Section 1.0 – Overview and Schedule

A. Executive Summary The New Hampshire Department of Environmental Services (NHDES) is seeking qualification statements and proposals from wetland scientists, wetland consulting businesses, and firms with ArcGIS expertise that are interested in reviewing and verifying the draft update to the National Wetland Inventory (NWI) maps for NH (“Verification Project”). Candidates should have extensive professional experience in ArcGIS, evaluating aerial photograph imagery, LiDAR data, NWI maps, wetland classification, NRCS Soils data, wetland functional assessment, and field delineation of the boundaries of wetlands.

The objective of this Verification Project is to secure a contractor (“Selected Contractor”):

To coordinate with NHDES through established review and verification quality assurance and quality control procedures;

To assist the NHDES in reviewing and verifying Ducks Unlimited (DU) draft wetlands and stream polygons and classification for National Wetland Inventory (NWI) map data for year 1 and year 2 areas, (See map above);

To conduct desktop review of ”Plus” data to the basic NWI (NWI+) that includes enhanced classification for landscape position, landform, water flow path and water body type (LLWW) “Plus” attributes applied to digital wetland polygons; (Note: the plus data is developed in an automated fashion after the map QAQC is completed).

To conduct QA/QC of draft DU NWI map data through on-site field assessments.

The Selected Contractor’s review will be required to ensure that all data and maps will meet the Federal Geographic Data Committee (FGDC) standards and requirements to allow for the inclusion of these data in the National Wetlands Inventory managed by the USFWS. The national NWI database does not include the “Plus” data, but these attributes will be available through the NH GIS clearinghouse known as GRANIT.

B. Schedule The following table provides a Schedule of Events for this RFP through contract finalization and approval. The Agency reserves the right to amend this Schedule at its sole discretion and at any time through a published Addendum.

Complete and timely submittal of all required proposal documents is required for the qualifications package to be considered.

Section 2.0 - Background

The NHDES regulates impacts to wetlands through RSA 482-A and requires permits for impacts to wetlands and surface waters. New Hampshire’s wetlands and stream systems provide important functions; including flood control, fish and wildlife habitat, water purification, water storage and recharge for both ground and surface waters. The US Fish and Wildlife Service established the NWI for the United States in the mid-1970s. Most of the New Hampshire’s NWI maps were produced in the 1980s and require revision to improve their spatial and temporal accuracy. Wetland inventories are an essential tool for effective land development planning, wetland management, protection, and restoration. Additionally, accurate maps of the location and distribution of aquatic resources are essential to sound decision-making by both government, the conservation community and developers. On September 19, 2017 the NHDES received a Wetland Program Development grant from EPA to “Enhance Wetland mapping and assessment tools for wetlands protection in New Hampshire”, CD# 00A00262 (“EPA Grant”). On April 13, 2018 the NHDES requested and obtained Governor and Council approval to enter into a Sole Source Contract with Ducks Unlimited, Inc. (DU) Dexter, Michigan, to update and enhance NH’s NWI maps and data through December 2020. A sole source contract with DU was necessary because they are a federally recognized contractor that has provided this type of service for state agencies in the region and beyond and has extensive experience in digital imagery analysis from updating NWI maps for other states. DU’s mapping is being completed at a minimum scale of 1:6,000 and a target mapping unit (TMU) of 0.5 acre. Smaller or more complex wetlands may be mapped at a finer scale at/or below the TMU. The final maps will have overall accuracies ≥93% for upland-wetland discrimination. Classification accuracy to be at ≥85% for the Cowardin class level. The U.S. Fish and Wildlife Service’s new standards for NWI (Version 2) require the delineation of streams and rivers in polygon format (see: https://www.fws.gov/wetlands/data/Wetlands-Product-Summary.html). Through the EPA Grant, the NHDES is responsible for coordinating the work to update and publish NWI map data, which includes the mapping contractor, DU, the US Fish and Wildlife Service, and the University of New Hampshire’s GRANIT. The NHDES is responsible for evaluating products, acquiring field validation data, and conducting the accuracy assessment. As part of the EPA grant, the NHDES is required to provide state match to ensure proper review and verification of the NWI maps and products. The NHDES will ensure this responsibility is met by securing and overseeing a Selected Contractor to complete this Verification Project. DU is updating wetland map data using the most current aerial imagery and recently completed LiDAR data and providing additional information on wetland functions by applying descriptors associated with NWIPlus. This information will be available to the public through the UNH-based New Hampshire Geographically Referenced Analysis and Information Transfer System (GRANIT). The NHDES contract with DU is to update the state’s NWI map data and bring the statewide data up to NWI v2 standards (which includes polygons for streams). In addition, DU will develop LLWW data (landscape position, landform, water flow path, and waterbody type) and provide it to the NHDES with the updated spatial data. DU has

completed 100 % of the digitization and classification of the Year 1 area. Field verification of Year 1 area is planned for spring of 2020. DU is expected to digitize and classify more than 50 % of the Year 2 area by April 1, 2020.

Section 2.1 - How will the NHDES use the State-wide NWI information? The NWI map data will be available through US Fish and Wildlife Service NWI website and NH GRANIT (New Hampshire’s clearinghouse for geographic information (GIS). The NWI map data will be used to develop new tools and update existing tools and models to inform regulatory decisions. The NWI map data will be shared with other state and with federal resource agencies, businesses, regional planning commissions, developers, private industry, conservation commissions, contractors, and the general public. Examples of NWI map data users and uses include the NH Fish and Game Department’s Wildlife Action Plan, the Natural Heritage Bureau (NHB) for the identification of natural communities and application of the EIA, the US Army Corps of Engineers and its New England Wetlands Functional Assessment method, the NHDES for the identification of surface water and wetlands for water quality assessment and mitigation, the USEPA for the National Wetland Condition Assessment, wetland scientists using the New Hampshire Method for Inventorying and Evaluating Wetlands, by businesses and landowners for project planning, and local municipalities for land use planning. Under the NHDES mitigation rules, a project proponent is required to ask the municipality for a list of local mitigation projects for consideration. The NWIPlus update and information will support the identification of wetland restoration and land protection opportunities by municipalities and developers. Enhanced and accurate maps and data translate to better decisions for and by affected stakeholders.

Section 3.0 - PROPOSED SCOPE OF WORK The NHDES is responsible for coordinating the work to update the NWI map data, which includes the mapping contractor (DU), the US Fish and Wildlife Service, and the University of New Hampshire’s GRANIT. The NHDES contract with DU to map and classify wetlands, and produce the updated digital spatial data in ESRI’s ArcGIS File Geodatabase format (10.5) to meet or exceed the Federal Geographic Data Committee (hereinafter “FGDC”) wetland mapping standards (2013). The project approach is described in the proposal submitted by DU (Technical Procedures for Updating the National Wetland Inventory for New Hampshire, dated February 28, 2018). The NHDES is responsible for evaluating products, acquiring field validation data, and conducting the accuracy assessment. DU is responsible for day-to-day mapping map production and internal quality control. The FWS and GRANIT are responsible for ensuring that the data meet their standards before making them available on their respective websites. The NHDES, with assistance from the Selected Contractor as part of this Verification Project, will conduct review of the data produced by DU. The final updated NWI data will be delivered to the USFWS for incorporation into the national NWI database. In addition, the same NWI layer with the added NWIPlus data will be provided to GRANIT.

This Verification Project covers the southwest and the Lakes regions (Year 1: 1,938,386 acres), mid-northern region (Year 2a: 1,078,262 acres), and northern region (Year 2b; 926,593 acres). Southeastern New Hampshire (Merrimack and Contoocook watersheds) and the coastal watershed were updated in 2017. As part of this Verification Project, stream polygons will be added to make the mapping of the entire state compliant with NWI version 2 standards. In addition, LLWW (NWIPlus) data will be added to the wetlands in the coastal zone to complete the data for the state.

Section 3.2 REQUIRED WORK TASKS The Selected contractor shall be required to complete the following work tasks:

1. Digitally review and verify Updated Draft DU NWI wetlands locations and boundaries, classifications, and data – coverage of updated NWI polygons and classification;

2. Digitally verify Draft DU Map NWI+ data assignments: (Year 1, 2a and 2b areas plus coastal zone towns – a small area of 17 towns within “completed NWI” area.);

3. Digitally verify Draft DU Stream polygons locations and boundaries – entire state to the FGDC standard;

4. Based on review of draft digital DU maps, assist DU and the NHDES in selecting verification points to be sampled in the field by the Selected Contractor and by the NHDES;

5. Meet monthly (remotely as agreed to) with the NHDES, and/or DU, to coordinate quality control procedures, scheduling, progress, EPA reporting, and needed adjustments to the draft verified maps and data.

6. Provide results analysis, maps, and reporting as required by the NHDES and/or EPA and as listed in products below.

7. Develop proposal with accuracy goal for wetland types is to achieve 85% overall classification accuracy (counting both errors of omission and commission) for wetlands at the Cowardin class level.

Section 3.3 REQUIRED PRODUCTS The Selected Contractor shall be required to deliver the following products to the NHDES as part of the Verification Project:

1. Proposed ArcGIS edits to revised map data with narrative reports identifying needed corrections to draft NWI wetland locations, boundaries, classifications, and data. The Selected Contractor shall be required to provide the results of analysis and the basis for the changes or adjustments to locations or boundaries;

2. Digital map data and narrative reports showing identification of needed corrections to digital draft NWIPlus designations. The Selected contractor shall be required to provide to the NHDES with the results of analysis and the basis for the changes or adjustments to the NWIPlus designations;

3. Digital map data and narrative report showing identification of needed corrections to Stream polygon locations and boundaries – entire state. The Selected contractor shall be required to provide to the NHDES the results of analysis and the basis for the changes or adjustments to locations or boundaries;

4. Recommendations for field verification sampling points. The Selected contractor shall be required to provide a summary narrative report of the results of analysis with spatial data, locations and the basis for the field verification points;

5. A Selected Contractor report with ArcGIS spatial data, narrative, and photos, clearly showing the results of field verification work showing areas of needed corrections or adjustments to maps, classifications, stream polygons, and NWI+ data. The Field verification report shall include results of analysis and the basis for the changes or adjustments to locations or boundaries;

6. The Selected Contractor shall provide a work log, noting date and time of work conducted, hours worked, identification of work done with work products records;

7. The Selected Contractor shall provide a final report documenting the overall results of the Selected Contractor Verification Project.

Section 4.0 PROCESS FOR SUBMITTING A PROPOSAL

A. Proposal Submission, Deadline and Location Instructions

Request for Qualifications and Request for Proposals for the Desktop Review and Field Verification of Draft Updates to National Wetland Inventory (NWI) Map Data Unless waived as a non-material deviation in accordance with Section 6B, late submissions will not be accepted and will be returned to the proposers unopened. Delivery of the Proposals shall be at the Proposer’s expense. The time of receipt shall be considered when a Proposal has been officially documented by the NHDES, in accordance with its established policies, as having been received at the location designated above. The NHDES accepts no responsibility for mislabeled mail or mail that is not delivered or undeliverable for whatever reason. Any damage that may occur due to shipping shall be the Proposer’s responsibility.

All Proposals submitted in response to this RFP must consist of at least: A qualifications and technical proposal package to the NHDES that including the following components as described in detail below:

The project team, including project team organization, team member qualifications and anticipated level of involvement of key team members in each phase of the project as described in the project approach and scope of work.

A technical proposal that described the team’s project approach and scope of work.

A proposed project schedule

A Task Table that includes the following elements: Brief description of each task

Proposers who are ineligible to bid on proposals, bids or quotes issued by the Department of Administrative Services, Division of Procurement and Support Services pursuant to the provisions of RSA 21-I:11-c shall not be considered eligible for an award under this proposal.

B. Proposal Inquiries The NHDES will answer questions submitted to the NHDES to all parties submitting contact information to the NHDES. All inquiries on the RFP shall be made through the designated point of contact. The NHDES will not respond to telephone questions about the RFP. Questions concerning this RFP must be received via email to Mary Ann Tilton at [email protected] with subject line: NWI Verification Project RFP Question and must be submitted no later than Thursday, April 2, 2020. The NHDES will post responses to all submitted questions at the NHDES Wetlands Bureau website.

C. Disclaimer

This RFP does not commit the NHDES to award a contract or to pay any costs incurred during the preparation of the proposal or during the interview process. NHDES reserves the right to reject any or all the proposal for completing this work. NHDES also reserves the right to eliminate the need for the selected consultant to complete one or more tasks, pending the outcome of the preceding related tasks or issues, and/or the availability of project partners to complete that task. This project is funded from state sources. The consultant will be governed by state contractual provisions. State contracts are governed by Chapter Adm 600 Procurement and Property Rules that are available at http://www.gencourt.state.nh.us/rules/state_agencies/adm600.html. The consultant will need a vendor code from the NH Secretary of State’s office. The general provisions for state contracts may be found at http://www.dhhs.nh.gov/business/documents/p37.pdf. This contract is part of a state commitment under an EPA federal grant award. All applicable requirements, regulations, provisions, terms and conditions of this Federal Grant Agreement will be adopted in full force and effect to the relationship between the NHDES and the consultant. Additionally,

the consultant shall comply with the terms of the Federal Funding Accountability and Transparency Act (FFATA) by providing NHDES with the Data Universal Numbering System (DUNS) number, and all applicable Executive Compensation Data Information as required under FFATA.

Section 5.0 Content and Requirements for Proposal Each applicant/ consultant must submit the following to qualify for consideration under this process:

1) Qualification Proposal and Technical project proposal 2) Budget

Section 5.1 Qualifications and Technical Proposal package Applicants are required to submit a “Qualifications and Technical Proposal” package containing and original hard copy and an electronic copy as a PDF of their “Qualifications and Technical Proposal” package. Double-sided copies are appreciated. PDFs will be submitted on a USB drive. This package shall include:

a. Technical Proposal, not to exceed fourteen (14) typed, single-spaced pages. This proposal shall include the applicant’s methods, quality control procedures, access to computer hardware, GIS software, computer memory capability, GIS enhanced software and hardware capabilities, Collector for ArcGIS , printer, and access to specialists and equipment to carry out the tasks outlined in this RFP.

b. Statement of Qualifications and directly relevant work experience, not to exceed seven (7) pages. c. Curriculum vitae or resumes for project team members, not to exceed two (2) pages per team

member; and not to exceed a total page limit of fifteen (15) pages for the entire project team. d. List of references who may be contacted about the consultant’s qualifications and work

experience, not to exceed one (1) page. e. The consultant shall clearly identify a primary contact for their proposal and provide that person’s

phone number and email address. f. The consultant shall in their “Qualifications Proposal” describe in detail their approach for tasks

and scope of work and provide expected duration for each task. NHDES anticipates this project to take several months.

Section 5.2 Budget – “Price Proposal” In addition to the Qualifications and Technical proposal, applicants are required to submit a detailed budget (“Price Proposal”) listing of costs to justify the basis for the budget. Line items need to include the number of estimated hours by staff, hourly rate per employee, and the estimated number of hours per task. Other costs, including field equipment, estimated cost of gas, hotel, or computer software and hardware. The overall price proposal should be tallied by task. The budget should also detail the percent of assessment per wetland class type, wetland polygons, desktop verification time, and field assessment time.

Section 6.0 Evaluation of the Proposals

A. Criteria for Evaluation and Scoring

A NHDES selection team will evaluate and rank the qualifications and proposals based on the following criteria identified below:

The NHDES will select a proposer based upon the criteria and standards contained in the RFP and from applying the weighting in this section. Oral interviews and reference checks. To the extent they are utilized by the NHDES, will be used to refine and finalize the scores.

B. Planned Evaluations

The NHDES plans to use the following process: • Initial screening to ensure that the Proposals are in compliance with submission requirements; • Preliminary evaluation of the Proposals; • Oral interviews; • Final Evaluation of Technical Proposals and scoring; • Review of Price Proposals and final scoring; • Select the highest scoring Proposer (s) and begin contract negotiation

C. Initial Screening The NHDES will conduct an initial screening step to verify Proposer compliance with the technical submission requirements set forth in the RFP and the minimum content set forth in Section 5 of this RFP. The Agency may waive or offer a limited opportunity to cure immaterial deviations from the RFP requirements if it is determined to be in the best interest of the State.

D. Preliminary Technical Scoring of Proposals The NHDES will establish an evaluation team to initially score the Technical Proposals. This evaluation team will review the technical proposals and give a preliminary score to the technical proposals under the guidelines set forth in Section 6. Should a Proposer fail to achieve 50 Points in the preliminary scoring, it will receive no further consideration from the evaluation team and the Proposer’s Price Proposal will be returned unopened. Price Proposals will remain sealed during the preliminary technical review.

E. Interviews The NHDES selection team will invite the consultants with the best ranked qualifications/proposal to interview with the selection team. Those consultants invited to interview will ensure that the anticipated project managers, individual responsible for public presentations, and sub-consultants (if applicable) for this project are present during the interview.

F. Final Technical Scoring of Proposals Following Oral Interviews, Reference Checks (if appropriate) and/or review of written clarifications of proposals requested by the Agency, the evaluation team will determine a final score for each Technical Proposal.

G. Price Proposal Review Price proposals will be reviewed upon completion of the final technical scoring of proposals. The Proposer’s Price Proposal will be allocated a maximum potential score of 20 points. Proposers are advised that this is not a low bid award and that the scoring of the price proposal will be combined with the scoring of the technical proposal to determine the overall highest scoring Proposer. The following formula will be used to assign points for costs: Proposer’s Price Score = (Lowest Proposed Price / Proposer’s Proposed Price) x Number of Points for Score

For the purpose of use of this formula, the lowest proposed price is defined as the lowest price proposed by a Proposer who has scored above the minimum necessary for consideration on the Technical Score.

H. Final selection The NHDES selection team will develop a final score for each firm interviewed using the criteria outlined in 6.3 above. The selection team will select the top finalists based on the numerical results of the process described above.

I. Rights of the Agency in Accepting and Evaluating Proposals The Agency reserves the right to: • Make independent investigations in evaluating Proposals; • Request additional information to clarify elements of a Proposal; • Waive minor or immaterial deviations from the RFP requirements, if determined to be in the best interest of the State; • Omit any planned evaluation step if, in the Agency’s view, the step is not needed; • At its sole discretion, reject any and all Proposals at any time; and • Open contract discussions with the second highest scoring Proposer and so on, if the Agency is unable to reach an agreement on Contract terms with the higher scoring Proposer(s).

J. Contract negotiations Once the selection is complete, the NHDES will begin contract negotiations with the highest ranked finalist. The NHDES selection team will open the price proposal of that firm. If the negotiations are unsuccessful, the NHDES will contact the second ranked consultant and proceed with contract negotiations with that firm, and so on.

K. Final Selection The Agency will conduct a final selection based on the final evaluation of the initial proposals or, if requested, as a result of the Best and Final Offer and begin contract negotiations with the selected Proposer(s).

L. Rights of the Agency in Accepting and Evaluating Proposals The Agency reserves the right to: • Make independent investigations in evaluating Proposals; • Request additional information to clarify elements of a Proposal;

SECTION 7 – Terms and Conditions Related To The RFP Process

A. RFP Addendum The NHDES reserves the right to amend this RFP at its discretion, prior to the Proposal submission deadline. In the event of an addendum to this RFP, the Agency, at its sole discretion, may extend the Proposal submission deadline, as it deems appropriate.

B. Non-Collusion The Proposer’s signature on a Proposal submitted in response to this RFP guarantees that the prices, terms and conditions, and Work quoted have been established without collusion with other Proposers and without effort to preclude the NHDES from obtaining the best possible competitive Proposal.

C. Property of the Agency All material received in response to this RFP shall become the property of the State and will not be returned to the proposer. Upon Contract award, the State reserves the right to use any information presented in any Proposal.

D. Confidentiality of a Proposal Unless necessary for the approval of a contract, the substance of a proposal must remain confidential until the Effective Date of any Contract resulting from this RFP. A Proposer’s disclosure or distribution of Proposals other than to the NHDES will be grounds for disqualification.

E. Non-Commitment Notwithstanding any other provision of this RFP, this RFP does not commit the NHDES to award a Contract. The NHDES reserves the right, at its sole discretion, to reject any and all Proposals, or any portions thereof, at any time; to cancel this RFP; and to solicit new Proposals under a new acquisition process.

By submitting a Proposal, a Proposer agrees that in no event shall the NHDES be either responsible for or held liable for any costs incurred by a Proposer in the preparation of or in connection with the Proposal, or for Work performed prior to the Effective Date of a resulting Contract.

G. Ethical Requirements

From the time this RFP is published until a contract is awarded, no bidder shall offer or give, directly or indirectly, any gift, expense reimbursement, or honorarium, as defined by RSA 15-B, to any elected official, public official, public employee, constitutional official, or family member of any such official or employee who will or has selected, evaluated, or awarded an RFP, or similar submission. Any bidder that violates RSA 21-G:38 shall be subject to prosecution for an offense under RSA 640:2. Any bidder who has been convicted of an offense based on conduct in violation of this section, which has not been annulled, or who is subject to a pending criminal charge for such an offense, shall be disqualified from bidding on the RFP, or similar request for submission and every such bidder shall be disqualified from bidding on any RFP or similar request for submission issued by any state agency. A bidder that was disqualified under this section because of a pending criminal charge which is subsequently dismissed, results in an acquittal, or is annulled, may notify the department of administrative services, which shall note that information on the list maintained on the state’s internal intranet system, except in the case of annulment, the information, shall be deleted from the list.

H. Challenges on Form or Process of the RFP

Any challenges regarding the validity or legality of the form and procedures of this RFP, including but not limited to the evaluation and scoring of Proposals, shall be brought to the attention of the Agency at least ten (10) business days prior to the Proposal Submission Deadline. By submitting a proposal, the Proposer is deemed to have waived any challenges to the agency’s authority to conduct this procurement and the form and procedures of this RFP.

Section 8 – Contract Terms and Award

A. Non-Exclusive Contract Any resulting Contract from this RFP will be a non-exclusive Contract. The State reserves the right, at its discretion, to retain other Contractors to provide any of the Services or Deliverables identified under this procurement or make an award by item, part or portion of an item, group of items, or total Proposal. (*If an Agency believes that an exclusive contract is necessary to attract bidders and get competitive pricing, this section should be deleted.)

If the State decides to award a contract as a result of this RFP process, any award is contingent upon approval of the Contract by Governor and Executive Council of the State of New Hampshire and upon continued appropriation of funding for the contract.
