Discussion under Rule 58

On July 19, 2012, the House discussed the serious situation that has arisendue to the closure of four district offices of NABARD and the decrease inAgriculture Loans in Kerala, based on the notice given by Shri K. On July 19, 2012, the House discussed on the Sixth Report of theCommittee on Private Members’ Bills and Resolutions based on the notice givenby Shri T. N. Prathapan under Rule 205 (B). Minister for Health, Family Welfareand Devaswom and the Chief Minister replied to the points raised in thediscussion.

Announcement by the Speaker

On July 20, 2012, the Speaker announced that as per the informal decisionof the Business Advisory Committee meeting on 5-7-2012, “The CommonwealthTrust, Kozhikode (Acquisition and Transfer of Undertaking) Bill, 2012” will beintroduced and the motion for reference to the Subject Committee will beconsidered on 23rd July, 2012.

Statements under Rule 300

On July 20, 2012, Minister for Health, Family Welfare and Devaswommade a statement on the measures taken by the Government to check therecently reported instances of food poisoning.

On July 24, 2012, Minister for Education made a statement on the measurestaken by the Government following the verdict by the Hon’ble High Court on thestandard and sanction of Self-Financing Engineering Colleges in the State.

Consideration of Amendment to Rules

On July 24, 2012, Shri A. K. Balan moved an amendment to the KeralaCo-operative Societies (Amendment) Rules, 2012 issued in Notification G.O.(P)No.19/2012/Co-op. dated 14-2-2012 (S.R.O. No. 137/2012). After reply by theMinister for Co-operation, Khadi & Village Industries and Pollution Control, theamendment moved was put to vote and declared lost.

Statutory Resolution

On July 25, 2012, the House adopted a statutory resolution under Article252 of the Constitution moved by the Minister for Health, Family Welfare andDevaswom to adopt in the State the Transplantation of Human Organs(Amendment) Act, 2011 (Central Act 16 of 2011).10/2013.

FINANCIAL BUSINESS

I. Budget for 2012-13

13 days were allotted for the discussion on Demands for Grants in theBudget for the Financial Year 2012-2013, during the Fifth Session.

Out of 2179 cut motions received, 1133 were moved and disposed off.There were 225 occasions for speech including reply by the Ministers inconnection with the discussion and voting on Demands for Grants.

The Assembly devoted 61 hours and 18 minutes for transacting financialbusiness relating to the Budget for 2012-2013. The details are given inAppendix IX and X.

The Appropriation (No. 2) Bill, 2012, in respect of the Budget for the year2012-2013 was introduced by the Minister for Finance, Law and Housing,on 16-7-2012. The Bills were taken up for consideration and passed on thesame day.

II. Supplementary Demands for Grants

On 17th July 2012, the Minister for Finance, Law and Housing laid beforethe House the Supplementary Demands for Grants for the year 2012-13.

The Discussion and voting on the Supplementary Demands for Grants tookplace on 24th July, 2012 and the House devoted 4 Hours 27 minutes for thetransaction of the business.

The Kerala Appropriation (No. 3) Bill, 2012, in respect of theSupplementary Demands for Grants for the year 2012-2013 was introduced inthe Assembly on 25-7-2012. The Bill was taken into consideration and passedon the same day. The house devoted 15 minutes for the business.

PRIVATE MEMBERS’ BUSINESS

According to the calendar of sittings of the Fifth Session of the ThirteenthKerala Legislative Assembly, six days were set apart for transacting PrivateMembers’ Business viz., 15th, 22nd, 29th June, 6th, 13th and 27th July 2012. Eventhough six days were set apart for transacting Private Members’ Business,business was done only in 3 days ie., on 22-6-2012, 6-7-2012 and 13-7-2012.During the Session, the House devoted 3.16 hours in toto for Private Members’Business.

I. Private Members’ Bills

During the Session, the Business on Private Members Bills was transactedin one day only, ie., on the 13th of July 2012. On the first day scheduled forPrivate Members’ Bills, ie., on 15th of June 2012, motions for leave to introduce9 Bills and the discussion on 3 pending Bills were listed in the business. But theHouse was adjourned before considering Private Members’ Business.

On the 29th of June 2012, being the second day scheduled for transactingPrivate Members’ Bills, no Business was transacted since there was no sitting ofthe Assembly. On 13th July 2012, the third day scheduled for transacting PrivateMembers’ Business motions for leave to introduce 15 bills and the motion forcontinuation of discussion of 3 pending bills were listed in the business. Out ofthese, motions for leave to introduce 9 Bills have come up before the House. Butthe discussion on 3 pending Bills were not moved due to the lack of time.

Details regarding the name of Members’ who moved the motions for leaveto introduce the Bills and the results thereof, during the aforesaid days is givenin Appendix XI.

II. Private Members’ Resolutions

During the Session, three days, ie., on the 22nd June, 6th July and 27thJuly 2012 were allotted for transacting Private Members’ Resolutions. On 22ndJune, three Resolutions came up before the House.

The first Resolution, given notice of by Shri M. P. Vincent was moved inthe House. The Resolution was passed by the House.

The Second Resolution, given notice of by Shri Purushan Kadalundy wasmoved in the House. Since the discussion was inconclusive, it was left for thenext day. The third resolution given notice by Shri A. M. Ariff was not moved inthe House.

On July 6th 2012, four Resolutions came up before the House. At first theHouse considered the pending discussion on the Resolution given notice byShri Purushan Kadalundy. The Minister for Water Resources replied to the pointsraised in the discussion. After the reply the Resolution, moved by Shri PurushanKadalundy was withdrawn by the leave of the House. Then the Minister forWater Resources moved an Official Resolution and the same was passed by theHouse unanimously. Then the first Resolution, scheduled for 6-7-2012 givennotice of by Shri Therambil Ramakrishnan was moved in the House. TheResolution was passed by the House. The Second and third Resolutions, given

notice of by Shri A. Pradeepkumar and Shri K. Dasan respectively were notmoved due to the lack of time.

On the 27th of July, 2012, scheduled for transacting Private Members’Resolution, no business was transacted since there was no sitting of theAssembly.

SALIENT FEATURES OF THE BILLS

THE KERALA GOVERNMENT LAND ASSIGNMENT

(AMENDMENT) BILL, 2011

As per sub-rule (1) of rule 15 of the Kerala Land Assignment (Regularisationof Occupations of Forest Lands prior to 1-1-1977), Special Rules 1993, the landsassigned under the said rules are heritable but not alienable. There were widespread demands from the people to remove the restriction on alienation. As theassignees of the lands are in occupation of the land for more than 30 years andthe area covered by the said rules are not likely to increase, Government considerit not necessary to restrict, the alienation of the said lands. Hence, theGovernment have decided to amend the rules retrospectively so as to enable theassignees to alienate the land with certain restrictions, but, at present there is noprovision in the Kerala Government Land Assignment Act, 1960 to make rulesretrospectively. Hence, the Government have decided to amend section 7 of theKerala Government Land Assignment Act, 1960 so as to enable the Governmentto make rules either prospectively or retrospectively.

2. As the Legislative Assembly was not in session and the aboveproposals had to be given effect to immediately, the Kerala Government LandAssignment (Amendment) Ordinance, 2010 (52 of 2010) was promulgated by theGovernor on the 12th day of September, 2010 and the same was published in theKerala Gazette Extraordinary No. 2077 dated 13th September, 2010.

3. Though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 387 of the 12th Kerala Legislative

Assembly, the same could not be introduced in, and passed by, the LegislativeAssembly of the State of Kerala during its session which commenced on the 21st

day of December, 2010 and ended on the 3rd day of January, 2011. In order tokeep alive the provisions of the said Ordinance the Kerala Government LandAssignment (Amendment) Ordinance, 2011 (15 of 2011) was promulgated by theGovernor on the 23rd day of January, 2011 and the same was published in theKerala Gazette Extraordinary No. 153 dated 23rd day of January, 2011.

4. Though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 408 of the 12th Kerala LegislativeAssembly, the same could not be introduced in, and passed by, the LegislativeAssembly of the State of Kerala during its session which commenced on the 4th

day of February, 2011 and ended on the 24th day of February, 2011. In order tokeep alive the provisions of the said Ordinance, the Kerala Government LandAssignment (Amendment) Ordinance, 2011 (21 of 2011) was promulgated by theGovernor on the 17th day of March, 2011 and the same was published in theKerala Gazette Extraordinary No. 650 dated the 18th day of March, 2011.

5. The Bill is intended to replace Ordinance No. 21 of 2011 by an Act ofthe State Legislature.

THE KERALA LOCAL AUTHORITIES LOANS (AMENDMENT) BILL, 2011

The Kerala Local Government Development Fund (KLGDF), one of thecomponents of the Kerala Sustainable Urban Development Project had to beoperational by December, 2009. An amount of ` 100 crores has been set apartby the Asian Development Bank for the purpose. On the basis of the abovecommitment, the operational policy, procedure and the manual of the KeralaLocal Government Development Fund (KLGDF) has to be finalised. If the sameis not fulfilled, the Government of Kerala will have to pay the commitmentcharges of approximately ` 70 crores to the ADB. The formation of the KeralaLocal Government Development Fund (KLGDF) could be done only byamending the provisions of the Kerala Local Authorities Loans Act, 1963.Hence the Government have decided to amend the Kerala Local AuthoritiesLoans Act, 1963. Therefore the Kerala Local Government Development Fund(KLGDF) is to be established which would get support from the budget and thenraise resources from financial institutions and the market to finance infrastructureprojects of the Local Governments. The fund would have two partstructure—a Board of Management to lay down policy and priorities and aprofessional Asset Management Company to run the operations. The Asset

Management Company will have the majority stake by the Government of Kerala(51%) and the remaining stake (49%) by public sector institutions. Theformation of the Kerala Local Government Development Fund (KLDGF) couldbe done only by amending the provisions of the Kerala Local Authorities LoansAct, 1963. Hence the Government have decided to amend the Kerala LocalAuthorities Loans Act, 1963.

2. As the Legislative Assembly of the State of Kerala was not in sessionand circumstances existed for making immediate legislation for implementing theabove said decision, the Kerala Local Authorities Loans (Amendment) Ordinance,2010 was promulgated by the Governor of Kerala on the 30th day of January,2010 and the same was published as Ordinance No. 11 of 2010 in the KeralaGazette Extraordinary No. 214 dated 30th January, 2010.

3. Though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 318 of the 12th Kerala Legislative Assembly,it could not be introduced in, and passed by, the Kerala Legislative Assemblyduring its session which commenced from 24th day of February 2010 and endedon the 31st day of March, 2010. Therefore the Kerala Local Authorities Loans(Amendment) Ordinance, 2010 was promulgated by the Governor on the 6th dayof April, 2010 and the same was published as Ordinance No. 12 of 2010 inKerala Gazette Extraordinary No. 858 dated 7th April, 2010.

4. Though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 352 of the 12th Kerala LegislativeAssembly, it could not be introduced in, and passed by, the Kerala LegislativeAssembly during its session which commenced on the 28th day of June, 2010and ended on the 29th day of July, 2010. Therefore the Kerala Local AuthoritiesLoans (Amendment) Ordinance, 2010 was promulgated by the Governor on the8th day of August, 2010 and the same was published as Ordinance No. 35 of2010 in the Kerala Gazette Extraordinary No. 1815 dated 8th August, 2010.

5. Though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 378 of the 12th Kerala LegislativeAssembly, it could not be introduced in, and passed by, the Kerala LegislativeAssembly during its session which commenced on the 21st day of December,2010 and ended on the 3rd day of January, 2011. Therefore the Kerala LocalAuthorities Loans (Amendment) Ordinance, 2011 was promulgated by theGovernor on the 22nd day of January, 2011 and the same was published as

6. The Bill seeks to replace Ordinance No. 36 of 2011 by an Act of theState Legislature.

THE KERALA FINANCE BILL, 2012

The Bill seeks to amend the following enactments to give effect to thefinancial proposals of the Government of Kerala for the financial year 2012-13as announced in paras 364, 369, 372 to 394 and 396 of the Budget Speech2012-2013, namely:—

(1) The Kerala Stamp Act, 1959 (17 of 1959);

(2) The Kerala Land Tax Act, 1961 (13 of 1961);

(3) The Kerala General Tax Act, 1963 (15 of 1963);

(4) The Kerala Motor Vehicles Taxation Act, 1976 (19 of 1976);

(5) The Kerala Tax on Luxuries Act, 1976 (32 of 1976);

(6) The Kerala Value Added Tax Act, 2003 (30 of 2004);

(7) The Kerala Finance Act, 2008 (21 of 2008).

THE LEGISLATIVE ASSEMBLY (REMOVAL OFDISQUALIFICATIONS) AMENDMENT BILL, 2012

As per sub-clause (a) of clause (1) of article 191 of the Constitution ofIndia, a person shall be disqualified for being chosen as, and for being, amember of the Legislative Assembly or Legislative Council of a State, if he holdsany office of profit under the Government of India or the Government of anyState specified in the First Schedule other than an office declared by the

Legislature of the State by law not to disqualify its holder. The LegislativeAssembly (Removal of Disqualifications) Act, 1951 has been enacted pursuant tosub-clause (a) of clause (1) of article 191 of the Constitution of India to declarecertain offices as offices which will not disqualify the holders thereof beingchosen as, and for being, members of the Legislative Assembly of the state ofKerala. Clause (i) of sub-section (1) of Section 2 of the said Act inter aliaprovides that a person shall not be disqualified for being chosen as and for beinga member of the Legislative Assembly of the State of Kerala. By reason only thathe is in receipt of the salaries or allowances to which he is entitled under the lawbeing in force relating to the payment of salaries and allowances to members ofLegislative Assembly of the State of Kerala. The payment of Salaries andAllowances Act, 1951 is an enactment to provide for the salaries and allowancesof the Ministers, the Speaker, the Deputy Speaker, the Leader of Opposition, theChief Whip and the members of the Legislative Assembly. In view of the above,all the holders of the above mentioned offices are insulted from disqualificationunder the office of profit. However, taking advantage of the fact that suchoffices have not been specifically mentioned in clause (i) of sub-section (1) ofsection 2 of the Legislative Assembly (Removal of Disqualifications) Act, 1951,doubts have been expressed at some corners that the holders of the offices ofthe Chief Whip and the Leader of the Opposition are disqualified from being aMember of Legislative Assembly. With a view to remove such doubts and toclarify the position, it is necessary to specifically mention the various offices inthe said provision by making amendments in the Legislative Assembly (Removalof Disqualifications) Act, 1951 (XV of 1951) with retrospective effect. In thesecircumstances, Government have decided to amend the Legislative Assembly(Removal of Disqualifications) Act, 1951.

2. As the Kerala Legislative Assembly was not in session and the saidproposal had to be given effect to immediately, the Legislative Assembly(Removal of Disqualifications) Amendment Ordinance, 2011 was promulgated bythe Governor of Kerala on the 10th day of November, 2011 and the same waspublished as Ordinance No. 47 of 2011 in the Kerala Gazette ExtraordinaryNo. 2129 dated the 10th day of November, 2011.

3. A Bill to replace Ordinance No. 47 of 2011 by an Act of the StateLegislature could not be introduced in, and passed by, the Legislative Assemblyduring its Third Session which commenced on the 9th day of December, 2011and ended on the same day itself. As the provisions of the said Ordinance haveto be kept alive, the Legislative Assembly (Removal of Disqualifications)Amendment Ordinance, 2012 was promulgated by the Governor on the 16th day

of January, 2012 and the same was published as Ordinance No. 7 of 2012 in theKerala Gazette Extraordinary No. 121 dated the 18th day of January, 2012.

Though a Bill to replace Ordinance No. 7 of 2012 was published as BillNo. 82 of the 13th Kerala Legislative Assembly, the same could not be introducedin, and passed by, the Kerala Legislative Assembly during its Fourth Sessionwhich commenced on the 1st day of March, 2012 and ended on the 23rd day ofMarch, 2012. Since difficulties would arise, if the provisions of the saidOrdinance were not kept alive, the Legislative Assembly (Removal ofDisqualifications) Amendment Ordinance, 2012 was promulgated by the Governorof Kerala on the 11th day of April, 2012 and the same was published asOrdinance No. 23 of 2012 in the Kerala Gazette Extraordinary No. 725 dated,the 11th day of April, 2012.

5. The Bill is intended to replace Ordinance No. 23 of 2012 by an Act ofthe State Legislature.

THE KERALA HEALTH CARE SERVICE PERSONS AND HEALTH CARESERVICE INSTITUTIONS (PREVENTION OF VIOLENCE AND

DAMAGE TO PROPERTY) BILL, 2012

Various organisations complained that there were attacks against doctors,hospitals and other employees working in hospitals and, submitted representationsbefore the Government to enact a separate law to protect doctors and otheremployees working in health care service institutions and hospitals in the wake ofattacks on them at various parts of the State.

2. The Government became convinced that there is a situation necessitatinga legislation to be made to prohibit violence against health care service personsand to prevent damage and loss to property in health care service institutions.Hence, Government decided to define violence against hospitals and to bringsuch activities within the ambit of a separate law.

3. The Government also decided to make legislation incorporating aprovision that the hospital authorities shall have the responsibility to givecomplete information about treatment, in writing, to the patients who seektreatment in the health care service institutions or to their relatives.

4. As the Kerala Legislative Assembly was not in session and the saidproposal had to be given effect to immediately, “The Kerala Health care ServicePersons and Health care Service Institutions (Prevention of Violence and Damageto Property) Ordinance, 2010” was promulgated by the Governor of Keralaon the 21st day of August, 2010 and the same was published as OrdinanceNo. 51 of 2010 in the Kerala Gazette Extraordinary No. 1959 dated the 26th day

of August, 2010.

5. Even though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 388 of the Twelfth Kerala LegislativeAssembly the same could not be introduced in, and passed by, the LegislativeAssembly during its session which commenced on the 21st day of December,2010 and ended on the 3rd day of January, 2011. Therefore, the Kerala Healthcare Service Persons and Health care Service Institutions (Prevention of Violenceand Damage to Property) Ordinance, 2011 was promulgated by the Governor onthe 22nd day of January, 2011 and the same was published as Ordinance No. 19of 2011 in the Kerala Gazette Extraordinary No. 155 dated the 23rd day ofJanuary, 2011.

6. Even though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 417 of the Twelfth Kerala LegislativeAssembly the same could not be introduced in, and passed by, the LegislativeAssembly during its session which commenced on the 4th day of February, 2011and ended on the 24th day of February, 2011. Therefore, the Kerala Health careService Persons and Health care Service Institutions (Prevention of Violence andDamage to Property) Ordinance, 2011 was promulgated by the Governor on the17th day of March, 2011 and the same was published as Ordinance No. 23 of2011 in the Kerala Gazette Extraordinary No. 622 dated the 18th day ofMarch, 2011.

7. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be published and introduced in, and passed by, the Thirteenth KeralaLegislative Assembly during its first session which commenced on the 1st day ofJune, 2011 and ended on the 24th day of July, 2011. Consequently the saidOrdinance ceased to operate on the 13th day of July, 2011 by virtue of sub-clause (a)of clause (2) of Article 213 of the Constitution of India. Even though theKerala Health care Service Persons and Health care Service Institutions(Prevention of Violence and Damage to Property) Bill, 2011 incorporatingvalidation clause to validate the actions, if any, taken after the Ordinance No. 23of 2011 ceased to operate and omitting clause 6 of the said Ordinance, waspublished as Bill No. 33 of the 13th Kerala Legislative Assembly, the same couldnot be introduced in and passed by the Thirteenth Kerala Legislative Assemblyduring the second session which commenced on the 26th day of September,2011 and ended on the 4th day of November, 2011. Therefore, the KeralaHealth care Service Persons and Health care Service Institutions (Prevention ofViolence and Damage to Property) Ordinance, 2012 was promulgated by theGovernor on the 11th day of February, 2012 and the same was published as

Ordinance No. 20 of 2012 in the Kerala Gazette Extraordinary No. 290 dated the11th day of February, 2012.

8. Even though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 79 of the Thirteenth Kerala LegislativeAssembly the same could not be introduced in, and passed by, the ThirteenthKerala Legislative Assembly during its Fourth session which commenced on the1st day of March, 2012 and ended on the 23rd day of March, 2012. Therefore, theKerala Health care Service Persons and Health care Service Institutions(Prevention of Violence and Damage to Property) Ordinance, 2012 waspromulgated by the Governor on the 11th day of April, 2012 and the samewas published as Ordinance No. 27 of 2012 in the Kerala Gazette ExtraordinaryNo. 729 dated the 11th day of April, 2012.

9. The Bill seeks to replace the said Ordinance by an Act of the StateLegislature.

THE KERALA STATE HOUSING BOARD (AMENDMENT) BILL, 2012

Government have approved a package for the revival of the Kerala StateHousing Board. It envisages for the setting up of housing and commercialcomplexes in different parts of the State through joint venture projects or public-private partnership. As there is no provision in the Kerala State Housing BoardAct, 1971, enabling the Kerala State Housing Board to undertake housing andimprovement schemes through joint venture projects or public-private partnership,Government have decided to insert a new section in the Act for the purpose.

2. As the Kerala Legislative Assembly was not in session andcircumstances existed for making immediate legislation for implementing theabove said decision, the Kerala State Housing Board (Amendment) Ordinance,2012 was promulgated by the Governor of Kerala on the 16th day of February,2012 and published as Ordinance No. 21 of 2012 in the Kerala GazetteExtraordinary No.315 dated 16th February, 2012.

3. A Bill to replace the said Ordinance by an Act of the StateLegislature could not be introduced in and passed by the Legislative Assembly ofthe State of Kerala during its session which commenced on the 1st day of March,2012 and ended on the 23rd day of March, 2012.

4. In order to keep alive the provision contained in the said Ordinanceand as the Legislative Assembly of the State of Kerala is not in session theKerala State Housing Board (Amendment) Ordinance, 2012 was promulgated bythe Governor of Kerala on the 11th day of April, 2012 and the same waspublished as Ordinance No.22 of 2012 in the Kerala Gazette ExtraordinaryNo. 724 dated the 11th day of April, 2012.

THE UNIVERSITY LAWS (AMENDMENT) BILL, 2012

As per the existing provisions of the Kerala University Act, 1974 (17 of1974), the Calicut University Act, 1975 (5 of 1975), the Mahatma GandhiUniversity Act, 1985 (12 of 1985) and the Kannur University Act, 1996 (22 of1996), the upper age limit for the appointment of Pro-Vice-Chancellor is fifty-sixyears. The Government have decided to raise the upper age limit to sixty years.It has also been decided to include a nominee of the students’ representative inthe Syndicate of the Kannur University as in the case of other Universities and tocreate a post of Pro-Chancellor in the Mahatma Gandhi University besidesincorporating provision for inter University transfer to teachers of colleges underthe corporate management subject to certain conditions.

2. Moreover it is felt that representation from the field of HigherEducation covering wide range of subjects is highly essential in the Senate ofthe Kerala University, Kannur University, Mahatma Gandhi University and in theSyndicate of the Sree Sankaracharya University of Sanskrit as the said statutoryauthorities are vested with statutory as well as decision making powers. As themembers from the field of Higher Education are not adequately represented inthe above said authorities, it is decided to include members from that field also.Government have also decided to include a provision regarding the tenure of themembers coming under the heading “Other Members” in the Senate of the KeralaUniversity and Kannur University and tenure of the nominated members in theSenate and Syndicate of Mahatma Gandhi University and tenure of the memberscoming under the heading “Nominated Members” in the Syndicate of the SreeSankaracharya University of Sanskrit. It is also decided to nominate a postgraduate student of the University/Colleges/Centres affiliated to the University, tothe Syndicate of the Sree Sankaracharya University of Sanskrit instead of theexisting student member. Further there is no enabling provision in the SreeSankaracharya University of Sanskrit Act, 1994 (5 of 1994) empowering theGovernment to constitute a University Appellate Tribunal as provided in otherUniversity Acts. Government have, therefore, decided to incorporate a provisionin the Sree Sankaracharya University of Sanskrit Act, 1994 to provide anenabling provision empowering the Government to constitute an AppellateTribunal under the said Act also. The Government have decided to amend therelevant Acts for the above said purposes.

A Bill to replace the said Ordinanceby an Act of the State Legislature could not be introduced in, and passed by, the13th Kerala Legislative Assembly in its session which commenced on the 9th dayof December, 2011 and ended on the same day. Under sub-clause (a) of clause(2) of article 213 of the Constitution of India, the Kerala University(Amendment) Ordinance, 2011 (50 of 2011) ceased to operate on the 20th day ofJanuary, 2012. The Bills to replace the above said Ordinance including the SreeSankaracharya University of Sanskrit (Second Amendment) Ordinance, 2012 (17of 2012) by Acts of the Kerala Legislative Assembly could not be introduced in,and passed by, the Legislative Assembly in its session which commenced on the1st day of March, 2012 and ended on the 23rd day of March, 2012, and in orderto keep alive the provisions of the said Ordinance and whereas it was expedientto codify all the proposals contained in the said Ordinances, the UniversityLaws (Amendment) Ordinance, 2012 (25 of 2012) was promulgated by theGovernor of Kerala on the 11th day of April, 2012 and the same was publishedas Ordinance No. 25 of 2012 in the Kerala Gazette Extraordinary No. 727 datedthe 11th day of April, 2012.

THE COCHIN UNIVERSITY OF SCIENCE AND TECHNOLOGY(SECOND AMENDMENT) BILL, 2012

Representation from the field of Higher Education, which covers wide rangeof subjects, is highly essential in the Senate of the Cochin University of Scienceand Technology, as the said statutory authority is vested with statutory as well asdecision making powers. As the members from the field of Higher Education arenot adequately represented in the Senate, it is necessary to include members fromthat field among the “Other Members” to the Senate. Government have alsodecided to amend the Cochin University of Science and Technology Act, 1986(31 of 1986) to include provisions to make the nominated members eligible forrenomination and to include the chair person of the Kalamassery Municipalityunder ex-officio members of the Senate and to amend the provision regarding thetenure of the members coming under the heading “Other Members” in the Senate.It is therefore, felt necessary to amend the Cochin University of Science andTechnology Act, 1986 (31 of 1986) for the above purposes.

Since a Bill to replace the saidOrdinance by an Act of the State Legislature could not be introduced in, andpassed by, the Legislative Assembly of the State of Kerala in its session whichcommenced on the 9th day of December, 2011 and ended on the same day and inorder to validate the actions taken under the said Ordinance and to keep alivethe provisions of the said Ordinance, the Cochin University and to keep alivethe provisions of the said Ordinance, the Cochin University of Science andTechnology (Amendment) Ordinance, 2012 was promulgated by the Governor ofKerala on the 30th day of January, 2012 and the same was published asOrdinance No. 14 of 2012 in the Kerala Gazette Extraordinary No. 222 dated31st day of January, 2012. Since a Bill to replace the said Ordinance by an Actof the State Legislature could not be introduced in, and passed by, theLegislative Assembly of the State of Kerala in its session which commenced onthe 1st day of March, 2012 and ended on the 23rd day of March, 2012 and inorder to keep alive the provisions of the said Ordinance, the Cochin Universityof Science and Technology (Amendment) Ordinance, 2012 was promulgated bythe Governor of Kerala on the 11th day of April, 2012 and the same waspublished as Ordinance No. 24 of 2012 in the Kerala Gazette Extraordinary No.726 dated 11th day of April, 2012.

THE KERALA CO-OPERATIVE SOCIETIES (AMENDMENT) BILL, 2012

As per the existing proviso to clause (oc) of section 2 of the KeralaCo-operative Societies Act, 1969, the Primary Co-operative Agricultural andRural Development Banks having area of operation in more than one Taluk shallrestrict their area of operation within one Taluk, within six months from the dateof commencement of the Kerala Co-operative Societies (Amendment) Act, 1999.However, such societies did not comply with the said stipulation. Therefore, theGovernment decided to amend the Kerala Co-operative Societies Act, 1969(21 of 1969) suitably so that the assets and liabilities of such societies shall bebifurcated to form new societies and the existing committees of the societies areto be declared void whereby the management of the existing societies shall beentrusted with a Special Officer to be appointed by the Registrar. It was alsoproposed to make necessary provisions in the Act to constitute committees as

provided in section 28 of the Act within a period of six months.

2. As the Legislative Assembly was not in session, and as the saidproposals had to be given effect to immediately, the Kerala Co-operativeSocieties (Third Amendment) Ordinance, 2011 was promulgated by the Governoron the 12th day of August, 2011 and was published as Ordinance No. 45 of 2011in the Kerala Gazette Extraordinary No. 1534 dated 12th August, 2011.

3. A Bill to replace the said Ordinance by an Act of the StateLegislature could not be introduced in, and passed by, the Kerala LegislativeAssembly in its session which commenced on the 26th day of September, 2011and ended on the 4th day November, 2011. The said Ordinance ceased to operateon the 7th day of November, 2011 by virtue of the provisions contained in sub-clause (a) of clause (2) of article 213 of the Constitution of India.

4. As the Legislative Assembly of the State of Kerala was not insession and as it was highly necessary to keep alive the provisions of the saidOrdinance and to validate the actions taken under the said Ordinance, the KeralaCo-operative Societies (Third Amendment) Ordinance, 2011 was promulgated bythe Governor on the 18th day of November, 2011 and published as Ordinance No.51 of 2011 in the Kerala Gazette Extraordinary No. 2173 dated the 18th

November, 2011.

5. A Bill to replace the said Ordinance by an Act of the StateLegislature could not be introduced in, and passed by, the Kerala LegislativeAssembly in its session which commenced on the 9th day of December, 2011 andended on the same day.

As the Legislative Assembly of the State of Kerala was not insession and as it was highly necessary to keep alive the provisions of the saidOrdinance, and to extend the time limit fixed for completing the bifurcation ofthe areas, assets and liabilities of existing societies from six months to one yearthe Kerala Co-operative Societies (Amendment) Ordinance, 2012 waspromulgated by the Governor on the 19th day of January, 2012 and published asOrdinance No. 9 of 2012 in the Kerala Gazette Extraordinary No. 146 dated the20th January, 2012.

It was also proposed to amend section 2 of the Kerala Co-operativeSocieties Act, 1969 (21 of 1969) for substituting clause (ia) and to omit thesecond and third proviso to sub-section (1) of section 18 which deals with theadmission of nominal or associate members in the District Co-operative Banksand Hospital Co-operative Societies and to insert sub-sections (1-F) and (1-G) insection 28 of the Act so as to reserve two seats in the committee for depositorsin the Bank, two seats for persons who possess experience in banking or

professional qualification and to insert sub-sections (1-H) and (1-I) in section 28of the above said Act to make provisions for ensuring that at least one seat inrespect of each Taluk be reserved for the representatives of Primary AgriculturalCredit Society in the committee of the District Co-operative Bank and also toensure that at least four seats in the committee of the District Co-operative Bankare reserved for other types of Co-operative Societies as members in the DistrictCo-operative Banks. As the Legislative Assembly was not in session and as theproposals had to be given effect to immediately the Kerala Co-operative Societies(Second Amendment) Ordinance, 2012 was promulgated by the Governor on the11th day of February, 2012 and published as Ordinance No. 18 of 2012 in theKerala Gazette Extraordinary No. 288 dated the 11th February, 2012.

8. Bills to replace Ordinance No. 9 of 2012 and Ordinance No. 18 of2012 by Acts of the State Legislature could not be introduced in, and passed bythe Legislative Assembly of the State of Kerala during its fourth sessionwhich commenced on the 1st day of March, 2012 and ended on the 23rd day ofMarch, 2012.

9. As the Legislative Assembly was not in session and as it was highlynecessary to keep alive the provisions of the above said Ordinance and in orderto combine the proposals contained in both the Ordinances with certainmodifications the Kerala Co-operative Societies (Amendment) Ordinance, 2012was promulgated by the Governor of Kerala on the 11th day of April, 2012 andwas published as Ordinance No. 26 of 2012 in the Kerala Gazette ExtraordinaryNo. 728 dated 11th April, 2012.


THE KERALA RIGHT TO SERVICE BILL, 2012

Good governance is essential for sustainable development on both economicand social arena of public life. The three essential elements of good governanceare transparency, accountability and responsiveness of the administration. Toimprove and strengthen the relationship between the citizens and the serviceproviders, the Government of Kerala have already introduced the Citizens Charterbased on the recommendations of the Third Kerala Administrative ReformsCommittee and to ensure transparency in administration, the right to InformationAct, 2005 (Central Act 22 of 2005) is in force.

2. To provide for the effective and time bound redressal of grievancesof citizens and for delivery of services to the general public within stipulated

time limit and to make the Government servants liable in case of their default, theGovernment have decided to enact a legislation as a part of its one hundreddays’ programme so as to create a system, whereby the general public can makethe Government servants answerable in terms of their functions, duties,commitments and obligations towards the people and also to make them aware ofthe rights, obligations and entitlements in relation to these, the Government ofKerala is committed to bring out a legislation.

3. By the proposed legislation, the Government intend to guarantee thedelivery of public services like the issuance of Birth Certificates, CasteCertificates, Income Certificates, Ration Cards, Domicile Certificates, DeathCertificates, Electricity connection and Water connection to houses and shops,Passport verification report, Job verification report etc. which will be notifiedunder the proposed law. A time limit will be fixed for the delivery of eachservice. If the officials fail to perform their duties and provide such notifiedservices within such time they will be liable to pay fine. The Bill also providesfor appeal at two levels. The proposed legislation intends to check delay inproviding service to the general public.

The Bill is intended to achieve the above objects.

THE KERALA APPROPRIATION (NO. 2) BILL, 2012

The Bill is introduced in pursuance of Clause (1) of Article 204 of theConstitution of India, to provide for the appropriation out of the ConsolidatedFund of the State of Kerala of the moneys required to meet the expenditurecharged on the Consolidated Fund of the State and the grants made in advanceby the Legislative Assembly in respect of the estimated expenditure of theGovernment of Kerala for the Financial Year 2012-2013.

THE COMMONWEALTH TRUST, KOZHIKODE (ACQUISITION ANDTRANSFER OF UNDERTAKING) BILL, 2012

The Handloom Weaving Factory at Mananchira unit of CommonwealthTrust (India) Ltd. remains closed since 1st February, 2009. The efforts taken bythe Government to get the undertaking revived with the co-operation of theexisting management became futile.

2. In order to make a solution in the case of Handloom WeavingFactory at Mananchira, Government consider it necessary to acquire and transferthe said company and the right, title, interest of the owner in respect of the saidundertaking with a view to reorganize and rehabilitate the undertaking and toestablish an Industrial Museum and Productive Centre under the Kerala StateIndustrial Development Corporation Limited (KSIDC).
