P.D. NO. 1096, THE 1977 NBCP (THE LAW) AND ITS STREAM OF REGULATIONS: 1) P.D. No. 1096, the 1977 NBCP, the law and legal basis for the NBCP stream of regulations; the NBCP sets the minimum standards for building design and construction; this is for mandatory compliance by all; being only the minimum standards, the NBCP can be exceeded by more stringent or stricter standards that may be required by public and private entities; 2) the 2004 Revised IRR of the NBCP (with initial guidelines); per SC doctrine, the Revised IRR is part of the law (if not the law itself), hence for mandatory compliance by all; 3) the NBCP Referral Codes (RCs) consisting of other laws, rules and regulations, executive issuances (EIs), and self-regulatory documents (SRDs) by the professional associations (POs); the first 2 are mandatory; the last 2 i.e. EIs and SRDs by POs, while setting standards higher (i.e. more stringent or stricter) than the NBCP or its Revised IRR, are only for optional compliance; the NBCP also serves as a RC of other development-oriented laws such as P.D. No. 957 (on Condominiums, Subdivisions and Open and Medium Cost Housing) and B.P. Blg. 220 (on Economic and Socialized Housing); 4) the NBCP Derivative Regulations (DRs) which may take the form of DPWH Department Administrative Orders (DAOs) addressed to all DPWH employees and staff or Memorandum Circulars (MCs) addressed to all Local Building officials (LBOs) nationwide; these are for mandatory compliance by the DPWH staff/ employees and LBOs nationwide; 5) soon to be promulgated DPWH Design Guidelines (initially for public buildings), which may be considered only for optional compliance if the concerned provisions are decidedly more stringent or stricter (and therefore potentially more expensive) than the minimum set under the NBCP or its Revised IRR; and 6) NBCP Manual of Procedure/ MoP (initially for public buildings), which may be considered only for optional compliance if the concerned provisions are decidedly more stringent or stricter (and therefore potentially more expensive to comply with) as compared to the minimum set under the NBCP or its Revised IRR; the NBCP MoP should readily tell the target users i.e. designers, LBOs, developers, constructors, etc. as to what to do when confronted by a situation, the responses to which should be based on the collective experiences of NBCP users in the past e.g. designers, LBOs, developers, constructors, etc.; this is the last document in the NBCP stream of regulations and does not yet exist.

THE NBCP REFERRAL CODES (RCs) The following are what may be considered as the REFERRAL CODES (RCs) of P.D. No. 1096, the 1977 National Building Code of the Philippines (NBCP) i.e. constituting the complementary laws, rules, regulations, standards and guidelines for architectural and allied design/ works. The same are official references that are typically used by the DPWH and its agents nationwide in the review of building plans, specifically of ARCHITECTURAL documents, to wit: 1) the latest derivative regulations (DRs, such as Department Orders/DAs issued to all

DPWH employees and staff and DPWH Memorandum Circulars/MCs issued to Local Building Officials/LBOs nationwide), in compliance with the 1977 NBCP (P.D. No. 1096) and its 2004 Revised (or later) IRR;

2) 2008 Fire Code (R.A. No. 9514) and its 2009 or later IRR; 3) P.D. No. 957 dated July 12, 1976, Regulating The Sale of Subdivision Lots and Condominiums and its

latest IRR promulgated by the HLURB (i.e. a RC specifically on matters pertaining to condominiums, subdivisions and open and medium market housing developments and on the site planning for such developments);

4) Batas Pambansa (B.P.) Blg. 220 dated March 25, 1982, An Act Authorizing the Ministry of Human Settlements to Establish and Promulgate Different Levels of Standards and Technical Requirements for Economic and Socialized Housing Projects in Urban and Rural Areas from Those Provided Under P.D. No. 957, P.D. No. 1216, P.D. No. 1096 (NBCP) and P.D. No. 1185 (old FCP) and its latest IRR (i.e. a RC specifically on matters pertaining to economic and low-cost/socialized housing developments and on the site planning for such developments);

5) Architecture Law of the Philippines (R.A. No. 9266 and its 2004 or later IRR) and the 2000 or later Architectural Code promulgated by the DPWH (as an executive issuance, not as a law);

1983 Accessibility Law (B.P. Blg. 344) and its latest IRR; 6) Revised National Plumbing Code of the Philippines (latest edition); 7) Various other professional regulatory laws (PRLs) governing the State-regulated practice of the various

allied design professions (geology, environmental planning, landscape architecture, master plumbing, interior design, etc.); and

8) Environmental laws and laws dealing with climate change adaptation and disaster risk reduction. The following are the engineering guidelines and references that are typically utilized by DPWH: 1) National Structural Code of the Philippines(NSCP), 2010 or latest edition; 2) the DPWH Blue Book in its latest edition; 3) Philippine Electrical Code (last updated 2009 or latest edition); 4) Philippine Society of Mechanical Engineering/ PSME Code (latest edition); 5) 1974 Code on Sanitation of the Philippines (CSP) (P.D. No. 856) and relevant Department of Health

(DoH) issuances (latest editions); 6) Relevant DPWH Orders, Memorandum Circulars (MCs), specifically those addressed to Local Building

Officials (LBOs), etc.; and 7) Various other professional regulatory laws (PRLs) governing the State-regulated practice of the various

engineering professions (geodetic, civil, electrical, mechanical, electronic, sanitary, etc.).

The following are laws that incorporate elements of building and facility planning/ design references and are NOT utilized by DPWH as these are under independent agencies such as the PEZA and the TIEZA, to wit: 1) R.A. No. 7916, as amended by R.A. No. 8748, The Special Economic Zone Act of 1995, also known as

An Act Providing for the Legal Framework and Mechanisms for the Creation, Operation, Administration, and Coordination of Special Economic Zones in the Philippines, Creating for this Purpose, the Philippine Economic Zone Authority (PEZA), which also gave rise to the PEZA OBOs; and its latest IRR; and

2) R.A. No. 9593, The Tourism Act of 2009 which created the Tourism Infrastructure and Enterprise Zone Authority (TIEZA) and its OBO; and its latest IRR.

Other applicable building standards i.e. standards that are not found in the NBCP or that are more detailed than those found in the NBCP (in their latest editions), but which are subject to review by the LGU Office of the Building Official (OBO) are as follows: 1) for hospitals and health care facilities c/o the DoH; 2) for primary and secondary school buildings c/o the DepEd; 3) for tertiary school buildings c/o the CHED; 4) for public markets c/o the DTI and/or the HLURB and HUDCC; 5) for recreational facilities c/o the HLURB and HUDCC; 6) for sports facilities c/o the PSC; 7) for heritage conservation facilities c/o the NCCA; 8) for office and residential condominiums c/o the HLURB and HUDCC; 9) for economic housing c/o the HLURB and HUDCC; and 10) socialized housing c/o the NHA and HUDCC i.e. following B.P. Blg. 220 standards rather than P.D. No.

1096 standards. Other applicable building standards i.e. standards that are not found in the NBCP or that are more detailed than those found in the NBCP (in their latest editions), but which are NOT subject to review by the LGU Office of the Building Official (OBO) but are instead are instead reviewed and approved by the respective internal/ independent OBOs, are as follows: 1) for industrial buildings c/o the PEZA; and 2) for tourism facilities c/o the TIEZA. The following laws (both valid and subsisting) use P.D. No. 1096, the 1977 National Building Code of the Philippines (NBCP) as their REFERRAL CODES (RCs), to wit: 1) P.D. No. 957 dated July 12, 1976, Regulating The Sale of Subdivision Lots and Condominiums and its latest IRR promulgated by the HLURB; and 2) Batas Pambansa (B.P.) Blg. 220 dated March 25, 1982, An Act Authorizing the Ministry of Human Settlements to Establish and Promulgate Different Levels of Standards and Technical Requirements for Economic and Socialized Housing Projects in Urban and Rural Areas from Those Provided Under P.D. No. 957, P.D. No. 1216, P.D. No. 1096 (NBCP) and P.D. No. 1185 (old FCP) and its latest IRR; note that B.P. Blg. 220 space planning and building design and construction standards are LOWER than P.D. No. 1096 (1977 NBCP) standards.
