USAID/Macedonia anticipates awarding a firm fixed price purchase order with a period of performance of eight months from the date of award as a result of this solicitation. Competition under this procurement will be limited to local organizations. SECTION C – DESCRIPTION / SPECIFICATIONS / STATEMENT OF WORK C.1 STATEMENT OF WORK C.1.1 BACKGROUND In 2017, USAID Macedonia was selected as one of three USAID Missions worldwide to receive funding to implement a localworks program in Macedonia. Localworks is about tapping into the creativity and resources of local communities and enabling them to drive their own development. Through localworks, USAID employs a wholesale approach that encourages local resource organizations to play the role of a facilitator and enable interaction between key local actors. In focusing on key players, the idea is to strengthen an expansive network of local actors that will eventually become self-sustained. USAID Macedonia is currently in the preparatory stage of designing its localworks program. Per the localworks guidance, USAID Missions begin localworks by listening to a broad range of ordinary people and local organizations to better understand their development priorities, how they define challenges and opportunities, and how they work to meet them. As Missions listen, they continue learning about the formal and informal rules, regulations and customs as well as the economic, cultural, ethnic, and other factors that define local systems. Localworks emphasizes listening without a specific sector or design agenda. Open-ended listening enables us to hear more clearly what is most important to local organizations and people, and yields broader insights. C.1.2 SCOPE OF WORK AND DELIVERABLES The Contractor shall: 1. Arrange meetings for the USAID localworks team with key stakeholders and actors, which

entails:

Identifying and proposing to USAID potential organizations, informal groups, and/or individuals for meetings, particularly at local level

Organizing and arranging logistics for meetings in various locations and venues with organizations, informal groups, and/or individuals identified by USAID localworks team; - Establishing initial contact, agreeing meeting dates, times, venues and agendas in consultation with the localworks team

Taking detailed meeting notes and preparing them electronically in English language; Maintaining an electronic log of conducted meetings and all participants Provide interpretation services as needed in one or more languages (Macedonian, English,

Albanian, Turkish, and Roma - depending on the meetings’ participants) Deliverables (section 1):

Up to 25 meetings organized for the USAID localworks team with the key local actors during the period of performance. Meetings will be one on one discussions between USAID and CSO or informal groups representatives, preferably at in their premises.

Electronic log of conducted meetings prepared that includes: date, time, name of the organization, contact information, and list of participants

Electronic meeting notes (in MS Word) highlighting background, cooperation with other local actors (NGOs; local Government; private sector; etc.) that thoroughly captures issues discussed, including what enables and drives community/local development, what are the issues and inhibitors, and what are the opportunities

2. Organize workshops and focus groups, which includes:

Developing a logistical plan and timeline for the workshops and focus groups, which will last up to 8 (eight) hours - Planning of all requirements for a successful event and notional timeline for completion of each planning requirement

Managing business relations with vendors for each event Booking event venue with an appropriate set-up Renting technical equipment Arranging timely catering for breaks and lunch Sending invitations to event participants Printing event materials (e.g. agendas, handouts, questionnaires) Providing interpretation/translation services as needed in one or more languages

(Macedonian, English, Albanian, Turkish, and Roma) depending on the events’ participants Providing facilitation services for the events

- Assuring interactions and participation of all participants and keeping the event focus on the desired outcome

Deliverables (section 2):

4 workshops and 2 focus groups for up to 20 persons each organized and facilitated Logistical plan and timeline for each workshop and focus group prepared that includes:

participant identification, event space reservation, set-up and layout, technical equipment needs, catering for breaks and lunch, printing of event materials and purchase of flipcharts, notebooks, post-its, pens and markers

Electronic post-event report, including list of participants, key notes and summary of conclusions

3. Organize a two-day localworks conference, including:

Developing a logistical plan and timeline for the conference Planning all requirements for a successful two-day conference and notional timeline for

completion of each requirement Booking of fully equipped conference room with the appropriate set-up Sending invitations to the conference participants Provide transportation and arrange accommodation, including 4 meals (lunch and dinner on

day 1 and breakfast (if not included in hotel rate) and lunch on day 2) for approximately 40 participants (no alcoholic drinks must be included)

Providing interpretation services in one or more languages (e.g. Macedonian, English, Albanian, Turkish, and Roma)

Providing attendance log, including: name, organization and contact information

Facilitating the conference and assuring interactions and participation of all participants while keeping the conference focused on the desired outcome

Deliverables (section 3):

Logistical plan and timeline for the conference prepared that includes: identifying participants, conference space reservation, set-up and layout, necessity of technical equipment and other expendables, arraigning transportation and room reservation for the participants, catering for the brakes and all meals during the stay, and printing of conference materials

Two-day localworks conference organized, arranged, and facilitated Electronic conference report, including list of participants; thorough, complete, and

comprehensive notes; all major conclusions and recommendations captured

Additional Deliverables - Reporting Requirements:

Quarterly Reports, not to exceed _5_ pages, that provide the following content: - Executive Summary - Summary of meetings and events organized and findings for each meeting or event

Final Report, not to exceed _15_ pages, that provide the following content: - Executive Summary - Event Matrix that includes all meetings, workshops, focus groups and conference that took place during the period of performance - Findings, conclusions and recommendations divided by type of activity (meetings, workshops, focus groups, conference)

SECTION D – PACKAGING AND MARKING AIDAR 752.7009 MARKING (JAN 1993) a) It is USAID policy that USAID-financed commodities and shipping containers, and project construction sites and other project locations be suitably marked with the USAID emblem. Shipping containers are also to be marked with the last five digits of the USAID financing document number. As a general rule, marking is not required for raw materials shipped in bulk (such as coal, grain, etc.), or for semi-finished products which are not packaged. b) Specific guidance on marking requirements should be obtained prior to procurement of commodities to be shipped, and as early as possible for project construction sites and other project locations. This guidance will be provided through the cognizant technical office indicated on the cover page of this contract, or by the Mission Director in the Cooperating Country to which commodities are being shipped, or in which the project site is located. c) Authority to waive marking requirements is vested with the Regional Assistant Administrators, and with Mission Directors. d) A copy of any specific marking instructions or waivers from marking requirements is to be sent to the Contracting Officer; the original should be retained by the Contractor.

SECTION G – CONTRACT ADMINISTRATION DATA G.1 CONTRACTING OFFICER’S AUTHORITY The Contracting Officer is the only person authorized to make or approve any changes in the requirements of this contract and notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event the Contractor makes any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment must be made in the contract terms and conditions, including cost/price. All questions concerning the administration of this award must be sent to the Contracting Officer. It is the responsibility of the Contractor to inform the Contracting Officer of requests that affect any and all sections of this award. G.3 PAYING OFFICE The completed and signed SF-1034 “Voucher for Services for Other Than Personal” and relevant invoices and other documentation must be submitted electronically in pdf format to email address: [email protected] Note: Original invoices along with the original form 743 (Образец 743 – извештај за наплата од странство), must be submitted to USAID for reimbursement of VAT through the Public Revenue Office. 4) Employee salary does not include overseas recruitment incentives, post differential, per diem, housing allowance, travel expenses, temporary quarters allowance, education allowance, and other miscellaneous post allowances. USAID limits the maximum compensation rate applicable to claimants to 200 percent of the current national average weekly wage (NAWW) as calculated by the Secretary of Labor. 5) The new rate structure aligns DBA rates to the likelihood that specific types of contracts will incur different frequency of DBA payouts and of differing dollar amounts. Those having greater risk pay greater premiums. Those with anticipated lower risk pay lesser premiums. The concept is to associate specific costs to a contract predicated upon the

potential DBA risks under the same contract. The risk is predicated on the nature and inherent danger of certain categories of contracts (and performance under those awards).

6) For contracts that include Aviation, ground crews shall be categorized as Construction, and flight crew shall be categorized as Security.

Upon the Option Year being exercised, the contractor must confirm in writing, the security payroll percentage as of the measurement date of the preceding period of performance to the CO.

(End of clause) 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but

52.232-1 PAYMENTS (APR 1984)

The Government shall pay the Contractor, upon the submission of proper invoices or vouchers, the prices stipulated in this contract for supplies delivered and accepted or services rendered and accepted, less any deductions provided in this contract. Unless otherwise specified in this contract, payment shall be made on partial deliveries accepted by the Government if -

(a) The amount due on the deliveries warrants it; or

(b) The Contractor requests it and the amount due on the deliveries is at least $1,000 or 50 percent of the total contract price.

52.232-33 PAYMENT BY ELECTRONIC FUNDS TRANSFER – SYSTEM FOR AWARDS MANAGEMENT (JUL 2013)

(a) Method of payment. (1) All payments by the Government under this contract shall be made by electronic funds transfer (EFT), except as provided in paragraph (a)(2) of this clause. As used in this clause, the term "EFT" refers to the funds transfer and may also include the payment information transfer.

(2) In the event the Government is unable to release one or more payments by EFT, the Contractor agrees to either-

(i) Accept payment by check or some other mutually agreeable method of payment; or

(ii) Request the Government to extend the payment due date until such time as the Government can make payment by EFT (but see paragraph (d) of this clause).

(b) Contractor's EFT information. The Government shall make payment to the Contractor using the EFT information contained in the System for Award Management (SAM) database. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the SAM database.

(c) Mechanisms for EFT payment. The Government may make payment by EFT through either the Automated Clearing House (ACH) network, subject to the rules of the National Automated Clearing House Association, or the Fedwire Transfer System. The rules governing Federal payments through the ACH are contained in 31 CFR part 210.

(d) Suspension of payment. If the Contractor's EFT information in the SAM database is incorrect, then the Government need not make payment to the Contractor under this contract until correct EFT information is entered into the SAM database; and any invoice or contract financing request shall be deemed not to be a proper invoice for the purpose of prompt

payment under this contract. The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.

(e) Liability for uncompleted or erroneous transfers. (1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor's EFT information incorrectly, the Government remains responsible for -

(i) Making a correct payment;

(ii) Paying any prompt payment penalty due; and

(iii) Recovering any erroneously directed funds.

(2) If an uncompleted or erroneous transfer occurs because the Contractor's EFT information was incorrect, or was revised within 30 days of Government release of the EFT payment transaction instruction to the Federal Reserve System, and -

(i) If the funds are no longer under the control of the payment office, the Government is deemed to have made payment and the Contractor is responsible for recovery of any erroneously directed funds; or

(ii) If the funds remain under the control of the payment office, the Government shall not make payment, and the provisions of paragraph (d) of this clause shall apply.

(f) EFT and prompt payment. A payment shall be deemed to have been made in a timely manner in accordance with the prompt payment terms of this contract if, in the EFT payment transaction instruction released to the Federal Reserve System, the date specified for settlement of the payment is on or before the prompt payment due date, provided the specified payment date is a valid date under the rules of the Federal Reserve System.

(g) EFT and assignment of claims. If the Contractor assigns the proceeds of this contract as provided for in the assignment of claims terms of this contract, the Contractor shall require as a condition of any such assignment, that the assignee shall register separately in the SAM database and shall be paid by EFT in accordance with the terms of this clause. Notwithstanding any other requirement of this contract, payment to an ultimate recipient other than the Contractor, or a financial institution properly recognized under an assignment of claims pursuant to subpart 32.8, is not permitted. In all respects, the requirements of this clause shall apply to the assignee as if it were the Contractor. EFT information that shows the ultimate recipient of the transfer to be other than the Contractor, in the absence of a proper assignment of claims acceptable to the Government, is incorrect EFT information within the meaning of paragraph (d) of this clause.

(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information made by the Contractor's financial agent.

(i) Payment information. The payment or disbursing office shall forward to the Contractor available payment information that is suitable for transmission as of the date of release of the EFT instruction to the Federal Reserve System. The Government may request the Contractor to designate a desired format and method(s) for delivery of payment information from a list

of formats and methods the payment office is capable of executing. However, the Government does not guarantee that any particular format or method of delivery is available at any particular payment office and retains the latitude to use the format and delivery method most convenient to the Government. If the Government makes payment by check in accordance with paragraph (a) of this clause, the Government shall mail the payment information to the remittance address contained in the SAM database.

(a) The Contracting Officer may at any time, by written order, and without notice to the sureties, if any, make changes within the general scope of this contract in any one or more of the following:

(1) Description of services to be performed.

(2) Time of performance (i.e., hours of the day, days of the week, etc.).

(3) Place of performance of the services.

(b) If any such change causes an increase or decrease in the cost of, or the time required for, performance of any part of the work under this contract, whether or not changed by the order, the Contracting Officer shall make an equitable adjustment in the contract price, the delivery schedule, or both, and shall modify the contract.

(c) The Contractor must assert its right to an adjustment under this clause within 30 days from the date of receipt of the written order. However, if the Contracting Officer decides that the facts justify it, the Contracting Officer may receive and act upon a proposal submitted before final payment of the contract.

(d) If the Contractor's proposal includes the cost of property made obsolete or excess by the change, the Contracting Officer shall have the right to prescribe the manner of the disposition of the property.

(e) Failure to agree to any adjustment shall be a dispute under the Disputes clause. However, nothing in this clause shall excuse the Contractor from proceeding with the contract as changed.

For the purpose of submissions to the DDL: (1) “Dataset” is an organized collection of structured data, including data contained in spreadsheets, whether presented in tabular or non-tabular form. For example, a Dataset may represent a single spreadsheet, an extensible mark-up language (XML) file, a geospatial data file, or an organized collection of these. This requirement does not apply to aggregated performance reporting data that the contractor submits directly to a USAID portfolio management system or to unstructured data, such as email messages, PDF files, PowerPoint presentations, word processing documents, photos and graphic images, audio files, collaboration software, and instant messages. Neither does the requirement apply to the contractor’s information that is incidental to award administration, such as financial, administrative, cost or pricing, or management information. “Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. “Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor. “Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). (a) Definitions. As used in this provision-

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) database means that-

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record "Active".

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) By submission of an offer, the Offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(d) If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

For the price quotation, offerors are reminded that budgeting DBA and including the cost as part of the overall quoted price is a requirement, just as securing DBA after award is a requirement. USAID provides the following guidance for calculating the cost of DBA: Offerors should calculate only one DBA amount for payroll, regardless of how many people are doing the work. Payroll includes standard salary, overtime, bonuses, danger/hazard pay, recruitment incentive, and post differential. It does not include Government mandated social benefits, such as retirement contributions. To calculate, take the daily rate of each worker times the number of working days only and this would equal the payroll. For example, you have 5 people working on a contract for $200 per day, for 15 days. The total payroll you would use to calculate the total quoted price would be $15,000. Then take the $15,000 and multiply it by the rate for the coverage and that equals the DBA premium to be charged. The current rate as of 30/11/17 is $2.00 per $100 of payroll, so the premium based on the above example would be $300.

SECTION M - EVALUATION FACTORS FOR AWARD USAID will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors, which are presented in descending order of importance, shall be used to evaluate offers: (1) Technical Approach: Quality of the technical proposal and the extent to which the presented

approach is likely to achieve the Statement of Work and the deliverables. (2) Past Performance: Extent to which the offeror’s past performance contributes to government’s

expectation that the contractor will successfully perform under the contract. The following ratings will be assigned: High Confidence and Low (or No) Confidence. A “low (or No) Confidence” score will be given to Offerors who have no record of relevant past performance.

(3) Price This procurement utilizes the tradeoff process set forth in FAR 15.101-1. The Contracting Officer shall award the purchase order to the offeror whose quotation represents the best value to the U.S. Government. USAID may award the purchase order to an offeror with a higher price, provided that the non-price factor merits the additional price. For overall evaluation purposes of this RFQ, the non-price factors are considered more important than the price factor. The Government may award a contract without discussions with offerors.

1.  Confirm that the NCB or NSPA has submitted your correct legal business name and/or physical address to the U.S. CAGE System by going to the Business Identification Number Cross Reference System (BINCS) and enter your NCAGE/CAGE code and click Search.

2.  BINCS is a public facing search engine for domestic and foreign vendors, suppliers and potential contractors supporting the U.S. federal supply chain and should be used to verify the registration information.

3.  BINCS is updated within 24-48 hours after U.S. CAGE System has processed the updates to the NCAGE/CAGE registration.
