Invitation from the MSPS PresidentGreetings,

I am pleased to invite you to the 2020 MSPS Convention being held at the Radisson Plaza Hotel & Suites in Kalamazoo. The Convention Committee’s primary objective is to provide you with top notch and multifaceted educational opportunities and to spawn an environment conducive to peer networking and collaboration. It is my prediction you will discover some great fun and comradery intermixed with the learning. There will be numerous activities throughout the convention that might just strike your fancy – not only from a professional development perspective, but also give you some well deserved time to relax away from the doldrums of everyday work. We sincerely hope you will be blessed with a whole lot more bang for your buck than simply enduring dry speeches to meet your CEU requirements.

The convention has been designed and structured a bit differently for 2020, and we hope you will find the new format to be a positive improvement toward enhancing your experience. A few highlights are:

• Tuesday pre-convention winter symposium presented by the Michigan Land Title Association and Hirzel Law, PLC

• Numerous choices in educational sessions

• Dedicated breaks as well as a Wednesday evening Exhibitor Reception to ensure time to visit the exhibit space

• County surveyor’s luncheon at noon on Wednesday (a few of you can now sleep in)

• Foundation Team Trivia Contest on Wednesday evening immediately following the Exhibitor Reception

• SURPAC luncheon at noon on Thursday (sleep in once again)

• The membership meeting will be Thursday afternoon. Please plan on attending, so you can meet your directors and provide us with your input.

• Member reception on Thursday evening instead of the traditional banquet. There will be heavy hors d’oeuvres, so not to worry about dinner.

• We’ll be done at noon on Friday. You’ll have the opportunity for a relaxing trip home (weather permitting, of course).

Be sure to attend the Thursday evening reception to meet the new licensees, life members, and recognize the 2020 award winners. There will also be give aways during the reception that you won’t want to miss.

This Convention promises to provide assorted activities for every attendee. I hope you enjoy yourselves, learn some new things and meet up with friends new and old. Finally, I would ask that you take a few minutes at the end of the convention to complete the feedback survey and let us know about other subjects you would be interested in learning about. To our multi-state licensees - Kindly share your assessment of this Convention and offer suggestions from others you may have attended.

8:00AM – 12:00PM 4 CEUS Railroad Rights of Way – Interests, Rights, and Rail-to-TrailsGary Kent, PS

Professional Surveyors frequently encounter railroad rights of way in their work as they retrace boundaries, deal with questions of seniority between public roads and railroads, address abandonments or reversionary rights, or guide clients on their needs for easements or licenses over railroad rights of way. In the process they often face confusion over the status of a railroad right of way: Is it a fee ownership or just an easement? Is it abandoned or just inactive? Is it active? How does one know? How does one find Railroad Valuation Maps and vesting deeds? What about “Rails to Trails?” In this session, we will review several judicial decisions regarding

railroad rights of way including Preseault v. Interstate Commerce Commission (U.S. Supreme Court, 1990), Howard v. U.S. (2012), several contemporary Michigan cases, Consolidated Rail Corporation v. Lewellen, and Clark  v. CSX. We will also examine the National Trails System Act of 1969 and its 1983 amendment in order to better understand the whole of the debate over “Rails-to-Trails” and how the standing of a railroad’s right of way can be perplexing.

We will review the FAA Reauthorization of 2018 which establishes the regulations for UAV flights in FAA airspace. What, when and where can we fly? We will also look at the current state of UAV legislation in Michigan.

As land title professionals we rely heavily on your work to guide our work and coverages. Today we will review the nuts and bolts of title insurance and parlay that discussion into how our two professions interact and support each other’s endeavors. We’ll share stories of things gone wrong, things gone right and the end results. This discussion is focused on helping you better understand the title insurance world and your role in it. Tips for Drafting and Amending Condominium Subdivision PlansKevin Hirzel

This seminar will discuss the basic requirements contained in the Michigan Condominium Act and administrative rules that are required to appropriately draft condominium subdivision plans that are necessary to establish a condominium.  The seminar will also discuss more complicated issues that arise with respect to changes in the composition of the condominium involving, convertible area in a condominium, expanding condominiums, contracting condominiums, withdrawing land from condominiums under Section 67 of the Condominium Act, subdividing condominium units and relocating condominium unit boundaries.

I’m often asked, “How did you do that?” from those around the office when I breakout the GIS toolbox. Public and third party organizations have an enormous amount of geographic data and it is becoming more readily available for everyone to use at the click of a button. While we all know and often question the quality of GIS data, it’s all about how you use it and understanding its limitation. During this program we will explore some data sources and tools available to utilize this data best. Additionally, we will demonstrate some ways to integrate the use of GIS into your projects, compare it to traditionally collected data, and even use it to aid in checking traditionally collected data for potential blunders and other errors.

Over the years geodesists have been implementing various datums in order to provide surveyors, and other users, with the most precise reference frame from which surveys can be described. Since the earth is dynamic, definition of these reference systems needs updating as we gain better knowledge of the earth’s size, shape and motion. In 2022 the National Geodetic Survey (NGS) will roll out a new system called the North American Terrestrial Reference Frame of 2022 (NATRF2022) to replace NAD 83 as well as a replacement to NAVD 88 called the North American-Pacific Geopotential Datum of 2022. This is important to surveyors because it will necessitate a change in our State Plane Coordinate System. This presentation will discuss the reason for the new datum, the policies and procedures developed by NGS to implement these changes, definition of these new systems and the status of the development of the new state plane coordinates in Michigan.

This session reviews how the Land Surveyor must find and evaluate evidence “collaterally” for its ability to serve as proof of an obliterated corner point. It will illustrate what constitutes as evidence and emphasize the use of “all means” to recognize and evaluate the elements of retracement evidence to ascertain theposition of an original corner point. Examples will demonstrate the challenges when the evidence is fragmentary, conflicting or almost nonexistent.

1:00PM – 2:00PM 1 CEU Planes, Drones, Photogrammetrists and Surveyors and How They All Fit Together Greg Lemke, CP, Denny Sauers Jr, CP, PPS

Greg Lemke, CP, UAV licensed pilot and Denny Sauers, Jr, CP, PPS will discuss how topographic projects can now be accomplished thru a combination of technologies. Manned and unmanned aircraft image acquisition, airborne and mobile LiDAR, photogrammetric mapping, digital orthophotography and land surveying all offer important pieces to the puzzle and can be combined to provide a quality mapping product.

2:00PM – 4:00PM 2 CEUS Remonumentation Status and New Plat ChecklistsMichael Barger, PS

This session will cover the current status of the Remonumentation program in Michigan, which will dive into how money is collected and distributed to the counties. The remaining time will cover the new plat checklists and the changes to the Subdivision rules.

4:00PM – 5:00PM 1 CEU Surveying Techniques for the Positioning, and Recovery of World War II American MIA/POW’sPaul Schwimmer, PS

This session will provide the audience with current land surveying techniques used in the positioning of 1940’s World War II potential MIA/POW recovery sites into real time information. This information can be used in present day land surveying efforts. We will also be discussing the archeological techniques of properly excavating a potential site for surveying artifacts.

In this workshop-type program we will review a variety of state-specific statutes and rules, and explore various topics such as sufficiency and purpose of a legal description, do’s and don’ts, what controls when there are conflicts, dealing with potential unwritten rights such as adverse possession, water boundaries, reversionary rights, eleven different types of descriptions, and subterranean and aerial descriptions.  We also ask attendees to bring a laptop or tablet for use in writing descriptions, if possible.  Otherwise, we will provide them with the necessary paper to work on up a number of property description exercises through the course of the day.

The MISS DIG 811 Certification workshop being presented covers an Overview, Call MISS DIG 811, PA 174, Positive Response, Pipeline Safety, Scope of Work and Ticket Ingredients, Response Times, Color Codes and Removing the Flags, and Online Programs, Tools and Resources including No Marks Ticket.  You can also earn Continuing Education Credits for Drinking Water, Waste Water, Professional Engineer or Surveyor, Residential Builder or Builder prelicensure, and Landscape Architect.  The workshop has also been Gold Shovel Standard Approved.

In just a few short years, our national horizontal and vertical datums will be replaced.  Do you understand the changes well enough to explain it all to your field crews?  We’ll review the fundamentals of geometric and physical geodesy, and we’ll compare the new approach with the current ones.  Come see how changes to our state plane coordinates and elevations will alter our field methods.

The 2016 ALTA/NSPS standards limit the relative positional precision of the points in your survey. Without using least squares adjustment software, it’s impossible to generate a realistic relative positional precision value. Join us to review the error sources in our surveys, refresh your basic statistics knowledge, and explore the impact of equipment specifications. You’ll see just how important redundant measurement truly is. Using error estimates, we’ll apply weights appropriately to adjust our measurement data. Through an example project, you’ll see the impact of redundancy, errors, and the resulting weights. We’ll dispel the mystery in least squares adjustment, show you how to interpret the results, and equip you to certify your next ALTA survey with greater confidence.

1:30 PM - 2:30 PM Mapping the Great Lakes 1 CEU Hans Van Sumeren

The Lakebed 2030 project has an ambitious goal to completely mapping the Great Lakes by the year 2030. The need exists for better mapping across broader areas within all large lakes of the world. The Great Lakes have limited high-resolution bathymetry and substrate data, estimates vary from 4% - 12% coverage for the entire basin, falling behind the 18% coverage from combined efforts across the world’s oceans. We know significantly more information at a much higher resolution for the surface of Mars than we do either the Great Lakes or the world ocean. Such large gaps point toward data collection strategies benefiting multiple user groups in a manner that streamlines access, emphasizes standards and competencies, and prioritizes areas of need. New collaborative approaches combined with accessible data repositories and technological advancements can help move us closer to a well understood Great Lakes basin and one day realize a complete and comprehensive view of the lakebed.

This session will review the complexities and nuances of unwritten title/transfers applied to boundary determination and the hazards they may cause for the surveyor. When evaluating boundary evidence, the Land Surveyor must distinguish between evidence of the record title boundary or possibly some other unrecorded/unwritten right, and avoid crossing the line between fact finder and ownership adjudicator.

Survey field crews are routinely exposed to a wide variety of environmental and societal factors that compromise their safety.  These can range from diseases such as Lyme disease to poisonous plants like Giant Hogweed, and from confined space issues to construction-related hazards such as working in, on or around excavations and scaffolding.  In this program, we will explore a number of the primary safety hazards that field crews encounter and how to recognize them by maintaining a constant awareness of one’s surroundings.  We will also review some of the important safety-related metrics that clients may look at as part of their process of selecting a surveyor, and steps companies and employees can take to help control them.  Finally, we will outline avariety of good practices that companies should maintain in order to help their employees get home safely each night.

Tour the historic Kalamazoo State Theatre located right on the Kalamazoo Mall. The State Theatre has been a fixture in downtown Kalamazoo since 1927. The original founder of the theatre was Colonel William Butterfield. John Eberson was the renowned architect who designed the theatre. In line with theatre design conventions of the era, the idea was to create a unique atmospheric effect. The early roots of the theatre were found in the Vaudevillian tradition of performance. Many acts that frequented the State Theatre included opera, dramas, big bands, ballet, dance reviews, stage shows and movies.

Individuals will be recognized for the value they have added to the profession thorough their investment of time and volunteerism. All of these activities will be done against the backdrop of a relaxed social atmosphere and giveaways throughout the evening. The Foundation’s Silent Auction and Raffle will be in full effect with silent auction items closing bids at various times throughout the evening and the raffle drawing will close out the evening’s activities.
