What are GWACs?

• Government wide acquisition contract (GWAC) means a

task-order or delivery-order contract for information

technology

• May be used by all Government Agencies

• Established pursuant to section 511(e) of the Clinger–

Cohen Act (1996), formerly the Information Technology

Management Reform Act

Fair Opportunity

• Unless a statutory exception is applied, each awardee

must be provided a fair opportunity to be considered for

each order exceeding $3,500

• However, FAR 16.505(b) (2)(i)(A-F) provides several

exceptions to the Fair Opportunity requirement

What is the Non-Manufacturer Rule?

• It’s all about competition and set asides

• The Non-Manufacturer Rule allows a small business to

offer a product that it did not manufacture under a small

business set-aside if SBA has offered a waiver

The NMR is an exception to the standard requirement that the

contractor must perform at least 50 percent of the cost of

manufacturing products (not including the cost of material) on a

supply contract

In other words, it allows a contractor that is not the manufacturer

to supply products that come from a small business

Who is Considered a Non-

Manufacturer?

• Non-Manufacturers are defined as any business that:

Does not exceed 500 employees

Is primarily engaged in the retail or wholesale trade and normally

sells the type of item being supplied

Will supply the end item of a small business manufacturer or

processor made in the United States, or obtains a waiver of such

requirement

When Does the Rule Apply?

• Determining the ability to set aside products for Small

Business

For small business set-asides other than for construction or

services, any concern proposing to furnish a product that it did

not itself manufacture must furnish the product of a small

business manufacturer unless the SBA has granted either a

waiver or exception to the non-manufacturer rule (see 19.102(f))

• NMR allows distributors and VARS to carry and be

awarded contracts under the manufacturing NAICS

codes

Contracting Officer Responsibilities

• As the Contracting Officer applying the Non-

Manufacturer Rule to your acquisition strategy, there are

some things to remember:

1. A non-manufacturer who receives a set-aside contract must agree to

supply the product of a domestic small manufacturer or processor,

unless the ordering activity receives a waiver from the SBA or a class

waiver exists

2. The contracting officer must designate the proper NAICS code and

size standard

o Note that for orders placed against GSA Schedule contracts the

NAICS code and size standard will flow down from the Schedule

contract to the ordering activity’s delivery order

Contracting Officer Responsibilities

• The NMR does not apply to service contracts

The NMR has traditionally not applied to service contracts

However a recent Court of Federal Claims ruling broadens the

reach of the NMR to all federal procurements that require the

provision of manufactured supplies

o Applies regardless of whether the procurement also has a services

component
