1. InvitationDetailed proposals are invited from consultants, consulting firms and academic institutions hereafterreferredtoasthe“Consultants”)todesignandimplementaoneyearlobstercatchabilitystudyprogramaspartofFORCEEnvironmentalEffectsMonitoringProgram(EEMP)for itsmarinedemonstrationandtestingfacilityintheMinasPassage,BayofFundy.2. BackgroundandContextTheFundyOceanResearchCenter forEnergy(FORCE), isCanada’s leadingcentertodemonstrateandevaluate technology and undertake research on tidal in-stream energy conversion (TISEC). FORCEcollaborateswithdevelopers,regulatorsandresearcherstostudytheinteractionbetweentidalturbinesandthedynamicenvironmentalconditionsintheBayofFundy.TheFundyTidalEnergyDemonstrationProject (the Project), being undertaken by FORCE in theMinas Passage, presently involves five berthholders, each proposing to deploy a different technology over the next five years. AdditionalinformationandbackgroundontheFORCEProjectandEEMPstudiescompletedtodateareavailableonFORCE’swebsite:www.fundyforce.ca.TheProjectEnvironmentalAssessment (EA) received formalapprovalonSeptember15,2009.Oneoftheconditionsof theapproval requiredFORCE,as theApprovalholder, toestablishanEnvironmentalEffectsMonitoringProgram(EEMP)coveringanumberofsubjectareas. ThesesubjectareasareFish,Lobsters,MarineBirds,MarineMammals,Acoustics,PhysicalOceanography,CurrentsandWaves,andBenthicenvironment.Inaddition(asrequiredbytheEAapproval),anEnvironmentalMonitoringAdvisoryCommittee(EMAC)wasestablishedtoprovideindependentexpertscientificandtraditionalecologicalknowledgeadvicetoFORCEontheadequacyoftheEEMP.BasedonthedatagatheredunderpreviousFORCEEEMprogramsundertakenfrom2009to2013andfeedbackfromEMAC,itwasdeterminedthatthefutureFORCEEEMPshouldfocusonfivesubjects:Fish,Lobsters,MarineBirds,MarineMammalsandAcoustics(marinenoise).For the lobster indicator, the2009EAnotes that“potentialadverseeffectson thecommercial lobsterfisherieswillbeeliminatedorminimizedtoinsignificantlevelsthroughouttheProjectlife”.TheEAgoeson to predict that “apart from direct displacement of a limited number of individual lobsters in theimmediateProjectfootprint,theremaybeindirecteffectsonmigratinglobstersduringconstructionasaresultofnoise,vibrations,orsediments”(AECOM2009).Inorder to test thesepredictions, a seriesofEEMPs focusedon lobster “catchability”andmovementwereundertakenin2009and2010,pluslobstertaggingstudiesin2011through2013.The next TISEC deployment is anticipated inmid-2016 at site D, as indicated in Figure 1. Ongoinglobstermonitoring studies are required to assess the potential effects and test the EApredictions asadditionalTISECdevicesaredeployed.

3. ObjectiveTheultimateobjectiveofthisEEMPistoassesstheimpactoftheFORCEprojectonlobstercatchability;that is,on thenumberandweightof lobstersenteringcommercial lobster traps in thevicinityof theProject.ThisinturnshouldprovideaperspectiveonthemagnitudeorsignificanceofProjecteffectsonthecommerciallobsterfishery.4. ScopeofWork4.1 TheConsultantwilldesignandimplementa lobstercatchabilitystudyforaperiodofoneyear
based on the methodology recommendations contained in Section 2 of the FORCEEnvironmental Effects Monitoring Program, dated March 2016. This Report and othersupporting documents are available for reference on the FORCE website, athttp://fundyforce.ca/environment/.The1yearcontractmaybeextendedforanadditionalyearuponreviewoftheConsultant’swork.
4.2 Provide descriptions of the data quality assurance program and its implementation for the
surveys;and,thestatisticalanalysisapproachtobeutilizedforthestudy.4.3 InconsultationwithFORCE,arrangeforproperlycertifiedand insuredvesselandcrewforthe
implementation and operation of the lobster catchability surveys (refer to Sections 7 and 8below). FORCE will provide the lobster traps, lines and buoys for the surveys. FORCE willcontractdirectlywiththevesselownerandsovesselcostscanbeexcludedfromtheproposal.However, the Consultant must provide an estimate of vessel rental days and associatedprofessionalfees.
4.4 Conduct the surveys and undertake the statistical analysis and data interpretation of the
collected data (including a comparison with data collected in the past) to meet the statedobjective,andprovideastatusreportforeachsurveyandafinal (summary)report. Thedataanalysisand interpretation in theFinalReportwill includeacomparison to thedatacollectedduringpreviousstudiesundertakenattheFORCEsite,asappropriate(seesection6below).
4.5 ProvideascheduleforsurveysanddeliveryofeachsurveystatusreportandtheDraftandFinal
report.4.6 TheConsultantwilldelivertoFORCEadigitalcopyof thestatusandfinalreports inMicrosoft
Word and PDF format addressing all of the requirements specified in the Detailed Scope ofWork,aswellasotherinformationconsideredbytheConsultanttoberelevanttoachievingthecontractualobjective.
5. SurveyTimingSurvey timing will be determined through discussions between FORCE and the Consultant, but theConsultant should propose a tentative schedule with supporting justification in the Proposal. Theultimate survey timingwill likely dependon turbine deployment, vessel availability, tides and lobsterfishingseason.

Withrespecttothe initialsurvey,timingwillbecontingentuponthetimingofturbinedeploymentbyCape Sharp Tidal Venture (CSTV). It is critical thatmonitoring does not interfere with or cause anysafetyconcernsduringtheCSTVturbinedeployment.Thiscontractconsistsofdatacollection,processingandreportingforthreelobstercatchabilitysurveysat the FORCE site, post-turbine deployment. Should the CSTV turbine deployments be delayed, thisprogramwill continue in to2017untilall threestudiesarecompleteat theappropriate timeofyear,andtheassociateddataanalysisandreportingiscompleted.6. Reporting
Followingeachfieldsurvey,abriefinterimstatusreportwillbeprepareddescribingplanning,theworkundertaken, problems encountered, and results of the survey. The status reports will also describecosts incurred so that project expenditures can be tracked over the course of the year. Uponcompletion of the final survey, a draft Summary Report will be submitted to FORCE and EMAC forreview.ThedraftSummaryReportwillcompileallresultsandpresentacomprehensiveoverviewoftheobjectives, methods, results and conclusions of the program (including comparison with past data).OnceFORCEcommentshavebeenreceived,afinalSummaryReportwillbesubmittedtoFORCEwhointurnwillsubmitthereporttotheregulators.TheConsultantwilldelivertoFORCEadigitalcopyofthefinalSummaryReportinMicrosoftWordandPDF format addressing all of the requirements specified in the Scope of Work, as well as otherinformation considered by the Consultant to be relevant to achieving the contractual objective. TheConsultantwillalsodeliverthemetadataandprocessedandrawdatainaformattobedeterminedindiscussionswithFORCE.TheConsultantshouldbeawarethatallprojectdeliverableswillbemadepublicatFORCE’sdiscretion.7. OperationalSafetyPlanAll bidders must describe their safety planning process in the proposal. Upon contract reward, thesuccessfulConsultantmustprepareanOperationalSafetyPlanspecifictothescopeofworkoutlinedinthis contract and in compliance with FORCE’s safety requirements, which will be provided to thesuccessfulConsultantshortlyfollowingcontractaward.Acopyof theOperationalSafetyPlanshallbeprovided forcommentand reviewbyFORCEwithin21days after contract award. TheContractor is responsible for any training, certification and insurancerequirementsthatarerequiredtoparticipateintheseavoyages.8. Insurance,CertificationsandPermitsConsultants (and any sub-consultants) must meet the minimum Transport Canada insurancerequirements and have passenger and third-party liability coverage to the limits specified. TheConsultantshallprovideproofofcoveragebytheWorkers’CompensationBoarduponrequest.Consultants(andanysub-consultants)willmeetallTransportCanadacertificationstandardsapplicablefor the proposed work. Contractors will demonstrate that all vessels proposed in the RFP meetTransportCanadaregulationstoatleastthestandardrequiredfortheproposedwork.Thevesselswill

have,throughouttheoperationalperiod,allcertificates, lifesavingequipmentandsafetyapparatusasrequiredbyTheCanadaShippingActandpursuantregulationsforthecrewandadditionalstaff.TheConsultantisresponsibleforobtaininganyrequiredscientificresearchorotherpermits.9. QualificationsThe consultant is expected to have a technical or academic background and extensive experience inmarinescience,includingexperiencewiththedesignandinterpretationofmarinemonitoringprograms.Competencyinstatisticalanalysisandmarinesamplingtechnologies,particularlyinregardtosamplingprotocolsisalsoarequirement.10. ProposalSubmissionThe Proposal must be submitted inWord document format as follows: single spaced, double sided,maximumof25pages,TimesNewRoman font, font size12-point,one inchmarginsonall sides,andreflect the requirements as presented in section 3. Appendices may be used for CVs and companybrochuresbuteffortshouldbetakentominimizethelengthoftheAppendices.TheSubmissionwillbeevaluatedaccordingtothecriteriainScheduleA.TheFullProposalshallbeorganizedwiththesubjectheadingsinthesequenceindicated:• Introduction.Describetheprojectobjectives.
• OrganizationandPersonnel. Indicatethelocationofyourofficeandofficesfromwhichthework
will be conducted. Identify the primary contact and provide brief biographies of the personnelassignedtothisproject.Thebiographiesshoulddescribetheperson’srelevantexperienceandroleintheproject.Pleaselistanddescribeanypartners,subcontractorsorexpertsformingpartoftheProposal,includingtheirexperienceandroles.
• Pastrelevantprojectexperience. TheProposalshallincludeatleastthree(3)examplesofrecent
projects as well as the applicable client contact information. Proponents must be able todemonstratethattheConsultantshasanin-depthknowledgeofthescopeofthisassignment.
• Proposed methodology. The proponent shall clearly indicate their proposed methodology,preferablydescribedonataskbytaskbasis,toaddressthescopeofworkasoutlinedinthisRFP.
• Proposed schedule. Proponents are to provide a detailed schedule for the tasks for the tasksabove,includingreviewandrevisionofdraftreports.
• Attentiontorelevantchallenges.ProponentsshalldescribeandattempttoaddressanychallengestotheassignmentwhichtheyhaveidentifiedbutmaynotbespokentointheRequest.
• Value added propositions and recommendations. Proponents may demonstrate an innovativeapproachtothecompletionoftheassignment,utilizingallpotentialresourcesavailabletothem.

• Costproposal.Provideacostbreakdownbyproposedtaskandstatethefirmfixedtotalpriceforthe servicesoutlinedunder theScopeofWork. Pricesare tobequoted inCanadiandollars andexclusiveofHST.Please indicateunit rates incaseadditionalwork is required. Inadditionpleaseindicateiftheseunitrateswillremainunchangedifthisprojectisextendedforanadditionalyear.If the Consultant proposes to increase unit rates for a subsequent year, please indicate a fixedpercentincreaseonunitrates.
