STATEMENT OF WORK
Project name: Video-Conference Systems for Criminal Courts
1. Project description: The U.S. Embassy – Guatemala requires the acquisition of 11 sets of audio
and videoconference systems per the following specifications:
Technical Specifications for Audio and Videoconference System
• Installation at site, which includes assembly of all the described equipment below, wiring,
gutter, assembly accessories, configuration, programming, testing of operation and start-up.
• Required training for equipment use and to accompany during and post start up to 25
people from the institution, potentially divided into groups from the different courts.
• Vendor shall include technical data sheets and specifications of the proposed
equipment.

SEC. 889. PROHIBITION ON CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES
OR EQUIPMENT.
(a) PROHIBITION ON USE OR PROCUREMENT.—(1) The head of an executive agency may not—
(A) procure or obtain or extend or renew a contract to procure or obtain any equipment,
system, or service that uses covered telecommunications equipment or services as a substantial
or essential component of any system, or as critical technology as part of any system; or
(B) enter into a contract (or extend or renew a contract)with an entity that uses any equipment,
system, or service that uses covered telecommunications equipment or services as a substantial
or essential component of any system, or as critical technology as part of any system.
(2) Nothing in paragraph (1) shall be construed to—
(A) prohibit the head of an executive agency from procuring with an entity to provide a service
that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection
arrangements; or
(B) cover telecommunications equipment that cannot route or redirect user data traffic or
permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(b) PROHIBITION ON LOAN AND GRANT FUNDS.—(1) The head of an executive agency may not
obligate or expend loan or grant funds to procure or obtain, extend or renew a contract to
procure or obtain, or enter into a contract (or extend or renew a contract)to procure or obtain
the equipment, services, or systems described in subsection (a).
(f) DEFINITIONS.—In this section:
(1) APPROPRIATE CONGRESSIONAL COMMITTEES.—The term ‘‘appropriate congressional
committees’ ’’ means—
(A) the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations,
and the Committee on Homeland Security and Governmental Affairs of the Senate; and
(B) the Committee on Financial Services, the Committee on Foreign Affairs, and the Committee
on Oversight and Government Reform of the House of Representatives.
(2) COVERED FOREIGN COUNTRY.—The term ‘‘covered foreign country’’ means the People’s
Republic of China.

(3) COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES.— The term ‘‘covered
telecommunications equipment or services’’ means any of the following:
(A) Telecommunications equipment produced by Huawei Technologies Company or ZTE
Corporation (or any subsidiary or affiliate of such entities).
(B) For the purpose of public safety, security of government facilities, physical security
surveillance of critical infrastructure, and other national security purposes, video
surveillance and telecommunications equipment produced by Hytera Communications
Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology
Company (or any subsidiary or affiliate of such entities).
(C) Telecommunications or video surveillance services provided by such entities or using such
equipment.
(D) Telecommunications or video surveillance equipment or services produced or provided by
an entity that the Secretary of Defense, in consultation with the Director of the National
Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an
entity owned or controlled by, or otherwise connected to, the government of a covered foreign
country.

2. Date and Place of Delivery:
All equiment shall be delivered and installed to the U.S. Government location within 8 weeks
after acceptance of purchase order from the awarded vendor.
Partial deliveries will not be accepted.
Delivery Address: Delivery will take place in Zone 1. The exact address and requirements will
be provided upon award to winning vendor.
Vendors outside Guatemala must consider taxes and delivery expenses when providing a
quote (Incoterms DDP).
U.S. Government will not provide customs clearance for the awarded vendor.
Local companies must provide price breakdown: net price + IVA = full price.
All pricing must include delivery and installation to site.
Schedule to work at site will be from Monday through Friday, from 8:00 to 15:00 hours.
3. Delivery information for Overseas vendors:
a. Delivery date:
According to date stablished on the contract. If an export license is required, delivery time
frame shall be considered as part of the process.
b. Shipping instructions
DDP Incoterm – Delivery Duty paid, including shipping and import customs charges and
insurance,
the US Embassy will support with tax exemption documentation to clear customs,
however vendor is responsible to cover expenses to release shipment and deliver to final
destination.
The vendor must consolidate the entire shipment to prevent loss and misdirection of the
items/equipment. Any lost or damaged goods during shipment shall be replaced by the
contractor upon notification.
The contractor shall ensure that all items are prepared for safe shipment and include all
necessary export approvals, licenses, and paperwork.
Price must include delivery to the confirmed address and compliance with all applicable
export/ITAR licensing requirements. If applicable, the items shall not be shipped until
necessary export license is received.
When the order is ready for air shipment, please forward the shipment prepaid directly to

This draft documentation will allow the advance information be provided for Customs
clearance purposes. Toconstitute a proper invoice, the invoice shall include all the items
required by FAR 52.212‐4(g).

One copy of the packing list must accompany the shipment, attached to the outside of the
“lead” or number one box/carton/package, or individually attached to the outside of each
box/carton/package. If you have any problems in complying with these instructions, please

*Please note:
Since this order is ultimately intended for an overseas destination, please make sure that all
wood packaging material and palletizing material used must conform the standards in the
International Standards for Phytosanitary Measures Publication No.15: “Guidelines for Regulating
Wood Packaging Material in International Trade” (ISPM 15) and have the appropriate domestic
delivery address that do not meet these standards will be rejected and must be corrected at
the contractor’s expense.
The MSDS – material safe data sheet might be required for shipment, so please attach it to the
shipment and send by e‐mail.

In Addition, after the AWB, Commercial Invoice and Packing List are cleared; documentation
will be used to initiate customs duties and tax exemption process in Guatemala, which usually
takes three to four (3‐4) weeks. This process can be submitted in advance before departure of
the shipment to save time and avoid unnecessary warehouse and other related charges.

4. Vendor requirements:
● Failure to comply with any part of this proposal may result in disqualification.
● The Government is not responsible in providing any kind of tools, materials, etc., for this
acquisition.
The contractor must comply with the Local law of labor and the “Acuerdo Gubernativo 229-
2014 y 33-2016”.
The Contractor must confirm that the personnel that will perform the work have social security
and/or Public Liability Insurance. Proof of either Public Liability Insurance or IGSS will be
required.

The awarded price shall be detailed including labor, materials, transportation, all necessary
permits, delivery charges for material and/or equipment needed any other customary
charges and tasks not considered in this proposal.
The Government will pay the Contractor the fixed price for standard services that have been
satisfactorily performed.
Valued added tax (VAT) shall not be included in the CLIN rates. It should be priced as a
separate line item in the proposal. The amount of tax to be charged is 12% (IVA). The
Government is exempt from taxes (IVA tax). Once invoiced, awarded vendor will be provided
with a tax exemption form as VAT payment.
Payment terms are Net 30 days.
Payment will be processed by EFT only.
6. Warranty:
The awarded company needs to provide 1‐year warranty and support.
Quality control acceptance of completed services and invoice under this contract shall be
based on:
o The required equipment should be installed, all cables connected, and equipment
assembled properly by the vendor, for basic hardware and software installation of
equipment. The POC must be contact in case of any concern at the time of installation.
o Delivery time is required and shall be in final destination, this is hard time delivery.
o Vendor shall demonstrate successful past performance in similar projects.
o Vendor shall include technical sheets and specifications of the proposed equipment, in
order to evaluate if it is technically acceptable.

o Commercial background on these systems, since it is a very delicate area in the local
government.
7. Award Determination
Award will be made to the offeror whose proposal is technically acceptable at the lowest price.
The Government reserves the right to reject any or all proposals or to make award without
conducting discussions.
Each proposal received will be carefully considered and all information submitted will be kept in
strict confidence within legal constraints. This request for proposals does not commit the
Government to pay any costs incurred in the preparation of the submission of proposals
Failure to comply with any part of this proposal may result in disqualification.
8. Information to include in the proposal
In order to be considered a complete proposal, the vendor must provide the following
information:

● Vendors must provide a description of quality control/quality assurance measures,
standards, and processes in the project methodology that will ensure high-quality project
deliverables that meet or exceed the specifications outlined in this request.

FTAs apply to this acquisition. Unless otherwise specified, these trade agreements apply to all
items in the Schedule. The Contractor shall deliver under this contract only U.S.-made or
designated country end products except to the extent that, in its offer, it specified delivery of
other end products in the provision entitled “Trade Agreements Certificate.” (End of clause)
