EXPO a message from ebrha president

EBRHA’s Trade Expo is returning on Sept. 29 and it will be bigger and better than ever. Our 2011 Expo was con-sidered by both visitors and vendors to have been the

most successful local rental property Expo ever held. For 2012 we have built on that success with plans to top that. Can we do it? You bet we can!

To start, we have a new venue. We’ve moved to the reno-vated Oakland Convention Center at the Marriott, which gives us twice the space for more vendor booths, an expanded schedule of workshops, a convenient downtown location, and access to local restaurants where you can slip out for lunch and refuel.

Our keynote speaker will be the motivating and always dynamic Michael Bush, founder of the 8 Factor Framework, who will introduce you to the eight things every business person should be thinking about. We may think we know

everything we need to be successful, but Michael will open our eyes to opportu-nities we are missing and will get us redirected, fired up, and ready to move to the next level.

Michael C. Bush has been inter-ested in business for as long as he can remember.

His father — the first African Ameri-can licensed contractor in Berkeley — taught him the values of hard work and self-respect. When Bush was young, he helped his father build and manage apartment buildings in the Bay Area and developed a deep connection with the apartment industry.

Surrounded by images of his father’s determination, Bush’s vision of success as a businessman grew more and more each day.

Bush attended Stanford University, and shortly after started his profes-sional career at Hewlett-Packard in the heart of Silicon Valley. After four years working at HP, he went to work for Kaiser Permanente. He saw profes-sional growth and success, but wanted more control of his destiny and wanted

Bush found that with his 8 Factors framework, he was making better deci-sions and less firefighting.

As a result, his business increased sales by 200% and merged with Whalen & Company, Inc., a telecommunications infrastructure development consult-ing firm. Bush took a position as Chief Operating Officer and within a couple of years, increased sales from $50 to $300 million dollars and grew its staff from 150 to 600 employees.

At every step in the process, Bush used his 8 Factors to ensure the business was making logical, sustainable and profitable decisions.

After convincing himself that he was indeed a good businessperson, he changed his focus to small business owners to help them achieve more success through the 8 Factors framework.

At the same time, Bush started teach-ing at Stanford University and Mills College, which deepened his commitment to helping other entrepreneurs. Fueled by his desire to create jobs in urban areas, he started advising the nonprofit organiza-tion Inner City Advisors and its portfolio of small businesses.

In total, he’s taught the 8 Factors framework to more than 2,000 people and witnessed remarkable improvements in their businesses as a result.

He developed the 8 Factors to provide structure and clar-ity to successfully run his businesses. Now, he looks forward to sharing with EBRHA and industry members how the 8 Factors can help manage businesses and properties, as well as his insights as an entrepreneur, educator and business turnaround consultant. Inspired by many years of set design, professional stager and HGTV host Cora Sue Anthony started her

own business to help people decorate and stage their homes to their highest potential.

Now the owner of a successful stag-ing business, Cora Sue works and lives in the Bay Area, where she’s staged various homes, including multi-million dollar homes and condos.

Although she grew up watching design TV shows as a kid, her first staging gig came when she was building theater sets for schools in the Oakland school district. A peer invited her to assist with a home staging business, and Cora Sue jumped on the opportunity.

After finding much success in the industry, Cora Sue started her own

success came in 2008, when Cora Sue was asked by a production company to audition as host for an HGTV show. She eagerly went for the position, and of all the auditioning talent, she got the part.

Two years later, she began co-hosting Real Estate Intervention, a popular HGTV show that provides homeown-ers with fresh advice for successful home sales. To this day, her enthusiastic per-sonality can be seen on the weekly show as she changes the way people approach home décor.

Recently, Cora Sue was featured as an expert and “real estate pro” in a column for HGTV Magazine, the TV network’s supplemental publication.

Aside from her duties as a TV host and professional stager, Cora Sue finds time to give back to the Bay Area community. She feels fortunate that her success has allowed her to donate furniture to more than 300 families in need through a partnership with a local church. She also founded the Season of Change Program, which teaches Bay Area at-risk youth to decorate and stage homes and events. She was awarded the City of Oakland’s Local Hero Award because of her efforts.

In 2008, she was also featured in the Oakland Tribune along with a story about her “Making a House a Home” business practice, in which she donates furniture to homeowners who normally can’t afford it.

Cora Sue is eager to get in front of people at the 6th Annual EBRHA Trade Expo.

“I’m looking forward to teaching peo-ple to not be intimidated by design,” she said.

She hopes that people leave the Expo with a desire to experi-ment with paint color, floor finishes, furniture, artwork and more to produce the high-end homes and rental units people look for. RH

“When I started, I staged one home a month, but now I have my furniture in about 40 homes at any given time,” she said about her business.

For years, Anthony Staging has worked with clients in advising what is most critical to achieve their goals. One of Cora Sue’s business goals is to sell clients’ home quickly and at the highest pos-sible price.

“We offer the oppor-tunity to show homes in the best possible light,” she said.

ELECTION DAY IS NOT FAR OFF and once again the implica-tions for apartment owners, operators and developers are significant. The results from the vote this fall will determine who controls the House and Senate, who leads key Congres-sional committees and, of course, who occupies the White House. Those results will have dramatic impacts on the federal policy agenda for 2013 and issues like tax reform, changes to the nation’s housing finance system — specifi-cally Fannie Mae and Freddie Mac — and the size and scope of the federal budget. The apartment industry has much to lose and gain out of the deliberations on these issues. This session will review the scenarios for the outcome of the fall elections, what they mean for the path forward on critical legislative issues and the potential implications for the apart-ment industry.

busy making the difference at the state capitol and city halls. At the state level, EBRHA’s lobbyist Ron Kingston successfully represented our interests. Locally, Jill Broadhurst attended all relevant committee and council meet-ings, and ensured that outreach efforts to like-minded organizations and other community stakeholders are familiar with our industry and concerns. Sometimes, at a moment’s notice, we hear of an effort that causes us to jump into high gear and wage a campaign for our voice to be heard. Actions by governmental officials take time and dedication. When weighing the value of your membership compared to other associa-tions out there, EBRHA’s loyalty is clear and relevant.

SB 184 (Leno): Permitted every local government to establish rent control on all new rental housing. It would have overturned the Palmer v. City of Los Angeles decision by expressly authoriz-ing cities and counties to not only set price controls on newly constructed rental housing and thereby preempt the Costa-Hawkins Rental Housing Act.

AB 710 and 910 (Skinner): This bill would have imposed new and burden-some parking requirements on owners of residential property who Ellis a building and then — at some time in the future — propose to improve that same property, thereby making it far more difficult to convert the property for another profit-able purpose. Only three trade associa-tions opposed the bill, and we were one of them. Not one state-level real estate group opposed the Ellis Act legislation.

Assembly Member Skinner and Sena-tor Hancock carried bills AB 2610 and SB 1473 that originally would have made it very difficult for a new owner following a foreclosure action to lawfully occupy his or her property. We successfully obtained amendments that assured the tenant(s) that were in possession follow-ing foreclosure were bona fide tenants, and that owners have a right to occupy their own property, and the law will sunset.

AB 1865 (Alejo): would have given tenants a whole new basket of remedies to fight evictions. State-level real estate associations did not fight the bill.

EBRHA successfully supported a bill, AB 2521 (Blumenfield), that would increase to $700, from $300, the thresh-old amount to determine whether a landlord must dispose of the departed tenant’s unclaimed property via a public sale. Only regional apartment associa-tions supported the bill.

EBRHA has worked with local jurisdictions on smoking ordinances, waste management contracts, rent board concerns, public safety and mass transit initiatives, economic development, and

other partnerships that favored healthy economies.

While the California Apartment Asso-ciation did not oppose the bill, EBRHA actively and strenously opposed the rent control measure.

SB 1384 (Lowenthal): Initially, the bill would have required every dwell-ing to replace existing battery powered smoke detectors in rental units prior to a new tenant taking occupancy and place new alarms in every bedroom. Our amendments included: every exist-ing device will remain in place as long as it is operable; every manufacturer must include instructions that inform the purchaser of where to place the alarms thereby limiting the liability of the landlord; the new retrofit require-ment is not tied to point-of-rent, but to a date certain-January 1, 2016; and tenants must inform the landlord or manager of an inoperable unit which is an extremely important amendment. The California Apartment Association did not ask for, nor thereby receive, these all too critical amendments.

AB 1726: would have required any landlord that has a swimming pool to hire a separate licensed person to complete a 14-hour class once every five years. The state apart-ment association simply sought amendments to the legislation, which included a delayed

Grand juries in California counties serve as watchdogs, investigating the operations of counties, cities,

and special districts. Recently, in response to a variety of

complaints, the Alameda County Grand Jury investigated the operations and administration of the Berkeley Rent Stabilization Board (BRSB). Among the specific concerns triggering the investiga-tion were complaints that BRSB is biased in favor of tenants, that it charges exces-sive fees to owners, that it uses improper hiring procedures and that it discourages open expression of concerns.

The investigation focused on two aspects of BRSB: 1) budget and fees;

and 2) personnel procedures. In the course of the investigation the grand jury interviewed witnesses, attended a board meeting, viewed videos of rent board meetings and reviewed materials provided by the city of Berke-ley and BRSB. Upon the conclusion of its investigation, the grand jury issued a report of its findings reflect-ing scathing criticism of the administration of the Berkeley Rent Stabilization Board, its operations and its lack of accountability.

Because some of the problems at BRSB, as outlined in the grand jury report, are very similar to many of those that have been the source of complaints by East Bay Rental Housing Association (EBRHA) members regarding Oakland’s Rent Adjustment Program, we will be taking a detailed look at the ramifications of the particular findings and reporting on these to our members in future issues of Rental Housing.

For example, the grand jury report gave considerable attention to the per unit fees that BRSB charges rental owners to administer the program. The grand jury found the fee of $194 per unit with penalties for late payment to be exces-sive. It further found that the portion of the fee that owners are allowed to pass through to tenants is too low and acts as a disincentive for BRSB to control its costs. It suggested that rental own-ers should be allowed to pass through a greater percentage of the unit fee to tenants as a way to reduce incentive by BRSB to constantly increase the fees.

Of equal importance, the grand jury found that the size of the staff at BRSB has not decreased commensurate with its decreased workload following the pas-sage of Costa Hawkins. Costa Hawkins — which decontrolled vacant units — was cited as a factor in the reduction in the number of rent board hearings from 364 in 1999 to 128 in 2011. The report concluded that although the number of hearing examiners has gone down, there are still more hearing examiners than are needed by the BRSB. These extra examiners are “rented out to the city,” for purposes unrelated to the administration of BRSB. This suggests that at the current unit fee, BRSB is overfunded for its needs.

Moreover, rather than reducing the fee to match the cost of the services being provided, BRSB has continued to collect more than is needed to fund its operations, and has entered into a side business of “renting” employees.

employees by BRSB is nothing that rental owners would have contemplated to be the ultimate use of any portion of the unit fees paid by them to administer the rent stabilization program. Such a practice clearly does not pass the muster of fairness.

But beyond the issue of fairness, it also raises questions of a legal nature for which the public is entitled to answers. Among these: is it permissible under California law for a governmental body funded by fees, such as the Berkeley Rent Stabilization Board, to use portions of those fees to fund or engage in activities completely unconnected to the service to be delivered by that body? Is it permis-sible for such a body, using fees imposed upon rental owners, to fund or facilitate the staffing, or other requirements of other city departments, that provide services to the general public?

Other questions reflect on the absur-dity of this practice such as how much rent does the Rent Board charge other city departments for the rental of its excess employees? Are there receivables involved? What documentation is available to show that BRSB is actually renting, rather than loaning, its excess employees to other city departments? What do these extra employees do when they are not rented nor needed by BRSB? These questions might prove very informative as public records requests to BRSB.

As the grand jury report contained numerous additional findings critical of the operation and funding of BRSB, these are by no means the only questions for which answers must be found.

Indeed, among the other issues addressed in the report, the grand jury criticized the 100% penalty imposed upon rental owners if the rent fee is paid one day late, it found fault with the board’s hiring practices and it described the Berkeley rent board Executive Director’s annual salary of $183,000 as excessive.

With these questions and other devel-opments regarding the operations of the local rent boards yet to be addressed, we will be continuing this and related stories in the months ahead.

California law requires that for tenancies

receiving greater than a 10% increase,

a 60-day notice is required; if the

increase is 10% or less, a 30-day

notice is required. Owners can only

impose “banked” rent increases equal

to three times the current annual

allowable rent increase rate.
