1. Executive Summary

Texas Health and Safety Code §578.006(a) states a person may not administer electroconvulsive

therapy (ECT) unless the equipment used to administer the therapy is registered with the

Department of State Health Services (DSHS). In addition, Texas Health and Safety Code

§578.007(a) requires a mental hospital or facility administering ECT, psychosurgery, pre-frontal

sonic sound treatment, or any other convulsive or coma-producing therapy administered to treat

mental illness or a physician administering the therapy on an outpatient basis shall submit to the

department quarterly reports relating to the administration of the therapy in the hospital or

facility or by the physician. The quarterly reports submitted to DSHS must state for each quarter

the:

number of patients who received the therapy, including the number of persons voluntarily

receiving mental health services who consented to the therapy, involuntary patients who

consented to the therapy, and involuntary patients for whom a guardian of the person

consented to the therapy;

age, sex, and race of the persons receiving the therapy;

source of the treatment payment;

average number of non-ECT treatments;

average number of ECT treatments administered for each complete series of treatments, but

not including maintenance treatments;

average number of maintenance ECT treatments administered per month;

number of fractures, reported memory losses, incidents of apnea, and cardiac arrests without

death;

autopsy findings if death followed within 14 days after the date of the administration of the

therapy; and

any other information required by department rule.

Texas Health and Safety Code, §578.008(a), requires DSHS to use the information received

under §578.006 and §578.007 to analyze, audit, and monitor the use of ECT, psychosurgery, pre-

frontal sonic sound treatment, or any other convulsive or coma-producing therapy administered

to treat mental illness. Additionally, §578.008(b), requires DSHS to submit an annual report

summarizing the above information by facility to the Office of the Governor and the presiding

officer of each house of the Legislature. If the therapy is administered by a private physician on

an outpatient basis, the report must include that information, but may not identify the physician.

Senate Bill 200, 84th Legislature, Regular Session, 2015, required the transfer of the legacy

DSHS Mental Health and Substance Abuse (MHSA) Division to the Health and Human Services

Commission (HHSC) on September 1, 2016. The MHSA Division is now part of the Intellectual

and Developmental Disabilities and Behavioral Health (IDD-BH) Services Department in the

Medical and Social Services (MSS) Division. As a result, HHSC is now responsible for the

collection, analysis, and report required under the Health and Safety Code, Sections 578.007 and

578.008. For purposes of this report, the legacy DSHS MHSA Division will be referred to as the

HHSC Behavioral Health (BH) Services Section.

In fiscal year 2016, 22 of the 25 facilities in Texas with registered ECT equipment performed

treatments and provided the required patient reports to the state. There was a 1.1 percent increase

in the number of treatments in fiscal year 2016 compared to 2015. Overall, patients experienced

less severe symptomology after ECT treatment, which demonstrates the overall effectiveness of

treatment. There was a slight decrease in the number of patients with a source of public funds for

treatment payment. There was 1 death reported within 14 days of treatment.

2. Introduction

The Texas Administrative Code (TAC) defines ECT as “a treatment in which controlled,

medically applied electrical current results in a therapeutic seizure, attenuated by anesthesia and

muscle relaxants”.1 Individuals are asleep during the procedure and are able to resume normal

activity within an hour of treatment ending. The TAC further states ECT is given as a series of

treatments, “usually consisting of 6-15 treatments”.2 The series of treatments may be followed by

additional maintenance treatments on a less frequent basis, from once a month to once a year, as

needed.

ECT is most often used to treat people with severe major depression, with or without psychotic

features; bipolar disorder (currently depressed or, less frequently, in a manic phase);

schizophrenia with mood component; catatonia (a state of apparent unresponsiveness to external

stimuli in a person who is apparently awake); or other conditions. ECT may be prescribed when

antidepressant medications have not worked.3 Most individuals will need a few treatments before

they experience a decrease in the severity of mood symptoms. Some individuals may show initial

responses to ECT in the hours afterward, with the response fading over time. However, this

positive response gradually lasts longer between treatments.4

Common, expected, and generally transient side effects of ECT may include physical symptoms

such as headaches, muscle pain, nausea, and confusion following treatment (lasting a few

minutes or hours). Memory loss, such as forgetting conversations or events right before or after

treatment, may also occur and usually resolves.5 Adverse effects are less common. These events

have more health significance and may be longer lasting. For example, transient anterograde

memory loss – the inability to form new memories – is frequent and usually resolves, compared

with retrograde memory loss – the loss of memories from the past – which does not immediately

resolve, is very rare, and is considered an adverse event.

Other, less common, treatments outlined in Health and Safety Code §578.007 (psychosurgery,

pre-frontal sonic sound treatment, or any other convulsive or coma­producing therapy

administered to treat mental illness) and defined in TAC, are out of step with current medical

practices (see Appendix A for TAC rule descriptions of reportable therapies). While included in

the statute, these medical practices are not routinely performed in the state and none were

reported by facilities in fiscal year 2016.

3. Background

The Health and Safety Code, Chapter 578 outlines the requirements for providers who offer ECT

and other treatments. The statute:

requires that only a physician licensed to practice medicine can administer electroconvulsive

therapy;

prohibits use in children under age 16;

outlines the process for obtaining proper consent for treatment from patients and withdrawal

of consent;

requires electroconvulsive equipment used to administer therapy to be registered with the

department; and

requires providers to submit specific data elements to the department.

To implement Chapter 578 requirements, the state promulgated rules on ECT and other

treatments resulting in the establishment of uniform procedures for informed consent, statewide

reporting requirements for the use of ECT and other procedures, statewide registration

requirements for ECT equipment (stimulus apparatus), and explicit safeguards in the form of age

limits, guidelines, and prohibition of chemical or gaseous agents for convulsive therapy.

This report includes an analysis of patient outcomes. Appendix B of this report provides a

summary of quarterly data reports received in fiscal year 2016. Appendix C includes a summary

of treatments given from September 1, 2015, to August 31, 2016, based on information received

from each provider.

4. Summary of Quarterly Data Reports

In fiscal year 2016, 25 facilities in Texas registered ECT equipment. Twenty-two of these

facilities performed treatments and provided the required patient reports to the state (Appendix

D).

There were 2,675 aggregate quarterly reports submitted in fiscal year 2016, a slight increase

from fiscal year 2015. The data presented in this report are annual aggregate total numbers of

patients who received ECT in each of the four quarters, not the unique number of patients

receiving ECT in fiscal year 2016. The lack of data representing the unique number of patients

receiving treatment is due to the quarterly reporting process. Patients may receive ECT

treatments in multiple quarters over the course of the fiscal year, and thus may be counted more

than once in the annual aggregate total.

The majority of patients who consented to receive ECT in fiscal year 2016 were voluntarily

hospitalized patients (2,636) compared to involuntary hospitalized patients (14), or whose legal

guardians consented to treatment on their behalf (25).

The primary source of payment for ECT was slightly higher for those using private third-party

payers such as private health insurance (1,492), versus those using public payers such as state or

county resources or Medicaid (1,121).

Additionally, 31 patients used their own funds or family funds, and another 31 patients used

other undetermined funds to pay for treatment.

The percentage of people served using public sources of payment decreased slightly from 45

percent in fiscal year 2015 to 42 percent in fiscal year 2016.

As previously defined, ECT is given in a series of treatments determined by the licensed

physician and based on patient needs. There are a set number of planned treatment series for

each individual patient. Acute treatments are the initial treatments given to a patient for the

purpose of stabilizing their symptoms. Maintenance treatments are provided to patients on an as

needed basis at lesser frequency. Since these treatments are only performed with the patient’s or

legal guardian’s informed consent, they may be stopped at any time by the patient or the

provider. During fiscal year 2016, there were 448 acute treatment series reported not yet

completed at the end of the reporting period. In addition, during the same reporting period, 771

acute treatment series were completed and a separate 450 series were stopped prior to

completion.

The total number of individual treatments administered in fiscal year 2016 was 17,006,

representing maintenance and acute treatments administered. The average number of treatments

(6.36) received by a patient as part of a series reflects a small increase from last year. Table 1

shows the total number and averages per patient of ECT treatment types (acute and maintenance)

that were planned, administered, and completed in fiscal year 2016.

5. Analysis of Patient Outcomes

HHSC analyzed overall physician-assessed patient outcomes related to levels of symptom

severity and levels of memory impairment before ECT treatment and two to four weeks after

ECT treatment in fiscal year 2016.

A facility has two to four weeks after the patient’s last treatment to make contact with

individuals for follow-up assessment. Some individuals were unable to be assessed (in the

“unable to be determined” category) and these are the number of individuals each quarter whose

ECT treatment ended during the quarterly reporting period, but the facility was not able to reach

them for follow-up. Other individuals’ treatment (“ongoing series” category) continued past the

end of the quarter and the facility was unable to follow-up within the required time frame.

Individuals in the “ongoing series” may be counted in more than one quarter.

5.1 Level of Symptom Severity Before and After ECT Treatment

Ninety-nine percent of the facility reports listed pre-treatment severity of mood disorder

symptoms from mild to extreme. Figure 2 shows the level of symptom severity before ECT

treatment and the decrease of severe and extreme symptoms after ECT treatment. Overall,

patients experienced less severe symptomology after ECT treatment, which demonstrates the

overall effectiveness of treatment.

5.2 Level of Memory Loss Before and After ECT Treatment

Memory loss is a known risk and common side effect of ECT treatment. As a result, discussion

of this risk is required prior to obtaining consent for ECT in Texas. Figure 3 shows the level of

memory impairment assessed before ECT treatment and two to four weeks after ECT treatment.

In fiscal year 2016, less than two percent of patients had reportable memory loss events. There

were 30 (1.12 percent) reports reflecting memory loss within 14 days of ECT (See Appendix B

for details). These memory loss events are not considered an adverse event. As mentioned

previously, adverse events related to memory loss are very rare. HHSC requires these special

circumstances be reported as adverse events. The treating physician at each facility makes a

clinical determination as to what is considered an adverse event and what is reported to HHSC as

an adverse event.

5.3 Other Adverse Events

HHSC did not receive any reports for the following other reportable adverse events: fractures,

incidents of apnea, and cardiac arrests without death. One death was reported within 14 days

following ECT treatment. The cause of death was reported to be an overdose which occurred

eight days after the last treatment. An autopsy was performed. Analysis revealed the data is not

considered significant from previous years.

6. Conclusion

Reports submitted to the state by providers of electroconvulsive therapy showed a 1.1 percent

increase in the number of treatments in fiscal year 2016 compared to fiscal year 2015.

Considering the increase in population across the state and the effectiveness of ECT for

treatment resistant depression, a small increase is not unexpected.

Overall, patients experienced less severe symptomology after ECT treatment, which

demonstrates the overall effectiveness of treatment. There was one death reported within 14 days

of treatment. Analysis revealed the data is not considered significant from previous years.

There was a slight decrease in the number of patients whose source of funding was public.

Appendix A: TAC §405.103 Definitions of Reportable Therapies for Mental Illness

As allowed in Health and Safety Code, Chapter 578, the TAC includes the following definitions

related to reportable therapies for the treatment of mental illness:

ECT – A treatment in which controlled, medically applied electrical current results in a

therapeutic seizure, usually attenuated by anesthesia and muscle relaxants.

Psychosurgery – Surgical intervention to sever fibers connecting one part of the brain with

another or to remove or to destroy brain tissue with the intent of modifying or altering severe

disturbances of behavior, thought content, or mood. For purposes of this subchapter, the term

does not include such surgery for the relief of intractable physical pain or the treatment of

neurological disease or abnormality.

Pre-frontal sonic sound treatment – A treatment, not described or defined in biomedical

literature, which is defined in California statutes governing ECT and other treatments as "The

direct stimulation and/or destruction of brain cells or brain tissue by ultrasound for

therapeutic purposes."

Insulin coma treatment – The production of a coma for therapeutic purposes through the

administration of insulin.

Multiple-monitored ECT – The induction of more than one adequate seizure during one

episode of anesthesia.

Regressive or depatterning ECT – The prolonged use of daily or more frequent treatments.
