Public Sector Rich List 2009

In November 2006 the TaxPayers’ Alliance produced the first ever list of the most highly paid executives in the public sector. Now in its fourth edition, the Public Sector Rich List is not only more detailed and exhaustive, it also feeds into a public debate that has changed markedly over the past eighteen months. Since the financial crisis, all parties are now fully committed to tackling the problem of excessive public sector pay, responding to anger at public sector fat cats whose fortunes have seemed unaffected by the recession. Harriet Harman recently blocked a £185,000 salary for the new Chief Executive of the Equality and Human Rights Commission. George Osborne has said that “anyone who wishes to pay a public servant more than the Prime Minister will have to put it before the Chancellor”.1 Vince Cable has said that “pay restraint should start at the top”.2

The key findings of the research are: There are at least 805 people receiving remuneration packages of £150,000 or

more a year across 358 government departments, quangos, public corporations, other public bodies and nationalised industries. For reference, there were 124 people earning more than £150,000 in this year’s Town Hall Rich List which covered 2007-08.3

The key difference with this year’s Rich List is that it includes the top employees from the state controlled banks. The most highly paid person in the public sector this year is therefore Mark Fisher of the Royal Bank of Scotland, whose remuneration was £1,388,000.

sector, earning £1,309,000. Gordon Brown is the 324th highest paid person in the public sector. The average total remuneration of the 805 people on the list is almost £226,055

By comparison, according to the Institute of Directors, a managing director of a private organisation with a turnover of between £50 million and £500 million could expect to earn £141,440 and an executive director £87,000.4

Even without the bankers, the average remuneration package on our list is £209,224.

The BBC has at least 53 people on £150,000 or over. Transport for London has

50 members of staff on or above £150,000. In comparison, the Treasury, the main Government department responsible for tackling the recession, has a modest 3 people in the Rich List.

There are 8 people in the public sector who earn more than £1 million a year,

compared with 4 people last year. There are 35 people in the public sector earning above £500,000 a year compared

with 21 last year. There are 120 people earning above £250,000 a year compared with 88 last year.

The average pay rise of the people with remuneration for 2007-08 and 2008-09 is

5.4 per cent. This is compared to a pay rise of 2.7 per cent for a nurse and 2.3 per cent for a teacher.5

Explanation of the 2009 figures The number of people on £150,000 or over in this survey is much larger than in previous Public Sector Rich Lists. This is because: The TaxPayers’ Alliance has carried out detailed surveys of the semi-autonomous state, allowing us to get a more realistic picture of executive pay in the public sector. More information was available than in previous years. For example, only eight of the fifty-three BBC employees on this year’s list came from their accounts; forty-five came from a Freedom of Information response that would have been missed in other years. Similarly, the state controlled banks are only required to publish the remuneration packages of employees who are also directors. We have looked extensively at NHS Trusts after work done by the TaxPayers’ Alliance in this area. The figures are therefore not directly comparable with previous editions of the Rich List

John O’Connell, Policy Analyst at the TaxPayers’ Alliance, said: “Executive pay in the public sector is completely divorced from the reality of Britain’s fiscal crisis. Ordinary families, struggling to make ends meet in the recession, don’t pay their taxes to fund gold-plated deals for public sector fat cats. All parties now agree that excessive pay packages must be tackled but the time for action is now, not next year. Taxpayers want genuine transparency, accountability and restraint in setting top public sector pay.”

Further details This note outlines the need for the TaxPayers’ Alliance Public Sector Rich List, its scope, and an explanation of the methodology used to compile the data. Table 1 shows the Top 10 remuneration packages in the public sector excluding the employees of state controlled banks. Table 2 shows the Top 10 remuneration packages for the employees of state controlled banks. Table 3 is the Public Sector Rich List in full, showing the remuneration details of 805 public sector workers earning £150,000 or more.

Purpose of the Public Sector Rich List The annual Public Sector Rich List is compiled by the TaxPayers’ Alliance for two reasons: Transparency and accountability. People and organisations that depend on

taxpayers’ money should be accountable to the public and industries they serve. In order to judge whether organisations and officials represent good value for money, taxpayers must have access to as much information as possible. The remuneration of senior executives is one important part of that. Although relevant details are published in annual corporate documents, there is no official register where details are consolidated to give a picture of the public sector as whole. Nor are they required to report details of senior remuneration in a standardised format. The Public Sector Rich List does so. Moreover, official remuneration reports are often complicated and unclear. The Public Sector Rich List aims to provide clear and concise data for all the individuals included, in one document.

Identifying rewards for failure. In too many cases, senior public sector officials

are paid over the odds for their performance. High salaries and bonuses are only legitimate if they are linked to results. Generous pay offs for staff who have failed are entirely unwarranted, as are the non-executive board positions – and even sometimes actual public sector executive roles – that such failed managers often move onto. The Public Sector Rich List enables the public to identify those individuals who have been excessively rewarded. Examples may include the Medical Directors and Chief Executives of NHS Trusts in which health regulators have found hospitals to be providing an inadequate level of care and protection.

Scope of the Public Sector Rich List 2009 The Rich List covers executives earning over £150,000 in all public sector organisations except local authorities.6

Types of organisations included in the Public Sector Rich List are: Central government departments and executive agencies; Non-departmental public bodies, public corporations and other quangos;

Companies in which the Government holds a controlling stake, including financial institutions;

NHS Trusts and Strategic Health Authorities; Police forces and emergency services. Every year the number of individuals on this list increases, driven in part by the continued growth of the state (last year for instance it assumed control over four banks) and the increases in pay for existing senior executives. The total number of people detailed in the Rich List will always be a conservative estimate for the number earning over £150,000 in the public sector. The Rich List does not include GPs, consultants and various other medical practitioners, nor judges and magistrates. Also, some public sector organisations continue to withhold information about their high earning employees, such as the BBC withholding pay details of ‘talent’. Others, such as Transport for London, do not produce detailed remuneration reports. Additionally, many public sector organisations have not yet released their annual accounts for 2008-09. Many NHS Trusts and the Metropolitan Police Service are particularly culpable for this.

Queries over the public sector status of some organisations The public sector status of several bodies has in the past been questioned. For these organisations we provide a justification for inclusion below. Royal Mail Holdings plc is classified by the Office for National Statistics and the

Government’s Shareholder Executive as a Public Corporation (a market body controlled by the UK Government) whose assets and liabilities fall within the Whole of Government Accounts.7

“The Government owns 100 per cent of Royal Mail Holdings plc’s shares. The Secretary of State for Business, Enterprise and Regulatory Reform owns 50,004 ordinary shares plus 1 special share and the Treasury Solicitor holds 1 ordinary share. The special share relates to areas where special shareholder consent is required, including major transactions, board appointments/remuneration and borrowing.” 8

Channel Four Television Corporation is listed in the DCMS’s Consolidated Resource Accounts 2007-08 as a “public corporation”.9

a statutory corporation without shareholders established under the Broadcasting Act 1990. DCMS is Channel 4’s sponsoring Department.”10

Network Rail consistently refuses to accept its status as a public sector organisation, maintaining that it is a private sector operation. However we, along with most people, believe the private sector classification for Network Rail is simply a convenient way for the Government to hide Network Rail’s debt, which along with direct grants from the Department for Transport, appear to be key financing mechanisms for Network Rail. More importantly though, on 28 June 2002, a National Audit Office press release stated: “Sir John Bourn, the Comptroller and Auditor General, has concluded that Network Rail should be accounted for as a subsidiary of the Strategic Rail Authority (SRA) and should be consolidated into the SRA’s accounts. He makes this judgement in his capacity as statutory auditor of the SRA. Sir John’s view is that the Government’s interest in Network Rail is akin to an equity shareholder’s interest.”11

In other words, the National Audit Office considers Network Rail to be a public sector body. (There are have been no substantive changes in the relationship between Government and Network Rail since 2002 that might change this judgement.)

In February 2007, then Leader of the Commons Jack Straw said: “We brought Network Rail into public ownership.” In October 2005 Transport Secretary Stephen Byers told the House of Commons he made “no apology” for his decision to place Railtrack in administration and “for unwinding the Tory privatisation that was Railtrack” (Network Rail). David Greene, a partner of Edwin Coe, the law firm which represented the interests of small shareholders in Railtrack, is in no doubt about the infrastructure company’s status: “Railtrack was a last minute privatisation under the Tory administration and it had shareholders. It was subsequently renationalised by the Government in a different guise as Network Rail without shareholders. The reason this long-running debate continues is that the Treasury wants its finances off the Government’s balance sheet.”12

The Royal Bank of Scotland Group, Lloyds Banking Group, Bradford and Bingley and Northern Rock are now part owned by the British taxpayer. At 30 June 2009, the state held the equivalent of 70 per cent of the RBS voting share capital, and 43 per cent of the Lloyds voting share capital.13

With further share purchase through the Asset Protection Scheme, the state’s holding in both banks increased substantially. As the UK Government is now the controlling stakeholder in both banks, they are effectively part nationalised and therefore within the scope of this report. Further, the

Office for National Statistics now counts workers from the banks as public sector employees.14

Sources and Methodology 1. Our 2009 list is considerably larger that our 2008 list. The TaxPayers’ Alliance has carried out extensive work on the scope and extent of the semi-autonomous state and this has allowed us to get a more realistic picture of executive pay in the public sector. 2. Total remuneration includes salary, bonuses, incentive plans, benefits-in-kind and (where made clear in the accounts) pension contributions. We are not just referring to basic salary, but the total amount paid to an individual by the taxpayer. 3. The average pay rise has been calculated by filtering out all of those people on the list who have disproportionately large percentage pay increases (50 per cent or above) to offer a fair figure. This is because some people did not have full year remuneration for 2007-08, as they may have only worked part of the year. 4. All the figures used are sourced from official publications, in almost all cases the annual reports/accounts of the organisations themselves. The figures for the majority of the BBC staff are from an FOI response. The response is dated 7th May 2009, and is the most robust source of the top 50 remuneration packages at the BBC. We have therefore used these figures for the Public Sector Rich List 2009, although they may not exactly reflect remuneration for the 2008-09 financial year. 5. Most of the organisations listed use financial years in their annual reports/accounts, although a few use calendar years, most notably the nationalised banks and Channel 4. In these cases, the annual reports for the calendar year 2008 were used. 6. As stated above, this year’s Rich List contains staff from the nationalised banks. They are written in red in the table. 7. In some cases, the names of individuals are not included in the remuneration reports, and this is identified in the tables where appropriate. This is especially prevalent with Transport for London, who do not disclose the full remuneration details of any members of staff except for the Commissioner. 8. Some of the 2007-08 remuneration packages are not applicable, for example because the individual had not yet joined the organisation. Hence they are represented by “-” and

there is no calculation made for the percentage increase in remuneration between the two years, and are not included in the average percentage increase calculation. 9. In certain cases the individual was not with the organisation for the full year in one of the two years. Wherever possible we have listed to exact remuneration received by the individual in each relevant year. In these instances, there are disproportionately large percentage increases, and where available the individual’s start date is included in the notes. 10. There are a small number of cases where the individual has held two positions in the same organisation in the same year, and where the actual remuneration (as opposed to a full-year equivalent) from each position is listed in the annual reports/accounts. 11. In most cases remuneration figures in annual reports/accounts are given within ranges of £5,000 (for example £160,000-£165,000) or £10,000 (for example £160,000-£170,000). We take the midpoint of any range (for example £162,500 or £165,000). Any other items of remuneration are then added to this midpoint figure. 12. In some cases, the remuneration was paid by an organisation to a third party agency, and may therefore not exactly reflect what the individual earned. For example some consultants are employed to carry out roles such as Human Resources Managers. Payment for these individuals often includes an agency fee and is paid directly to the third party. These people are written in blue in the table. 13. As stated above, we have not included the senior staff in local authorities. We publish an annual “Town Hall Rich List” which details Council staff earning £100,000 or more. In our latest report (covering the financial year 2007-08) 124 people were earning more than £150,000. 14. There have been recent newspaper reports of a growing number of GPs earning at least £250,000 a year. These are unfortunately not included on the list as we have no way of obtaining their names. We do, however, include a number of Medical Directors of NHS Trusts, and include in their remuneration packages remuneration from clinical duties, as listed in the relevant annual reports/accounts. 15. Data from 358 public sector organisations are included on the list. We would welcome any additions that can be sent in. 16. We are not responsible for the accuracy of information contained within official reports and accounts, but we are happy to make any corrections to the details of anyone named in the Public Sector Rich List.
