INTRODUCTION

Section 11507a of the Natural Resources and Environmental Protection Act, 1994 PA 451,

as amended (Act 451), requires all landfills in Michigan to “annually submit a report to the

state and the county and municipality in which the landfill is located that contains

information on the amount of solid waste received by the landfill during the year itemized, to

the extent possible, by county, state, or country of origin.” This report covers the period

from October 1, 1999, to September 30, 2000, and is the fifth annual report of solid waste

landfilled in Michigan as compiled from the information submitted by the individual landfills.

It is recognized by the Department of Environmental Quality (DEQ) that the data may

include estimates as to volume and point of origin of the waste stream reported by each

landfill. Additionally, use of both standard and waste-specific conversion factors between

tons and cubic yards may further alter the data accuracy.

The Waste Receipt Report forms sent by the DEQ to the landfills provided for breakdown

of the waste received into various categories. Besides Type II and Type III wastes, waste

types included: (1) foundry sand; (2) coal or wood ash; (3) wastewater treatment sludges;

and (4) sediments from wood processing or paper manufacturing that are placed in

segregated cells or separated from other wastes in a landfill either independently or in a

mixture. Waste types 1-4 are also Type III wastes but are labeled “Mixed Waste” or

“Segregated Waste” and may appear listed separately on tables within the report. The

accounting of these waste types is primarily used in establishing and maintaining perpetual

care funds for those landfill facilities.

It should be noted that this report addresses waste imported to Michigan landfills from in-

state and out-of-state locations. It does not address waste originating in Michigan that is

transported to locations outside Michigan for disposal. Additionally, this report covers only

waste landfilled in Michigan and does not attempt to determine the amount of waste

removed from the overall waste stream prior to final disposal by such means as waste

reduction and recycling. Incineration in Michigan is also not addressed except for the final

landfilling of ash from municipal incinerators.

Total waste disposal in Michigan landfills was reported at 56,152,311 cubic yards, an

increase of 4,194,846 cubic yards or 8.1 percent over the Fiscal Year (FY) 1999 report.

Total imports of waste into Michigan landfills rose from the previous reporting period from

6,349,695 cubic yards to 9,373,115 cubic yards, an increase of 47.6 percent. The largest

source of waste imports to Michigan continues to be from Canada, with total reported

imports to landfills of 4,216,814 cubic yards, up 1,874,023 cubic yards or 80 percent from

last year’s report. Canadian waste imports equal 7.5 percent of all waste disposed in

Michigan landfills. Based on this year’s landfill disposal reports, out-of-state waste imports

total 16.7 percent of all solid waste disposed of in Michigan landfills.

While there is no specific data available to support these conclusions, the DEQ believes

the overall increase in landfill disposal of waste is likely the result of several factors. The

continuing growth in the state and national economies certainly result in increased waste

production from business, industrial production, and increased consumer spending. In

addition, the strong economy has also seen fairly low prices for virgin manufacturing

materials, hindering the demand for recycled content materials for industrial production and

consumer products. Landfill disposal costs have also remained low, providing incentives

for landfill disposal versus more expensive recovery and recycling of wastes.

As can be seen from the data below, the out-of-state imports to Michigan, as a percentage

of total waste landfilled, rose slightly; however, the amount of waste imports from Canada

rose significantly. The increased amount of imports is likely due to the close proximity of

disposal areas to other states and countries, and the inability of states to restrict the import

of waste from outside of the state. On May 28, 1999, Governor John Engler took action to

address the issue of regulating imports of waste from other states and countries by

establishing the Michigan Solid Waste Importation Task Force (Task Force). The Task

Force discussed a variety of topics, which included volume and sources of waste imports,

court cases related to restricting imports of solid waste from outside of the state, and

efforts at the state level to address control of imports and federal legislative initiatives. As

mentioned in the Task Force’s final report, courts have found the states’ efforts to enact

legislation to restrict waste imports from outside of the state as unconstitutional because

Congress has not enacted laws to grant states authority to regulate this area of commerce.

The report further indicates that most court decisions have made clear that Congress has

the authority to grant states the authority to regulate this area of commerce and the only

resolution that will withstand legal challenge is based on this authority. Until such authority

is granted, DEQ staff and the Governor’s Washington, D.C. staff will continue to advocate

action on interstate waste legislation.

The following pages detail volumes of waste disposed in Michigan landfills and provide

breakdowns of the waste imported into Michigan for disposal for all landfills that reported

this information. Tables 1, 2, and 3 display total, in-state, and imported waste disposal

summary information, respectively. It is expected that some of the unassigned waste is

from out-of-state sources. However, this figure is unknown, and no reasonable estimates

of the origin of unidentified wastes are available.

WASTE IMPORTS

Based on the reported information for FY 2000, the solid waste industry in Michigan

imported solid waste from seven other states and from Canada for disposal in Michigan

landfills. Table 4 indicates the volume of Type II waste imported and the state or country of

origin of the waste. Table 5 indicates the volume of Type III waste imported and the state

or country of origin for that waste.

Table 6 shows the total amount of waste imported into each county from all

out-of-state sources. Table 7 breaks down those totals by place of origin of the waste

imported into each county receiving out-of-state waste.

The combined volume of all waste disposed at each reporting facility is given in Table 8.

Tables 9 and 10 list the Type II and Type III disposal volumes ranked in order of volume

disposed. It should be noted that the Type III waste has been subdivided into categories of

mixed and segregated wastes and those landfills are ranked within their categories on the

second page of Table 10, but not against the general Type III landfills listed on the first

page of Table 10.

APPENDIX - LANDFILL DISPOSAL BY WASTE ORIGIN AND TYPE

The appendix of the report lists every reporting landfill and indicates the amount of waste

received at the landfill, the type of waste received, and the place of origin of that waste. As

previously discussed in this report, the mixed and segregated waste categories describe

specific types of Type III waste that are identified in Act 451. These waste types consist of

foundry sand, coal or wood ashes, and wood processing or paper sediments, or

wastewater treatment sludges that are landfilled separate from other wastes, either in a

mixture or totally segregated by individual waste type. The accounting of these waste types

is primarily used in establishing and maintaining perpetual care funds for those landfill

facilities. For additional information on these segregated wastes, see Section 11525(3)

and (4) of Act 451.
