I. Introduction

A. PURPOSE OF SOLICITATIONThis is a competitive grant solicitation to establish bulk purchase prices for electric school buses. The purpose of this Grant Funding Opportunity (GFO) is to select one or more electric school bus manufacturers and/or dealers to design, construct, and deliver electric school buses to public school districts, county offices of education (COEs), and joint power authorities currently operating home-to-school transportation programs on behalf of local educational agencies (JPAs) awarded in the School Bus Replacement for California Public School Districts, County Offices of Education, and Joint Power Authorities Solicitation, GFO-17-607.

B. BACKGROUNDSenate Bill 110 (SB 110), Chapter 55, Statutes of 2017 allocates up to $75 million to public school districts, county offices of education, and joint power authorities currently operating home-to-school transportation programs on behalf of local educational agencies, for school bus replacement grants through a program administered by the Energy Commission, in consultation with the California Air Resources Board (CARB). SB 110 appropriated remaining funds in the Proposition 39 K-12 Grant Program Funds and established the Clean Energy Job Creation Program for the purpose of funding a new School Bus Replacement Program, in addition to two other school related energy efficiency programs.

In accordance with SB 110, priority shall be given to public school districts, COEs, and JPAs operating the oldest school buses, school buses in school districts, COEs, and JPAs operating in disadvantaged communities, and public school districts, COEs, and JPAs with a majority of students eligible for free or reduced-price meals as reported in the 2017-18 First Principal Apportionment.

In May 2018, staff released GFO-17-607, School Bus Replacement for California Public School Districts, County Offices of Education, and Joint Power Authorities to determine the oldest diesel school buses eligible for replacement. The Energy Commission is emphasizing electric school buses as the preferred type of bus replacement. As an incentive, the Energy Commission is planning to provide up to $60,000 per awarded bus for electric vehicle charging infrastructure. Additionally, the Energy Commission expects to provide school districts, COEs, and JPAs awarded an electric bus under GFO-17-607, access to workforce development and training resources.

Staff articulated in GFO-17-607 a plan for a Phase II to solicit electric school bus vendors to design, construct, and deliver the replacement electric school buses to applicants awarded in Phase I. This GFO serves as Phase II.

Based on information from Phase I staff have estimated the number of buses needed. These estimates are listed below.

The estimated number of buses is the current best estimate of the number of buses that will be funded under GFO-17-607. Actual order numbers may increase or decrease, depending on factors such as the final bulk purchase bus prices and ability to leverage funding.

C. COMMITMENT TO DIVERSITYThe Energy Commission is committed to ensuring that participation the School Bus Replacement Program reflects the rich and diverse characteristics of California and its people. To meet this commitment, Energy Commission staff conducts outreach efforts and activities to:

Ensure potential new applicants throughout the state are aware of the Energy Commission's School Bus Replacement Program and the funding opportunities the program provides.

Encourage greater participation by underrepresented groups including disabled veteran-, women-, minority-, and LGBT-owned businesses.

Assist applicants in understanding how to apply for funding and awards from the Energy Commission's School Bus Replacement Program.

E. EXPECTED TIMEFRAMES FOR BUS DELIVERYThe Energy Commission expects the applicant(s) awarded under this solicitation to deliver buses promptly, in accordance with or ahead of the schedule below. Percentages are based on the number of buses actually needed or the maximum number of buses the applicant proposed, whichever is less.

The Energy Commission considers each of these timeframes as critical and Energy Commission staff may call one or more Critical Project Reviews (CPRs) during the term of the agreement to review progress in meeting these timeframes.

F. HOW AWARD IS DETERMINEDApplications passing administrative and technical screening will be scored based on evaluation criteria. Applications obtaining at least the minimum passing score will be ranked according to the bid amount in the Bus Bid Form. Awards will be recommended to the lowest bidder(s) by bus type. Lowest bid is defined as the lowest cost per bus as listed on the Bus Bid Form (Attachment 5).

If an Applicant cannot commit to providing all the buses estimated under a given bus type category, the Energy Commission may award agreements to the next lowest bidder until all of the estimated number of buses can be delivered. In this event, the awardee with the lowest bid will provide the number of buses that they commit to provide in their application. If more buses are needed, the qualified applicant with the next lowest bid will provide the remainder of the buses.

G. AVAILABILITY OF FUNDSA total of $0 is available for awards under this solicitation. No funding will be awarded under agreements resulting from this solicitation. This is a vendor select grant and the award(s) will be made to the responsible Applicant(s) who passes the technical evaluation and has the lowest bid. These bulk purchase price agreement(s) will establish the price for electric school buses. There will be no funds directly awarded by this GFO, and no funds are guaranteed to awardees under this GFO. However, awardees under GFO-17-607 will be encouraged to order from the Applicant(s) selected under this GFO. GFO-17-607 will award $75 million for use by public school districts, COEs, and JPAs to purchase electric school buses.

H. MAXIMUM NUMBER OF APPLICATIONSApplicants are only eligible to submit one application per electric school bus type per original equipment manufacturer (OEM) under this solicitation.

II. Eligibility Requirements

A. APPLICANT REQUIREMENTS

1. EligibilityThis solicitation is open to all public and private entities.

2. Terms and ConditionsEach grant agreement resulting from this solicitation will include terms and conditions that set forth the Recipient’s rights and responsibilities. By providing the required authorizations and certifications, each applicant agrees to enter into an agreement, if awarded, with the Energy Commission to conduct the proposed project according to the terms and conditions that correspond to its organization, without negotiation: (1) University of California terms and conditions; (2) U.S. Department of Energy terms and conditions; or (3) standard terms and conditions. The standard terms and conditions are located at http://www.energy.ca.gov/research/contractors.html.

Failure to agree to the terms and conditions by taking actions such as failing to sign the Application Form or indicating that acceptance is based on modification of the terms will result in rejection of the application. Applicants must read the terms and conditions carefully. The Energy Commission reserves the right to modify the terms and conditions prior to executing grant agreements.

3. Public Works Contractor RegistrationImportant: Applicant and Applicant’s subcontractors (if any) must be currently registered and qualified to perform public work pursuant to Labor Code Sections 1771.1(a) and 1725.5 prior to submission of an application.

Registration costs $400 and must be renewed on an annual basis. Registration can be done through the following Department of Industrial Relations webpage:

4. California Secretary of State RegistrationAll corporations, limited liability companies (LLCs), limited partnerships (LPs) and limited liability partnerships (LLPs) that conduct intrastate business in California are required to be registered and in good standing with the California Secretary of State prior to its project being recommended for approval at an Energy Commission Business Meeting. If not currently registered with the California Secretary of State, applicants are encouraged to contact the Secretary of State’s Office as soon as possible to avoid potential delays in beginning the proposed project(s) (should the application be successful). Sole proprietors using a fictitious business name must be registered with the appropriate county and provide evidence of registration to the Energy Commission prior to their project being recommended for approval at an Energy Commission Business Meeting.

B. PROJECT REQUIREMENTSEach application must be for only one type of bus. If an Applicant wants to apply for more than one bus type, a separate application package for each bus type must be submitted. must include one or more of the following bus types: There are 6 eligible bus types:

Type A without Chair Lift Type A with Chair Lift Type C without Chair Lift Type C with Chair Lift Type D without Chair Lift Type D with Chair Lift

For each bus type included in the application, the applicant must submit a separate Bus Bid Form (Attachment 5), and Bus Specification Form (Attachment 6).

Applications must address each scoring criterion in the Project Narrative separately for bus type A, C and D, as applicable. Applications only need to address the distinction between “with” and “without chair lift”, per bus type, if there is a relevant difference.

Applications for school buses submitted under this GFO must, at a minimum, meet the following requirements. Bids for buses that do not meet these minimum requirements may be deemed non-responsive and therefore be disqualified.

Bus must meet or exceed all applicable local, state, and federal laws, ordinances and requirements, including but not limited to all applicable safety and air quality regulations, and those reasonably anticipated.

Each bus must have the ability to charge with level 2 SAE J-1772 charging.

Each bus must be capable of vehicle-to-grid (V2G) bi-directional charging and discharging via use of type 1 combined charging system (CCS). The bus must be designed so that no hardware or firmware changes

are necessary to allow the bus to immediately serve demand that is independent of the utility grid (e.g. vehicle-to-load functions that are “islanded” or electrically separated from the utility system).

The bus must be able to receive a remote update enabling grid-interconnected V2G functions (e.g. vehicle-to-building functions connected to the utility system), upon completion of applicable requirements for safe electrical interconnection.

Each bus must include all of the following: Telematics (GPS data and vehicles mileage) with remote access. High efficiency All electric heating and air conditioning for the driver and

students. A sound generator for variable speeds for low speed safety. LED interior and exterior lights, including fog lights. At least 1 spare wheel and 1 spare tire. All tires must be appropriate for

chassis.

Body parts that are rust proofed after fabrication, and before assembly. Body shall be fully undercoated under floor, skirt panels and wheel wells prior to mounting on chassis.

AM/FM/CD/PA radio installed. Include wiring for 2-way radio system. First aid kit, dry fire extinguisher, triangle warning devices in container,

sun visor, CHP certificate holder, and hand held stop sign and holder. Maintenance manual provided. Manual must include wiring diagrams and

recommended service requirements for vehicle. A digital copy of maintenance manual must be provided as well.

Two front and two rear frame mounted tow hooks. Regenerative braking. Handrail for passenger entrance/exit.

Bus must have at least an 8-year warranty on the battery, a 20-year warranty on the body and chassis, and a 5-year service warranty on all additional components. Bus must have a warranty that covers at least: Battery: Seven (7) years, unlimited miles or cycles Chassis frame and cross members: body shell (floor, side walls,

roof, front and rear sections) must include rust-through. School bus seat and barrier frames: Eight (8) years, unlimited miles or cycles.

Materials and workmanship relating to the installation of the air conditioning: Two (2) years, unlimited miles or cycles

All original components not covered above or warrantied by other manufacturers: Five (5) years, unlimited miles or cycles

Bus must be CHP certifiable.

Bus must be HVIP eligible. Bus must be certified and issued an Executive Order by the California Air Resources Board (CARB) in accordance with the provisions of the California Interim Certification Procedures for 2004 and Subsequent Model Hybrid-Electric and Other Hybrid Vehicles, in the Urban Bus and Heavy-Duty Vehicle Classes , amended by CARB on October 21, 2014, or subsequent revisions: (http://www.arb.ca.gov/regact/2013/hdghg2013/hdghgfrohybridinterimcp.pdf).

Bus must be a model year 2019 or newer.

Type A buses must have a range of at least 70 miles per full charge.

Type C and D buses must have a range of at least 100 miles per full charge.

Base Bus provider must have at least one maintenance service provider in California.

Type A buses must have at least a 16 student capacity, or reduced seat count as appropriate for wheel chair position(s).

Type C buses must have at least a 44 student capacity, or reduced seat count as appropriate for wheel chair position(s).

Type D buses must have at least a 70 student capacity, or reduced seat count as appropriate for wheel chair position(s).

Type A buses must have a minimum GVWR of 8,000.

Bus provider commits to work with Energy Commission staff for branding. (i.e. additional school bus markings such as Energy Commission logo and electric school bus display graphic).

Bus provider commits to work with Energy Commission and contractors/partners related to workforce training and development for electric school buses.

Bus provider must demonstrate adequate manufacturing capability to begin production of bulk bus orders by July 1, 2019 and deliver the proposed maximum number of buses within the Expected Timeframes for Bus Delivery. “Adequate manufacturing capability” means that no upgrades are required to deliver the number of buses proposed in the timeframe required.

All costs related to manufacturing and delivering the bus to the Recipient including taxes shall be included in the cost of the bus included on the Bus Bid Form.

C. MATCH FUNDING REQUIREMENTSNo match funding is required under this solicitation.

D. LEVERAGED FUNDING Strategies that reduce the overall cost per bus (including the commitment of match funding) will increase both the competitiveness of the application under the technical evaluation criteria and cost competitiveness under this solicitation. III. Application Format, Required Documents, and Delivery

A. REQUIRED FORMAT FOR AN APPLICATIONThis section contains the format requirements and instructions on how to submit an application. The format is prescribed to assist the applicant in meeting State requirements and to enable the Energy Commission to evaluate each application uniformly and fairly. Applicants must follow all application format instructions, answer all questions, and supply all requested data.

All applications submitted under this solicitation must be typed or printed using a standard 11-point font, single-spaced and a blank line between paragraphs. Pages must be numbered and sections titled and printed back-to-back.

B. METHODS FOR DELIVERY

1. Electronic Submission through the Grant Solicitation SystemThe preferred method of delivery for this solicitation is the Energy Commission’s Grant Solicitation System (GSS), available at: https://gss.energy.ca.gov/. This online tool allows applicants to submit their electronic documents to the Energy Commission prior to the date and time specified in this solicitation. Electronic files must be in Microsoft Word (.doc format) and Excel Office Suite formats unless originally provided in the solicitation in another format. Attachments requiring signatures may be scanned and submitted in PDF format. The system will not allow applications to be submitted after the due date and time.

First time users must register as a new user to access the system. Applicants will receive a confirmation email after all required documents have been successfully uploaded. A tutorial of the system will be provided at the pre-application workshops and you may contact the Commission Agreement Officer identified in the Questions section of the solicitation for more assistance.

2. Hard Copy Submittals

a. Relevant Experience and Qualifications

1) Team Qualifications. Identify, by name, all key personnel assigned to the project, including the project manager, and clearly describe their individual areas of responsibility. The project manager is the one individual responsible for interacting with the CAM on all issues relating to the overall project and coordinating all aspects of work under the project.

Describe how the project team’s qualifications (including organizational structure, relevant expertise, experience, skill sets, and availability to contribute to the project) are suitable to the tasks described in the proposed Scope of Work.

2) Ability to Meet Deadlines. Describe demonstrated ability to meet deadlines and milestones of current or past bus delivery projects: identify project, size of project, location, schedule, completed deadlines and milestones, and verification contacts. Electric bus experience is likely to score higher.

3) Battery Electric Bus Experience. Describe verifiable experience related to battery electric bus distribution. Include specific experience related to bid’s bus type.

4) Partner(s) Qualifications. Explain and demonstrate how project team members’, key project partners’, and technology provider’s qualifications, skills, abilities, and relevant technical and business experience align with the needs of the project and with the successful completion of the proposed project.

5) Previous Awards. If Applicant has received an award(s) from a previous Energy Commission solicitation, Applicant must describe how the requirements of the agreement(s) have been fulfilled/are being fulfilled.

6) Litigation and Audit Findings. List any threatened, pending or filed litigation or dispute that might impact Applicant’s or proposed subcontractor(s) ability to perform the proposed project, and explain the extent and likelihood of Applicant’s or proposed subcontractor(s) potential liability, if any. In addition, provide details on any audit findings within the last five years on a project awarded to Applicant or proposed subcontractor(s) from an Energy Commission solicitation. Discuss how audit findings have been or are being resolved and the status of the resolution.

b. Employee Work Environment, Policies, and Practices

In addition to addressing Employee Work Environment, Policies, and Practices in the project narrative, applicants must provide copies of policies relevant to items 1-6 as an attachment or with a direct link. Policies will not be part of the maximum number of pages.

Use references, such as Bureau of Labor Statistics surveys, located at https://www.bls.gov/iag/tgs/iag31-33.htm, and California Labor Market Information Division data and information, to complete this section. Where relevant identify baseline data with citations and assumptions.

1) Full-Time Employment. Discuss the number of employees in the core workforce with direct, year-round employment of at least 35 hours per week, in relation to total number of employees. Discuss employee turnover, in relation to industry turnover standards. Include citations and assumptions.

2) Training and Upward Mobility. Discuss employee opportunities for training, employee development programs, career coaching services, or targeted counseling services for employees. In addition, discuss how employees receive performance reviews.

3) Wage Levels. Describe how employees’ wage levels compete with the industry, relevant occupations, and the average wages for the occupation in the state. Include citations and assumptions.

4) Transparency. Describe the process used to ensure policies are easily accessible, relevant and enforceable. Provide copies or links to employee policies, handbooks, or employee orientation documentation, which include policies on the availability of paid leave, scheduling practices, and a clear and fair grievance process.

5) Benefits. Discuss the benefits provided to employees. Include a discussion of paid leave, dental insurance, retirement plan, subsidized child care, dependent care, transit passes, or paid family medical leave over and above any state-provided leave, if applicable. In addition, discuss how employer-supported medical insurance is “affordable”, as defined by the Affordable Care Act. Include citations and assumptions.

6) Scheduling. Describe scheduling practices. Explain how Applicant ensures predictable schedules, employees are informed of their schedule in advance, rest is given between shifts, and compensation is provided when the schedule changes.

c. Project Readiness and Implementation

1) Number of Buses. Identify the number of buses that can be produced within the timeframe specified in this GFO.

2) Timing. Applicant must complete all production and delivery within the Expected Timeframes for Bus Delivery.

i. Describe the proposed schedule for delivery of bulk order buses purchased. Discuss the strategy for expediting bulk order delivery deadlines and why the Applicant’s proposed schedule for delivery is reasonable.

ii. Describe how the Applicant can address purchase orders with delayed delivery requirements.

iii. Identify the risks associated with fulfilling the bulk order on the proposed schedule. Describe the methods the Applicant will use to effectively manage and mitigate those risks. At a minimum, Applicant should address risks associated with construction, cost overruns, supply chain management, technology, and customer-induced delays.

iv. Describe how the Applicant will assist customers in preparing bus sites for infrastructure, including pairing buses with appropriate charging technology, determining the need for utility upgrades if any, and timing bus delivery with infrastructure installation.

d. Battery and Fuel Range

1) Management. Describe the type of battery management system included with the bus. Discuss how the battery management system facilitates smart charging, and the system’s ability to, and rate at which it will, record and report data.

2) Range. Certify the range of each bus type, and describe the process used to arrive at the range. This should include a

description of the duty cycle used, and why it is appropriate. Include information on the expected range for the electric bus. Also, describe the way the battery, and battery management system, are optimized for range. Provide a range and description for each type of bus in the application.

3) Degradation. Discuss the rate of expected battery degradation on a per year basis.

4) Replacement. Discuss how the process for replacing the bus battery will be simplified and the costs minimized.

5) Disposal. Discuss the Bidder’s proposed plan for battery disposal or reuse.

e. Warranty, Service and Support

1) Warranty. Describe the bus warranty. Include information on the length of the warranty for the bus, battery, and body/chassis, list the items covered by the warranty.

2) Service. Describe how technicians will fix issues under warranty. Discuss how supply chain is managed to ensure that parts are available when required for maintenance to minimize maintenance delays for customers.

3) Support. Describe the strategy for maintenance after expiration of the warranty. Discuss training for basic repairs and maintenance available for customer fleets, as well as repair/maintenance manuals and wiring diagrams provided to customers, if applicable.

f. InnovationDescribe the Bidder’s manufacturing innovations that improve the consumer driving or charging experience, or increase bus or charging cost-effectiveness. Innovations may include, but are not limited to:

1) Unique or advanced features of the bus technology.

2) Efficiencies in supply chain management.

3) Ability to provide temporary charging to customers.

g. Economic Benefits to California Applicants should provide assumptions and background information to support any direct and indirect economic impacts, or multiplier effects being claimed.

1) Business Opportunities. Describe how the bulk bus order will expand business opportunities for California-based businesses, including suppliers, projects participants, and distributors.

2) Job Creation. Describe how the bulk order will result in high-quality jobs in terms of compensation and duration and related project payroll.

3) Taxes. Include the projected state and local tax impacts that will be generated.

4) Disadvantaged Communities. Describe how project benefits will benefit disadvantaged communities within California (as defined by CalEnviroScreen 3.0).1

h. Ability to Leverage Funding Applicants must discuss other sources of funding (including but not limited to federal, state, and local funding) that can be used in conjunction with this program. Applicants will be scored on their ability to secure additional funding that reduces the overall cost of the bus.

3. ResumesApplicants must include resumes for key personnel identified in the application. Resumes are limited to a maximum of 2 pages each.

4. Client References The Applicant must submit a complete reference list of   a reference list from at least five (5) electric bus clients covering the period from 9/30/2016 to 12/1/2018 and a complete list of government grants related to electric buses for the past four years. If the Applicant does not have a reference list of 5 electric bus clients, the Applicant may substitute with a reference list of up to 5 conventional school bus clients; however, references with specific experience related to electric school bus clients are likely to score better than references that do not.

5. Letters of Support/CommitmentApplicants must include appropriate letters of support/commitment. Letters must include sufficient contact information so the Energy Commission is able to efficiently contact the letter writer, as necessary. Letters must be limited to 2 pages each.

a. Key Project Partners (if applicable): Key project partners identified in the application must provide letters demonstrating their commitment to the proposed project and their ability to fulfill their identified roles. For dealership applicants, this includes the applicable bus manufacturers.

b. Third-party Leveraged Funding Contributors (if applicable): Any third-party funding contributors must provide letters that identify the intended amount of funding committed, the funding source(s), and state that the funding contributor will provide the identified amount of funds. Letters of commitment from third party funding contributors must contain a telephone number to allow the Energy Commission to contact the funding

partner or representative to confirm their authority to commit funds to the proposed project.

c. Letters of Support (optional): Applicants are encouraged to submit letter(s) of support that substantiate the estimated demand and/or the potential benefits of the proposed project. Third-party letters of support can be provided by, but are not limited to: air districts, state or federal agencies, local safety officials, potential users of the proposed project, and any other relevant organizations.

6. Contact ListApplicants must include a completed Contact List (Attachment 3) by including the appropriate points of contact for the Applicant. The Energy Commission will complete the Energy Commission points of contact during agreement development.

7. CEQA WorksheetApplicants must include a completed CEQA Worksheet (Attachment 4). The Energy Commission requires this information to assist it in making its own determination under the California Environmental Quality Act (Public Resources Code Section §§ 21000 et seq).

Applicants must complete the detailed CEQA Worksheet and submit it with their application. This worksheet will help applicants and the Energy Commission to determine CEQA compliance obligations by identifying which projects may require more extensive CEQA review. Failure to complete the worksheet may lead to disqualification of the application.

Applicants are encouraged to provide documentation of communication with the local lead agency, if one exists (e.g., a county or city). Documentation such as a completed notice of exemption, a letter from the local agency acknowledging their role in the CEQA process, or a permit application to the lead agency that is stamped as received. If no CEQA review would be required by the local lead agency, provide documentation (letter or e-mail) from the local agency explaining why not.

8. Other Necessary DocumentsIt is the intent of this solicitation to provide all necessary information for school districts, county offices of education and joint power authorities awarded under GFO-17-607 to be able to order school buses from the awardees under this solicitation. If there are any documents Applicants typically provide to assist in the award, provide them here.

REMINDER: For hard copy submittals, the following forms must be in a separately sealed package and labeled as “Bus Bid Forms.”

9. Bus Bid FormApplicants must include a complete Bus Bid Form (Attachment 5). Information in this form will be used during Bus Bid Evaluation. The Cost Per Bus and Maximum Number of Buses in this form must reflect the cost per bus and maximum number of buses the applicant will deliver if selected for an award.

The Cost Per Bus and Maximum Number of Buses cannot be made conditional. For example, it cannot be made conditional upon securing of leveraged funding. Awardees may negotiate with school districts, county offices of education and joint power authorities to provide lower bus prices at their discretion.

The information provided on this form will not be kept confidential.

IMPORTANT - Payment of Prevailing Wage and Compliance Monitoring:All projects resulting from an award under this solicitation are “public works” and subject to requirements under Public Works Laws (Labor Code Sections 1720 et seq.), including the payment of prevailing wages. Therefore, Recipient and Recipient’s subcontractors will be required to comply with all Public Works Laws, including to pay prevailing wages for work performed under the resulting Agreement.

The prevailing wage rates to be paid by Recipient and Recipient’s subcontractors for work performed under the resulting Agreement shall be:

The Cost Per Bus submitted by Applicant on the Bus Bid Form must take into account the payment of the prevailing wage rates listed above.

Applicants must read and pay particular attention to the Terms and Conditions Attachment 8. For terms and conditions related to Public Works Laws see Exhibit D of Attachment 8.

As required by Labor Code Section 1771.4(a)(1), the Commission is specifying in this solicitation that the resulting “project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.”

10. Bus Specifications FormThe Bus Specifications Form (Attachment 6) will not be evaluated, but will be included in the agreements resulting from this solicitation. This form is expected to provide optional bus specifications and prices for school districts, county offices of education, and joint power authorities to expedite bus orders. The information in this form will be binding upon applicants if selected for an award.

IV. Evaluation Process and Criteria

A. APPLICATION EVALUATIONThis section explains how the applications will be evaluated.

Applications will be evaluated and scored based on the responses to the information requested in this solicitation. The entire evaluation process from receipt of applications to posting of the Notice of Proposed Award is confidential.

To evaluate all applications, the Energy Commission will organize an Evaluation Committee. The Evaluation Committee may consist of Energy Commission staff or staff of other California state entities. The Evaluation Committee may consult state employees who are industry experts; however, industry experts will not provide a score and will be bound by confidentiality agreements.

1. Screening CriteriaThe Contracts, Grants and Loans Office will screen applications for compliance with the Administrative Screening Criteria. The Evaluation Committee will screen applications for compliance with the Technical Screening criteria. Applications that fail any of the Administrative or Technical Screening Criteria shall be disqualified and eliminated from further evaluation.

2. Administrative Screening Criteria

5. Technical EvaluationApplications passing all screening criteria will be submitted to the Evaluation Committee to review and score based on the Technical Evaluation Criteria in this solicitation.

The Evaluation Committee reserves the right to schedule a clarification interview with an applicant that will either be held by telephone or in person at the Energy Commission for the purpose of clarification and verification of information provided in the application. However, these interviews may not be used to change or add to the contents of the original application. Applicants will not be reimbursed for time spent answering clarifying questions.

The total score for each application will be the average of the combined scores of all Evaluation Committee members. A minimum score of 70 percent (14 points) is required for Criterion #1: Relevant Experience and Qualifications to be eligible for an award. Additionally, a minimum overall score of 70 percent (70 points) is required for the application to pass the Technical Evaluation. Applications not attaining at least 14 points for Criterion #1 or at least 70 points overall will be eliminated from the competition and will not move on to the Bus Bid Evaluation.

6. Bus Bid EvaluationApplications passing the Technical Evaluation will compete in the Bus Bid Evaluation, where the lowest bid will be awarded. Low bid is defined as the lowest Cost Per Bus as listed on the Bus Bid Form (Attachment 5). The Evaluation Committee will separate the Bus Bid Forms by bus type (i.e., Type A, Type C, Type D; and each type with or without chair lifts) and rank Bus Bid Forms in order from lowest cost per bus to highest cost per bus by bus type. Bus Bid Forms will not be viewed by the Evaluation Committee prior to Bus Bid Evaluation.

The Evaluation Committee will propose the lowest cost application for award. If that application indicates that the maximum number of buses delivered is less than the estimated Quantity Needed (see table below), the Evaluation Committee will propose awarding additional applicant(s) according to the ranked order until the total proposed maximum number of buses delivered meets or exceeds the estimated number of buses needed for that bus type.

Important: The Cost Per Bus submitted by Applicant on the Bus Bid Form must take into account the payment of prevailing wages. The prevailing wage rates to be paid by Recipient and Recipient’s subcontractors for work performed under an Agreement resulting from this solicitation shall be:

4. Since Applicant 1 has the second lowest bid, Applicant 1 is awarded second. Because the estimated number of Type D without chair lift buses needed is now 9535 buses, Applicant 1’s 125 buses offered exceeds the estimated need.

5. Applicant 2 will be allowed to provide up to the first 75 buses. Applicant 1 will provide the remaining 9535 buses.

6. It should be noted that, because the Energy Commission is only able to provide an estimate of the number of buses needed, Applicant 1, like any other applicant recommended for award, may see a difference in orders from the 95 buses this calculation suggests. The actual number of orders may be increased or decreased depending on how many school

B. NOTICE OF PROPOSED AWARDSThe results of the evaluation will be posted in a Notice of Proposed Awards (NOPA) and will include the rank order of applicants, the awardee(s), and the quantity, cost per bus, and type of bus awarded. The Energy Commission will post the NOPA at the Energy Commission’s headquarters in Sacramento, publish the NOPA on the Energy Commission’s website, and mail the NOPA to all parties that submitted an application.

C. DEBRIEFINGSUnsuccessful applicants may request a debriefing after the release of the NOPA. A request for debriefing should be received no later than 15 days after the NOPA is released.

D. TIE BREAKERSIf two or more applications are tied in the Bus Bid Evaluation, the application with a higher overall score in the Technical Evaluation will be ranked higher. If still tied, an objective tie-breaker (such as a random drawing) will be utilized.

E. ERRORSIf an applicant discovers any ambiguity, conflict, discrepancy, omission, or other error in the solicitation, the applicant shall immediately notify the Energy Commission of such error in writing and request modification or clarification of the document. Modifications or clarifications will be given by written notice of all parties who requested the solicitation, without divulging the source of the request for clarification. The Energy Commission shall not be responsible for failure to correct errors.

F. MODIFYING OR WITHDRAWAL OF APPLICATIONAn applicant may, by letter to the Commission Agreement Officer at the Energy Commission, withdraw or modify a submitted application before the deadline to submit applications. Applications cannot be changed after that date and time. An application cannot be “timed” to expire on a specific date. For example, a statement such as the following is non-responsive to the solicitation: “This application and the cost estimate are valid for 60 days.”

G. IMMATERIAL DEFECTThe Energy Commission may waive any immaterial defect or deviation contained in an applicant’s application. The Energy Commission’s waiver shall in no way modify the application or excuse the successful applicant from full compliance.

H. DISPOSITION OF APPLICANT’S DOCUMENTSThe entire evaluation process from receipt of applications up to the posting of the Notice of Proposed Award is confidential. On the Notice of Proposed Award posting date, or date of solicitation cancellation, all applications and related material submitted in response to this solicitation become a part of the property of the State and public record. Applicants who want any work examples they submitted with their applications returned to them shall make this request and provide either sufficient postage or a Courier Charge Code to fund the cost of returning the examples.

I. APPLICANTS’ ADMONISHMENTThis solicitation contains the instructions governing the requirements for a firm quotation to be submitted by interested applicants, the format in which the technical information is to be submitted, the material to be included, the requirements which must be met to be eligible for consideration, and applicant responsibilities. Applicants must take the responsibility to carefully read the entire solicitation, ask appropriate questions in a timely manner, submit all required responses in a complete manner by the required date and time, and make sure that all procedures and requirements of the solicitation are followed and appropriately addressed.

J. AGREEMENT REQUIREMENTSThe content of this solicitation shall be incorporated by reference into the final agreement. See the sample agreement terms and conditions included in this solicitation.

The Energy Commission reserves the right to negotiate with applicants to modify the project scope, the level of funding, or both. If the Energy Commission is unable to successfully negotiate and execute an agreement with an applicant, the Energy Commission, at its sole discretion, reserves the right to cancel the pending award and award the next highest ranked eligible project.

The Energy Commission must formally approve all proposed grant awards. All agreements must be scheduled and considered at an Energy Commission Business Meeting for approval by the Energy Commission.

Public agencies that receive an award under this solicitation must provide an authorizing resolution approved by their governing authority to enter into an agreement with the Energy Commission and designating an authorized representative to sign.

The Energy Commission will send the approved agreement, including the terms and conditions, to the grant Recipient for review, approval, and signature. Once the grant Recipient signs, the Energy Commission will fully execute the agreement. Recipients are approved to begin the project only after full execution of the agreement.

K. NO AGREEMENT UNTIL SIGNED AND APPROVEDNo agreement between the Energy Commission and the successful applicant is in effect until the agreement is signed by the Recipient, approved at an Energy Commission Business Meeting, and signed by the Energy Commission representative.
