V. Artist Selection Process All proposals will be reviewed by a jury panel as determined by the City of Sioux City. Entries will be critiqued on artistic merit, creativity, durability in an outdoor setting, artist experience, and ability to meet the budget and timeline. A winning proposal and runner-up will be selected for each currently available location. After the jurying process is complete, all participating artists will be notified of the jury’s final decision. The City of Sioux City reserves the right at its sole discretion to reject any and all proposals without penalty. The final selection, if any, will be that proposal which, in the opinion of the City after review of all submissions by the jury, best meets the requirements set forth in the Call for Art and is in the best interest of the City. The City reserves the right to make an award without further discussion of the proposal submitted. The Artist of the winning proposal should be prepared to enter into contract based on the terms as presented in the RFP. Additional information may be requested for clarification; failure to respond may disqualify the proposal. VI. Miscellaneous Provisions Independent Contractor: The parties agree that the Artist operates an independent business and is contracting to do work according to his/her own methods, without being subject to the control of the City, except as to the product or the result of the work. The relationship between the City and the Artist shall be that as between an independent contractor and the City and not as an employer-employee relationship. The payment to the Artist is inclusive of any use, excise, income, or any other tax arising out of this agreement. Hold Harmless: The Artist agrees to hold the City harmless from all claims or liability including attorneys’ fees arising out of the services furnished under this agreement and for bodily injury or property damage arising out of the services furnished under this agreement, providing that such claims or liability are the result of an act, error, or omission of the Artist and/or its employees/agents arising out of the services described in this agreement. Liquidated Damages: The artist will commence work under this agreement and fully complete the project by October 31, 2021. Artist further agrees to pay as liquidated damages the amount of $100.00 for each calendar day thereafter that the work remains uncompleted. Should the artist fail to complete the project within the time provided in the agreement or by formally approved extensions granted by the City, the amount of liquidated damages shall be deducted from monies or amounts due to the artist. Permitting the artist to continue and complete the work covered by the terms of the agreement after the completion date provided for therein and inclusive of any extensions granted, shall in no way be construed as a waiver by the City of its rights under this agreement. Termination: The City may by written notice to the Artist terminate this agreement in whole or in part at any time, either for the City’s convenience or because of the failure of the Artist to fulfill its contract obligations. Upon ten days’ written receipt of notice, the Artist shall immediately discontinue all services affected, unless the notice directs otherwise. If the termination is due to the failure of the Artist to fulfill the contract obligations, the City may take over the work and complete it by contract or otherwise. In such case, the Artist shall be liable to the City for any excess costs occasioned to the City thereby. The rights and remedies of the City provided in this section are in addition to any other rights and remedies provided by law or under this agreement.

Sioux City also offers over 1,132 acres of parkland located at 54 various locations, including riverfront and miles of tree‐lined recreational trails.

Project Statement

The West 7th Corridor Improvement Project includes the complete reconstruction of West 7th Street, from Wesley Parkway to Hamilton Boulevard. In addition, a façade improvement program is underway which improves the exteriors of buildings in within the Corridor. Public meetings regarding the project began in 2013, the façade improvement program was started in 2014, and the street design was completed in 2015. While the street reconstruction project is now complete, the façade improvement program is still underway. The installation of murals along the corridor is an important part of this project. Throughout the project’s public input process, a common theme was heard: The West 7th Street Corridor has long been a welcoming place to entrepreneurs who are minorities and new to the United States. West Seventh began as a manufacturing area, probably due to its proximity to Perry Creek. One of the early manufacturing businesses was the Sioux City Foundry and Machine Works which opened in 1871 at the southwest corner of West 7th Street and Main Street. Not far from West 7th Street were other manufacturing businesses, such as breweries, bakeries and dairies, which brought in immigrant groups to work in these factories. As the population began to increase on the west side of Sioux City, small business owners saw an opportunity for customers and began opening small retail shops, barber shops, groceries, restaurants, billiard halls, saloons, and mechanical shops. In 1886 a streetcar line was laid down West 7th Street and more businesses began to spring up along the street. Automobile dealers and repair shops began in the 1920s along West 7th Street and the street began to be known as “Motor Row”. The project includes the development and installation of four murals on West 7th Street, between Hamilton Boulevard and Wesley Parkway. Two of the proposed murals will be on large building facades that are visible from Downtown and welcome motorists into the Corridor (east side of J & L Staffing at 219 West 7th Street and east side of American Home Healthcare at 214 West 7th Street). In addition, one mural is proposed on 809 West 7th Street which is highly visible from Hamilton Boulevard. Finally, one is proposed at 712 West 7th Street which is also visible to motorists passing on West 7th Street. All building owners / tenants have given their permission to the City of Sioux City. West 7th Street has long been welcoming to minority entrepreneurs and those that are new to the United States. The West 7th Street Corridor has been the center of both the Sioux City Jewish and African American communities over the years. Most recently, additional immigrant communities from Southeast Asia have called West 7th home. This is in addition to the long-term businesses that have thrived on the street for decades. It is expected that the murals selected would celebrate Sioux City's diverse community. Further, it is expected that these murals will convey the message that Sioux City is proud of its diversity and entrepreneurs.
