PREFACE

To continue providing quality legal resources in the country,we present the second installment of the Rex Case Digest Series.

The Rex Case Digest 2006contains some one thousand fourhundred fifty-four (1,454) cases promulgated by the Supreme Court.These decided cases were digested and thoroughly classified into theeight bar subjects according to their topics and the issues presented.

This volume consists of cases in the areas of Labor Law and

Social Legislation, Legal Ethics, and Mercantile Law. Included inthis volume is the landmark case of Star Paper Corporation,et al., v. Simbol, et al., G.R. No. 164774, April 12, 2006, where theCourt ruled that the no-spouse employment policy is not a validexercise of management prerogative in the absence of a bona fideoccupational qualification. The Court further ruled that to justifya bonafideoccupational qualification, the employer must prove thatthe employment qualification is reasonably related to the essential

operation of the job involved and that there is a factual basis forbelieving that all or substantially all persons meeting the qualificationwould be unable to properly perform the duties of the job. Alsoincluded in this volume is the case of Soriano v. Dizon, A.C. No. 6792,

January 25, 2006, where the court reiterated the ruling inIRRI v. NLRCthat the crime of homicide may or may not involve moral turpitude,depending on the degree of the crime. However, unlike in the IRRIcase, the Court in this case found that the circumstances clearlyshowed the moral turpitude of the respondent and his unworthinessto practice law. Lastly, in the case of Shangri-la, et al., v. DGCI,G.R. No. 159931, March 31, 2006,the Court held that appropriation ofa trademark in bad faith does not necessarily ripen into ownership,despite the first-to-file rule.

Other interesting cases may be found in this volume. We hopethat this will serve as a useful and handy reference for your legalstudies and research.
