Background Pioneer Electric Cooperative, Inc. (“PEC”) is seeking proposals to establish a contract with a qualified and experienced firm, herein after referred to as “Contractor,” to provide Reconductoring services and Hazard Mitigation (“Services”) to PEC relating to April 2017 Severe Winter Storm, Snowstorm, Straight‐Line Winds, and Flooding, DR‐4319. Contractor will work under the direction of PEC. Services will be based on the requirements below and the general terms and conditions set forth in a Master Services Agreement (“Agreement”) in the form substantially similar to the one found in Exhibit A to this RFP. II. General Requirements A. Services may include, but are not be limited to, damage assessment, facility restoration and assistance with federal and state reporting. B. Services shall include Contractor’s provision of all labor, supervision, transportation, tools, equipment, communications, provisions, and other services and supplies necessary for, or incidental to, the performance of such Services pursuant to the Agreement. C. Any and all Services provided by Contractor must comply fully with all applicable federal, state and local laws, regulations and guidelines, as described in the Agreement. D. Return bid sheets, bid bond and your company information no later than 10:00 am CST December 2, 2019. Unit prices must be submitted for every unit listed in the excel spread sheet. PEC reserves the right to enter into multiple Agreements as a result of this RFP. It will be PEC’s intent to select one contractor from this RFP. I. BackgroundPioneer Electric Cooperative, Inc. (“PEC”) is seeking proposals to establish a contract with a qualified and 

experienced firm, herein after referred to as “Contractor,” to provide Reconductoring services and Hazard 

Mitigation (“Services”) to PEC relating to April 2017 Severe Winter Storm, Snowstorm, Straight‐Line Winds, 

and Flooding, DR‐4319.   Contractor will work under the direction of PEC.   Services will be based on the 

requirements  below  and  the  general  terms  and  conditions  set  forth  in  a  Master  Services  Agreement 

(“Agreement”) in the form substantially similar to the one found in Exhibit A to this RFP. 

II. GeneralRequirementsA. Services  may  include,  but  are  not  be  limited  to,  damage  assessment,  facility  restoration  and 

assistance with federal and state reporting.

E. Contractor's Designated Representative shall be physically present at PEC’s Headquarters within 

10 days after notification of award by PEC.  Commencement of work shall begin on or before 

January 2, 2020 and shall be completed by December 31, 2021. 

F. Any Agreement(s) issued pursuant to this RFP will be based on unit prices. 

G. PEC reserves the right to enter into multiple Agreements as a result of this RFP. It will be PEC’s 

intent to select one contractor from this RFP. A minimum monthly goal should be total project in 

miles divided by twenty‐four (24) months. Should Contractor not meet monthly minimum 

construction goals for two consecutive months, PEC reserves the right to enter into multiple 

agreements. Additional agreement may be at different unit costs.

III. FederalComplianceRegulationsPEC hereby notifies all proposers that the work covered by this RFP and any resulting Agreement may be 

funded  via  Federal  grant,  including,  but  not  limited  to,  those  issued  through  the  Federal  Emergency 

Management  Agency’s  (“FEMA”)  Public  Assistance  Program  following  federally  declared  disaster  or 

emergency events.  As such, prospective contractors will be required to comply with all applicable Federal, 

laws,  regulations, executive orders, and FEMA or other Federal agency requirements  for  the  type work 

being performed.  All proposers should carefully review the Agreement found in Exhibit A to this RFP for 

more information on the required minimum clauses as these are non‐negotiable. 

IV. ScopeofWork‐WorktobeCompletedReconductoringandHazardMitigationProject

 

A.  The Services of  the project  include a  total of approximately 230 miles  that  shall  include  facility 

restoration activities including, but not limited to, the following types of tasks: 

Approximately 159 miles of single phase overhead power line reconductor/respan that will include 

retiring of existing #4 ACSR as well as poles and hardware. These projects will be rebuilt with new 

poles and #2 T2 ACSR conductor 

Approximately 14 miles of single phase overhead power line reconductor that will include replacing 

existing #1/0 ACSR conductor with #2 T2 ACSR conductor 

Approximately 19 miles of three phase overhead power line reconductor/respan that will include 

retiring of existing #4 ACSR as well as poles and hardware. These projects will be rebuilt with new 

poles and #2 T2 ACSR conductor 

Approximately 39 miles of three phase overhead power line reconductor that will include replacing 

existing #1/0 ACSR conductor with #2 T2 ACSR 

Poles that were set during the initial emergency restoration will be re‐used and will require Osmose 

butt wrap to be installed before they are reset. Any pole with newer than 2016 pole brand or if 

noted on staking sheet as “Return To Stock” (RTS) will be salvaged, including all associated material, 

and need to be re‐used within the project that it was retired from or returned to PEC’s warehouse. 

All salvaged materials shall be returned and checked into PEC’s warehouse. Quantities shown are 

approximate. Total miles and projects could be reduced or increased with no change to unit cost 

bids. 

Hazard mitigation projects  on  the  above projects  to  include  installing double  deadened,  storm 

guyed poles at a rate of 1 per mile as noted on staking sheets, each pole on single phase to have 2

down guy wire and anchors. On two and three phase lines, each pole to have 4 down guy wires and 

anchors.  

Some projects may be completed as improved projects utilizing different conductor sizes, pole sizes 

and span lengths. 

Additional repair work for lines that are only being re‐conductored will include but not be limited 

to; plumping and re‐tamping poles,  tightening hardware,  replacing damaged hardware,  fix pole 

grounds, tighten guy wire.  Line sections that did not qualify for reconductor will also require repair 

work as listed above and the repair and resagging of conductor.  

The projects above will be divided into projects ranging in size from .05 miles to 6 miles. 

V. DocumentationManagement&SupportContractor shall provide data management and support to PEC during the recovery effort including but not 

limited to the following: 

A. If required, Contractor shall supply certification placards meeting FEMA requirements and place 

such placards on its vehicles. 

B. Contractor shall have a system for clearly tracking and documenting all costs associated with work 

conducted pursuant to this RFP and resulting Agreement, identifying expenditures and maintaining 

documentation of the recovery process. 

Contractor must maintain all records pertaining to work performed pursuant to this RFP consistent with 

the requirements set forth in the Agreement. 

VI. Staff&EquipmentRequirementsContractor shall ensure that its work force, including subcontractors, maintains self‐sufficiency related to 

fuel, vehicle repair/maintenance, housing, sanitation, food and related accommodations in a manner that 

is consistent with local requirements and minimizing adverse effects on the community. 

VII. ReportingContractor shall submit weekly written reports to PEC documenting the progress of project.  These reports 

shall include, but are not limited to, the following: 

A. Progress  Reports  –  Contractor  shall  provide  reports  to  PEC  to  detail  the  progress  of  power 

restoration operations.  Such reports shall include: 

1. Contractor’s Name;

2. Report Date; 

3. Location of Completed Work to include work order number; 

4. A  description  of  areas  where  work  was  done,  and  a  general  overview  of  the  work 

completed  (including  a  breakdown  of  value  by  unit  or  time/materials/equipment,  as 

applicable); 

5. The number of trucks, other equipment and personnel utilized that day; and 

6. Other operational and complaint tracking information as requested by PEC. 

The format of the reports shall be provided by PEC. 

VIII. OtherOperationalConsiderationsA. Contractor may work seven (7) days per week including holidays and shall work through to 

project completion.  No outages shall be allowed on Sunday or Holidays. 

B. It will be understood that it is necessary for all work to be performed energized to keep outages 

to a minimum for the least amount of impact to PEC’s customers. Any outages must have a two‐

day notice given to PEC. All outages must be PEC approved. PEC reserves the right to deny 

allowance of all outages. 

C. Lesser Prairie habitat exist in the PEC service territory.  Contractor will need to be familiar with 

the Western Association of Fish & Wildlife Agencies (WAFWA) Lesser Prairie Chicken Range Wide 

Conservation Plan and must follow all guidelines and operational requirements. 

D. All new poles will be required to have PEC provided pole number tags installed.  Pole tags are part 

of the pole unit, no additional charge will be allowed. 

E. Prospective Contractor should visit and be familiarized with the project site prior to submitting 

bids. 

F. All materials for construction provided under the Agreement shall be furnished by PEC. 

G. Contractor must follow American Public Power Association Safety Manual. 

H. PEC is not the safety officer for the contractor. 

I. Contractor must be able to be familiarized with PEC’s construction standards. 

J. Each contract crew will only be able to have material for one job at a time. Material Vendor 

Warehouse will only be open Monday through Friday. 

K. Contractor will be responsible to note, on the staking to be turned in at the completion of each 

job, the correct pole tag number for each pole installed. 

L. Contractor will be monitored daily by an Inspector that will not have any affiliation to Contractor. 

Each project will also be inspected when each project is completed.   

M. Contractor must be familiar or be able to be familiarized with RUS construction units and 

standards.

N. Contractor Superintendent and foreman will be required to meet with PEC project managers and 

coordinators at PEC offices in Ulysses, KS, within ten (10) days of acceptance of the contract.  

Contractor shall be prepared to discuss manpower, planning and scheduling for the completion of 

the contract at this meeting.  

O. Clean up of restoration site as directed by PEC; removal of damaged facilities (broken poles, 

damaged conductors, damaged hardware etc.).  Contractor should immediately report 

transformer oil spills or other environmental concerns to PEC.  

P. Contractor shall be responsible for having all foreign facilities such as rural water lines, 

underground telephone, fiber optic cables, cable TV, gas pipelines, underground electrical and 

any other facilities that may be within the area or construction located prior to doing any work. 

Contractor shall be required to contact “Kansas‐One Call: to arrange for the locating of foreign 

utilities a minimum of 48 hours in advance of the start of construction. Contact “Kansas‐One Call” 

at 800/344‐7233 or DIAL 811. Attention: Not all utilities are member of “Kansas‐One Call”.  The 

contractor shall be responsible for all costs charged by others for location of and repair of the 

foreign facilities. 

Q. Contractor is required to salvage existing transformers, reclosers, capacitors, meters, all line 

conductor, and other equipment units (both PEC owned and customer‐owned), from the area as 

noted on sheet, and bring back to warehouse and sorted as directed by PEC. 

R. When working on the traveled portion or shoulder of any public road, the Contractor shall 

conform to all State or County Requirements. The Contractor shall post warning signs in all 

directions of traffic flow, and at no time is traffic to be blocked for more than 10 minutes, during 

which time the Contractor shall furnish an employee to direct traffic. Contractor employees shall 

wear high visibility shirts or vests when working. 

S. A copy of Commercial General Liability Insurance Policy shall be submitted with Bid Proposal.  

T. Contractor will be required to submit a copy of Commercial General Liability Insurance with PEC 

as additional insured before work begins.  

U. Vendor will be required to have or obtain: liability insurance covering operations of not less than 

$5 million each occurrence, property damage not less than 5 million each occurrence, and $5 

million aggregate for accidents, liability auto insurance covering $5 million per person, $5 million 

each occurrence, and $5 million property damage each occurrence 

V. In some cases, the landowner may request the retired poles. The Contractor must coordinate with 

landowner  for  retired  pole  disposal.  It  is  required  that  the  Contractor  furnish  PEC with  a  pole 

release form signed by the  landowner(s). Release forms will be supplied by the PEC. No retired 

poles requested by the landowner shall be left along the distribution line for pickup. All other poles 

will be disposed of at a PEC approved landfill, with accompanying receipts and documentation. 

W. Invoices  for  completed  jobs  which  has  passed  inspection  will  be  processed  within  20  days  of 

receipt, unless additional time is needed to obtain all necessary information required. 

X. Time is of the essence for the completion of the work described in this contract. It is anticipated 

by the parties that all work described herein will be completed before December 31, 2021, and

that any delay in the completion of the work described herein shall constitute a material breach 

of this contract. 

IX. BondingIf  at  any  time  Services  being  performed  are  deemed  to  include  construction  or  facility  improvement 

projects or subcontracts exceeding the Simplified Acquisition Threshold as defined by 48 C.F.R. Subpart 2.1 

(currently defined as $150,000), or if for any other reason PEC determines it necessary, PEC reserves the 

right to require the following: 

A. A bid guarantee from each Bidder equivalent to five percent (5%) of the bid price.  The “bid 

guarantee” must consist of a firm commitment, such as a bid bond, certified check, or other 

negotiable  instrument  accompanying  the  bid  as  assurance  that  the  bidder  will,  upon 

acceptance of the bid, execute such contractual documents as may be required within the time 

specified. 

B. A performance bond on the part of  the Contractor  for one hundred percent  (100%) of  the 

contract price.  A “performance bond” is one executed in connection with a contract to secure 

the fulfillment of all the contractor’s obligations under such contract. 

C. A payment bond on the part of the Contractor for one hundred percent (100%) of the contract 

price.  A “payment bond” is one executed in connection with a contract to assure payment as 

required  by  law  of  all  persons  supplying  labor  and  material  in  the  execution  of  the  work 

provided for in the contract. 

X. PreparationofProposals

A. QualificationsProposals must consist of the following information in the order indicated below: 

i. Cover  letter  stating  the  proposer’s  interest  in  the  project  with  signature  of  authorized 

representative. 

ii. Evidence of any and all relevant licenses and bonding. 

iii. List of at least three professional references from which PEC may determine Contractor’s record 

of past performance. 

iv. Disclosure of any actual or alleged safety violations in the last five (5) years to include DART Rate 

and OSHA 300 Log.

v. Description of Contractor’s technical resources, including explanation of overall project approach 

and a listing of equipment and employees. 

vi. Description  of  Contractor’s  financial  stability,  including  an  audited  financial  statement  and 

disclosure of pending claims and litigation. 

vii. History of Contractor’s debarment or suspension from Federal contracting, including certification 

that Contractor is not currently debarred or suspended. 

viii. A copy of Commercial General Liability Insurance Policy shall be submitted with Bid Proposal.  

ix. Status as a small or minority‐owned business, women’s business enterprise, or labor surplus area 

firm. 

x. Use  of  equipment  or  provision  of  services  that  conserve  natural  resources  and  protect  the 

environment and are energy efficient. 

 

xi. Operational plan to include the use of sub‐contractors. All sub‐contractors must be PEC approved 

prior to sub‐contractor start of work. 

B. PriceProposalContractor  shall  complete  the  Price  Proposal  Form  (bid  sheet)  provided with  this  RFP  and  include  any 

additional information to provide a complete, all‐inclusive price proposal for all services to be provided as 

outlined in this RFP, including supplying all equipment, tools and labor necessary to perform the Services.  

The  documentation  and  recovery  process,  including  plan  development,  mobilization,  demobilization, 

record keeping and quality control, shall be included in the prices. 

Contractor will be given detailed work orders locating the damaged facilities. A map is provided showing 

the areas that the damages have occurred. 

Cost‐plus‐a‐percentage‐of‐cost pricing is not permitted and any bid sheets containing such pricing will be 

rejected. 

PEC is requesting pricing based on “typical” crews and Contractor should therefore include information in 

its response to this RFP regarding the composition of what it considers to be a typical power restoration 

crew, including anticipated equipment to be used by such crew. 

XI. AcceptanceorRejectionofProposalsProposals  will  be  accepted  from  contractors  whose  proposals  are  responsive  to  the  RFP  and  most 

advantageous  to  PEC,  price,  quality,  and  other  factors  considered.    PEC  reserves  the  right,  at  its  sole 

discretion,  to reject any and all proposals or  to cancel  this RFP entirely  if determined to be  in  the best

interest of PEC.  PEC reserves the right, at its sole discretion, to waive any technicality in proposals provided 

such action is in the best interest of PEC. 

All proposals will be subject to a review and evaluation process.  All proposers responding to this RFP, who meet the requirements, shall be ranked in accordance with the criteria established in these documents.  PEC will  consider  all  responsive  and  responsible  proposals  received  in  its  evaluation  process.    PEC will consider the following evaluation criteria, in order of importance:  

o Contractor is appropriately licensed and bonded. 

o Contractor has an acceptable record of past performance. 

o Contractor has adequate financial and technical resources including consideration of: 

The ability, capability and skill of the proposer to perform the contract; 

The quality, availability and adaptability of the supplies or contractual services to the 

particular use required; 

The ability of the proposer to provide future service for the use of the subject of the 

contract; and 

Whether  the proposer can perform  the contract within  the  time specified, without 

delay or interference. 

o Price proposal. o Contractor has a satisfactory record of integrity and business ethics. 

o Contractor  is  not  currently  and  has  not  been  previously  suspended  or  debarred  from 

Federal  contracting;  or,  has  an  acceptable  explanation  for  any  previous  suspension  or 

debarment. 

o Contractor is adequately insured. 

o Contractor has met applicable bonding requirements. 

o Whether Contractor is a small or minority‐owned business, a women’s business enterprise, 

or a labor surplus area firm. 

o Use  of  equipment  and  services  that  conserve  natural  resources  and  protect  the environment and are energy efficient are preferred. 

o Responsiveness of the proposal. 

o The previous and existing compliance by the proposer with laws and ordinances relating 

to the contract. 

o The number and scope of conditions attached to the bid or proposal. o Responsiveness of client references. 

XII. Small&MinorityBusinesses,Women’sBusinessEnterprises,andLaborSurplusAreaFirms

All Contractors must work to ensure  fairness  in bidding and sub‐contracting procedures with small and 

minority businesses, women's business enterprises, and labor surplus area firms.  PEC will potentially use

federal  funding  for  some  or  all  of  the  work  covered  by  this  RFP;  therefore,  if  Contractor  intends  to 

subcontract any portion of the Services covered by this RFP and the resulting Agreement, Contractor must 

take  all  necessary  affirmative  steps  to  assure  that  small  and  minority  businesses,  women’s  business 

enterprises,  and  labor  surplus area  firms are solicited and used when possible.   Affirmative steps must 

include: 

i. placing qualified small and minority businesses and women’s business enterprises on 

solicitation lists; 

ii. assuring  that  small  and minority businesses,  and women’s business enterprises are 

solicited whenever they are potential sources; 

iii. dividing  total  requirements,  when  economically  feasible,  into  smaller  tasks  or 

quantities  to  permit maximum participation  by  small  and minority  businesses,  and 

women’s business enterprises; 

iv. establishing  delivery  schedules,  where  the  requirement  permits,  which  encourage 

participation by small and minority businesses, and women’s business enterprises; and 

v. using the services and assistance, as appropriate, of such organizations as the Small 

Business  Administration  and  the  Minority  Business  Development  Agency  of  the 

Department of Commerce. 

XIII. TermThe  term  of  this  Agreement  shall  begin  on  the  Effective  Date  of  this  Agreement  and  shall  expire  and 

terminate 2 years after such date or when the Services are complete and final payment has been made and 

accepted. 

XIV. MiscellaneousA. Any contractor that participated in developing or drafting this RFP is excluded from competing for 

any contract under this RFP. 

B. By submitting a response to the RFP, the proposer certifies that its Proposal has not been arrived at collusively or otherwise in violation of federal, state, or local laws. Any contract or Agreement from which any agent, officer, or employee of PEC or any relative thereof, will realize a financial gain, directly or  indirectly, shall be subject to termination by PEC consistent with  its policies for review of such matters. 

C. Small and minority‐owned businesses, women’s business enterprises, and labor surplus area firms 

are encouraged to respond to this RFP. 

D. The  contents  of  this  RFP  are  incorporated  into  the  Agreement.    Where  a  conflict  exists,  the 

Agreement prevails. 

E. Contractor shall supervise and direct the work, using skillful  labor and proper equipment for all tasks.  Safety of Contractor’s personnel and equipment is the responsibility of Contractor.

F. Contractor shall pay for all materials, personnel, taxes, and fees necessary to perform under the terms of the Agreement. 

G. Contractor must be duly licensed in accordance with the state and local statutory requirements to perform  the  work.    Contractor  shall  obtain  all  permits  necessary  to  complete  the  Services requested by this RFP and as covered by the resulting Agreement.  Contractor shall be responsible for determining what permits are necessary.  Copies of all permits shall be submitted to PEC for inspection. 

H. Contractor shall be responsible for removing all equipment from any public or private property.  Contractor is not permitted to store equipment or trucks on any public or private property without express permission of the owner.  

I. Contractor will ensure all necessary materials for job are provided by material vendor as noted on material list. Any additional material needed, other than for material changes that are agreed upon by PEC and Field Designer, must be purchased from Vendor at Contractor’s expense.
