Whereas the forest land as specified in the Schedule appended hereto is the property of the Government and the Government has proprietary rights over it (hereinafter called as the "said land").

And, whereas the Government proposes to constitute the said land as reserved forest under Section 3 of the Indian Forest Act, 1927

(Central Act No. 16 of 1927) (hereinafter called as the "said Act").

Now, therefore, in exe_rcise of the powers conferred by sub-section (1) of Section 4 of the said Act, the Government of Goa hereby declares that it has been decided to constitute the said land as reserved forest and further appoints, under clause (c) of sub-section (1) of Section 4 of the said Act, Shri Netto D. R Pereira as the Forest Settlement Officer, to inquire into and determine the existence, nature and extent of any rights alleged to exist in favour at, any person in or over any land comprised within such limits, or in or over any forest produce, and to deal with the same as provided in Chapter II of the said Act.

Whereas the Regional Plan for Goa has been published in the Official Gazette, Series III, No. 37, dated 11-12-1986 (hereinafter referred to as "Regional Plan").

And, whereas the Government is of the opinion that revision of the certain provisions of the said Regional Plan is necessary.

And, whereas under Section 17 of the Goa Town and Country Planning Act, 1974 (hereinafter referred to as the said Act). the Government had directed the Chief Town Planner to undertake revision of the said Regional Plan.

And, whereas the Chief Town Planner has carried out necessary surveys/studies of the concerned areas and referred the proposals to the Town and Country Planning Board.

And, whereas the Board in its 103rd (adjourned) meeting and 104th meeting considered the cases from serial Nos. 1 to 9 and 10 to 31, respectively. Similarly

Honourable Chairman of Town and Country Planning Board based on powers delegated to him by Town and Country Planning Board in its 97th meeting considered the cases at serial Nos. 32 and 33 of the given below list for the revision and the changes needed to be made in the Regional Plan in terms of Section 12 of the said Act and approved the same.

Whereas the Government has prepared the Panaji Outline Development Plan and it has been published in the Official Gazette, Series III, No. 41, dated 11-1-1990 (hereinafter referred to as the "Development Plan" under the provisions of Section 37 of the Goa Thwn and Country Planning Act, 1974 (hereinafter referred to as the "said Act").

And, whereas the Government is of the opinion that alterations and making minor changes in the said Development Plan are necessary.

Now, therefore, under provisions of the Section 39(1) of the said Act the Chief Town Planner has carried out such fresh surveys, studies as may be necessary.

And, whereas the Goa Thwn and Country Planning Board in its 93rd, 99th and 99th adjourned meetings held on 22-6-2001, 6-6-2001 & 15-6-2001, respectively had considered below mentioned alterations and

changes made in the said Development Plan and the same were approved by the Government under Section 34 of the said Act.

And, whereas under Section 35 of the said Act the Chief Town Planner had notified in Official Gazette as weIl as in local newspapers the below mentioned alterations and changes in the said Development Plan for information of persons likely to be affected and inviting objections to the said alterations and changes in the Development Plan.

And, whereas No Objections have been received for the said alterations and changes in the said

Development Plan.

And, whereas under the proviSions ofthe Section 35

of the said Act, the Board in its 102nd and 103rd

meetings held on 21-11-2001 and 25-1-2002,

respectively considered and finally recommended

the said alterations and change$ in the said Develop

ment Plan.

public that by a Notarial Deed of Succession dated

5-4-2002, drawn by and before me at page 19

That Mr. Joao Manuel Dias, son of Pedro Mariano

Nonato Dias who was a resident of Santa Cruz,

Ilhas-Goa expired on 26-12-1996 at G. M. C.

Bambolim-Goa, who was married to Mrs. Maria Idalina

Gomes e Dias under the communion of assets and who

expired without a Will or any other disposition of his

last wish, leaving behind his wife Mrs. Maria Idalina

Gomes e Dias as moiety holder and half sharer and as

his legal heirs his 4 children, namely: (a) Mr. Joao

Balduino Didacio Dias, married; (b) Mrs. Tereza Rainha

Dias alias Teresa D. Vaghela, married to Mr. Dinesh

Vaghela; (c) Mr. Agnelo Francisco Ambrosio da

Conceicao Dias, married and (d) Helena Dias. Thereafter

expired Mrs. Maria Idalina Gomes e Dias at Santa Cruz,

Ilhas-Goa on 25-1-2002 without any disposition of her

last wish leaving behind her as the legal heirs, the

above named children.

That the said (a) Mr. Joao Balduino Didacio Dias,

(b) Mrs. Tereza Rainha Dias alias Teresa D. Vaghela,

(c) Mr. Agnelo Francisco Ambrosio da Conceicao Dias

and (d) Helena Dias are the only legal heirs of their

deceased parents Mr. Joao Manuel Dias and Mrs. Maria

Idalina Gomes e Dias.

And, that besides the above mentioned children,

there are no other persons who according to Law

may have preference over them who may concur

alongwith them to the estate left by the said

deceased persons.

the said Miguelinha Barreto as "moeity sharer" and to

children, namely: (1) Alberto Almeida alias Alberto da

Silva, married to Sebastiana Barreto and (2) Joanita

Almeida alias Joanita da Silva, married to Joseph

Abdonio Pereira as "sale universal' heirs",

That on 6-2-1970 the said ~;linguelinha Barreto,

married to Domingos Jose Almeida alias Domingos

Almeida (second marriage). That the said Domingo

Almeida died on 1-4-2001 at Mormugao Port 1hlst

Hospital, Baina, Vasco-da-Gama, without descendants

nor ascendants, brothers/sisters nor their children nor any other heir upto fifth degree in the line of succession

and without making Will, Gift or any other disposition

of his last wish leaving behind his widow the said

Miguelinha Barreto as his "moiety sharer and sole

universal heiress". That besides the above mentioned

heirs and moiety sharer there does not exist any other

person or persons who in terms of Law of Succession

prevailing in this State of Goa could prefer or concur
