Definitions

Applicant

(EN ISO/IEC 17065:2012/3.1)

Supplier applying for a certificate of conformity to a certification body.

CE-certificate Certificate of constancy of performance of the construction product

that is issued by BE-CERT in accordance with this Regulation in

application of the CPR within an AVCP system 1+.

Distributor Supplier who is responsible for the distribution of the ground

granulated blast furnace slag.

Manufacturer Supplier who is responsible for the production of the ground granulated

blast furnace slag.

Supplier

(EN ISO 9000:2015/3.2.5)

Party with the responsibility of ensuring that the product meets and

continues to meet the requirements on which the certification is based.

Importer Supplier who is responsible for the import of the ground granulated

blast furnace slag into a country different from the one where it is

manufactured.

Inspector Authorised representative from the inspection body, in charge of

inspection.

Autocontrol laboratory [industrial] Internal or external laboratory that conducts tests in the context of

autocontrol.

Control laboratory External laboratory commissioned to conduct control tests designed to

validate the autocontrol.

External laboratory Laboratory that is independent from the supplier.

Internal laboratory Laboratory that is dependent of the supplier.

Certification logo Monogram enabling the mark to be displayed.

Mark [of conformity]

(EN 45020 – EN ISO/IEC 17000:2004)

Protected mark, affixed or issued according to the rules of the

certification system, indicating with a sufficient degree of confidence

that the product covered conforms with the technical specifications

relating to it (also see definition 3.8 in EN 15167-2).

New factory See definition 3.18 in EN 15167-2.

Non-conformity Something that does not conform to the technical specifications of the

product, the regulatory provisions or the provisions of the factory

production control.

Certification body See definition 3.4 in EN 15167-2

Inspection body See definition 3.15 in EN 15167-2

Product Result of an industrial activity or process that is the subject of technical

specifications. In the context of these application regulations, the

product is solely the ground granulated blast furnace slag.

Certification regulations Document that lays down the procedural and management rules of the

certification system.

Technical specifications [of a product]

Document that specifies the technical requirements that a product has

to meet (a standard or any other reference document).

Certification system [of products]

(EN ISO/IEC 17065:2012/3.9, NOTE 2)

System with its own procedural and management rules, designed to

lead to the certification [of a product].

Quality system Whole of the organisation, procedures, processes and resources

necessary to implement quality management.

Production unit Factory, in the sense of definition 3.13 in EN 15167-2.

Art. 1 Area of application and rules

Art. 1.1 Area of application

Art. 1.1. This document defines the provisions to be applied for the use of the CE-marking by a

manufacturer and the use of this marking by the manufacturer in the process of assessment

and verification of constancy of performance of construction products in the context of the CE

marking of system 1 + as defined in point 1.1 of The Commission Delegated Regulation (EU) No

568/2014 of 18 February2014 amending Annex V to Regulation (EU) No 305/2011 of the

European Parliament and of the Council as regards the assessment and verification of

constancy of performance of construction products.

As soon as a manufacturer wishes to affix a CE mark under AVCP 1 + on its ground granulated

blast furnace slag, the obtaining of a CE certificate is essential. This certificate is based on the

conformity of the FPC with the harmonized part of one or more parts of the above-mentioned

European ground granulated blast furnace slag standards.

Art. 1.1.2 The manufacturer is responsible for its products for which he declares performance based on:

§ the factory production control (FPC);

§ further testing of samples taken at the factory in accordance with the prescribed test plan.

Art. 1.1.3 In case of system 1+, BE-CERT shall decide on the issuing, restriction, suspension or withdrawal

of the certificate of constancy of performance of the construction product on the basis of the

outcome of the following assessments and verifications carried out by BE-CERT:

§ an assessment of the performance of the construction product carried out on the basis of

testing (including sampling), calculation, tabulated values or descriptive documentation

of the product;

§ initial inspection of the manufacturing plant and of factory production control;

§ continuous surveillance, assessment and evaluation of factory production control;

§ audit-testing of samples taken by the notified product body at the manufacturing plant or

at the manufacturer's storage facilities.

Art. 1.2 Application Rules

Art. 1.2.1 These regulations apply for the issuing of CE-certificates by BE-CERT to a manufacturer of

ground granulated blast furnace slag and when using the CE-marking by the manufacturer.

Art. 1.2.2 The standard EN 15167-2 applies in full, with exception of sections 8 and 9. Unless there is

dispensation mentioned specifically in the wording of these regulations, in the event of any

contradiction between EN 15167-2 and other certification regulations, EN 15167-2 prevails.

Art 1.2.3 According the revision of the regulations, the guidelines drawn up by the Notified bodies and

approved by the “Advisory Group of The Notified Bodies” in order to contribute to the

equivalent application of CE certification procedures by the various European notified bodies

shall be implemented.

Art. 2 Certification body

Art. 2.1 Notifications

Art. 2.1.1 The list of sectors, for which the FPS Economy, P.M.E, Middle Classes and Energy has notified

BE-CERT in terms of organization and management of the CE marking, is kept up-to-date at BE-

CERT’s secretariat. BE-CERT has a certificate of accreditation issued by BELAC (510-PROD) for

this activity.

Art. 2.1.2 The Enterprise Directorate General at the European Commission attributed the identification

number 0965 to BE-CERT in the context the CPR Regulations No 305/2011.

Art. 2.1.3 An overview of the domains for which BE-CERT has been notified may be requested at the

secretary of BE-CERT. A list of the notified bodies is published by the European Commission on

the website ‘NANDO’ – the database of the notified bodies –

(http://ec.europa.eu/growth/tools-databases/nando/).

The FPS Economy manages for Belgium the NANDO database in which the data of the bodies

notified by the Belgian public authorities are mentioned.

Art. 2.2 Legal status

Art. 2.2.1 BE-CERT has the legal status of a non-profit association in accordance with Belgian law.

Art. 2.3 Registered offices and secretariat

Art. 2.3.1 The registered offices of BE-CERT are established at Avenue Edmond Van Nieuwenhuyse6, B-

1160 Brussels, Belgium.

Art. 2.3.2 BE-CERT’s secretariat is located at the same address.

Art. 2.4 Correspondence and work languages

Art. 2.4.1 All correspondence regarding the CE marking shall be addressed to BE-CERT’s secretariat, with

the exception of correspondence relating to:

· the activities and responsibilities of the inspection body, for which the correspondence shall

be addressed to the secretariat of the inspection body, with a copy to BE-CERT;

· the appeal against a decision by BE-CERT, which should be sent to the competent appeal

body (Art. 16.3), with a copy to BE-CERT.

Art. 2.4.2 The working languages of BE-CERT are French and Dutch

Unless provided otherwise, all documents drawn up and published by BE-CERT are made

available in these two working languages. BE-CERT is not responsible for the unavailability of

the applicable harmonized standards and ‘Position Papers’ in the aforementioned languages.

The manufacturer may write the documentation and the records as part of the assessment for

CE-certification in English.

Art. 2.5 Operation and structure

Art. 2.5.1 The operation and structure of BE-CERT for the organisation and management of the CE

certification are described in its Statutes and in the internal Regulations of the Steering Board,

the Direction Committee for certification and of BE-CERT’s Certification Committee.

Art. 2.5.2 BE-CERT’s operations and structure conform to ISO/IEC 17065:2012 standard for the area of

application stated in Art. 1.1.

Art. 2.6 Internal Regulations

Art. 2.6.1 The Internal Regulations of the Steering Board (ROI-PVP), of the Direction Committee (ROI-CD)

and of the Certification Committee (ROI-CC) set out the authorities that take the decisions or

which issue opinions in accordance with these regulations.

Art. 2.6.2 The Hearing and Appeal Rules of BE-CERT set out the procedure for handling the appeal of a

manufacturer against a certification decision of BE-CERT. It can be obtained on request from

BE-CERT.

Art. 2.7 Confidentiality

Art. 2.7.1 Without the manufacturer’s written authorization or legal obligation, BE-CERT shall not provide

information to thirds parties about a specific product or specific manufacturer obtained during

the certification activities.

Art. 2.7.2 If required by law that such information must be disclosed to third parties, BE-CERT shall notify

the manufacturer about the information to be disclosed.

Art. 2.7.3 The personnel of BE-CERT, inspection bodies or any other body that has concluded a

cooperation agreement with BE-CERT or makes personnel available to BE-CERT shall be bound

by the obligation of professional secrecy regarding the content of the certification files.

Art. 2.7.4 Members who sit in the committees of BE-CERT and who, as part of the certification process,

have knowledge of the contents of certification files, are subject to confidentiality.

Art. 2.7.5 BE-CERT shall inform the notifying or market surveillance authorities of any refusal, restriction,

suspension or withdrawal of a CE-certificate and, on request, of all information regarding the

activities carried out under this regulation (article 53 of CPR).

Art. 2.7.6 BE-CERT provides, on request, other bodies notified carrying out similar tasks for construction

products covered by the same harmonized technical specification, with relevant information

on issues relating to negative and positive results from these assessments and/or verifications

(article 53 of CPR).

Art. 2.7.7 BELAC auditors have access to the contents of the manufacturers’ individual certification files

as part of BE-CERT’s accreditation file’s processing. They are also subject to confidentiality.

Art. 3 Inspection bodies

Art. 3.1 Generalities

Art. 3.1.1 BE-CERT, the certification body, carries out itself the function of inspection body; however, the

fulfilment of inspection assignments may be subcontracted to other inspection bodies, which

in no way reduces the final responsibility of BE-CERT regarding certification. If reference is

made to BE-CERT elsewhere in this text, BE-CERT is understood to be exclusively a Certification

Body.

Art. 3.2 Collaboration with the inspection bodies

Art. 3.2.1 The list of inspection bodies with which BE-CERT has subcontracting agreements or mutual

recognition under certain special circumstances, is attached in Annex 2.

Art. 3.2.2 The manufacturer selects an inspection body that is accredited by an accreditation body that

itself is recognised by the EA (European cooperation for Accreditation, http://www.european-

accreditation.org). Accreditation of the inspection body must have been obtained in

accordance with the standard EN ISO/IEC 17020 and this inspection body must have amongst

its staff trained auditors for their entrusted tasks. In all cases, BE-CERT ensures that the

inspection body works in compliance with the approval and notification specifications

(standard or ETAG) and has the necessary skills to carry out inspection operations.

Art. 3.2.3 If a manufacturer selects an inspection body not featured in the list, he must first obtain the

written authorization of the inspection body for the inspections to be carried out by BE-CERT

to ensure that the inspection body works in accordance with EN ISO/IEC 17020 and has the

necessary skills to carry out the tests. This can lead to delays and additional costs, borne by the

manufacturer.

Art. 3.2.4 BE-CERT may not be held liable for any delays that arise from the choice of a non-notified

inspection body by the manufacturer. The manufacturer is required to pay BE-CERT all costs

incurred for the acceptance of the inspection body that it has designated, even if the body turns

refuse the body as a subcontractor.

Art. 3.2.5 The inspection body will invoice its services directly to the manufacturer.

Art. 3.2.6 An inspection body is selected by the factory.

Art. 3.2.7. BE-CERT may replace one inspection body by another, possibly to carry out a specific

assignment, based on a reasoned opinion.

Art. 4 Control laboratories

Art. 4.1 Collaboration with the control laboratories

Art. 4.1.1 The list of control laboratories with which BE-CERT has subcontracting agreements or mutual

recognition under certain special circumstances, is attached in Annex 3.

Art. 4.1.2 The manufacturer selects a control laboratory that is accredited by an accreditation body that

itself is recognised by the EA (European cooperation for Accreditation, http://www.european-

accreditation.org). Accreditation of the laboratory must have been obtained in application of

standard EN ISO/IEC 17025 and this laboratory must have amongst its staff trained technicians

for their entrusted tasks. In all cases, BE-CERT ensures that the control laboratory works in

compliance with the approval and notification specifications (standard or ETAG) and has the

necessary skills to carry out test operations.

Art. 4.1.3 If a manufacturer selects a control laboratory not featured in the list, he must first obtain the

written authorization of the control laboratory for the inspections to be carried out by BE-CERT

to ensure that the control laboratory works in accordance with EN ISO/IEC 17025 and has the

necessary skills to carry out the tests. This can lead to delays and additional costs, borne by the

manufacturer.

Art. 4.1.4 BE-CERT cannot be held responsible for delays arising from the choice of a non-notified control

laboratory by the manufacturer. The manufacturer is required to pay BE-CERT all costs incurred

for the acceptance of the control laboratory that it has designated, even if the laboratory turns

out to be unable to meet the requirements of standard EN ISO/IEC 17025, thus forcing BE-CERT

to refuse the body as a subcontractor.

Art. 4.1.5 The control laboratory will invoice its services directly to the manufacturer.

Art. 4.1.6 One or more control laboratories are selected per factory.

Art. 4.1.7 BE-CERT may suggest replacing one control laboratory by another, for all or certain tests, based

on a reasoned opinion.

Art. 4.1.8 A laboratory that is unable to demonstrate its independence from the manufacturer, or which

is involved in the manufacturer’s autocontrol, will be excluded from carrying out control tests

for that manufacturer.

Art. 5 Application for a CE certificate of conformity by a new factory

Art. 5.1 General provisions

Art. 5.1.1 An application for a certificate may be laid down by any manufacturer of ground granulated

blast furnace slag covered in the reference documents or by its authorised representative

established in the European Economic Area (EEA).

Art. 5.1.2 The working languages accepted by BE-CERT are defined in §2.4.

Art. 5.1.3 The manufacturer has facilities capable of supplying products conform to the harmonized

standards (hEN) to be applied.

Art. 5.1.4 The manufacturer has implemented a factory production control or FPC allowing him on a

continuous basis to ensure the conformity of the performance of his products in line with the

DoP established, in accordance with the requirements of the CPR and with the applicable

harmonized standards. This control relates to the essential characteristics for which the

manufacturer declares a performance. The manufacturer shall record all data related to the

FPC. The manufacturer is responsible for the organisation of the FPC and its effective

application.

The manufacturer remains solely responsible for the conformity of his products with the

declared performance with all provisons of the CPR, including aspects related to the

production.

Art. 5.1.5 The manufacturer determines the product-type on the basis of type testing (TT). These tests

are described in the harmonized specifications and further specified in the manufacturer‘s

quality documents. The results of these tests are recorded and evaluated by the manufacturer.

Art. 5.1.6 The manufacturer shall have a procedure for dealing with complaints.

It consists at least of:

§ a description of the complaint;

§ an investigation to determine the causes and an analysis of the extent;

§ an analysis of the causes and the possible solutions;

§ a corrective action plan to be implemented;

§ a verification of the effectiveness of those corrective actions;

The manufacturer shall record all the elements listed above in a complaint register and

document them (see art. 9.10 of this document).

Art. 5.2 Informative request

Art. 5.2.1 The manufacturer who wishes to obtain a CE-certificate may submit an informative request to

BE-CERT. This request contains at least the following information:

§ the identity of the person submitting the request;

§ the mail and/or e-mail address for sending the application file;

§ if necessary, the place and name of the production facility;

§ the hEN standards in force and a list of products covered by the application.

Art. 5.2.2 After receiving the informative request, BE-CERT informs the applicant in writing over the

principles involved in the procedure for issuing the certificate and will send the applicant the

following documents:

§ a copy of the regulations in force or the instructions in order to download the available

documents on BE-CERT’s website;

§ a list of standards and normative documents in force;

§ the service contract for the evaluation and verification of the constancy of performances

of the factory production control (FPC).

Art. 5.2.3 If, prior to the submission of his formal request, the manufacturer wishes to receive more

detailed information about the technical aspects of the application file, he may request an

informative visit to this effect. If applicable, the related costs shall be borne by the

manufacturer.

Art. 5.3 Formal application by a new factory

Art. 5.3.1 The manufacturer shall establish one request per factory; the request mentions the list of

ground granulated blast furnace slags for which the certification is requested.

Art. 5.3.2 The applicant sends to BE-CERT an application file that contains at least the following

documents:

§ two original signed copies of the contract stating:

- the capacity of the applicant, demonstrating that he may apply for a certificate;

- the name and address of the factory for which the CE-certificate(s) is (are) requested;

- the name of the person responsible for the contacts with BE-CERT and authorized to

represent the applicant regarding BE-CERT and his deputy;

- where applicable, the inspection body and the control laboratory which the factory wishes

to use in the context of certification;

§ the service contract for the assessment and verification of constancy of performance of the

factory production control (FPC) signed by a duly authorised member of the management;

§ a copy of the quality manual provided for in § 4.1.2 of EN 15167-2 as well as a list of FPC

documents and procedures regarding the production facility.

Art. 5.3.3 By submitting his formal application, the applicant undertakes, inter alia:

§ to respect the provisions of these regulations;

§ to take all the measures to ensure that the conformity of the FPC is guaranteed

continuously.

Art. 5.4 Admissibility of the formal application

Art. 5.4.1 As soon as the application file is complete and it can therefore be concluded that the

manufacturer is authorized to apply for a CE-certificate, and as soon as the financial obligations

have been met, BE-CERT informs the applicant of the admissibility of the formal application.

Art. 5.5 Importers and distributors– Article 15 of CPR

Art. 5.5.1 An importer or distributor shall be considered a manufacturer according to Article 15 of CPR

and shall be subject to the obligations of a manufacturer pursuant to Article 11 of CPR, where

he places a product on the market under his name or trademark or modifies a construction

product already placed on the market in such a way that conformity with the declaration of

performance may be affected.

Art. 5.5.2 BE-CERT always carries out an initial visit of the production facility, which will lead to the issue

of the CE-certificate. This means that BE-CERT must visit the production facility where the

physical manufacturing is taking place. To visit the premises of the importer/distributor would

not be enough.

Art. 5.5.3 If the importer/distributor performs storage or other operations that may affect the conformity

of the product with the declared performances, it should be included in the FPC. Consequently,

the places where these operations take place must undergo inspection visits.

Art. 6 Application for certification of a new ground granulated blast furnace slag from an

existing factory

Art. 6.1 Application for certification and quality control

Art. 6.1.1 If a manufacturer applies for the certification of a new ground granulated blast furnace slag, he

sends a formal written application to BE-CERT, accompanied by a copy of any modifications

made to its quality manual that may be necessary to handle production of a new product

successfully.

Art. 6.1.2 The manufacturer demonstrates by his factory production control system and by his

autocontrol that the new ground granulated blast furnace slag(s) is (are) and remains conform.

Art. 6.2 Inspection, initial test, initial period, allocation of the certificate

Art. 6.2.1 If the modifications of the production equipment and quality system justify it, BE-CERT is

authorised to impose an additional inspection of the factory (§ 5.5.2 of EN 15167-2).

Art. 6.2.2 BE-CERT also organises an initial type test and an initial period (§ 7 of EN 15167-2 and Art. 7

below) relating to the new ground granulated blast furnace slag(s) that is (are) the subject of

the new application.

Art. 6.3.3 If the results of the initial type test are conform, BE-CERT issues the CE-certificate to the ground

granulated blast furnace slag concerned. BE-CERT adapts the official list of ground granulated

blast furnace slags for which it has issued CE-certificates.

Art. 7 Preliminary visit and initial period

Art. 7.1 Preliminary visit and initial type test

Art. 7.1.1 The first two paragraphs of section 7 of EN 15167-2 apply.

Art. 7.2 Initial period

Art. 7.2.1 The initial period serves to demonstrate the ability of the applicant to guarantee the continuity

of the ground granulated blast furnace slag’s conformity.

Art. 7.2.2 The initial period starts from the time that the CE-certificate is issued for a ground granulated

blast furnace slag (see definition 3.5 in EN 15167-2).

Art. 7.2.3 The duration of the initial period is a minimum of 3 months (see § 5.6.1 of EN 15167-2).

Art. 7.3 Autocontrol during the initial period

Art. 7.3.1 Autocontrol testing is carried out according to the requirements of the relevant table of the

applicable standard mentioned in the reference documents. As soon as the application for a

certificate has been filed the manufacturer applies his factory production control system.

Except if he has run a unique, punctual production campaign for this application, he realises

autocontrol testing at least to a frequency as mentioned in the column for a ‘routine situation’.

During the initial period, autocontrol is carried out according to the frequencies mentioned in

the column under ‘initial period’.

Art. 7.4 Identification of the ground granulated blast furnace slags in the initial period

Art. 7.4.1 As soon as the application for a certificate has been filed, identification of the ground

granulated blast furnace slags is carried out in accordance with the requirements of the

standards mentioned in the reference documents. The CE marking cannot be applied before a

CE-certificate has been issued.

Art. 7.5 External control in the initial period

Art. 7.5.1 During the initial period, at least three samples of ground granulated blast furnace slag shall be

taken at intervals of approximately one month (see § 5.4.2 of EN 15167-2).

Art. 7.6 Closure of the application file

Art. 7.6.1 If the initial period cannot be completed despite the extensions granted according to Art. 7.7.1,

BE-CERT will notify the applicant in writing of the closure of the application file. If he wishes,

the applicant may submit a new application at a later date.

Art. 7.6.2 The applicant may at any time withdraw its application in writing. However, the applicant

remains liable for the cost of all operations that have been carried out by all of the bodies

involved in the context of dealing with the applicant’s file. BE-CERT confirms in writing to the

applicant the closure of its application file.

Art. 7.7 Extension and end of the initial period

Art. 7.7.1 If the applicant is facing particular difficulties during the initial period or if he submits a justified

request, BE-CERT is authorised, based on a positive advice from the inspection body, to extend

the length of the initial period on exceptional basis.

Art. 7.7.2 The initial period is completed either by:

· the confirmation of the issuance of the CE-certificate(s);

· the refusal of the CE-certificate(s);

· the closure of the application file by the applicant or by BE-CERT.

Art. 7.8 Control reports

Art. 7.8.1 The reports provided for in § 5.2.3, 5.3.5, 5.4.6, 5.5.5 and 5.6.3 of EN 15167-2 are drawn up by

the inspection body. The evaluation and control reports contain all of the relevant comments

required to assess control over production, autocontrol by the manufacturer and the

conformity of the ground granulated blast furnace slags .

Art. 7.8.2 The control reports, signed by a person in charge at the inspection body, are sent without delay

to BE-CERT.

Art. 8 External control

Art. 8.1 General provisions

Art. 8.1.1 The purpose of the external control is to verify the validity of the manufacturer’s autocontrol

system. The external control includes visits carried out by one or more representatives from

the inspection body to the factory (visits for taking samples - § 5.4.1 of EN 15167-2 and visits to

evaluate the factory production control (quality audits) - § 5.2.2 of EN 15167-2) and control

tests carried out in a control laboratory.

Art. 8.2 Control visits

Art. 8.2.1 § 5.2 and 5.4 of EN 15167-2 apply.

Art. 8.2.2 The inspection body may be accompanied by observers (BE-CERT and/or accreditation body).

The responsibility of the inspection remains with the inspection body. The observer is subject

to a confidentiality clause.

Art. 8.3 Follow-up of the inspection body’s visits

Art. 8.3.1 At the end of each visit, all classified remarks (type A, B or C) requiring a corrective action by

the manufacturer are given to the manufacturer’s representative. Remarks can be notified by

the inspection body as well as BE-CERT. In this case, BE-CERT notifies its remarks and endorses

those notified by the inspection body after examination of the visit report according to its

internal procedures and any eventual consultation of the manufacturer. The manufacturer may

enter any comments directly on the form or by means of a separate letter.

Art. 8.3.2 A remark shall be notified for each finding, during the visit, of non-conformity related to the

technical specifications of the product or to the regulations, as well as to the specific provisions

imposed by BE-CERT.

Art. 8.3.3 The manufacturer is required to investigate the causes of the non-conformity and to take the

corrective actions that may be necessary to avoid the retention or the repetition of this non-

conformity. A deadline should be defined between the manufacturer and the body that has

made the remark with regard to the realization of the corrective actions according to:

§ the regulations;

§ if no deadline is included in the regulations, the case-law established with BE-CERT’s

Certification Committee;

§ if no case-law exists within BE-CERT’s Certification Committee, an agreement between the

parties.

A written answer should be sent to the inspection body within a month after the date of the

closing meeting to present the corrective actions plan – including the time frame for the

implementation of the correctieve measures – and/or the overview of actions that have

already been carried out following the inspection remarks.

Art. 8.3.4 In case of absence of corrective actions within the agreed deadlines, retention or repetition of

a non-conformity, BE-CERT is entitled to not renew or to withdraw the CE-certificate.

If the importance of the remarks and/or the monitoring of the effectiveness of the corrective

actions justify it, BE-CERT can impose a new visit at the manufacturer’s expense.

If BE-CERT considers that the corrective actions taken and/or planned as a result of the remarks

made at the end of the initial visit are insufficient, it informs the manufacturer in writing to

invite him to act. In the absence of actions to ensure conformity of the FPC with the

requirements of TRA CE, BE-CERT is entitled to end the certification process and the contract

unilaterally, not without having first informed the manufacturer in writing and examined his

arguments.

Art. 8.4 Types of remarks that can be notified

Art. 8.4.1 Non-conformities relate only to the FPC and its implementation.

The presence of one or more control test results outside the declared values is not necessarily

considered as a non-conformity. However, in this case, the absence of corrective actions

constitutes a non-conformity of type A, B, or C depending on the case.

Art. 8.4.2 Depending on the seriousness of the non-conformities found, three types of remarks can be

notified to the manufacturer:

§ A-type remarks concern non conformities that affect the functioning and efficiency of the

FPC in such a way that there is a risk of bringing products to the market that don’t satisfy

the requirements of the technical specifications. The existence of an A type remark can

lead to the repetition of the entire audit or part of it at the manufacturer’s expense. The

need to repeat all or part of the inspection is decided by BE-CERT;

§ B-type remarks concern non conformities that don’t represent any risk for the efficient

functioning of the FPC if they are eliminated within a limited time span (for example,

within 2 months). In this case, the manufacturer must inform BE-CERT and the inspection

body in writing of the effective implementation of the correctives actions within the

defined deadlines.

§ C-type remarks concern non conformities that don’t represent any risk for the efficient

functioning of the FPC but must be handled by the next control visit of the FPC.

Art. 8.4.3 The measures imposed have a binding character.

The recurring finding of identical or similar shortcomings can lead to a more severe

classification of the remark.

Art. 8.4.4 In case of a significant number of remarks of type B and/or C, BE-CERT is free to decide whether

or not it is necessary to repeat all or part of the inspection at the manufacturer’s expense.

The control visits normally take place once per calendar year and by production unit.

Art. 8.5 Control tests

Art. 8.5.1 Following control tests can be distinguished:

· periodical control tests, for which samples are taken during sampling visits;

· exceptional control tests, for which samples may also be taken any time BE-CERT deems

it to be necessary.

Art. 8.5.2 The frequency of sampling for periodical control tests is set by EN 15167-2, § 5.4.

By derogation with § 5.4.4 "Testing" of EN 15167-2, it is recommended that the number

of sub-samples taken be four; two of these being kept by the manufacturer for 6 months

following the sampling.

Art. 8.5.3 Sampling and transport of the samples for the control tests are carried out according to a

procedure subject to approval by the inspection body, either by the manufacturer or the

inspection body, at the manufacturer’s expense.

Art. 8.5.4 The test samples are given an identification by the inspection body.

Art. 8.5.5 For every assignment involving control tests, the inspection body establishes a document that

includes all of the relevant details regarding the samples. This document is signed for approval

by the manufacturer’s authorised representative.

Art. 8.5.6 Unless otherwise agreed by BE-CERT, the control laboratory only sends the test report to the

inspection body, which itself sends a copy of the report to the manufacturer after having

received the corresponding autocontrol results. Under no circumstances does the control

laboratory provide the results nor send the report to third parties.

Art. 8.5.7 The control laboratory has the right to report to BE-CERT the difficulties that may arise during

the payment of an invoice in the context of the agreement with BE-CERT.

Art. 8.6 Visit reports

Art. 8.6.1 § 5.2.3 of EN 15167-2 applies.

Art. 8.6.2 At the end of each audit, during a closing meeting, the auditor submits a form containing all of

his written remarks to the manufacturer’s representative. By signing this form, the authorized

representative of the audited factory confirms having read the remarks and understood their

content.

Art. 8.6.3 The initial and surveillance audit reports are prepared by the inspection body. The reports

contain all relevant findings necessary for the assessment of the control of production. They

need to ensure the traceability of the elements examined during the audit.

Art. 8.6.4 Inspection body’s reports are validated in accordance with the quality system’s rules of the

bodies concerned.

Art. 8.7 Observations and observations with warning

Art. 8.7.1 In case of first non-conformity of autocontrol test results and/or external control test results

for the specified characteristic value of the criterion and the limit value for individual results,

table 1 of standard EN 15167-2 is applied.

Art. 8.7.2 In case of observation with warning, the provisions of §6.1 in standard EN 15167-2 are applied.

Art. 9 Autocontrol

Art. 9.1 General requirements

Art. 9.1.1 § 4.1.1 of EN 15167-2 applies.

Art. 9.2 Production facilities

Art. 9.2.1 The manufacturer shall have facilities which are suitable to produce ground granulated blast

furnace slag that conforms to the requirements. § 5.5.3 of EN 15167-2 applies.

Art. 9.3 Autocontrol laboratory

Art. 9.3.1 The factory has an in-house autocontrol laboratory equipped to carry out all of the autocontrol

tests imposed by the relevant standards mentioned in the reference documents, the

description and operation of which are described in the factory’s quality manual (see § 4.2.2

and 5.5.4 of EN 15167-2).

Art. 9.3.2 Provided prior agreement is given by BE-CERT, the manufacturer may use an external

laboratory, to which all of the requirements in Art. 4.1 apply, to carry out all or part of the

autocontrol tests. The mutual obligations of the manufacturer and external autocontrol

laboratory are specified in a written agreement which states in particular that the auditors of

the inspection body must be authorised to check the conformity of the external laboratory

when they visit the manufacturer’s facilities.

Art. 9.4 Calibrations and verification

Art. 9.4.1 The calibration and verification of the measurement equipment at the production facilities and

the measurement equipment used for autocontrol tests are to be carried out in accordance

with the manufacturer’s quality manual and under the manufacturer’s responsibility.

Art. 9.4.2 Calibration and verification are carried out either:

· by an external laboratory:

§ accredited by a member of EA;

§ or, if not available, accepted by the certification body BE-CERT;

· by the supplier of the equipment if he proves that he has the appropriate means to do so;

· by the manufacturer himself, under the supervision of the inspection body and in

accordance with a written procedure included in its quality manual.

Art. 9.4.3 Calibration or verification is in any case carried out by qualified persons, using appropriate

means.

Art. 9.4.4 If there is any doubt regarding the calibration or verification carried out by the manufacturer

or the supplier, the certification body BE-CERT may request to execute the calibration or

verification again in the presence of the inspection body.

Art. 9.5 Control staff

Art. 9.5.1 § 4.1.3.1 and 4.1.3.3 of EN 15167-2 apply.

Art. 9.5.2 The manufacturer will give authority to at least two qualified persons to sign the sampling

reports.

Art. 9.6 Technical records

Art. 9.6.1 § 4.1.2 of EN 15167-2 applies.

Art. 9.7 Control scheme

Art. 9.7.1 The control scheme indicating the minimum requirements for autocontrol are defined in the

relevant table of the standards mentioned in the reference documents.

Art. 9.7.2 The measures to be taken in the event of non-conform control results are described in the

factory’s quality manual and in § 6.1 of EN 15167-2.

Art. 9.8 Workbooks

Art. 9.10 Complaints register

Art. 9.10.1 The complaints register includes complaints received in relation to the certified ground

granulated blast furnace slags , stating the origin and the date of the complaint, its content and

the action taken as a result.

Art. 9.10.2 The complaints register contains in annex additional documents relating to the way in which

the complaint was handled (correspondence, departmental memos, any corrective action

taken, etc.).

Art. 10 Identification of ground granulated blast furnace slags and use of the certification

logo

Art. 10.1 Identification of ground granulated blast furnace slags

Art. 10.1.1 Annex ZA of the relevant standards mentioned in the reference documents applies, as does §

5 of Annex 1 of these regulation.

Art 10.1.2 If a manufacturer produces ground granulated blast furnace slags for which the application of

these regulations would lead to identical designations, the manufacturer must distinguish

between them by way of an additional individual identification that forms part of the

designation. The choice of the additional identification is subject to the approval of BE-CERT.

Art. 10.1.3 The designation of the ground granulated blast furnace slag may be accompanied by a

statement of additional characteristics not covered by the CE marking.

Art. 10.1.4 The CE-marking should be the only marking of the conformity of the construction product with

the declared performance and compliance with applicable requirements relating to European

Union harmonization legislation. However, other markings may be used, provided that they

help to improve the protection of users of construction products and are not covered by the

existing European Union harmonization legislation (extract “Expected 33” of CPR, Regulation

No 305/2011).

The standard product designation, apart from the CE marking as given in Annex ZA.3 of the

harmonized standard (hEN), may be accompanied by additional characteristics not covered by

the CE marking provided that no confusion between the certified and non-certified

characteristics is allowed.

Art. 10.2 Use and specifications of the certification logo

Art. 10.2.1 The form, specifications and rules applied for the use of the certification logo are given on the

website http://ec.europa.eu/growth/single-market/ce-marking/ and in Annex ZA of the

standards mentioned in the reference documents.

Art. 11 Management of stocks

Art. 11.1 Accessibility of stocks

Art. 11.1.1 § 5.4.1 of EN 15167-2 applies.

Art. 11.2 Subdivision of stocks

Art. 11.2.1 The manufacture identifies and distinguishes clearly those ground granulated blast furnace

slags bearing the CE marking from those that might be exempt or from ground granulated blast

Art. 12 CE Certificate

Art. 12.1 Conditions for granting a CE-certificate

Art. 12.1.1 BE-CERT issues the CE-certificate as soon as, on the basis of control reports and the audit report,

it appears that conformity with § 7 of EN 15167-2 is met and it was observed that all

requirements of a technical, administrative and financial nature are met.

Art. 12.2 Scope of CE-certificates

Art. 12.2.1 CE-certificates are issued to the manufacturer by factory and by ground granulated blast

furnace slag.

Art. 12.2.2 By issuing the CE-certificate, BE-CERT declares that

§ the product mentioned is subject to the FPC by the manufacturer

§ the product mentioned is subject to tests on samples, taken in the factory, in accordance

with a determined test programme

§ BE-CERT has determined the performances of the product on the basis of TT

§ BE-CERT has done the initial inspection of the factory and the FPC and executed a

random control of the samples

§ BE-CERT is responsible for the continuous surveillance, assessment and evaluation of

the FPC

§ All tasks related to the ACVP are carried out in accordance with the harmonized

standards in force

§ the conformity of the certified ground granulated blast furnace slag has been checked

at a frequency imposed on the basis of an external control of the manufacturer’s

autocontrol procedure by a third party.

Art. 12.2.3 By issuing the CE-certificate, the manufacturer is not discharged of his legal responsibilities and

obligations concerning the CE-certification and may not substitute those of BE-CERT, the

inspection body or any other body concerned by the CE-certification.

Art. 12.3 Refusal to issue a CE-certificate

Art. 12.3.1 In the event of refusing to issue the CE-certificate, BE-CERT shall inform the applicant in writing,

giving reasons for its decision.

Art. 12.4 Period of validity of the CE-certificate

Art. 12.4.1 The CE-certificate has a validity date and is in principle renewed annually.

Art. 12.4.2 The validity of the CE-certificate may be suspended:

- at the request of the manufacturer (Art. 12.6) ;

- by BE-CERT as the result of a sanction (Art. 15).

The maximum period of suspension requested by the manufacturer - voluntary suspension - is

12 months.

The normal period for a suspension decided as the result of a sanction is 3 months; this period

may be reduced to 1 month or increased to 6 months if the authority imposing the sanction

justifies it.

Art. 12.4.3 The validity of CE-certificate is terminated as the result of:

- the CE-certificate being withdrawn by BE-CERT as the result of the manufacturer’s

renunciation (Art. 12.6), production being halted, a sanction (Art. 15) or refusal to issue

the CE-certificate at the end of the initial period (Art. 7.7.2);

- a period of 12 months without production after a request for the voluntary suspension of

the CE-certificate;

- the cessation of the CE-certification system for ground granulated blast furnace slags.

Art. 12.4.4 The suspension of end of the validity of the CE-certificate shall be notified in writing to the

manufacturer by BE-CERT.

Art. 12.5 CE-certificate

Art. 12.5.1 Annex ZA of the standards mentioned in the reference documents applies.

Art. 12.5.2 The manufacturer may only distribute complete copies of the CE-certificate. The manufacturer

is obliged to provide free of charge a full copy of the CE-certificate to any direct customer.

Art. 12.6 Suspension and withdrawal by the manufacturer

Art. 12.6.1 The manufacturer may request the suspension of a CE-certificate, or renounce to it. The

suspension and withdrawal can therefore relate to one of the ground granulated blast furnace

slags or the whole of the certified production.

Art. 12.6.2 The manufacturer must lodge a written request for suspension, indicating the required period

of suspension, as well as the time required for stocks of the certified ground granulated blast

furnace slags to be exhausted.

Art. 12.6.3 The certification body shall grant the suspension from the end of the stocks being exhausted

and for a maximum period of 12 months.

Art. 12.6.4 The manufacturer notifies the certification body of the withdrawal of a ground granulated blast

furnace slag by registered letter. The letter includes an indication, giving reasons, of the time

required to exhaust the stocks of the certified ground granulated blast furnace slag. On this

basis of this indication, the certification body determines the date of the withdrawal of the CE-

certificate.

Art. 12.6.5 Renouncing the signed commitment can only take effect at the end of a calendar year by way

of 6 months’ notice. During the time of its commitment, the minimum fee due to BE-CERT by

the manufacturer corresponds to the amount stated in the fees for the CE-certification of a

ground granulated blast furnace slag.

Art. 12.7 Modification of the technical specifications of the ground granulated blast furnace

slags and the regulations

Art. 12.7.1 BE-CERT informs in due time the manufacturer of any modification to the technical

specifications of the ground granulated blast furnace slag and the regulations relating to the

CE-certification of the ground granulated blast furnace slag, stating the period of time that the

manufacturer has to adapt to the modified prescriptions unless if it is indicated in the Official

Journal of the European Union.

Art. 12.7.2 BE-CERT informs in due time the inspection bodies and the control laboratories of any

modification to the technical specifications of the ground granulated blast furnace slag and the

CE regulations relating to the inspections and control tests concerning them, stating the

moment at which the modifications come into effect.

Art. 12.7.3 BE-CERT may decide, if necessary, to carry out an additional visit at the the manufacturer’s

expense on the basis of the type of modifications.

Art. 12.8 List of certified products

Art. 12.8.1 BE-CERT keeps up to date a list of the manufacturers and ground granulated blast furnace slag

for which BE-CERT has issued a CE-certificate. The list is available on the BE-CERT website

http://www.be-cert.be and can also be obtained from BE-CERT by simple request.

Art. 12.8.2 In addition to the manufacturers and the certified ground granulated blast furnace slag, the list

also mentions the date of applications for withdrawal that have taken place in the three months

prior to the publication, as well as the date of the application and the length of any suspensions

that were in effect in the three months prior to the publication. Sanctioned (Art. 15) or

voluntary (Art. 12.6) suspension or withdrawal is indicated clearly.

Art. 13 Production during the period of validity of a certificate

Art. 13.1 Downgraded ground granulated blast furnace slags

Art. 13.1.1 Ground granulated blast furnace slags that do not conform after the final stage of production

are downgraded by the manufacturer.

Art. 13.1.2 Downgraded ground granulated blast furnace slags are recorded in the production status

report in such a way that their traceability can be ensured. The identification of a downgraded

ground granulated blast furnace slag features a clear and indelible symbol that is proof of its

downgrading.

Art. 13.2 Delivery of ground granulated blast furnace slag with CE marking

Art. 13.2.1 The FPC must give confidence in the constancy of performance of the product concerning the

essential characteristics for which the manufacturer has declared a performance.

Art. 13.2.2 Each delivery note for certified ground granulated blast furnace slag must state the quantity

and identification of the ground granulated blast furnace slag being delivered and satisfies the

requirements of Annex ZA of the standards mentioned in the reference documents.

Art. 13.2.3 The CE marking cannot be affixed to non-conforming ground granulated blast furnace slags

under any circumstances.

Art. 13.2.4 The treatment of downgraded ground granulated blast furnace slags is described in the

factory’s quality manual (§ 4.2.1.3 of EN 15167-2). Informing BE-CERT, as provided for in the

note at the end of § 4.3.2 in EN 15167-2, is required.

Art. 13.2.5 The manufacturer establishes and applies an appropriate procedure ensuring the cleanliness

of the tanks on trucks and ships before bulk ground granulated blast furnace slags are loaded.

Art. 13.3 Modification of production

Art. 13.3.1 If production is discontinued or interrupted on a temporary basis, the manufacturer is required

to inform BE-CERT and the inspection body of any period of production or interruption, in such

a way that control visits can be programmed to coincide with period of production.

Art. 13.3.2 BE-CERT is authorised to take all measures necessary to ensure that confidence in the

conformity of the ground granulated blast furnace slag is maintained after an interruption in

production.

Art. 13.3.3 The manufacturer informs BE-CERT by registered letter of the final end to any production. The

final end of production is considered by BE-CERT as a withdrawal by the manufacturer (Art.

12.6).

Art. 14 Complaints

Art. 14.1 Complaints relating to the certification of ground granulated blast furnace slags

Art. 14.1.1 Any written complaint submitted to BE-CERT is dealt with in application of the appropriate

procedure covered in its quality manual. As the responsibility for the quality of the ground

granulated blast furnace slag is always incumbent upon the manufacturer, complaints that

relate to the use of the ground granulated blast furnace slag and that would be passed on to

BE-CERT are always for the manufacturer and will be forwarded to it systematically.

Art. 15 Sanctions

Art. 15.1 Definition

Art. 15.1.1 BE-CERT is authorised to take the measures described in Table 1 of EN 15167-2 following the

observation of a non-conformity with the technical specifications of the ground granulated

blast furnace slag on application of this table.

BE-CERT is also authorised to notify sanctions and to take the measures provided for in the

reference documents, regulations and quality manuals that apply after a non-conformity has

been observed with regard to regulatory provisions and special provisions that it has imposed

in the context of certification.

Art. 15.1.2 A sanction may concern part or all of the certified production. The sanction may be

accompanied by a strengthening of the industrial autocontrol procedures or external control

and the various measures of a mandatory nature required of the manufacturer. The

manufacturer must take all of the corrective action necessary to avoid the breach or failing

being maintained or repeated.

Art. 15.1.3 Depending on the seriousness of the non-conformity, except for those provided for in Table 1

of EN 15167-2, the following sanctions can be distinguished:

· WARNING: the manufacturer is warned that the maintenance or repetition of the non-

conformity will place in doubt the manufacturer’s ability to ensure the continuity of the

ground granulated blast furnace slag’s conformity and may give rise to a heavier

sanction;

· SUSPENSION OF INDEPENDENT DELIVERY: the manufacturer may no longer deliver

under CE marking those parts of the production concerned without prior authorisation

from BE-CERT. The autocontrol procedure and external control are then continued

without restriction.

· SUSPENSION: the manufacturer may no longer deliver under CE marking those parts of

the production concerned for a period defined at the moment the sanction is

announced. The autocontrol procedure and external control are then continued without

restriction.

· PARTIAL WITHDRAWAL: the manufacturer may no longer deliver under CE marking

those parts of the production concerned. The external control relating to those parties

of the production concerned is halted.

· WITHDRAWAL OF ALL CERTIFICATES: the manufacturer may no longer deliver ground

granulated blast furnace slag with CE marking. External control is halted, with the

exception of a visit made during the three months following the withdrawal, the aim

being to check on the level of stocks.

Art. 15.1.4 The suspension of independent delivery is pronounced for an indeterminate period. The

suspension may only be lifted at a time when there is a sufficient level of confidence in the fact

that the manufacturer is once again in a position to ensure the conformity of its ground

granulated blast furnace slag.

Art. 15.1.5 The suspension is pronounced for a specific period, which may be extended if necessary. The

maximum period for a suspension is 6 months.

Art. 15.1.6 The withdrawal of a certificate is final. The manufacturer may only submit a formal application

for a new certificate after a period of at least 6 months.

Art. 15.1.7 A warning or suspension of independent delivery are confidential sanctions and are never

divulged to third parties. They are notified in writing.

Art. 15.1.8 The suspension and withdrawal of a certificate are public sanctions and are clearly stated in the

list of certified products. These sanctions are notified to the manufacturer by registered letter,

after the manufacturer has been informed of the risk being run and not without allowing the

manufacturer to present its defence on the matter.

Art. 15.2 Application of sanctions

Art. 15.2.1 For every non-conformity, depending on the regulatory provisions, findings made by the

inspection body and observations, as well as the jurisprudence constituted by it, BE-CERT’s

Certification Committee decides on the appropriateness of notifying a sanction and determines

its level and duration, as well as any additional measures that may be required.

Art. 15.2.2 The following occurrences in particular may give rise to a warning:

§ non-compliance with the nature or frequency of a control required in the context of

autocontrol;

§ non-compliance with the quality system provided for in the manufacturer’s quality manual.

Art. 15.2.3 Another occurrence that may also lead to a suspension of independent delivery, is the delivery

affixing CE marking of parts of production whose non-conformity is observed after delivery has

been made.

Art. 15.2.4 The following occurrences in particular may give rise to the suspension of one or more

certificates:

§ the delivery affixing CE marking of parts of production whose non-conformity should have

been known to the manufacturer;

§ non-compliance with the measures imposed in cases where the autocontrol results do not

meet the technical specifications of the ground granulated blast furnace slag or the

regulatory provisions;

§ the non-payment of invoices relating to work carried out in the context of the certification

process and owed to BE-CERT, an inspection body or a control laboratory.

Art. 15.2.5 The following occurrences in particular will lead to the withdrawal of all certificates:

§ any voluntary act designed to conceal the non-conformity of parts of production;

§ the delivery affixing the CE marking of parts of production during a period of suspension or

without the authorisation of BE-CERT during the period of suspension of independent

delivery.

Art. 15.2.6 Non-compliance with an obligation arising from a sanction or the observation during the period

relating to a sanction, of the same type of non-conformity, or a second non-conformity also

resulting in a sanction, may result in the sanction being made heavier.

Art. 16 Hearings, appeals and pleas

Art. 16.1 Hearing

Art. 16.1.1 Any manufacturer disputing a decision taken or a sanction handed down by BE-CERT has the

right to be heard by BE-CERT.

Art. 16.1.2 Applications for a hearing must be made in writing.

Art. 16.1.3 The decisions taken and sanctions handed down by BE-CERT are not suspended by an

application for a hearing.

Art. 16.1.4 The hearing takes place during the first Certification Committee following the examination of

the application.

Art. 16.2 Appeal

Art. 16.2.1 Any manufacturer disputing a decision taken by BE-CERT regarding the suspension or

withdrawal of a certificate following a sanction has the right to lodge an appeal against the

decision with an Appeal Committee established within BE-CERT.

Art. 16.2.2 Lodging an appeal is carried out by registered letter within ten working days after receipt of the

notification of the sanction in question, addressed to BE-CERT’s secretariat.

Art. 16.2.3 The suspension or withdrawal of a certificate following sanction is not suspended by an appeal.

Art. 16.3 Pleas

Art. 16.3.1 A plea against any decision taken by BE-CERT is possible with the authority that has notified BE-

CERT, i.e. the Federal Public Service Economy1.

Art. 16.3.2 The suspension or withdrawal of a certificate following sanction is not suspended by a plea.

Art. 17 Financial system

Art. 17.1 Financial rules

Art. 17.1.1 The fees that apply and rules of the financial system for the certification of ground granulated

blast furnace slag are established by BE-CERT. They are communicated with each modification

or on request.

The fees for the inspection bodies and the control laboratories are managed by each of them.

Art. 18 Disputes

Art. 18.1 Arbitration of disputes

Art. 18.1.1 The applicant or the manufacturer on the one hand, and BE-CERT on the other hand, undertake

to have any dispute ruled on by arbitration that may arise in terms of the implementation or

interpretation of the regulatory provisions. The procedure takes place in accordance with the

CEPANI regulations (see http://www.cepani.be). Belgian law applies. The place of arbitration is

Brussels. The national languages are accepted as the languages for conducting the arbitration.

The arbitration will take place in first instance and final appeal.

Art. 19 Misuse of CE-certification and CE-certificates

Art. 19.1 Regardless of the media used, the manufacturer complies with the requirements of this

regulation and of the CPR in its communication regarding CE-certification.

Art. 19.2 The manufacturer’s DoP is within the scope of the CE-certification.

Art. 19.3 The manufacturer does not use CE-certification in a way that could harm BE-CERT. He makes

no declaration regarding CE-certification that BE-CERT could consider misleading or unlawful.

Art. 19.4 In the event of suspension, withdrawal or end of validity of the CE-certification, the

manufacturer ceases all reference to CE-certification.

Art. 19.5 BE-CERT reserves the right to draw the manufacturer’s attention to any inaccuracies or

deficiencies in the DoP that he established or in the information accompanying the CE-marking

which bear the identification number of BE-CERT as a notified body.

Art. 19.6 BE-CERT reserves the right to take legal action against any misuse or falsification of its

identification number as a notified body or a CE-certificate issued by its services.

Art. 20 Market surveillance

Art. 20.1 The manufacturer meets all the requirements of CPR for the use of CE-marking and for editing

and communicating the DoP.

Art. 20.2 BE-CERT is not competent for market surveillance in the context of the application of CPR.

Art. 20.3 The competent administrative authorities of the Member States are responsible for the market

surveillance in the context of the application of CPR.

Annex 1: Additional clauses

1 Chloride Cl- content of ground granulated blast furnace slags

The maximum content of chlorides Cl- in ground granulated blast furnace slags that contain more than 0.10%

shall be explicitly stated on the bags and delivery documents.

The manufacturer shall declare the maximum chlorides content in these ground granulated blast furnace slags

to the certification body; the inspection body is responsible for checking that this maximum content is indeed

complied with.

2 Division of autocontrol samples

In cases where a ground granulated blast furnace slag type is distributed in varying types of packaging (bags,

bulk, big bags, etc.), the samples for autocontrol and external control shall be divided between the various

methods of distribution, pro rata with the quantities delivered in the various forms of packaging.

In cases where the holder of the CE-certificate distributes the same certified ground granulated blast furnace

slag via more than one point of delivery managed under its own responsibility (different points of delivery in the

factory and/or in one or more depots), the samples for autocontrol and external control shall be divided between

the various points of delivery, pro rata with the quantities delivered from each site.

3 Transmission of autocontrol results

The person in charge of contacts with BE-CERT, designated by the applicant, shall have an e-mail address.

The results of the autocontrol shall be sent monthly to the inspection body in a format and according to a

procedure defined by BE-CERT.

4 Inter-laboratory tests

In accordance with §5.4.7 of standard EN 15167-2, the testing laboratory shall carry out regular proficiency

testing with other testing laboratories in order to maintain the required accuracy.

The laboratories involved in the CE certification of ground granulated blast furnace slags shall take part in inter-

laboratory tests organised by the Direction Committee for the certification of Additions Type II for concrete of

BE-CERT regarding ground granulated blast furnace slags.

5 Designation of ground granulated blast furnace slags on bags and delivery slips

In order to be placed on the market, ground granulated blast furnace slag shall carry the CE-marking as described

in Annex ZA of the standards mentioned in the reference documents.

5.1 CE-marking of ground granulated blast furnace slags in bags

In cases where ground granulated blast furnace slags are supplied in bags, those must display all of the CE-

marking, the identification number of the certification body and any accompanying information, as described in

§ ZA 3 of EN 15167-1.

Regarding the date of bagging, it is permitted to mention in the box, in the place designed for the date, where it

may be found on the bag (for example: "see the side of the bag").

No particular specification is provided for in terms of the delivery documents for these ground granulated blast

furnace slags; however, they may mention the CE-marking and the information that goes with it, or only a part

of the prescribed information. If the "CE" logo is printed on the delivery slip, it must be accompanied by the

identification number of the certification body (0965 in the case of BE-CERT).

5.2 CE-marking of ground granulated blast furnace slags in bulk

5.2.1 General rule

Regarding the shipping date, it is permitted to mention in the box, in the area designed for it, where it may be

found on the delivery document, (for example: "see shipping date above").

5.2.2 Individual cases

If the layout cannot be achieved, it is permitted not to abide by it, although differing as little as possible. In all

cases, all of the information required must nevertheless be mentioned on the delivery slip and be present in such

a way as to avoid any equivocation or ambiguity relative to CE-marking.

6 Calibration of strength testing machines

Laboratory strength testing machines shall be calibrated at least once a year by a body accredited by a member

of EA.

7 Identification of points of delivery and points of sampling

The points of sampling of ground granulated blast furnace slags for autocontrol and audit testing are clearly

identified with the designation of the ground granulated blast furnace slags in application of §5 of this annex.

The points of delivery for bulk ground granulated blast furnace slag have to be univocally identified at any

position where it is required for production, dispatch or inspection purposes.

8 Allocation plans of the silos

An allocation plan of the silos shall be established by the factory. This plan is systematically updated when

modifications are made to the allocation of ground granulated blast furnace slags in the silos or if the installations

are modified. With each update of the silo plan, a copy shall be sent immediately to the inspection body.
