ASSEMBLY FROM 3RD JUNE 1985 TO 19TH JULY 1985 ---------

I. SUMMONS

Summons for the Second Meeting of the First Session of Eighth Legislative Assembly were issued to the Members on the 24th May 1985 in D.O. No.10541/85-1 TNLAS(BI), dated 24th May 1985.

II. DURATION OF THE MEETING

The Second Meeting of the First Session of the Eighth Legislative Assembly commenced on the 3rd June 1985 was adjourned sine die on the 19th July, 1985.

III. PROROGATION The First Session of the Eighth Tamil Nadu Legislative Assembly was prorogued with effect from 6th September 1985- vide S.O. MS. No.226 Legislative Assembly Secretariat, dated 6th September 1985.

IV. SITTING OF THE ASSEMBLY The Tamil Nadu Legislative Assembly met for 33 days during the period from 3rd June 1985 to 19th July 1985 on the following days:- 3rd June 1985, 4th June 1985, 5th June 1985, 6th June 1985,7th June 1985, 10th June 1985, 11th June 1985 , 12th June 1985, 13th June 1985, 14th June 1985,17th June 1985,18th June 1985, 19th June 1985,24th June 1985,25th June 1985, 26th June 1985, 27th June 1985, 28th June 1985, 1st July 1985,2nd July 1985,3rd July 1985,4th July 1985,5th July 1985, 8th July 1985,9th July 1985,10th July 1985,11th July 1985,12th July 1985, 15th July 1985, 16th July 1985,17th July 1985, 18th July 1985 and 19th July 1985. It also met in the evening for 4 days on the following dates:- 25th June 1985, 27th June 1985, 11th July 1985, and 18th July 1985. In terms of hours it sat for 175 hours and 10 minutes.

The Members stood in silence for two minutes as a mark of respect to the deceased. Obituary reference was also made in the House on the 24th June 1985 by

Hon.Speaker to the persons who lost their lives in the Air-India Jumbo Jet "Kanishka" which crashed in Atlantic Ocean with 329 passengers on board. The Members stood in silence for two minutes as a mark of respect to the deceased.

VI. QUESTIONS

Six hundred and sixty-five Starred Questions and Seven Short Notice Questions were answered on the floor of the House. One hundred and twenty five Unstarred Questions were placed on the Table of the House.

VII. STATEMENT MADE BY MINISTER UNDER RULE 111 (OLD RULE 106) OF THE TAMIL NADU LAGISLATIVE ASSEMBLY RULES.

During the period under review nine statements were made under Rule 111(Old Rule

106) of the Tamil Nadu Legislative Assembly Rules:- (1) On the 17th June 1985, Hon. Minister for Local Administration made a statement in regard to certain decisions taken at the Meeting of the Madras Metropolitan Development Authority on 14th June 1985. (2) On the 18th June 1985, Hon. Minister for Transport made a statement in regard to enhancement of Bus fares in the other Transport Corporation in the Districts of Tamil Nadu as was done in the case of Pallavan Transport Corporation in Madras city.

(3) On the 1st July 1985, Hon. Minister for Electricity made a statement in regard to the relaxation of power cut in Tamil Nadu due to the setting in of South West Monsoon in Tamil Nadu.

(4) On the 5th July 1985, Hon. Minister for Transport made a statement in regard to the Purchase of a ship by the Poompuhar Shipping Corporation.

(5) On the 8th July 1985, Hon. Minister Public Works made a statement in regard to release of water from Mettur Dam for the benefit of Agriculturists in Thanjavur district.

(6) On the 9th July 1985, Hon. Minister for Industries made a statement in regard to the fire accident on 2nd July 1985 in the Pugalur Paper Mill.

(7) On the 15th July 1985, Hon. Minister for Labour made a statement in regard to the strike notice given by the Textile Workers in Tamil Nadu.

(8) On the 15th July 1985, Hon. Minister for Co-operation made a statement in regard to the adoption of a new procedure relating to the repayment of loans by the Members of the Co-operative Societies.

(9) On the 16th July 1985, Hon. Minister for Health made a statement in regard to the cancellation of 30 per cent seats reserved in the Tamil Nadu Medical Colleges for the all India students. VIII. STATEMENT MADE BY MINISTER UNDER RULE 112 (OLD RULE 107) OF

THE TAMIL NADU LEGISLATIVE ASSEMBLY RULES

During the period under review, three statements were made under Rule 112 (Old Rule 107) of the Tamil Nadu Legislative Assembly Rules:-

(1) On the 4th July 1985, Hon. Minister for Industries made a statement correcting the

answer given to a starred question No.239 answered on the floor of the House on 9th March 1984.

(2) On the 8th July 1985,Hon. Minister for Public Works made a statement correcting the answer given to a question answered on the Floor of the House on 8th July 1985 in regard to the level of water in Mettur Dam.

(3) On the 15th July 1985, Hon. Minister for Transport made a statement in connection with an answer given to a starred question answered on the Floor of the House on 12th July 1985.

IX. STATEMENT MADE BY MINISTER UNDER RULE 238 OF THE TAMIL NADU LEGISLATIVE ASSEMBLY RULES

On the 8th July 1985, Hon. Minister for Transport made a statement under newly

incorporated Rule 238 in regard to the creation of 'Theeran Chinna malai Transport Corporation' in Tiruchirappalli with effect from 1st April 1985.

X. ADJOURNMENT MOTIONS

The Tamil Nadu Appropriation (No. 2) Bill, 1985 (L.A. Bill No. 41 of 1985), relating to the Budget for the year 1985-86 was introduced in the Assembly on the 12th July 1985 and it was taken up for consideration on the 15th July 1985 and it was passed on the same day.

XIV. GOVERNMENT RESOLUTIONS (1) On the 28th June 1985, Hon. Dr. V.R. Nedunchezhiyan, Minister for Finance moved the following resolution:-

"That this House resolves to recommend to the Hon. Speaker its wishes to convey its tributes and encomiums to Thiru G.M. Alagarsamy, B.A., B.L., on his attainment of superannuation on 30th June 1985 for having served both Houses of the Legislature for a long period of 30 years and as Secretary to this august House since 1976, and places on record its deep appreciation of his distinguished and meritorious services which by his deep and great knowledge of the law and custom of the Legislature and Parliament, he has rendered with unswerving devotion in the conduct of the business of this House and its Committees and for the assistance given to all Members, of the House during his long service from 1955 to 1985, all of which have been spent at the Table". Hon. Leader of the House, Thiru N.S.V. Chithan and Hon. Speaker took part in the discussion. The Resolution was then put to vote of the House and adopted. (2) On the 18th July 1985, Hon. Thiru P.U. Shanmugam, Minister for Local Administration moved the following four Resolutions:- (i) "That in pursuance of sub-section (1) of section 4 of the Tamil Nadu Panchayats Act, 1958 (Tamil Nadu Act XXXV of 1958), the House do resolve that the existing area covered by Manali Town Panchayat, Chinnasekkadu town Panchayat, Sadayankuppan Village Panchayat, Kadappakkam Village Panchayat including Elandancheri Village in

Pozhal Panchayat Union in Chengalpattu district, which is an industrial colony, be declared to be a township". (ii) "That in pursuance of sub-section (1) of section 4 of the Tamil Nadu Panchayats Act, 1958 (Tamil Nadu Act XXXV of 1958), the House do resolve that the entire area comprised in Potheri, Kattankolathur, Ninakarai Peramaur, Keliventhapattu, Thirukachiyur and Sengundram village Panchayats in Kattankolathur Panchayat Union in Chengalpattu District which is an industrial colony be declared to be a township". (iii) "That in pursuance of sub-section (1) section 4 of the Tamil Nadu Panchayats Act, 1958 (Tamil Nadu Act XXXV of 1958), the House do resolve that the entire area comprised in Ward Nos. 6, 7 and 8 of Punjai Pugalur town Panchayat in Karur Panchayat union in Tiruchirappalli district which is an industrial colony, be declared to be a township". (iv) "That in pursuance of sub-section (1) of section 4 of the Tamil Nadu Panchayats Act, 1958 (Tamil Nadu Act XXXV of 1958), the House do resolve that the existing Velankanni Panchayat in Nagapattinam Panchayat Union in Thanjavur district, which is an institutional colony, be declared to be a township". Thiruvalargal G.K.J. Bharathi, S. Balan, G. Veeraiyan and A.K.A. Abdul Samad took part in the discussion. Hon. Thiru P.U. Shanmugam, Minister for Local Administration replied to the debate. The above Four Resolutions were put to Vote of the House and adopted.

XV. GOVERNMENT MOTIONS

(1) Election of a Member to the Board of Management of the Tamil Nadu Agricultural University:- On the 13th June 1985, Hon. Dr. K. Kalimuthu, Minister for Agriculture moved the following motion:- "That, in pursuance of clause (h) under the heading "Class II Other Members' of sub-section (2) of Section 18 of the Tamil Nadu Agricultural University Act, 1971 (Tamil Nadu Act 8 of 1971), this Assembly do proceed, on a date to be fixed by the Hon. speaker, to elect one member from among themselves to the Board of Management of the Tamil Nadu Agricultural University to fill up the vacancy caused by Thiru M. Chinnaraj, M.L.A., ceasing to be a member of the said Board of Management". The Motion was put to vote and carried. On the 1st July 1985, Hon. Leader of the House (Minister for Finance) moved the following Motion: "That the Report of the Committee of Privileges of the Seventh Assembly on "Vaniga Ottrumai" presented to the House on 28th March 1984 be taken into consideration under Rule 255 (b) of the Tamil Nadu Legislative Assembly Rules.

The Motion was put to vote and carried. (3) On the 1st July, 1985, Hon. Leader of the House (Minister for Finance) moved the following Motion:- This House resolves that Thiru Paul Raj, Editor and Publisher of Vaniga Ottrumai, a Tamil monthly be sentenced to two weeks simple imprisonment and therefore be arrested and lodged in Central Jail, Madras for having committed a breach of privilege of the House."

The Motion was put and carried.

(4) On the 9th July 1985, Hon. Leader of the House (Minister for Finance) moved that Rule 32 of the Tamil Nadu Legislative Assembly relating to time for Questions be suspended on 10th July 1985 and the House do resolve to transact Government Business viz., Discussion and Voting of Demands for Grants for the Year 1985-86." The Motion was put and carried. (5) On the 18th July 1985, Hon. Minister for Electricity moved the following Motion: "That the Rule 33 of the Tamil Nadu Legislative Assembly Rules be suspended and the House do resolve to transact Government Business." The Motion was put and carried (6) On the 19th July 1985, Hon. Leader of the House (Minister for Finance) moved the following Motion: "The under Rule 25 (1) of the Tamil Nadu Legislative Assembly Rules, the House be adjourned sine die." The Motion was put and carried.

XVI. PRIVILEGE MATTERS

(1) On the 19th June 1985, Hon. Speaker announced that under rule 247 of the Tamil

Nadu Legislative Assembly Rules, Thiruvalargal N.S.V. Chithan, G.K.J. Bharathi and S. Jeyachandran have given notices of privilege against "Thuglak", a Tamil fortnightly, for having published derogatory and disparaging remarks about Members of the Legislature in its issue dated 15th June 1985. Under Rule 251 of the Tamil Nadu Legislative Assembly Rules Hon. Speaker held that the matter requires the intervention of the House and allowed Hon. Leader of the House to move the following Motion:- "That the matter relating to the publication of Cartoon and caricature and questions and answers in its (Thuglak) issue dated 15th June 1985 amounts to reflection on Members of the House and therefore, the matter be referred to the 'Committee of Privileges' for its examination and report". The Motion was put and carried.

(2) On the 1st July 1985, Thiru Durai Govindarajan raised a matter of privilege against "Thuglak", a Tamil fortnightly for having published derogatory remarks and cartoons and caricature in its issue dated 1st July 1985, Hon. Speaker suo moto referred this matter also to the "Committee of Privileges for its examination and report. (3) On the 2nd July 1985, Thiru M. Chinnaraj raised a matter of privilege against "Dinakaran" and "Murasoli" Tamil Dailies and against Thiru M. Karunanidhi, M.L.C. for having published wrong information regarding the petitions presented to Hon. Chief Minister by the Members of the House, in the House itself. Hon. Speaker announced that he would give his ruling after ascertaining explanations from the concerned. (4) On the 16th July 1985, Hon. Speaker announced that in connection with the matter of privilege raised on 2nd July 1985, he has obtained explanations from the concerned and ruled that there is breach of privilege in this issue, Hence he has referred the issue in respect of Thiru M. Karunanidhi M.L.C., to the Chairman Legislative Council and in respect of Thiru Murasoli Maran, M.P., to the Chairman, Rajya Sabha for necessary action at their end. And Thiru M. Chinnaraj moved that issue relating to the matter of privilege against "Dinakaran" a Tamil Daily be referred to the Committee of Privileges for its examination and Report." The Motion was put and carried.

XVII. ELECTION TO THE BOARD OF MANAGEMENT OF THE TAMIL NADU AGRICULTURAL UNIVERSITY AND TO THE SENATE OF THE TAMIL

UNIVERSITY, THANJAVUR

(1) Election to the Board of Management of the Tamil Nadu Agricultural University. On the 24th June 1985, Hon. Speaker announced to the House that Thiru P. Anbazhagan was elected to the Board of Management of the Tamil Nadu Agricultural University with reference to his announcement on the 13th June 1985. (2) Election to the Senate of the Tamil University, Thanjavur.

On the 18th July 1985, Hon. Speaker announced to the House that Thiruvalargal S. Rajaraman and T. Marimuthu were elected to the Senate of the Tamil University, Thanjavur with reference to his announcement on 12th July 1985.

XIX. ANNUAL FINANCIAL STATEMENT FOR 1985-86 AND SUPPLEMENTARY FINANCIAL STATEMENT

FOR 1984-85 OF THE TAMIL NADU ELECTRICITY BOARD

The discussion on the Annual Financial Statement for 1985-86 and the Supplementary Statement for 1984-85 of the Tamil Nadu Electricity Board was initiated by Hon. Thiru S. Ramachandran, Minister for Electricity on the 18th July 1985 and the discussion took place for two days viz., 18th and 19th July 1985, Nineteen Members took part in the discussion, Hon. Minister for Electricity replied to the debate,

XX. SPECIAL REFERENCE. On the 18th June 1985, Hon. Leader of the House congratulated Thiru Rajiv Gandhi, Prime Minister of India for his successful tour of Russia, America and other States abroad, Hon. Speaker also, on behalf of the Tamil Nadu Legislative Assembly, and himself congratulated the Prime Minister.
