenance period to cover the risk of F.M. University which
may be extended further as per requirement of F.M. University. The proceeds of the
Performance Security shall be payable to F.M. University as compensation for any loss
resulting from the Company’s failure to compete its obligations under the terms and
conditions of the work. The Performance Security regarding commencement of job /
task will be discharged by F.M. University and returned to the company not later than 30
days following the date of completion of the company’s performance related obligations
under the terms & conditions of the work.
2.17 Payment Schedule:

2.18 Termination for Default:
F.M.University may without prejudice to any other remedy for breach up terms and
conditions (including forfeiture of Performance Security by written notice of default sent to
the company, terminate the work / task in whole or in part after sending a notice to the
bidder in this regard.
∑ If the bidder fails to deliver or complete the job assigned in the terms and conditions
within the time period (s) specified in the Tender Document.
∑ If the bidder fails to perform any other obligations under the terms and conditions.
2.19 Confidentiality:
All disputes, differences, claims and demands arising under the contract shall be referred to
arbitration of a sole arbitrator to be appointed by the Registrar, F.M.University. All
arbitrations will be held in Balasore, Odisha/High court of Odisha.

2.20 Legal Jurisdiction:
All legal disputes are subject to the jurisdiction of Balasore courts/Odisha High court only.
2.21 Completeness of Tender Offer:
The Bidder is expected to examine all instructions, forms, terms, conditions and deliverables
in the Tender Documents. Failure to furnish all information required by the tender
documents or submission of a tender offer not substantially responsive in every respect to
the tender documents will be at the Bidder's risk and may result in rejection of its tender
offer. The tender offer is liable to be rejected outright without any intimation to the Bidder if
complete information as called for in the tender document is not given therein, or if
particulars asked for in the Forms / Performa in the tender are not fully furnished.
3. Scope of Work3.1 Brief Scope
The scope of Work is to supply install and maintain Campus WI-FI, Smart Class & Video
Conferencing Unit in F.M.University, Balasore Odisha as per the Bill of material and
specifications. The scope of work includes but not limited to the following
∑ Install and maintain Campus WI-FI, Smart Class & Video Conferencing Unit in
F.M.University, Balasore Odisha.
∑ All precautionary and safety measures shall be taken care by the bidder till the date
of final commissioning and handing over of the commissioned equipments to
F.M.University.
∑ Configuration, installation and testing of the supplied equipments will be conducted
by the bidder in university network at different locations in presence of our Technical
staffs as per layout drawing.
∑ After the installation and commissioning of the equipment the bidder has to provide
a brief training session on the entire features of equipments with all the supporting
manuals /documents on the working, configuring, general trouble shooting, safety
measures on the same to nominated Technical Staffs of F.M.University at each
location.
∑ The projects i.e. supply, installation, testing and commissioning of equipments shall
be completed within 45 days from receipt of order.
∑ Warranty: The bidder has to provide warranty on the entire supplied device for
minimum of three years onsite comprehensive from the date of Commissioning. The
warranty statement should be confirmed from the OEM through an official e-mail.

∑ Product Life Guarantee: Supplied products shall bear a minimum product life of Five
years from the date of installation. (Declaration for Product End-of-Life must be
submitted from OEM).
∑ Defects Liability Period: - During the warranty period, if any trouble or defect
originating with the design & operating characteristics of equipment installed, the
Bidder at his own expense and at no cost to F.M.University shall replace the
equipment with complete re-installation as promptly as possible with all such
alternations, repairs and replacements at site as may be necessary to permit the
functioning of the equipment in accordance with all the minimum technical
specifications. If agency fails to provide the satisfactory service in respect to above
the Performance security liable to be forfeited.

3.5 Cost of Bidding
The Bidder shall bear all costs associated with the preparation and submission of its bid and

Part 1 –Technical Bid: (Form D)
In support of his eligibility, a Bidder must submit the following documents:
(i) Detailed profile of the Company / Firm.
(ii) Audited Statement regarding turnover of the Bidder.
(iii) DD of Rs. 1,000/- towards the cost of the tender document in favor of F.M.University
Dev. Fund II, payable at Balasore in a separate envelope inside all Technical Bids.
(iv) Declaration in Form 'A’ by an authorized signatory to the effect that all conditions
contained in the Tender Document is acceptable to the Bidder. Such an authorization may
be seen during scrutiny of bids.
(v) Declaration in Form ‘B’ that the Bidder has not been debarred / blacklisted by any
Government / Semi-Government organization for quality of services / product and that
there is no major complaint against the Bidder by any organization mentioned in this clause.
(vi) Details of the jobs undertaken during the last three years in the format given in Form
'C’.
(vii) Documentary proof for establishing the capability of the Bidder to undertake this
consultancy by showing satisfactory / timely completion reports or similar activities
currently being delivery.

∑ List and profile of experts in the organization along with profile of the experts proposed
to be stationed in Balasore. The staff to be deployed for this Project should comprise
of employees of the Bidder. Employees to be out-sourced especially for this Project

If a Bidder withdraws its bid during the period of bid validity specified in the Tender
Document or in the Award of Work.
During the tendering process, if a Bidder indulges in any such activity as would jeopardize
the tender process. The decision of the Purchaser regarding forfeiture of the Bid Security
shall be final & shall not be called upon question under any circumstances.
In the case of a successful bidder, if the Bidder fails to,
∑ accept award of work,
∑ Fails to furnish Performance Security.
∑ Violates any of the important conditions of this tender document or indulges in any
such activity as would jeopardize the interest of F.M.University in timely finalization
of this tender.
