Question: My fiance and I offeredto buy a home owned by a bank.The bank responded to our offerbut said they would not pay for

any FHA fees or for any of the inspec-tions.

There are two other offers on thishome by other potential buyers. Thoseother buyers are also obtaining FHAloans. Before responding to our offer, thebank asked whether we would be willingto still buy the home even if the homedid not appraise out for the amount weoffered for the home. If we did, we wouldhave to pay the bank the difference incash.

We didn’t agree to their terms relatingto the appraisal but they responded toour offer. About two days later, the listingagent for the home told our agent thatthe bank was negotiating with anotherbuyer and left us completely in the dark.

We were almost sure we got this house,and I fear that the listing agent or bankor someone is playing games with us. Italmost seems to me that the listingagent may be trying to get a friend orclient of hers to get this house.

What should we do in this situation? Isthere any way we can find out what is go-ing on? If we haven’t heard anything backfrom them for such a long time, does thismean we will probably not get it?

Our agent is out of the country andwe’re working with her replacement.

Answer: You should face the fact thatyou probably did not get the house.When a seller is faced with multiple of-fers for a home, the seller may pick andchoose which offer to accept. Until the

parties sign a contract for the purchaseand sale of the home, the deal may be upfor grabs.

While the bank may have responded toyour offer, that response might have beenverbal and the bank may have decided togo a different way when a different buyeroffered more or offered the bank a betterdeal.

In the best of real estate markets andin the worst, the old adage holds true:Buyer beware.

You don’t know you have a deal with aseller or a buyer until both parties havesigned on the dotted line. You should alsoknow that in some parts of the country,buyers and sellers can sign a real estatecontract, and if that contract contains aprovision that allows the buyer or sellerto have his or her attorney review and ap-prove the contract, either party might beable to cancel the deal during that reviewp ro c e s s .

While you may suspect funny businessgoing on with the listing broker, youmight be wrong about that. While thereare some real estate agents who may tryto work a deal in favor of their clients, farmore agents in multiple bid situationsactually work to get the seller the highestprice and the best deal.

Usually, the higher the sales price, themore money the listing broker will make.Furthermore, if the listing agent finds abuyer who is more qualified to buy thehome, who offers a higher amount andwho is willing to close sooner, the listingbroker will likely try to influence the sell-er to accept that buyer’s offer.

While it’s possible that the listing bro-ker is trying to freeze you out of the pur-chase of the home, the information youhave included in your letter does not pro-vide any clues that anything irregular has

occurred.If you find out more, please

keep me posted.In the meantime, when your

agent comes back from vacation,be sure to have a conversationabout the situation and ask himor her to follow up.

The National Association of Realtors hasjoined forces with the National CommunityStabilization Trust to help rebuild American

communities devastated by the foreclosure crisis.The collaboration will bring Realtors and the

plans to rebuild communities. The partnership wasmade possible by the new federal NeighborhoodStabilization Program, which provides $6 billion toreclaim neighborhoods wracked by high levels offoreclosed and abandoned property, property disin-vestment, extremely low prices and low residentconfidence.

“Realtors build communities and have the mar-ket expertise and property transaction tools to helplocal housing organizations understand local mar-ket conditions and how to put foreclosed housesback into the hands of stable homeowners,” said

NAR President Vicki Cox Golder,.“Neighborhoods across America have been deci-

mated by high concentrations of abandoned andforeclosed homes. To reverse neighborhood de-cline, we need the Realtor community workinghand in hand with other housing providers,” saidCraig Nickerson, president of NCST.

Say you’re considering some dec-orating updates for your home,but you think most of the ideas

you have are unaffordable. All youhave to do is rethink the way you ac-complish those changes. Here aresome suggestions.

Refurbish rather than replace someof those items in your home. If yourcouch is showing some wear and tear,rather than replacing it, consider re-upholstering it. Granted, in many cas-es, reupholstering is as expensive asreplacing, but look for bargain fab-rics, and you should be able to recov-er the furniture with less cash spentthan buying new furnishings.

Consider visiting flea markets and

going to yard sales. You might findthe right dresser or dining-room tableor perhaps the right cocktail tablethat works for your home and justneeds to be refinished. There is a cer-tain charm in old furniture that canadd appeal to your home.

L et’s talk about that dining area abit more. Sometimes the table is inpretty good condition, but the chairsare a mess from spilled wine or choco-laty finger marks that just don’t seemto come off no matter how many up-holstery cleaners you’ve tried. Per-haps it is time to get new chairs. Twochoices: 1) If the chairs are fabric-based, again you might consider re-upholstering. 2) If the chairs are justunacceptable, purchase new ones.Again, try looking around resaleshops or flea markets. Agood thing about spending timehome sick in bed is watching oldmovies. Reruns of stories you love can

pull a smile in between coughing fits, andoccasionally you see something that sparksa connection in your fever-addled brain.

The Wizard of Oz is such a movie, andwhen the Wicked Witch of the West begancrooning “poppies, poppies, poppies,” thisgardener paid attention like it was an inspi-rational show on Home and Garden Televi-sion. The time for sowing these silky flow-ered sensations is approaching.

We have Bread Seed poppies (Papaversomniferum) which are known to self soweagerly. This is an understatement; onebump of the dried pods hurls hundreds ofseeds to the ground. In spring, they all ger-minate. Not only are they vigorous self-seed-ers, they’re promiscuous too, cross pollinat-ing with one another to the point where Ican’t tell common Hungarian from Lau-ren’s Grape. But it’s nice to know some-one’s having a good time out in the garden,and the different colors that come up arewonderful surprises.

An annual that blooms in late spring, bak-ers love the seeds for breads and fillings. Fora spectacular, double-blooming display, trythe peony type (paeoniflorum) with itsshredded petals. These need light to germi-nate; choose a sunny location and sow seedsin early spring by sprinkling them over theg ro u n d .

Bread Seed poppies will take care of re-sowing, flinging seeds across the gardenfrom their huge pods. To keep them fromtaking over, clip off and remove seed headsafter the flower is finished; this will also en-courage the plant to keep blooming. Ice -landic poppy (Papaver nudicaule) is thedainty darling of the group, seducing gar-deners with fragrant flowers that come andgo quickly in spring. A tender perennial, itsurvives for two to three years in many gar-dens, and because it thrives in areas withcooler summers, grows well at elevation.

Spread seed early in spring and cover witha little soil. Chronically moist areas are fatalto Icelandic poppies; pick a spot that drainsquickly, but close to walks or patios whereyou can enjoy their perfume.

As much fun as these smaller poppies are,they can’t compare to the stunning effect ofOriental poppy (Papaver orientale) planteden masse. Any plant that lifts six-inch flow-

ers to stare you in the face is sure to com-mand attention. A large perennial bloomingMay and June, they sport doubled, ruffled,or single flowers in crimson, orange, pink orwhite.

Preferring sunny locations with well-drained soil, these do well in xeric beds andat an elevation where summers are cool.Plant seeds in spring, sowing them acrossthe surface of the soil. Root cuttings andplant divisions, generally planted in fall, canbe successfully placed in the garden inspring.

Oriental poppies come back each year ina dazzling display but leave a gaping hole inthe garden in mid-simmer, when the foliagegoes dormant. To cover this, many garden-ers plant the poppies to the back of the bedand let summer plants mask the gap. In fall,new leaves often sprout, and require wintermulch for protection.

Medium sized at just over two-feet tall,the corn, or field, poppy (Papaver rhoeas)poppy’s petals are crinkled, thin, and pa-pery. A late spring flowering annual, followdirections on the seed packet for sowing.

Question: I have a question about the newer An-derson windows with double-pane glass. Shouldone still hang a storm window to prevent furtherinsulation?

My husband and I have a home that was built in 2003,and we would like to lower our utilities bills any way wecan. We have walls with extra insulation, but we realizethe windows and doors are a great energy zapper.

We have noticed that some of the windows have mildewaround them during some seasons. We have an Aprilairesystem on our heat pump system with UV light. It helpsconsiderably. Please give any additional advice to keepour environment and home safe and economical.

Answer: Anything you do to add a thermal barrier be-tween the inside air and the outside air, or to simply pre-vent air infiltration to the home, helps to conserve ener-g y.

Adding storm windows is both economical and energy-efficient as a thermal barrier even for new windows. Thewindows you have might have significant air leaks, whichallow condensation to promote mildew and mold growth.

Adding storm windows should help some, but what youreally need to do is seal the windows where they are at-tached to the home.

By removing the trim around the windows, the woodframing of the home should be partially exposed. By in-jecting an expanding foam in the space between theedge of the window and the wood frame of the home, youcan seal out a lot of air infiltration.

It is very important to use a foam designed for windowand door frames. Expanding foam can damage the win-dow or the wall if it expands too much. I would stronglyrecommend that this be left to professionals.

When you are at the hardware or home store, makesure the salesman knows exactly where the foam is to beinstalled. There will be a foam for filling large voids andone known as a low-expanding foam for small, tightplaces.

Be careful not to get the foam on your skin because itreally sticks. Wear rubber gloves, and work in well-venti-lated areas. After the foam has set, the excess foam canbe scraped off with a knife and the wood trim reinstalled.

Also, keep a close watch on the humidifier on the fur-nace. Levels should be between 40 and 60 percent at 65degrees.

your advice on a challenging realestate situation we’re facing.

My husband bought a rentalproperty in 2005 using a first andsecond mortgage. The property hassince dropped in value and we nowowe more than it will appraise for— not the first you’ve heard ofthat, I’m sure.

The first mortgage is at 9 percentand the second is at 12 percent.These are horrendous loans thathe’d be able to refinance out ofwithin five years except the bottomfell out of the market.

We have tried for over a year toget someone to work with us to re-finance these loans and have got-

ten absolutely nowhere.My husband has been without a

paycheck for six months, and weare reaching the point where wewill have to either face foreclosureon this rental, thus ruining ourcredit, or sell it at a significant lossto a wholesaler and still owe on theproperty loans.

Again, because of a lack of in-come for months, we have signifi-cant debt-to-income ratios that willalso make getting a loan nearly im-possible. Do you have any sugges-tions on a way to refinance thisproperty so we can avoid a com-plete collapse of our personal fi-nances?

Answer: I’m sorry, but I don’thave any easy answers for you.Without an income, you won’t beable to get any conventional lenderto refinance your loans.

Worse, this isn’t your primary

residence. It’s a rental property,and there are fewer lenders willingto give loans on investment proper-ties these days, or modify theterms of an investment propertyloan.

If you or your husband were em-ployed, and your home had someequity, you could try a regularlender. But lenders who finance in-vestment properties typically re-quire a down payment of 25 per-cent in cash (at a minimum) — it’stough to meet that requirement ifyour savings are running dry.(Some investment lenders are nowrequiring even 40 percent down tofinance or refinance investmentp ro p e r t i e s . )

Although I don’t often recom-mend this, you and your husbandneed to seriously think about notpaying any more on this propertyand simply turning it over to the

lender and trying to negotiate adeed-in-lieu or short sale. Hiring agood real estate attorney may helpyou resolve this more easily. Butyou can count on ruining yourcredit for the next few years.

Unfortunately for some, thefastest path back to financial secu-rity may be to cut their losses nowand then work toward rebuildingtheir future. For some, that maymean filing for bankruptcy, whilefor others it may just mean reset-ting priorities about where theirmoney should go.

While some people may find an-other job and continue to makepayments to their lender, othersmay conclude it’s necessary to stoppaying the lender and try to getout from under the debt burdenbrought on by a bad investment de-cision.

I’m so sorry.

The bathroom sat adjacent to a small dress-ing room that Tonia and Francis never used, soI kicked off the redesign by tearing down thewall between the two rooms and making it intoone large space. I got rid of the dated stripedwallpaper and put up a light, fresh coat ofpaint. I also ripped up the ugly, cracked flooringand put down some large-scale marble tileswith heated flooring below.

On a wall, I put in a gorgeous mirror, twosmall windows draped in soft, translucentblinds and cabinets built out of warm, rich ma-hogany. Below this installment, I placed a stun-ning vanity that features a gorgeous, white-quartz countertop, a contemporary vessel sinkand wooden storage cabinets.

On one side of the vanity, I installed a new toi-let, and on the other, a huge, 24-inch soakertub, surrounded by the same white quartz asthe countertop. To keep the warmth of thewood flowing throughout the space, I added acabinet for linens and laundry right beside thetub.

Across from the vanity, I put in a fantasticshower with a frameless glass enclosure. Itboasts a rain shower, a steam shower, bodysprays and a white-quartz bench on which to sit

and take it all in.I wanted the room to be calm and refreshing,

so I chose cool, watery greens for the colorscheme. I selected a small, green marble mosa-ic tile for the steam shower and for the back-splash for the soaker tub and vanity. The tilematches the green in the solid glass vessel sinkand the painted glass in the luxurious shower.

Then, because this is no ordinary bathroom, Iput in extraordinary lighting. In addition to re-cessed lighting in the ceiling, I also put in twogorgeous sconces on each side of the vanitymirror, and put up a brilliant crystal fixtureover the tub, so Tonia will have a great viewwhile she is soaking.

This bathroom was cramped, cluttered anddingy. By adding luxurious fixtures, fabulousfinishes and a relaxing color scheme, I turned itinto a calm, refreshing oasis to which Tonia andFrancis can retreat from the chaos of everydaylife. Now that’s divine.
