Dual agent dilemma

In the business of buying and selling a home, real estate agents have an attorney-like role, protecting, advocating and representing the rights

and interests of their clients.

Considering that these clients must place a lot of trust in an agent, it’s no wonder that the term “dual agent” can have an ominous ring to it.

So, what exactly is a dual agent? There are two main types, one that is of more concern than the other.

With Two Agents

A licensed real estate broker (either an individual or company) often employs several salespeople, commonly known as agents, who work directly with clients.

“If a broker has two agents, one who is listing a property and another who represents a buyer who wants to purchase the same property, that is considered dual agency, because they are both under the same broker,” says Clare Ellingwood Mullen, an agent with Prudential Reddington Realtors in Glenside, Pa. Mullen says her company often represents clients on both sides of a transaction.

In this form of dual agency, there’s less of a chance for a confl ict of interest. It’s helpful if the broker does not get involved “in any negotiations or other transaction details unless there is a major issue,” such as a death on the premises during transaction or breach of contract, as is the case with Mullen’s broker.

“[Real estate] offi ces and brokers are area-specifi c, so this is common and sometimes unavoidable,” Mullen says of this situation.

With One Agent

The other form of dual agency is when an agent lists a property for sale and represents the buyer for the same transaction. As can be expected, this causes a confl ict of interest.

“In states where there is agency law, agents have the highest fi duciary responsibility under law to the person you are representing,” says Sheldon Detrick,

CEO of Prudential Detrick/Prudential Alliance real estate companies covering the Oklahoma City and Tulsa, Okla., markets. “Fiduciary” means making decisions that are in the client’s best fi nancial interest.

Each client should have an agent who works for his or her interests exclusively, so the client can get the best deal. But, it’s impossible to advocate for the best price for the seller and the lowest price for the buyer at the same time.

Dual agents get to know all the secrets of both the buyer and the seller. Just like someone wouldn’t want to share the same divorce attorney with an estranged partner, it’s a bad idea to share an agent with a buyer or a seller.

In Practice

Agents and companies who practice dual agency often have to walk a very cautious path.

“Under the law of agency … you have to keep both the buyers’ and sellers’ information private and you need to do what is in the best interest of both parties to positively affect the deal,” Detrick says.

Mullen says agents have different ways of dealing with such situations.

“Some agents have created techniques that they believe overcomes the grey area of [dual agency],” she says. For instance, they might keep all offers sealed until presenting them to the seller.

She continues, “I personally do not feel comfortable with this type of dual agency. How can you truly represent a party when you have equal ties to both sides?”

Despite the apprehension, there could be situations where a buyer or a seller has no option but to go with a shared or dual agent. In that case, tread carefully and ask lots of questions, Mullen advises.

“Discuss the process for presenting offers and dealing with inspection and appraisal issues,” she says. “Do research as to market values in specifi c neighborhoods to be sure you are not overpaying or accepting a lower offer that benefi ts an agent more than you.”

Every state has its set of disclosure laws. Visit the Real Estate Commission’s website for your state or connect to its hotline. You can also inquire about the laws with a licensed real estate professional, Mullen says.

When I started writing this column a

year ago, I fi gured it gave me a way to educate and inform the local Spokanite about real estate related topics. In

reality, I too became more aware and knowledgeable.

This in turn, helped me immensely in my role this year as the 2013 President of the Spokane Association of REALTORS®.

Statistically, 2013 has brought a lot of buyers out of the woodwork. We have had a huge run of home sales with an increased volume over last year of 22% through the end of November. For the fi rst time since 2008, the Spokane market has sold over 5,000 homes. Our prices have fi nally stopped falling and there is a newfound confi dence in the air.

Now more than ever today is the time to plan for your fi nancial future. Whether you plan to buy or sell a house it is crucial to have a game plan in place. There are some real estate resolutions that you can and ultimately should make for 2014.

If you want to buy a home this next year, it will take a bit of time and effort. But, the reward is so worth it.

First, meet with a lender as soon as possible to obtain your credit score and help determine your buying power. You need to take stock in your fi nancial solution. If there are credit issues resolve to take the necessary steps in order to fi x them. Your credit score is so important and if your FICO score is too low you will need the advice of an local expert mortgage professional who can help you rebuild your credit or increase it in order to obtain a better mortgage rate.

Second, start and scout early in your home search. Over 90% of homebuyers start their search online. It is crucial that you learn all about the market and home values in your targeted neighborhood. Going to open houses is a good way to not only view desirable properties but it might also be the way that you meet your future REALTOR®. You can also ask your friends and trusted colleagues who they recommend and/or have used in the

past year. REALTOR® don’t just show and sell homes, they are your strategic real estate fi nancial adviser. Experts in negotiation, REALTOR® have the skills needed to help secure and they provide advice on how to best obtain your home of choice.

For sellers, start thinking like a potential buyer. The question you need to ask yourself is would you buy your own home back?

Sellers should start to think of his/her house as a product that needs to be marketed to its fullest potential.The home needs to be in the best condition possible and it should be competitively priced for the neighborhood. It is time to take a good hard look at the home. Houses that are clean and clear of clutter as well as have up-to-date fi nishes sell faster. REALTOR® have access to a team of professionals whose jobs are to help you sell your home. Staging your home is highly recommended. Stagers can bring in furniture for the home or they can use what you have by rearranging it. The key is to edit your current belongings as much as possible to create a sense of spaciousness. Hiring a professional photographer can also show your home in the best light.

What is it the right time to sell? Timing is everything. It is always best not to place your home on the market until your “to do list” is complete. First impressions do matter. In the Spokane market our house inventory does slow down in the colder months and this can make it a more attractive as it will have less competition. If you don’t mind a little competition but want to capitalize on pent up demand, then placing for sale at the fi rst hint of warmer weather, just as the tulips are coming out of the ground is a great idea.

Hire a REALTOR® from the start whether you are buying or selling, that way you always have someone in your corner. They are your advocate to help you navigate through the rough waters of a transaction. A REALTOR® can give you a variety of options and ideas which can save you a lot of time and money in the long run. Experience counts so tap into their expertise. They will guide you down the right path and see you through and get you to that closing table.

Best advice I can give in 2014 is to resolve to engage a REALTOR®.
