BOARD MEMBERSHIP The Board shall consist of five members elected by the qualified voters of the District. Members shall be elected by and represent the registered voters of the Trustee Area in which they reside. Any person who meets the criteria contained in law is eligible to be elected or appointed as a member of the Board. An employee of the District may not be sworn into office as an elected or appointed member of the Board unless and until he or she resigns as an employee, except as permitted under Section 72103(b) of the Education Code. No member of the governing Board shall, during the term for which he or she is elected, hold an incompatible public office. No member of the governing Board shall, during the term for which he or she was elected, be eligible to serve on the governing board of a high school district whose boundaries are coterminous with those of the Desert Community College District. RECORDING BOARD MEETINGS Any audio or video recording of an open and public Board meeting made by or at the direction of the Board shall be subject to inspection by members of the public in accordance with the California Public Records Act, Government Code Sections 6250, et seq. The Superintendent/President is directed to enact administrative procedures to ensure that any such recordings are maintained for at least thirty days following the taping or recording. Persons attending an open and public meeting of the Board may, at their own expense, record the proceedings with an audio or video recording, or a still or motion picture camera, and may broadcast the proceedings. However, if the Board finds by a majority vote that the recording or broadcast cannot continue without noise, illumination, or obstruction of view that constitutes or would constitute a persistent disruption of the proceedings, any such person shall be directed by the Board Chair, or by a majority of the Board, to stop. COMMUNICATIONS AMONG BOARD MEMBERS Members of the Board shall not communicate among themselves by the use of any form of communication (e.g., personal intermediaries, e-mail, or other technological device) in order to reach a collective concurrence regarding any item that is within the subject matter jurisdiction of the Board. In addition, no other person shall make serial communications to Board Members. A majority of the members of the Governing Board shall not, outside a regularly scheduled meeting, use a series of communications of any kind, directly or through intermediaries, to discuss, deliberate, or take action on any item of business that is within the subject matter jurisdiction of the Board. This policy shall not be construed as preventing an employee or official of the District from engaging in separate conversations or communications with members of the Board outside of a meeting in order to answer questions or provide information regarding a matter that is within the subject matter jurisdiction of Board, if that person does not communicate to members of the Board the comments or position of any other member or members of the Board. ACCREDITATION The Superintendent/President shall ensure the District complies with the accreditation process and standards of the Accrediting Commission of Community and Junior Colleges and of other District programs that seek special accreditation. The Superintendent/President shall keep the Board informed of approved accrediting organizations and the status of accreditations. The Superintendent/President shall ensure that the Board is involved in any accreditation process in which Board participation is required. The Superintendent/President shall provide the Board with a summary of any accreditation report and any actions taken or to be taken in response to recommendations in an accreditation report. INSTITUTIONAL PLANNING The Superintendent/President shall ensure that the District has and implements a broad-based comprehensive, systematic, and integrated system of planning that involves appropriate segments of the college community and is supported by institutional effectiveness research. The planning system shall include plans required by law, including, but not limited to,

ADMISSION AND CONCURRENT ENROLLMENT The District shall admit students who meet one of the following requirements and who are capable of profiting from the instruction offered:

• Any person over the age of 18 or possessing a high school diploma or its equivalent. • Other persons who are over the age of 18 years and who, in the judgment of the

Superintendent/President or his or her designee are capable of profiting from the instruction offered. Such persons shall be admitted as provisional students, and thereafter shall be required to comply with the District’s rules and regulations regarding scholastic achievement and other standards to be met by provisional or probationary students as a condition to being readmitted in any succeeding semester.

ASSOCIATED STUDENTS FINANCE Associated Student funds shall be deposited with and disbursed by the Superintendent/President (or designee in accordance with established financial office procedures). The funds shall be deposited, loaned or invested in one or more of the ways authorized by law. All funds shall be expended according to procedures established by the Associated Students, subject to the approval of each of the following three persons, which shall be obtained each time before any funds may be expended:

• the Superintendent/President or designee;

• the employee who is the designated adviser of the particular student body organization; and

• a representative of the student body organization.

The funds of the Associated Students shall be subject to an annual audit. ASSOCIATED STUDENTS FINANCE Associated Student funds shall be deposited with and disbursed by the Superintendent/President (or designee in accordance with established financial office procedures). The funds shall be deposited, loaned or invested in one or more of the ways authorized by law. All funds shall be expended according to procedures established by the Associated Students, subject to the approval of each of the following three persons, which shall be obtained each time before any funds may be expended:

• the Superintendent/President or designee;

• the employee who is the designated adviser of the particular student body organization; and

• a representative of the student body organization.

The funds of the Associated Students shall be subject to an annual audit. STUDENT CREDIT CARD SOLICITATIONS The Superintendent/President shall establish procedures that regulate the solicitation of student credit cards on campus. Credit card solicitations shall not be permitted on the premises of the Desert Community College District. References:
