2 Clause 10.3 The State Government and the Successful Bidder shall enter into the MDPA upon the Successful Bidder having obtained all consents, approvals, permits, no-objections and the like as may be required under Applicable Law for commencement of mining operations.

Few clearances/permission for commencement of mining operations can be obtained only after the execution of Mining Lease e.g. DGMS permissions.

Further, pursuant to the tender document, MDPA is predecessor to the mining lease. Hence, it will not be possible for the Successful bidder to obtain all consents, approvals, permits, no-objections for commencement of mining operation before MDPA, as required under this clause

The clause 10.3 to be suitably amended.

The MDPA signing after obtaining all permission will not be given by certainGovt agencies due to ML grant is not there. This will affect the timeline and also commencement of production from the block.

Part-B of tender document is merely a listing of clearances to be obtained on the part of the successful bidder. Only Environmental Clearance will be needed for MDPA

Other clearances are requried to be obtained after registration of the lease

3 Clause 10.4: Grant of mining LeaseSubsequent to execution of the MDPA, the Successful Bidder shall pay the thirdinstalment of the Upfront Payment which is INR 36,35,75,542.00(Indian Rupees Thirty Six Crores Thirty Five Lakhs Seventy Five Thousand Five Hundred Forty Two Only). Upon such payment the State Government shall grant a mining lease to the Successful Bidder within a period of 30 days from the date of payment. The date of the commencement of the period for which a mining lease is granted shall be thedate on which a duly executed mining lease is registered.

Please clarify whether Stamp Duty shall be chargeable only on amount of Royalty and not on Final Price Offer at the time of execution.

The mention of Stamp duty is not there alongwith the method of calculation for stamp duty.

This will help us in planning for Budgetary provisions.

Stamp duty will be as decided as per the Rajasthan Stamp Act

4 Clause 12 – Time Table - Stage IIMine Development Production Agreement (MDPA) to be executed between State Government & Successful Bidder

Please clarify:1. What will happen if the Preferred bidder fails to meet all prerequisites before the timeline as per Stage II timelines.2. What will happen if obtaining all consent, approvals gets delayed from due date because of reasons beyond the control of bidder.

There shall be mention for the action to be done by us, if it is not complied with timeline due to reasons beyond our control.

Since Bidder by this time has already paid 20% upfront payment, which is almost 9 Crores in this block.

Appropriate time will be given to furnish environmental clearance in the letter of intent. In case of delay in furnishing environmental clearance, it will be considered on a case-to-case basis.

T1 in Stage-II will start after submission of the environmental clearance

Preferred bidder shall be supported by the State Government through the PAMCAF in obtaining all necessary clearances and approvals.

5 The mining lease area falls in only Harima village or in Pitasar village 3D1, near villages Harima and Pithasar, Tehsil-Nagaur, district-Nagaur, Rajasthan

The name of all the villages falling in the mining lease area should be clearly spelt, because the permissions and clearances are to be obtained from Gram Panchayat level also for Environmental Clearances also this is important.

The mining lease area does not fall in Pithasar village, as per revenue records. Block falls only in Harima, Deh & Sarasani village.

The Successful Bidder’s Bid Security will be returned, without any interest,upon furnishing of the Performance Security in accordance with theprovisions thereof.

The return of Bid Security should be expedited at the earliest. Bid Security is valid for 240 days including 60 days of claim period (clause 15.1). After completion of bidding process, the objective of bid security is completed and the delay in return of Bid Security affects the interest of Bidder.

Bid security will be refunded after completing the conditions of the letter of intent

The mining lease shall be for minerals found in the area pursuant to exploration prior to the e-auction: In the mining block alongwith limestone, dolomite is also found, whether bidder can sell this dolomite to prospective buyers.

After becoming successful bidder, on which date T-1 will start. ?

How many days /months are there in between Satge I and Stage II.

Time Period for Stage –II is not clear. (submission of all necessary clearances /approvals from Govt agencies )

Document shall discuss appropriatetime period for each stage. Confidence in mineral proving is not good and hence it requires detailed exploration prior to start land acquisition and infra-structural development works.

To draw mining strategy, realistic time taken for clearances shall be clearly reflected in the terms of the tender conditions, conditions provided in MDPA, etc.

T1 for Stage-II is the date of submission of environmental clearance

Two blocks comprise charagah land. Whether Govt will provide any support to obtain surface right and divert charagah land for mining ?

Based on the filed visit of Notified blocks, it is understood that block 3D2 and 3B2 comprises Angor Land (Water catchment) as part of Govt Land.

We would like to know whether Govt will facilitate to mine the Angor land area on the line of Charagah land (compensate the same amount of land outside lease area) and it is requested to kindly disclose the sub-category (Angor/ waste / charagah/water body) of Govt Land stated in the Notified blocks , if any.

Diversion and taking possession of Charagah/Angor Land always creates conflict.

17 Exploration Report - Introduction

It is understood that the notified blocks 3D1 and 3D2 are part of earlier notified block 3D Deh Harima (Jan2016) which was having resources around 291Miot over an area of 941 Ha . Now, these notified blocks have total resources of 354 Miot, over an area of 791.19 Ha. Pl clarify how resources have increased while area is reduced and level of exploration seems to be same.

The notified blocks are part of earlier notified block and in absence of no additional drilling and any data collection in year 2016-17. How the resources have been increased against the reduction in the block area?

Earlier resources were calculatde taking cut-off grade as 42% for CaO. Now, the resources have been re-calculated using cut-off grade of 40% CaO. Therefore, quantity of mineral resources have increased as compared to previous notification.

When block was first notified, the block area was inclusive of the area for ancilliary activities but this time, the area for ancilliary activities has been deducted from the total block area as no end use for limestone has been defined.

18 Exploration Report- Resources Calculation

As per GR, it seems the entire area is mineralized. In such case, no area available within Block for non-mining allied activities such as waste dumping, sub-grade dumping and building related facilities which need non-mineralised area.

Types of Maps/Plans/Sections are inadequate to prepare Mining Plan.

Based on field visit, it is observed that Sarasani block 3B2 has significant encroachment( towards NE side) . How the resources would be mineable is a big question.? Whether, due consideration of such habitants have been taken care while estimating resources?

There is a need to add some non-mineralised area within Block since huge waste/reject need to be dumped within Block over non mineralized areas.

Blocks should be converted to CL or detailed exploration and revised evaluation to be undertaken.Based on the field work it is recommended to convert block 3B2 into CL.

19 Exploration Report - Summary of Core Logs(Annexure – II)

The details of mineralized zone and summarized lithology (original lithology based on field report of project geologist) is not correlating . (3D1 block/Bh-HRB10, mineralised zone thickness is upto 43 .50m whereas insummarized lithology, it depicts 31 m ) .

Mineralized zone shall be as per original lithology based on field report of project geologist and shall be accordingly revised. A detailed litholog as persamples / meterage given in Chemical log shall be given.

There should not be any ambiguity/discrepancy in the data provided which reduces the confidence level of the bidder.

Value of CaO is coming out 45.36% in the mentioned zone i.e. 36.00 - 43.50 (as per chemical analysis). Therefore, it is included in resource calculation, but was not reported in the field report of project geologist i.e. in initial summarized lithology report which is based on visual estimation.

20 Exploration Report - Summary of Core Logs (Annexure – II)

What is the reason of Poor core recovery ? It reduces the confidence in estimates.

Whether Govt will compensate, if given quality and quantity is not re-confirmed post Detailed Exploration by the SB ?

Since CR% is upto 40% and hence what is the % confidence level / surety of DMG regarding estimates ?

Complete drilled metreage wise lithologs including respective core recoveries to be shared. Seeing such a poor core recovery during exploration, the category of concession should be changed from ML to CL.ORState to arrange Permission to undertake detailed exploration, post issue of LOI.

Poor core recovery gives a low confidence in the estimated resources – both quality and tonnage.

As per current Mineral Auction Rules 2015, there is no such provision for compensation if quality of quantity are not re-confirmed

21 Exploration Report- Chemical Analysis of Boreholes (Annexure-III)

Only 7 radicals have been analyzed.

In the given chemical logs, what is the Ins % ? There should be detailed total analysis viz. LOI, SiO2, Al2O3, Fe2O3, CaO, MgO, SO3, K2O, Na2O, TiO2, Mn2O3, P2O5, Cl including , TOC , Pyritic sulpher, Ammonia , heavy metals etc.

This will give more information about nature of deposit to define future strategy in more transparent way.

The % of Ins. is given in chemical analysis of Boreholes. Five samples from near by block 3B1 (a) and 3B1 (b) got analysed. The analysis result are as follows:-

Na2O - 0.35 to 5.02, K2O - 0.04 to .24, S - absent, Mn - 85 to 197 ppm, Cl - absent, R2O3 - upto 1.62, TiO2 - absent, P2O5 - absent

22 Information Memorandum- Sr no 12 (c ) Cross check sample analysis(5%) resultis not discussed in the report and how it correlates with original analysis? Cross check sample analysis result shall also be part of the report.

This will increase the level of confidence about the deposit.

The results of cross check samples were not found different from the original sample analysis reports. Therefore, they have not been reported seperately in the GR

As per toposheet no 45 E/15 , underground pipeline is passing through the notified blocks, however in Tender document it is not mentioned anywhere ?

Details of pipeline andits safeguards should be discussed and plotted over maps. To understand reserves and safety issues.

2. Going through different Core logs, it has been observed that percentage of core recovery has not taken into account (as per our calculation Core recovery comes out to be 47% only). 1. It should have been Mineable Reserves given so as to confirm the size and life of the plant as well as mine.

3. Mineable reserves to be given based on Core recovery and Quantity of Waste and interburden / overburden tonnage to be given so that Economic factor can be determined.

As per the land type, it had been mentioned that Private land (Khatedari) is approximately 259.7169Hects..No where in the tender document, it has been mentioned that Government will help in getting the Consent of the land owner to do the mining operation within their areas by the successful bidder which is an essential clause for obtaining the Environment Clearance.

This may cause for the delays which are beyond the jurisdiction of successful bidder.

The onus for getting consent/purchase of the private land is on the investor. The department will provide support to the extent possible Further, while bidding the bidder has to take into consideration all the facts and circumstances with his own assessment and wisdom after ground level verification of the block.
