AND EXPIRING AUTHORIZATIONS

OVERVIEW

The Balanced Budget and Emergency Deficit Control Act of 1985(Public Law 99-177) requires the Congressional Budget Office (CBO)to report to the Congress on unauthorized appropriations andexpiring authorizations. Section 221(b) of the act added thisrequirement to Section 202(f) of the Congressional Budget andImpoundment Control Act of 1974, as amended:

(3) On or before January 15 of each year,the Director, after consultation with theappropriate committees of the House and theSenate, shall submit to the Congress areport listing (A) all programs andactivities funded during the fiscal yearending September 30 of that calendar yearfor which authorizations for appropriationshave not been enacted for that fiscal year,and (B) all programs and activities forwhich no authorizations for appropriationshave been enacted for the fiscal yearbeginning October 1 of that calendar year.

The conference report on the Balanced Budget Act states thatthe purpose of the requirement is "to help Congress use the earlymonths of the year to adopt authorizing legislation that must be inplace before the thirteen regular appropriation bills can beconsidered."

The content of this report consists of two appendixes.Appendix A summarizes programs that have received fiscal year 1991appropriations, but which lack specific authorizations ofappropriations for that year. Appendix B lists programs whosespecific authorizations of appropriations will expire by the end offiscal year 1991. The listings include data on all public lawsenacted during the Second Session of the 101st Congress. Theinformation on authorizations is contained in CBO's LegislativeClassification System (LCS). The information on amountsappropriated for fiscal year 1991 is from CBO's estimates of thecurrent level of federal spending.

PROGRAMS FUNDED IN FISCAL YEAR 1991WITHOUT AUTHORIZATIONS OF APPROPRIATIONS

Appendix A summarizes programs and activities that have receivedfiscal year 1991 appropriations, but which lack authorizations ofappropriations for that year.

The Congress at one time provided explicit authorizations ofappropriations for the programs listed, but the authorizationsexpired and have not been renewed. Appendix A shows the lastfunding level authorized for each of these programs.

Where the appropriate fiscal year 1991 appropriation bills orthe legislative history provided explicit funding levels forprograms listed in Appendix A, the amounts are shown. When noexplicit amounts were provided (as when a small program was fundedat an unidentified level in a large appropriation account), theAppendix notes that no amounts are available, and no dollar figuresare shown.

Two characteristics of the information in Appendix A should benoted. First, even if the fiscal year 1991 appropriation for aprogram or activity was not authorized, the agency normally mayobligate and spend the funds. Second, Appendix A may not list everyprogram and activity funded in fiscal year 1991 without anauthorization. CBO does not track expiring authorizations that donot explicitly authorize appropriations, such as the VeteransAdministration's authority to provide respite care. CBO also doesnot track unauthorized earmarks--that is, set asides--inappropriation acts.

Tables 1 and 2 summarize the amounts appropriated in FY 1991for programs and activities without authorizations by House andSenate authorizing committees, respectively. Table 3 summarizes thefunding levels for programs that once had explicit authorizations ofappropriations, listing the amounts by public law.

Major Unauthorized Programs

The total amount of unauthorized appropriations decreased from $55.5billion in FY 1990 to $34.1 billion in FY 1991. This resulted fromthe reauthorization of several programs included among the FY 1990unauthorized appropriations. The two largest are the Department ofHousing and Urban Development's housing and community developmentprograms and the activities of the National Aeronautics and SpaceAdministration. In addition, the majority of the two laws with thelargest authorizations expiring in 1990 were reauthorized. Thereauthorizations for the Department of Defense and a majority of thefood and agriculture programs accounted for $313.4 billion of the$324.5 billion which had been scheduled to expire in 1990.

Only $1.7 billion of the $34.1 billion in fiscal year 1991appropriations summarized in Appendix A are for programs whose mostrecent authorizations of appropriations expired at the end of fiscalyear 1990. The largest of these programs is the Department ofAgriculture Puerto Rico block grant ($974 million). Other programsin this category included activities of the Intelligence Community

and the CIA retirement and disability fund ($194 million).

The other $32.4 billion in unauthorized fiscal year 1991appropriations are for programs whose authorizations expired beforethe Second Session of the 101st Congress. In this category,unauthorized funds for international security and development andforeign assistance programs totalled $11.4 billion. The 99thCongress authorized funding for those programs through fiscal year1987. Over $7.3 billion are for the Department of Justice. Theannual authorization for most of the Department's programs has notbeen enacted since 1979.

Over $5.0 billion of the unauthorized funds are for civilianDepartment of Energy (DOE) programs. Annual authorizations forthese programs are required by law, but funding for most of them waslast authorized, through fiscal year 1984, by the Omnibus BudgetReconciliation Act of 1981. The Renewable Energy and EnergyEfficiency Competitiveness Act of 1989 reauthorized DOE renewableenergy programs for fiscal years 1991 through 1993.

SUMHARY OF AUTHORIZATIONS OF APPROPRIATIONS EXPIRINGBETWEEN JANUARY 15, 1991 AND SEPTEMBER 30, 1991

Appendix B summarizes the authorizations of appropriations that willexpire between January 15 and September 30, 1991. The listingindicates by public law the amounts authorized to be appropriatedfor expiring programs and activities.

Tables 4 through 7 provide aggregate information on theexpiring authorizations of appropriations listed in Appendix B.Table 4 shows the number of laws that will expire before fiscal year1992, classified by the amounts they authorize to be appropriatedfor fiscal year 1991. Tables 5 and 6 summarize the expiring laws byHouse and Senate authorizing committees, respectively. Shown foreach committee is the number of expiring laws under its jurisdictionand the total authorizations for fiscal year 1991. Table 7 liststhe expiring laws that authorize fiscal year 1991 appropriationsgreater than $50 million.

Major Expiring Authorizations

The laws with the largest expiring authorizations are annual onesand are included in Appendix B. The largest of these includestatutes that authorized fiscal year 1991 funding for the Departmentof Defense, the National Aeronautics and Space Administration, andDepartment of State narcotics control activities.

Also expiring before fiscal year 1992 are two-yearauthorizations for foreign relations activities of the StateDepartment and the Department of Transportation Coast Guardactivities. The largest expiring three-year authorization is forthe Department of Health and Human Services assistance to olderAmericans.
