Most people know that they should have a document as part of their estate plan called a health care proxy, which allows you to name someone to make your health care de-cisions if a doctor determines that you are unable to do so. However, in Massachusetts, unlike many other states, you are not able to become an organ donor in your health care proxy. In Massachusetts there are two ways to become an organ donor. A simple way to is to check “yes” on ques-tion 1 of your driver’s license application. Th is will register you as an organ and tissue donor with the Registry of Motor Vehicles, enter you into the Massachu-setts Donor Registry and provide legal consent for donation. For individuals who do not drive, the same option is available when applying for a state issued

ID card. A driver who is un-der the age of 18 may register to be an organ donor, but consent only becomes valid at the age of 18 years. Th e second way to become an organ donor is to register directly with the Donor Registry online at donatelifenewengland.org/.Even if you register online, you will still need to check “yes” on the driver’s license application in order to remain in the donor registry.

Although organ donation is not part of the Massachusetts health care proxy, it is still important to discuss your desires with your health care agent regarding organ dona-tion to help ensure your ultimate wishes will be carried out.
