Sub: Illegal Strike resorted by the employees without any notice or intimation and as todeclare the strike as illegal unjustified, uncalled for and unwarranted

Sir,

This is to inform you that we are in cash management services, we provide cash van, to

ferry from one branch to another as per the requirement of the banks on daily basis. We

also cash pickup services and ATM replenishment services of various Nationalized bank.

We are providing the services to the nationalized banks like State bank of India, punjabNational Bank, Bank of Baroda, United Bank, bank of Maharastra and Union Bank of

India etc. The services as provide to the customers which is very sensitive in nature andmore particularly trust worthy business between the principal employer and service

provider, The said services as provided to the customers in case any delay and or

stoppage of services may cause huge losses and can create crises if services are delayed

by service providers.This services have been provided to the valuable customers by us ina diligent and faithful manner.

The employees has raised the dispute against us with regard to the certain demand , thesaid matter is pending before the conciliation officer . On 12.11.2009 the some of the

employees without any cause or reason call the strike without any notice or intimation tous. When the striking workers are resort their strike illegally when the matter is pending before the conciliation officer and as such if they gone on strike to pressing the

management to exceed their demand then they resort their strike in more strength. Due to

this illegal strike the services as provide to the customer were paralyzed and they havealso the peace and harmony of the company. The striking workers threatening, abusing,

asserting and they have violent towards the senior officer of the company. The striking

workers further threaten to stage demonstration, illegally gherao and insubordination and

picketing and also persistently all sort of indiscipline amongst the other loyal employeeof the management, moreover the so called union represented through S/Sh Dipti Singh,

Avdhesh Kumar, Shailendra Kumar have criminally intimating the loyal employees of

the management and their co associate also threaten to join the agitation, if they do notagitate then they would intimate the loyal employees of the management.

S/Sh Dipti Singh, Avdhesh Kumar, Shailendra Kumar and their co associates indulgingspreading malicious and false propaganda against the management and not only this they

have agitated with militant activities and willful breaking damage and destroy the

companys movable (Cash Van) and immovable properties. Due to the said act of S/Sh

Dipti Singh, Avdhesh Kumar, Shailendra Kumar and their co associates indulging against

the management subject to the heavy loss to the management as well as to the customers.

Most of the customers of the management, the management is provide the services to the

bank customers and the banks are covered under the Essential Services and maintainanceact. The management has taken the serious action towards the striking workers and their

services were suspended by the management. The management has sent letter dated

12.11.2009, 16.11.2009, 17.11.2009, 23.11.2009 and police complaint to this effect andalso lodge the police complaint dated 24.11.2009 and intimation to all the employees to

resume their duties otherwise serious action will be taken against the striking workers.

Even after receive the letters by S/Sh Dipti Singh, Avdhesh Kumar, Shailendra Kumarand their co associates they have still resort their strike illegally.

The situation was so grave, the management decide to discuss the matter with striking

workers, On 14.11.2009 the Mr. Dinesh Gupta The Vice President of the company callthe Sh. Dipti Singh, Avdhesh Kumar and Shailender Singh etc. to discuss the issues as

raised by the workers and as such the management give the assurance to the workers that

the demand whatsoever likely to be provide but the striker workers wants immediate

provide the facilities, the management would not agreed and the management advice tothe workers to come and discuss the issues on 25.11.2009. Unfortunately the workers did

not accept to discuss the issues with the management and they resort their illegal strikewithout notice and without information to the management.

On 27.11.2009 & 30.11.2009 the management also served letter to the striking workers

namely Vanvari Lal Singh, Dipti Singh, Avdhesh kumar, Kuwar Pal, Shailendra Kumar,Rajesh Kumar Pandey, Vimlesh Kumar, Narendra Singh, Manoj Kumar, Balister Singh,

Brajmohan, Satya Prakash Singh, Praveen Kumar, Rakesh Nagar, Jaiveer, Tejender,

Krishna, Rajendra Ojha, Jyoti and Laljee Tiwari . The management has taken the seriousaction as suspended their services vide above said letters. The management also directed

the suspended employee to mark their presence in suspension register 10 am in the

morning and 3.30 pm in the evening. However during the suspension period thesuspended employee will get 50% of the wages as suspension allowance. Incase the

suspended employees fail to mark their presence in the suspension register then they are

not entitled for any suspension allowance for their absence period. It may kindly be notedthat the some outside agencies may instigated and provoking the employees of the

management resultant to resort their strike illegally. The management is fully

apprehended due to the striker workers who were resort violence and may cause

hindrance and they also stop the visitors, valuable customers and the loyal employees ofthe management, they also stop ingress and or egress valuable customers. The

management is also apprehended that the striker workers may damage the cash van

vehicles and also loot cash(s) of the valuable customers.It may kindly be noted that some other outside agency hold a meeting along with S/Sh

Dipti Singh, Avdhesh Kumar, Shailendra Kumar and their co associates outside the gate

of the premises and they have also shouted slogans in abusive language which they haveuse unparliamentry language and also defarmetery remarks were pass by the striker

workers.
