Under the current law, those with signed, valid contracts to buy a home are required to close by June 30 to collect the $8,000 first-time home buyer tax credit or the $6,500 long-term homeowner tax credit. If the law clears the House, the new dead- line to close will be September 30. Sen. Harry Reid (D-Nev.) noted that approximately 180,000 home buyers had signed valid contracts by April 30 but will not be able to close by June 30 due to outside forces. Basically, the banks, appraisers and title com- panies are overwhelmed by the crush of demand from home buy- ers and can’t keep up. The new rules of mortgage fi- nance require lenders to double- and triple-check documents, veri- fy all information and pull several credit checks. Verifying income, tax returns, bank accounts and assets can be time-consuming. Meanwhile, appraisers are now booked weeks in advance in some communities, making it difficult to meet the June 30 deadline. And many title companies that had laid off workers after the real estate bubble burst don’t have enough time in the next two weeks to schedule the closings. Home sales rise through May REPORTER -HERALD H ome sales continued rising through May in Loveland, with 158 home sales, totaling 559 for the year, up from 440 at this time last year. Monthly sales volume for May ($39,407,269) is up 58.1 percent from May last year, and year-to-date sales volume is up 29.7 percent from May of 2009. Fort Collins saw similar gains in May, with a 25.9 percent gain in year-to-date listings sold. Year-to-date sales volume, at $245,724,054, is up 20.3 percent over last year at the end of May. How to: Choose your neighborhood

When evaluating a neighborhood you should investigate local conditions.Depending on your own particular needs and tastes, some of the followingfactors may be more important considerations than others:

• Quality of schools• Property values• Tr a f f i c• Crime rate• Future construction• Proximity to schools, employment, hospitals, shops, public transporta-

tion, prisons, freeways, airports, beaches, parks, stadiums and cultural activ -ities such as museums, concerts and theaters.

Another group ofbuyers who are run-ning short of timeare those who arehoping to buy shortsales, homes that areworth less than themortgage amount.One Realtor left acomment on my blogsaying that she hadthree buyers whomade bids on shortsale properties inJanuary and Febru-ary and had yet to re-ceive a response fromthe lenders. Thesecontracts containcontingencies thatallow the buyers tocancel the deals,penalty-free, if forthey do not qualifyfor the home buyertax credits.

Despite the ObamaAdministration up-ping the fee paid tolenders who approvea short sale, approvalfor these deals is stilltaking months. Onemortgage bankerspeculated thatlenders aren’t partic-ularly eager to writeoff the loss on theseloans, even thoughtaking back proper-ties through foreclo-sure generally netslenders less money.

Extending thedeadline for the

home buyer tax cred-its is bound to con-fuse home buyers. Allthey’ll hear is thatthe home buyer taxcredit deadline hasbeen extended, notrealizing that it’s thedeadline for closingonly; to qualify, theymust have a validcontract that was ex-ecuted by April 30.

But perhaps this iswhat the Realtors,mortgage bankersand others associat-ed with the real es-tate industry is hop-ing for — a little con-fusion and a fewmore sales.

Homebuyer de-mand has plummet-ed 40 percent sincethe end of April,more than most in-dustry observers ex-pected — all thewhile mortgage in-terest rates havedropped to a new 50-year record low of 4.6percent for a 30-yearfixed rate loan.

Indeed, lenders na-tionwide are offering30-year fixed-ratemortgage interestrates as low as 4.58percent, and as lowas 4.42 percent inColorado, accordingto Zillow’s MortgageRate Ticker. Zillowreports that the ratefor a 15-year fixedrate loan is currently4.03 percent.

But low interest

rates aren’t enoughto overcome high un-employment and amodest U.S. recov-ery. Still, for 180,000buyers who wouldotherwise have seentheir tax credits slipaway, this is goodnews.

Question: My di-vorce was final twoyears ago, and in thedivorce decree I wasawarded the house.But prior to my get-ting a spousal trans-fer deed, one of myex-spouse’s creditorsput a lien on thehouse which prevent-ed me from complet-ing a short-sale.

If one of us or bothend up filingbankruptcy, whichlooks inevitable, isthere any way to getthe lien removed sothe house can besold and prevent aforeclosure?

Answer: Yo u ’d haveto convince the cred-itor that the house isworthless and thereis no cash comingout of it. The credi-tor might be con-vinced by an ap-praisal of the proper-ty and a report thatlists what nearbyhomes have sold for.

If you can reach adecision-maker whounderstands whatyou’re saying, there’sa chance that thismight work out and

the lien will be re-moved. Otherwise,you’re probablystuck.

You are trying tosell your home as ashort sale. There isno equity in thehome and the credi-tor won’t get paidany money if thehome is sold via ashort sale or in fore-closure.

If you can’t con-vince the creditor toallow you to sell thehome through ashort sale, your otheroption would be tolet the home go intoforeclosure. In fore-closure, the lenderwould wipe out thelien of the creditorand then sell thehome to a buyer freeof that lien.

Finally, if you filefor bankruptcy, yourbankruptcy won’t re-lease the lien placedon your home byyour ex-spouse’screditor. Yourspouse’s bankruptcyshould release thelien.

If you’re worriedabout your credit his-tory showing abankruptcy and aforeclosure, don’t be.Once you have abankruptcy on yourcredit history, it’s un-likely adding a fore-closure will do muchadditional damage.

Tomatoes, lettuce, cab-bage, potatoes,onions, herbs, beets

and varieties of squashesand melons are growing atthe High Plains Environ-mental Center’s volunteer-based Giving Garden inL oveland.

Last year that food, all13,000 pounds of it, was do-nated to House of Neighbor-ly Service and the Lovelandbranch of Food Bank forLarimer County, a numberHPEC plans to achieveagain this year.

School groups, scoutgroups, church groups, indi-viduals and even businessesseeking team-building op-portunities volunteer at theGiving Garden, said SarahFox, HPEC’s Director ofCommunity Outreach.

This summer’s volunteercount has already exceededlast year’s of 300, Fox said.

“It’s a great chance tolearn how to garden if youdon’t know how, but also agreat way to give back tothe community,” Fox said.

Individual plots for rent

will be available at HPECnext summer for partici-pants so they can also growtheir own food.

“People who are on theirsecond year of helping outare really interested in com-ing out and getting a littlemore hands on on theirown,” Fox said.

HPEC is in many ways ahub for the growing com-munity garden scene inL oveland.

HPEC works with Thomp-son School District to “pro -vide opportunities for kidsto experience gardening,work with plants and learnmore about food,” said Su-san Singley, HPEC’s Com-munity Garden Coordinator.

Third graders from threeThompson District Schoolsare part of an ongoing fieldtrip experience called EveryChild Plants a Seed. Theywill come back next year as4th graders and teach thenext set of 3rd graders whatthey learned about savingseeds and gardening withtheir plot of pumpkins fromthis year.

The Loveland Youth Gar-deners share the space withHPEC and have their youth

garden there.As the recipient of fund-

ing from CanDo (Coalitionfor Activity and Nutrition toDefeat Obesity), the coordi-nating agency for theLiveWell Colorado initia-tives in Fort Collins andLoveland, HPEC is offeringfinancial and technical sup-port to community gardensthat have popped up aroundtown including an educa-tion garden at Cresset Com-munity Farm and communi-ty gardens at the LovelandBoys and Girls Club, Love-land Historical Society’sMilner Schwarz House, andat Loveland’s RV Park whereone resident spearheaded agarden for the neighbor-hood.

Organizations such asCanDo also see communitygardens as an opportunityfor communities to becomeh e a l t h i e r.

“CanDo (focuses on com-munity gardening) to in-crease physical activity anddecrease obesity. You’ll try avegetable if you grow it,”Fox said.

“Community gardeningprovides a one stop shop forphysical activity, nutrition,good food access and com-munity building,” said Su-san Singley, HPEC’s outgo-ing Community Garden Co-ordinator who will begin hernew job as CanDo’s ObesityPrevention Coordinatornext week.

HPECs Giving Garden al-so demonstrates how com-munity gardens can feed ac o m m u n i t y.

“We want to encouragegardens all over Lovelandand if you donate some of

that food to organizationsyou can feed everybody,”Fox said. “It’s our goal togive everyone fresh pro-duce.”

“Community gardens aredefinitely on the upswing,”Carol O’Meara with CSU Ex-tension in Boulder said.

Community gardens allowindividuals to have access tofresh, healthy food that theyknow is clean from pesti-cides, O’Meara said.

Community gardens alsooffer a forum for gardeners,novice and old-school alike,to come together, learnfrom each other and sharetechniques.

O’Meara likes the saying,‘what a new gardener needsis an old gardener.’

“You can read all about it,but it’s a living thing so thebest person to teach you issomeone who’s beenthrough it.”

“I also think they’re be-coming social gatheringplaces as well, Fox said,“People get to know eachother well and enjoy theirtime together and becomefast friends.”

The increased interest incommunity gardening mayhave something to do withthe unsteady economy.

“Historically speaking, alot of people do turn to foodgardening during toughtimes,” O’Meara said.

What’s unique about thecurrent trend, O’Mearasaid, is that people “not on-ly raise their own food butraise enough to help oth-ers.”

“This big surging interestin growing your own foodhas really become quite aphenomenon that is drivingthe interest of gardenersand the way that peopleview their community,”O’Meara said.

“People are reaching out

to help one another andcommunity gardens dothis,” she said.

Use caution when seeking foreclosed properties

While many such homes are in excellentcondition, some of these properties have been

neglected or even consciously damaged.

Question: How do I go about buy-ing a house or condominiumthat is in foreclosure?

Answer: Over the last two years therehas been a significant increasein the number of foreclosed homesin Colorado. Buying one of theseproperties — either as a primaryresidence or for investment purposes —may be tempting. However, unless youhave some experience with foreclosedreal estate, the complexity of the pro-cess may be surprising and overwhelm-ing.

If a property is in foreclosure the legalowner(s) likely became unable to makerequired payments on the mortgage,and the lender took the property back.While many such homes are in excellentcondition, some of these propertieshave been neglected or even conscious-ly damaged. Some unscrupulousowners may even remove plumbing,wiring, countertops, lighting and otherfixtures as they vacate the property,

falsely believing they are entitled tothose items and leaving the home inshambles.

There are actually three points atwhich you might consider purchasinga foreclosure. If an owner is clearlyheaded towards losing a home, hemay consider a pre-foreclosure salein which the owner and lender cooper-ate in selling you the home at aconsiderable discount. A second optionis to attend publicly held auctions offoreclosed properties. This is a high re-ward (good prices) and high risk (possi-ble costs to you, less chance to inspectthe home thoroughly ahead of time) op-tion.

The third option is to purchase fore-closed properties after they have beentaken back by the lender. While the

prices may not be as good as at an auc-tion, or the process as straightforwardas in pre-foreclosure, lenders, whoare not regularly in the business ofbuying and selling property, are oftenhighly motivated to get rid of foreclo-sures.

Finding such properties can be as easyas driving neighborhoods, scanningnewspaper real estate sections and do-ing some on-line research. Contacting aRealtor is an important step in the pro-cess — both to help with the search andto have the benefit of that person’s pro-fessional expertise and experience. Notall foreclosures are advertised and somelenders (owners) will not accept offersfrom unrepresented buyers, simply as ameans of sorting out the legitimatebuyers.

Many of the same steps you wouldtake in buying other kinds of propertyapply if you are making an offer on aforeclosed property. Tour the propertycarefully to be sure you know its assetsand its problems. It may be worth theinvestment to have the propertyprofessionally inspected ahead of anoffer, if the lender will allow. Have yourRealtor do the research to determinewhat other properties in the area andof similar condition have sold forr e c e n t l y.

With foreclosures it becomes evenmore important to research the legalstatus of the property. Are there unpaidtaxes you will be asked to assume? Isthere a lien of any kind on the property(e.g., for work the previous owner or-dered but never paid for)?

In the end, be prepared for a slow pro-cess with a considerable amount of pa-perwork. Engaging a Realtor with expe-rience in buying foreclosed propertieswill be of considerable help throughout,as well as in introducing you to lenderswho will be interested in financing yourp u rc h a s e .

If you’ve been itching to grow yourown but the yard just isn’t the rightlocale, retool your thinking by ex-

panding into glass and water. Colorado isperfect for an alternate state of being forplants, if you have the right tools andk n o w - h o w.

At the upcoming Food ProductionWorkshop from Colorado State UniversityExtension on July 10, you’ll learn howgreenhouses, hydroponics and aquapon-ics can become your favorite way of grow-ing food.

“Pretty much you can grow anythingin a small greenhouse,” said BrookeEdmunds, Greenhouse and NurseryRegional Specialist for CSU Extension.“It’s perfect for small crops throughthe winter, like spinach, kales,greens.”

Cooking homegrown produce is fine ifyou’re in the kitchen, but when it crispsbefore you get it out of the overheated

greenhouse, you’re left with a mess.“Most people buy hobby greenhousesbuilt to go into east coast yards. They’renot sustainable in Colorado. We have todeal with heat from intense sun, wind,cold winters — the greenhouse is goingto blow away or if you don’t have insula-tion, plants will cook,” Edmunds said.

She’ll walk participants through modifi-cations for smaller greenhouses, and pro-vide tips for build-your-own sources ofgreenhouse kits and materials for glazingthe windows. Once you’ve mastered theglass enclosure, Edmunds will take youinto the wonderful world of hydroponics,a popular method for growing without us-ing soil.

“Colorado is the fastest growing statefor hydroponic supplies; it’s a result ofthe medical marijuana industry,”Edmunds said. “Home gardening getsgreat benefits from this for food produc-tion.”

Setting up and making sense of all thesupplies, often labeled for marijuana pro-

duction, can be challenging but the classwill cover how to sort through the materi-al to use it for food production.

In comparison to soil-based production,hydroponics smokes the competition,turning in 20-percent greater yields perplant. This is due to plants growing faster,rolling out yields sooner and over longertime. What you grow depends upon thespace you provide and the size of the sys-tem.

“We ’ll discuss using kits to build yourown and also found materials. A simpleice chest system for hydroponic growingcan be as inexpensive as $25, supportingup to four basil plants. Larger systemsvary in price,” she said.

But if growing plants under glass isn’tgiving you the challenge you crave, don’tworry — this class is super-sized withaquaponics, where fish swim lazily in wa-ters below the plants and their water isfiltered up through the roots to feed andhydrate the crop.

“We ’re merging fish and plant culturein an organic, complex ecosystem,” saidJ.D. Sawyer, owner of Colorado Aquapon-ics and instructor in the class. Thoughrelatively new to the United States,aquaponics is fairly mainstream inwater-limited countries like Australia, hesaid.

Plants and fish support one another inthe system, where the aquarium water ispumped into the grow bed so roots canfilter off fish waste. The clean water thendrains back into the fish tank.

“You can get into this inexpensively andgrow fish like perch or tilapia as a proteinsource, or just use pet store fish like gold-fish or zebra tetras.” Tilapia take approxi-mately 28 weeks to get big enough toharvest, he said, though how you getthem from the tank is up toyou. Sawyer recommends nettingthem out, but fishing poles might addan element of excitement to the back-y a rd .

Lids are necessary to keep predatorslike raccoons or squirrels out of thefish, but in general the system doesn’tdraw attention to itself with odors. Checkout the workshop to explorenew ways of expanding your crop produc-tion.
