Republic Act No 5487 ISANG ACT SA ayusin ang organisasyon at pagpapatakbo NG PRIBADONG tiktik, WATCHMEN SEGURIDAD O GUARDS AHENSIYA. (Rep Act No 5487, bilang susugan sa pamamagitan ng Presidential decree No 11. ) Seksyon 1. Maikling Title ng Act. Batas na ito ay dapat na kilala bilang "Ang mga Private Security Agency Law." (B) Pribadong tiktik Agency. (Rep Act No 5487, bilang susugan sa pamamagitan ng Presidential decree No 11. )

Seksyon 1. Maikling Title ng Act. Batas na ito ay dapat na kilala bilang "Ang mga Private Security Agency Law."

Seksyon 2. Saklaw ng Batas na ito. Ang organisasyon, na operasyon, sa negosyo at mga gawain ng mga pribadong detectives, watchmen o security guards ahensiya ay dapat na pamamahalaan ng mga probisyon ng Batas na ito.

Seksyon 3. Kahulugan ng mga Tuntunin. (A) Tao. Tulad ng ginagamit sa Batas na ito, ang tao ay dapat kabilang ang hindi lamang likas na tao kundi pati na rin juridical tao tulad ng korporasyon, sosyohan, kumpanya o samahan gaya ng nararapat na nakarehistro sa Securities and Exchange Commission at / o ang Bureau of Commerce. (B) Pribadong tiktik Agency. Seksyon 4. Sino May Ayusin ang isang Security o tanod Agency. Anumang Filipino citizen o isang korporasyon, sosyohan, samahan o, na may isang minimum na capital ng 5000 piso, isang daang porsyento ng kung saan ay pag-aari at kontrolado ng Filipino mamamayan ay maaaring isaayos ang isang security tanod o ahensiya: Ibinibigay, Iyon walang tao ay dapat ayusin o magkaroon ng isang interes sa, higit sa isang tulad ahensiya maliban sa mga na kung saan ay umiiral na sa pagpapahayag ng atas na ito: Ibinibigay, karagdagang, na ang operator o manager ng nasabing ahensiya ay dapat hindi bababa sa 25 taong gulang, isang college graduate at / o isang commissioned opisyal sa di-aktibo sa serbisyo ng Hukbong Sandatahan ng Pilipinas; ng mabuting moral character; walang nakaraang record ng anumang mga matibay na paniniwala ng anumang krimen o pagkakasala na kinasasangkutan moral kahiya-hiyang kasamaan at hindi paghihirap mula sa alinman sa mga sumusunod disqualifications:

(1) Ang pagkakaroon ng nai-dishonorably pinalabas o separated mula sa Hukbong Sandatahan ng Pilipinas;

(2) Ang pagiging isang walang kakayahan sa kaisipan;

(3) Ang pagiging sugapa sa paggamit ng gamot na pampamanhid gamot o mga bawal na gamot; at

Para sa mga layunin ng Batas na ito, inihahalal o appointive pamahalaan mga empleyado na maaaring tinatawag na sa sa account ng ang mga function ng kani-kanilang mga opisina sa pagpapatupad at pagpapatupad ng mga probisyon ng Batas na ito at ang anumang mga tao na may kaugnayan sa ganoong mga empleyado ng gobyerno sa pamamagitan ng relasyon o pagkakamag-anak sa ikatlong antas sibil ay hindi dapat humawak ng anumang interes, sa tuwiran o di-tuwirang sa anumang seguridad o bantay tanod ahensiya. Section 5. Qualifications Kinakailangan. Walang tao ay dapat na nagtatrabaho bilang seguridad o bantay tanod o pribadong tiktik maliban na lamang kung siya ay: (a) ang isang Filipino citizen; (b) ang isang mataas na nagtapos ng paaralan; (c) pisikal at itak magkasya; (d) ay hindi mas mababa sa 21 o higit pa sa 50 taong gulang; (e) ng hindi bababa sa 5 mga paa at 4 na pulgada sa taas; at (f) paghihirap wala sa mga disqualifications na ibinigay para sa seksyon na sinusundan: Ibinibigay, Iyon dayuhan ay na nagtatrabaho bilang watchmen o security guards bago ang approval ng Batas na ito ay hindi dapat na napapailalim sa mga nabanggit na kinakailangan: Ibinibigay, karagdagang, Na Veterans ay dapat na binibigyan ng prayoridad sa pagtatrabaho bilang security bantay, tanod o pribadong tiktik: At ibinigay, sa wakas, na nahatulan tao ng anumang mga krimen na kinasasangkutan moral kahiya-hiyang kasamaan ay hindi dapat nagtatrabaho bilang security bantay, tanod o pribadong tiktik.

Section 6. License kailangang. Section 7. Aplikasyon para sa License. Ang mga aplikasyon ay dapat gawin sa pamamagitan ng sulat at dapat isampa sa Chief, Philippine tanod-bansa. Ito ay dapat naglalaman ng mga buong pangalan ng aplikante, ang kanyang edad, civil status, kanyang paninirahan, at lokasyon ng negosyo. Kung ang aplikante ay isang korporasyon, asosasyon o samahan, ang isang kopya ng sertipiko ng rehistrasyon sa Securities and Exchange Commission kasama nito sa pamamagitan ng-batas at mga artikulo ng pagsasama, sa Bureau of Commerce.

Section 8. Bayad na bayad at Bonds. Kapag ang lahat ng mga requisites para sa pagpapalabas ng lisensiya ay complied sa, ang Chief ng Philippine tanod-bansa o ang kanyang gaya ng nararapat awtorisadong kinatawan ay dapat na isyu ng pahintulot para sa pagpapalabas ng mga tulad ng lisensiya at magrehistro ang parehong sa ang kanyang opisina, sa pagbabayad ng aplikante ng bayad alinsunod sa mga sumusunod na iskedyul:

(C) ang kabuuan ng 2005 piso sa isang taon bilang lisensiya munisipal na bayad para sa anumang mga munisipyo kung saan ito ay maaaring gumana, ang sinabi fee na kailangang bayaran sa munisipyo ingat-yaman-aalala;

(D) ang mga pribadong tiktik at tanod Agency ay dapat sa karagdagan sa itaas magbayad ng isang nakapirming Internal Revenue ng Tax isang daang piso sa isang taon bilang kapalit ng mga buwis sa porsyento;

(E) ang mga indibidwal na mga pribadong tiktik at / o tanod ay dapat magbayad para sa Mayor's Permit, Health at / o may kinalaman sa kalusugan bayad sa isang halaga na hindi hihigit sa tatlong piso sa isang taon at ang ahensiya ay dapat bayaran ang sum ay hindi hihigit sa sampung piso para sa Mayor's Permit at Kalusugan at / mabuti sa kalusugan o mga bayad; at

Ang aplikasyon ay dapat karagdagang ay sinamahan ng isang bono na inisyu ng anumang karampatang mga kagalang-galang o garantiya o katapatan o kompanya ng seguro gaya ng nararapat pinaniwalaan ng mga opisina ng Insurance Commissioner sa kabuuan ng hindi bababa sa 5,000 piso o higit sa sampung libong piso sa pagpapasiya ng ang Chief, Philippine tanod-bansa, na bono ay dapat na sagot para sa anumang mga may-bisang at mga legal na paghahabol laban sa mga ahensiya sa pamamagitan ng kanyang mga kliyente o mga empleyado: Ibinibigay, Iyon lisensya issued sa lalawigan ng isang awtorisadong kinatawan ng Chief ng tanod-bansa ay sumailalim sa pagsusuri ng ang Chief ng tanod-bansa.

Ang anumang probisyon ng mga ito o iba pang mga batas na sumasalungat sa kabila, ang Chief ng tanod-bansa ay maaaring, sa anumang oras isuspinde o kanselahin ang mga lisensya ng mga pribadong tanod o bantay seguridad ahensiya ay natagpuan na lumabag sa anumang ng mga probisyon ng Batas na ito o ng mga alituntunin at mga regulasyon promulgated sa pamamagitan ng ang Chief ng tanod-bansa alinsunod dito. Iba pang mga probisyon ng Pres. Decree No 11

Sinumang tao na gumawa ng anumang gawa sa paglabag ng Republic Act No 5487 at ito ng kautusan, at ang pagpapatupad ng mga alituntunin at mga regulasyon promulgated na kung saan ay hindi sa conflict kasama nito, at sa mga na maging promulgated sa pamamagitan ng ang Chief ng tanod-bansa alinsunod mula dito, ay dapat, sa paniniwala nito, magdusa pagkabilanggo ng 10-15 na taon at isang pagmultahin ng hindi kukulangin sa sampung libong piso o higit sa 15,000 piso bilang isang militar hukuman / hukumang o komisyon ay maaaring direktang.

Ang Chief ng tanod-bansa ay dapat ipahayag ang mga kinakailangang mga alituntunin at regulasyon sa isagawa ang mga probisyon ng ito decree.

Section 9. Employees Kailangan Hindi maaaring Licensed. Ang bawat tao operating, pamamahala, pamamahala o pagsasagawa ng isang lisensiyadong pribadong tiktik o watchmen ahensiya ay dapat ding itinuturing na lisensiyado pribadong tiktik, o tanod at walang tao ay dapat na trabaho o ginagamit sa isang pribadong tiktik trabaho maliban na lamang kung siya ay isang lisensiyadong pribadong tiktik o tanod: Ibinibigay, Iyon wala sa seksyong ito ay dapat ipakahulugan na isang tiktik na nangangailangan ng lisensya para sa mga taong nagtatrabaho para lamang sa bilang pari o manwal na trabaho.

Section 10. Display ng License. Ang lisensiya ay ipapakita sa lahat ng oras sa isang dakila at na mga lugar sa opisina ng ahensiya o punong-himpilan ng mga ahensiya at ay exhibited sa kahilingan ng sinumang tao na may kapangyarihan ay sa ugnayan sa negosyo ng ahensiya o ang mga empleyado nito, o ng Chief ng Philippine tanod-bansa o ang kanyang gaya ng nararapat awtorisadong kinatawan o anumang kapayapaan opisyal.

Section 11. Pangangasiwa ng Philippine tanod-bansa. Sa pag-apruba ng Batas na ito, ang Philippine tanod-bansa ay dapat gamitin ang pangkalahatang pangangasiwa sa operasyon ng lahat ng mga pribadong tiktik at tanod o bantay seguridad ahensiya.

Section 12. Powers ng City o Municipal Mayors sa kaso ng emergency. Sa kaso ng kagipitan o sa oras ng kalamidad o calamities kung saan ang mga serbisyo tulad ng mga ahensya ng magbuhat, ang City o Municipal Mayor, bilang direktor ng Civil Defense, ay maaaring mag-ipon o isama ang mga serbisyo ng ahensiya ang pinakamalapit na lugar kung saan tulad ng emergency, kalamidad o sakuna at arises nito gaya ng nararapat lisensiyadong tauhan sa tulong mapanatili ang kapayapaan at kaayusan, at / o ang pag-iingat o pangamba ng mga violators ng batas at sa pangangalaga ng buhay at ari-arian. Deputized pribadong detectives, watchmen o security guards ay dapat gumawa ng direktang kautusan mula sa Chief of Police sa panahon ng sunog, baha, lindol, riots o iba pang emergency.

Section 13. Pagpapalabas ng Firearms. Section 14. Uniform. Ang magkakatulad ng tanod o bantay seguridad pati na rin ang mga organisado, pinananatili o sa ilalim ng trabaho ng pamahalaan o anumang pamahalaan-ari at / o kontrolado korporasyon, mga ahensiya o mga nilalang, ay dapat na naiiba mula sa mga uniporme pagod at inireseta para sa mga kasapi ng Hukbong Sandatahan ng Pilipinas, City at Municipal Police Force. Ang Chief, Philippine tanod-bansa, sa pamamagitan ng kanyang gaya ng nararapat awtorisadong kinatawan ay dapat inireseta ng uniporme o burloloy, kagamitan at mga kagamitan upang maging pagod sa pamamagitan ng guards ang seguridad at watchmen sa buong Pilipinas.

Section 15. Compensation ng Watchmen o Security Guards. Watchmen o security guards ay dapat makatanggap ng suweldo ay hindi mas mababa kaysa na inireseta sa pasahod Batas Pinakamababang.

Section 16. Limitasyon at pagbabawal. 1. Sa Membership: (1) Walang mga ahensiya ng operating sa Lunsod ng Manila at suburbs ay maaaring gamitin ng higit sa 1,000 watchmen o security guards; (b) walang ahensiya ng operating sa ibang mga lungsod at unang klase munisipyo ay maaaring gamitin ng higit sa 500 watchmen o security guards; ( c) walang ahensiya ng operating sa munisipyo ng iba pang kaysa sa unang klase ay maaaring gumamit ng higit sa 200 watchmen o security guards.

2. Sa Organization: Walang tao, korporasyon, sosyohan o kapisanan ay maaaring isaayos ang higit sa isang ahensiya sa anumang isa ng lungsod o ng munisipalidad.

3. Sa Service: Walang ahensiya ay nag-aalok, render o tumatanggap ng mga serbisyo nito sa dens pagsusugal o iba pang iligal na negosyo. Ang lawak ng mga serbisyo ng seguridad na ibinigay sa pamamagitan ng anumang ahensiya ng seguridad ay hindi dapat lumampas ng buong bakuran o ari-arian ng tao o pagtatatag humihiling ng seguridad serbisyo maliban na lamang kung sumama sila malaking halaga ng salapi.

Section 17. Batas at Regulasyon sa pamamagitan ng Chief, Philippine tanod-bansa. Ang Chief ng Philippine tanod-bansa, sa pagsangguni sa ang Philippine Association of tiktik at Protective Agency operator, inkorporada at napapailalim sa mga probisyon ng umiiral na mga batas, sa pamamagitan nito ay awtorisadong sa isyu ng mga patakaran at regulasyon na kinakailangan upang isakatuparan ang mga layunin ng Batas na ito.

Section 18. Penal Panutos. Anumang paglabag sa Batas na ito o ang mga tuntunin o regulasyon na ipinalabas dito ay dapat na parusahan sa pamamagitan ng suspensyon, o multa na hindi hihigit sa P200.00 o pagkansela ng kanyang o ang kanyang lisensya upang gumana, pag-uugali, direktang o pamahalaan ang isang pribadong tiktik, tanod o bantay seguridad ahensiya at ang lahat ng mga miyembro nito sa pagpapasiya ng mga hukuman kasama ang alis ng pagkakataon ng kanyang bono isampa sa Philippine tanod-bansa.

Kung ang paglabag ay ginawa ng mga taong binanggit sa ilalim ng parapo 2, apat na seksyon ng Batas na ito ang parusa ay dapat na pagkabilanggo ranging 1-4 na taon at multa ranging 1-4000 piso sa pagpapasiya ng mga hukuman.

Section 19. Repealing Clause. Lahat ng mga batas, mga patakaran, resolution, ordinansa ng munisipyo, mga alituntunin at administrative order laban o hindi naaayon sa mga probisyon nito ay sa pamamagitan nito repealed.

Section 20. Effectivity. Batas na ito ay dapat gumawa ng epekto nito sa pag-apruba.

AN ACT TO REGULATE THE ORGANIZATION AND OPERATION OF PRIVATE DETECTIVE, WATCHMEN OR SECURITY GUARDS AGENCIES.

(Rep. Act No. 5487, as amended by Presidential Decree No. 11.)

Section 1. Short Title of Act. This Act shall be known as "The Private Security Agency Law."

Section 2. Scope of this Act. The organization, operation, business and activities of private detectives, watchmen or security guards agencies shall be governed by the provisions of this Act.

Section 3. Definition of Terms. (a) Person. As used in this Act, person shall include not only natural persons but also juridical persons such as corporation, partnership, company or association duly

registered with the Securities and Exchange Commission and/or the Bureau of Commerce. (b) Private Detective Agency. A private detective agency is any person, who, for hire or reward or on commission, conducts or carries on or holds himself or itself out as conducting or carrying on a detective agency, or detective service. (c) Private Detective. A private detective is any person who is not a member of a regular police agency of the Armed Forces of the Philippines who does detective work for hire, reward, or commission. (d) Watchman or Security Guard, Watchman or Security Guard Agency. Any person who offers or renders personal service to watch or secure either residential or business establishment, or both, or any building, compound, or area including but not limited to logging concessions, agricultural, mining or pasture lands for hire or compensation, or as an employee thereof shall be known as watchman or security guard; and any person, association, partnership, or corporation, who recruits, trains, muster, furnishes, solicits individuals or business firms, private or government-owned or controlled corporations to engage his service or those of its watchmen, shall be known as Watchman of Security Guard Agency. Section 4. Who May Organize a Security or Watchman Agency. Any Filipino citizen or a corporation, partnership, or association, with a minimum capital of five thousand pesos, one hundred per cent of which is owned and controlled by Filipino citizens may organize a security or watchman agency: Provided, That no person shall organize or have an interest in, more than one such agency except those which are already existing at the promulgation of this Decree: Provided, further, That the operator or manager of said agency must be at least 25 years of age, a college graduate and/or a commissioned officer in the inactive service of the Armed Forces of the Philippines; of good moral character; having no previous record of any conviction of any crime or offense involving moral turpitude and not suffering from any of the following disqualifications:

(1) Having been dishonorably discharged or separated from the Armed Forces of the Philippines;

(2) Being a mental incompetent;

(3) Being addicted to the use of narcotic drug or drugs; and

(4) Being a habitual drunkard.1awphil.net

For purposes of this Act, elective or appointive government employees who may be called upon on account of the functions of their respective offices in the implementation and enforcement of the provisions of this Act and any person related to such government employees by affinity or consanguinity in the third civil degree shall not hold any interest, directly or indirectly in any security guard or watchman agency. Section 5. Qualifications Required. No person shall be employed as security guard or watchman or private detective unless he is: (a) a Filipino citizen; (b) a high school graduate; (c) physically and mentally fit; (d) not less than 21 nor more than 50 years of age; (e) at least 5 feet and 4 inches in height; and (f) suffering none of the disqualifications provided for in the preceding section: Provided, That foreigners who are already employed as watchmen or security guards prior to the approval of this Act shall not be subject to the above-mentioned requirements: Provided, further, That veterans shall be given priority in employment as security guard, watchman or private detective: And provided, finally, That person convicted of any crime involving moral turpitude shall not be employed as security guard, watchman or private detective.

Section 6. License Necessary. No person shall engage in the business of, or act either as a private detective, or detective agency; and either engage in the occupation, calling or employment of

watchman or in the business of watchman's agency without first having obtained the necessary permit from the Chief, Philippine Constabulary which permit as approved is prerequisite in obtaining a license or license certificate: Provided, That all existing private detective or watchman or security guard agencies shall have a period of one (1) year from the approval of this Act to secure the said license: Provided, further, That existing agencies, and any new agency which may hereafter apply for a license, certify under oath that their private detectives, watchmen or security guards, have received the appropriate training from either the Philippine Constabulary, the National Bureau of Investigation, any local police department, or any other public institution duly recognized by the government to conduct police training.

Section 7. Application for License. The application shall be made in writing and shall be filed with the Chief, Philippine Constabulary. It shall contain the full name of the applicant, his age, civil status, his residence, and location of business. If the applicant is a corporation, association or partnership, a copy of the certificate of registration with the Securities and Exchange Commission together with its by-laws and articles of incorporation, with the Bureau of Commerce.

Section 8. Fees to be Paid and Bonds. When all requisites for the issuance of the license have been complied with, the Chief of the Philippine Constabulary or his duly authorized representative shall issue a permit for the issuance of such license and register the same in his office, upon payment by the applicant of the fee in accordance with the following schedule:

(a) the sum of one hundred pesos per annum as national license;

(b) the sum of fifty pesos per annum as municipal license fee in any city where it may operate, the said fee to be payable to the city treasurer concerned;

(c) the sum of twenty-five pesos per annum as municipal license fee for any municipality where it may operate, the said fee to be payable to the municipal treasurer concerned;

(d) the private Detective and Watchman Agency shall in addition to the above pay a fixed Internal Revenue Tax of one hundred pesos per annum in lieu of percentage taxes;

(e) the individual private detective and/or watchman shall pay for Mayor's Permit, Health and/or Sanitary fee an amount not exceeding three pesos per annum and the agency shall pay the sum not exceeding ten pesos for the Mayor's Permit and Health and/or Sanitary fees; and

(f) the Chief of the Philippine Constabulary or his duly authorized representative shall issue an appointment over his signature and affix the seal of his office, to each license and for each such appointment, the sum of one peso shall be paid. 1awphil.net

The application shall further be accompanied by a bond issued by any competent or reputable surety or fidelity or insurance company duly accredited by the office of the Insurance Commissioner in the sum of not less than five thousand pesos nor more than ten thousand pesos in the discretion of the Chief, Philippine Constabulary, which bond shall answer for any valid and legal claim against the agency by its clients or employees: Provided, That licenses issued in the province of an authorized representative of the Chief of Constabulary is subject to review by the Chief of Constabulary.

Any provision of this or other law to the contrary notwithstanding, the Chief of Constabulary may, at any time suspend or cancel the licenses of private watchman or security guard agency found violating any of the provisions of this Act or of the rules and regulations promulgated by the Chief of

Constabulary pursuant thereto. (This paragraph was inserted by Sec. 3, Pres. Decree No. 11.)

Other provisions of Pres. Decree No. 11

Any person who commit any act in violation of Republic Act No. 5487 and of this Decree, and the implementing rules and regulations already promulgated which are not in conflict herewith, and those to be promulgated by the Chief of Constabulary pursuant hereto, shall, on conviction thereof, suffer imprisonment of from ten to fifteen years and a fine of not less than ten thousand pesos nor more than fifteen thousand pesos as a military court/tribunal or commission may direct.

The Chief of Constabulary shall promulgate the necessary rules and regulations to carry out the provisions of this Decree.

Section 9. Employees Need Not be Licensed. Every person operating, managing, directing or conducting a licensed private detective or watchmen agency shall also be considered licensed private detective, or watchman and no person shall be employed or used in a private detective work unless he be a licensed private detective or watchman: Provided, That nothing in this section shall be construed as requiring detective license for persons employed solely for clerical or manual work.

Section 10. Display of License. The license shall be displayed at all times in a conspicuous and suitable place in the agency office or headquarters of the agency and shall be exhibited at the request of any person whose jurisdiction is in relation with the business of the agency or the employees thereof, or of the Chief of the Philippine Constabulary or his duly authorized representative or any peace officer.

Section 11. Supervision of the Philippine Constabulary. Upon approval of this Act, the Philippine Constabulary shall exercise general supervision over the operation of all private detective and watchman or security guard agencies.

Section 12. Powers of City or Municipal Mayors in Cases of Emergency. In case of emergency or in times of disaster or calamities where the services of such agencies arise, the City or Municipal Mayor, as director of Civil Defense, may muster or incorporate the services of the agency nearest the area where such emergency, disaster or calamity arises and its duly licensed personnel to help maintain peace and order; and/or the prevention or apprehension of law violators and in the preservation of life and property. Deputized private detectives, watchmen or security guards shall take direct orders from the Chief of Police for the duration of the fire, inundation, earthquakes, riots or other emergencies.

Section 13. Issuance of Firearms. A watchman or security agency shall be entitled to posses firearms after having satisfactorily passed the requirements prescribed by the Chief, Philippine Constabulary pertinent to the possession of firearm of any caliber not higher than 45 caliber in a number not exceeding one firearm for every two watchmen or security guards in its employ: Provided, however, That a watchman or security agent shall be entitled to possess not more than one riot gun or shotgun in order to provide adequate security when circumstances so demand: Provided, further, That all the firearms mentioned herein shall be carried by the watchman or security guard only during his tour of duty in proper uniform within the compound of the establishment except when he escorts big amounts of cash or valuables in and out of said compound.

Section 14. Uniform. The uniform of watchman or security guard as well as those organized, maintained or under the employment of the government or any government-owned and/or controlled corporations, agencies or entities, shall be different from the uniform worn and prescribed for members

of the Armed Forces of the Philippines, City and Municipal Police Force. The Chief, Philippine Constabulary, through his duly authorized representative shall prescribed the uniform or ornaments, equipment and paraphernalia to be worn by the security guards and watchmen throughout the Philippines.

Section 15. Compensation of Watchmen or Security Guards. Watchmen or security guards shall receive a salary not lower than that prescribed in the Minimum Wage Law.

Section 16. Limitations and Prohibitions. 1. On Membership: (a) No agency operating in the City of Manila and suburbs may employ more than 1,000 watchmen or security guards; (b) no agency operating in other cities and first class municipalities may employ more than 500 watchmen or security guards; (c) no agency operating in municipalities other than first class may employ more than 200 watchmen or security guards.

2. On Organization: No person, corporation, partnership or association may organize more than one agency in any one city or municipality.

3. On Service: No agency shall offer, render or accept its services to gambling dens or other illegal enterprises. The extent of the security service being provided by any security agency shall not go beyond the whole compound or property of the person or establishment requesting the security service except when they escort big amount of cash.

Section 17. Rules and Regulations by Chief, Philippine Constabulary. The Chief of the Philippine Constabulary, in consultation with the Philippine Association of Detective and Protective Agency Operators, Incorporated and subject to the provisions of existing laws, is hereby authorized to issue the rules and regulations necessary to carry out the purpose of this Act.

Section 18. Penal Provisions. Any violation of this Act or the rule or regulation issued hereunder shall be punished by suspension, or fine not exceeding P200.00 or cancellation of his or its licenses to operate, conduct, direct or manage a private detective, watchman or security guard agency and all its members in the discretion of the court together with the forfeiture of its bond filed with the Philippine Constabulary.

If the violation is committed by those persons mentioned under paragraph two, section four of this Act the penalty shall be imprisonment ranging from one to four years and fine ranging from one to four thousand pesos in the discretion of the court.

Section 19. Repealing Clause. All laws, rules, resolutions, municipal ordinances, regulations and administrative orders contrary or inconsistent with the provisions hereof are hereby repealed.

Section 20. Effectivity. This Act shall take effect upon its approval.

Security guards protect their employer's investment, enforce rules and laws on the property, deter criminal activity or other problems, and many times they are the First Responders in emergency situations.

There are three things to consider when hiring security guards: 1) what needs to be protected, 2) what level of protection is desired, and 3) who is going to do the

protecting.

1) The first step is to determine what needs to be protected and what the guard's responsibilities will include. Security guards can be posted at stationary locations to control entrances and check people entering and leaving the property, control crowds, give directions, accept packages, and discourage misbehavior. Guards also patrol and inspect property to protect against fire, theft, vandalism, and

illegal activity.

2) Security guards can be armed or unarmed, in uniform or plain clothes, posted on the property or thousands of miles away viewing video cameras that are part

of an interactive system. What is the level of security needed and what is the budget required to achieve that level?

3) When it comes to hiring security guards, it doesn't matter whether the guards are employed by an agency or hired directly by the end user; interviewing is

essential in order to find the right person for the position. The advantage of using a security guard service is that the company is bonded, background checks have

already been made, a certain amount of training has been completed, and the guard can be terminated easily since he works for the agency. The advantage to

directly hiring the security guard is greater control over hours, appearance, behavior and in many cases, lower overall costs.

Often, security officers are uniformed and act to protect property by maintaining a high visibility presence to deter illegal and inappropriate actions, observing (either directly, through patrols, or by watching alarm systems or video cameras) for signs of crime, fire or disorder; then taking action and reporting any incidents to their client and emergency services as appropriate.

Security guards, also called security officers, patrol and inspect property to protect against

fire, theft, vandalism, terrorism, and illegal activity. They protect their employer's property,

enforce laws on the property, deter criminal activity, and other problems. These workers

may be armed. They use various forms of telecommunications to call for assistance from

police, fire, or emergency medical services. Security guards write comprehensive reports

outlining their observations and activities during their assigned shift. They also may

interview witnesses or victims, prepare case reports, and testify in court.

Although all security guards perform essentially the same function, their specific tasks

depend on whether they work in a “static,” or stationary, security position or on a mobile

patrol. Guards assigned to static security positions usually stay at one location for a

specified length of time. These guards must become closely acquainted with the property

and people associated with their station and must often monitor alarms and closed-circuit

TV cameras. In contrast, guards assigned to mobile patrol drive or walk from one location to

another and conduct security checks within an assigned area. They may detain or arrest

criminal violators, answer service calls concerning criminal activity or other safety concerns,

and issue traffic violation warnings.

The security guard's job responsibilities also vary from one employer to another. In

department stores, guards protect people, records, merchandise, money, and equipment.

They often work with undercover store detectives to prevent theft by customers or

employees, and help apprehend shoplifting suspects prior to the arrival of the police. Some

shopping centers and theaters have officers who patrol their parking lots to deter assaults,

car thefts, and robberies. In office buildings, banks, and hospitals, guards maintain order and

protect the institution's customers, staff, and property. At air, sea, and rail terminals and

other transportation facilities, guards and screeners protect people, freight, property, and

equipment. Using metal detectors and other identification equipment, they may screen

passengers and visitors for weapons and explosives, ensure that nothing is stolen while a

vehicle is being loaded or un

job of a security guard is to safeguard, patrol and monitor any theft or violence in the premises where he has been assigned duty. For a large organization, the duties of security guards are directed by a higher security director, while for small buildings, he may work alone. In both cases, the security guard is responsible for serving his employer by providing safety against any law violator and determining any sort of disturbances that will incur losses to the client. Some organizations may train their employees regarding security tips and job responsibilities.

The actual duties of a security guard depends on whether he is employed for a static security position or a mobile position. In the former case, the guard works in a particular location for specific hours. He may be

assigned with security systems, like, alarms, arms, close circuit security cameras, etc. As part of the job profile, the security guard closely monitors the visitors as well as the property. Some employees assign the security guard to monitor the entry and exit of employees. For those who are employed for mobile positions, the security guard either patrols on foot or roams in scooters and / or cars. He is assigned a defined zone for performing security checks.

The job description for security guard also includes writing daily reports regarding the activities and any disturbances occurring during his serving period. If unusual circumstances, like, entry of unauthorized individuals or property damages occur during his duty period, then he should include these in the report. Such a security report serves as a reference tool for determining possible damages to the client or company. In case of fire and other emergencies, the guard should call fire departments or other appropriate service providers. Last but not the least, the security guard also checks lights, alarm system, windows, doors and gates.

Speaking about the educational qualification and training required to become a security guard, he / she has to earn a high school certificate and undergo security training. There are several schools that provide special courses for security guards. In some states, getting a license is mandatory to become a security guard, whereas in other regions, only security training is sufficient to apply for jobs in the security field. Security guards are employed either directly by the companies or indirectly by private organizations / agencies that provide security services.

Once training is completed, he / she can apply for security jobs either in private sector or in government agencies. The pay scale of a security guard ranges between $20,000 - $35,000 per year. With experience, the security guard may achieve a higher position, like, security director or supervisor. At times, the job profile of a security guard may be dangerous. Hence, while taking a decision, one should always consider the duties and the associated circumstances of security jobs.
