Dear Fellow Conservative,

The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the New York State Legislature. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).

Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress.

The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in 2010. With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”

It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES

ACU researched and selected a range of bills before the New York State Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of New York’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. S 365 Implementing a Spending Cap. This bill establishes an annual spending growth cap comprising the annual rates of inflation for the three previous calendar years and increases the capacity of the rainy day fund from 3 percent to 10 percent of the general fund. ACU supports spending caps that prevent reckless increases in spending that lead to tax increases and supported this bill. The Senate passed the bill on January 9, 2017 by a vote of 36-21.

2. S 1207 Making the Property Tax Cap Permanent. This bill makes the current property tax cap permanent. Currently, the property tax cap is subject to periodic renewal by the legislature. Reducing tax burdens increases economic growth, which increases family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports tax caps that prevent tax increases to pay for increased government spending and supported this bill. The Senate passed the bill on January 30, 2017 by a vote of 52-9.

3. S 4158 Moratorium on Carryout Bags. This bill extends a moratorium on a New York City law requiring fees on carryout bags of any type for 270 days in order to consider other ways of decreasing the use of these bags and “managing the waste stream.” ACU opposes penalizing people for the use of carryout bags and supported this bill as a step in the right direction. The Senate passed the bill on February 6, 2017 by a vote of 43-16.

4. S 750 Banning E-Cigarettes on School Grounds. This bill expands the law banning tobacco on school grounds to e-cigarettes even though it contains no tobacco. ACU believes that use of tobacco and e-cigarettes is a personal liberty issue, that government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The Senate passed the bill on March 29, 2017 by a vote of 59-1.

5. S 2003-D Funding Abortion Clinics. This bill allocates $500 million in “Aid to Localities” that includes funding for clinics that perform abortions, such as Planned Parenthood. ACU believes abortion is a human tragedy, supports restrictions on the practice, opposes taxpayer funds that support Planned Parenthood (the nation’s largest abortion provider) and opposed this bill. The Senate passed the bill on April 4, 2017 by a vote of 57-3.

6. S 6569 Making It Easier to Staff Charter Schools. In addition to extending mayoral control over New York City schools for five years and reorganizing various education boards, this bill reforms laws regarding charter schools to more easily staff these schools with qualified teachers. Educational attainment provides substantial economic returns for families and for states, which is illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports strengthening charter schools and other school choice opportunities and supported this bill. The Senate passed the bill on June 13, 2017 by a vote of 37-25.

7. S 724 Legalizing Sparklers. This bill exempts sparklers from the definition of fireworks and allows people 18 years of age or older who live outside New York City to buy them. ACU supports expanding individual liberties and supported this bill as a step in the right direction. The Senate passed the bill on June 13, 2017 by a vote of 61-2.

8. S 6515 Making it Easier to Receive Welfare Checks. This bill directs the Commissioner of Health to devise a method of alternative identification for recipients of the Women, Infants and Children (WIC) Program to obtain vouchers and checks even if they do not have an ID card issued by the program. ACU opposes weakening fraud prevention in welfare programs and opposed this bill. The Senate passed the bill on June 15, 2017 by a vote of 41-19.

9. S 6651 Eliminating Funding for the Regional Greenhouse Gas Initiative. This bill withdraws funding for the Regional Greenhouse Gas Initiative (RGGI) that includes a cap and trade program for those states that participate. The program allows companies to trade “pollution credits.” The cap on pollution credits decreases over time, forcing up the price of energy. ACU opposes this scheme that was rejected by the Democrats in Congress during the Obama Administration, and is designed to make energy less and less affordable for most people over time and supported this bill. The Senate passed the bill on June 15, 2017 by a vote of 32-28.

10. A 7082 Extending the Moratorium on Liquified Natural and Petroleum Gas. This bill extends until April 1, 2019 the siting or transporting of liquefied or petroleum gas in New York City. ACU opposes this interference in the free market that drives up the cost to consumers and is based on an explosion of a liquefied natural gas facility in 1973 and opposed this bill. The Senate passed the bill on June 15, 2017 by a vote of 60-0.

11. A 260 Expanding Tax Exemptions for Favored Energy Systems. This bill expands the real property tax exemptions for solar and wind energy systems to include micro-hydroelectric and fuel cell systems, among others. ACU supports all forms of energy, believes government should not favor one form of energy over another and opposed this bill. The Senate passed the bill on June 19, 2017 by a vote of 62-0.

12. S 6768 Requiring College Degrees for Future Registered Nurses. This bill requires those nurses who become registered practical nurses after this bill is passed to obtain a baccalaureate in nursing within 10 years of being licensed, while exempting all current licensed nurses and those students currently in nursing programs. ACU opposes the proliferation of license requirements that are primarily designed to restrict competition and opposed this bill. The Senate passed the bill on June 19, 2017 by a vote of 56-6.

13. S 6089 Allowing Private and Religious Schools to Receive State Funds. This bill continues to allow private and religious schools to receive the level of state aid they have been receiving for the past 40 years by basing the funding formula on “instructional time” instead of a new formula that has resulted in a reduction in aid to non-public schools. ACU supports strengthening school choice and supported this bill. The Senate passed the bill on June 20, 2017 by a vote of 63-0 but it was vetoed by the governor.

14. S 5422 Mandating Content of Heating Oil. This bill requires that heating oil used in three suburban New York City Counties—Nassau, Suffolk and Westchester—contain 5 percent biodiesel and creates a new tax credit for the use of biodiesel. ACU supports all forms of energy, believes government should not favor one form of energy over another and opposed this bill. The Senate passed the bill on June 21, 2017 by a vote of 43-19.

1. A 1748 Legalizing Abortion on Demand. This bill repeals a number of laws that restrict abortion in New York state, including performing an abortion after 24 weeks of pregnancy and requiring an abortion after 12 weeks of pregnancy to be performed in a hospital. ACU believes abortion is a human tragedy, supports restrictions on the practice and opposed this bill. The Assembly passed the bill on January 17, 2017 by a vote of 97-49.

2. A 1378 Mandating Free Insurance Coverage for Contraceptives. This bill requires insurance companies to provide coverage for all contraceptives and voluntary sterilization with no co-pay. ACU opposes insurance mandates and believes the use of contraceptives is a matter of individual liberty and something others should not be forced to pay for through higher insurance premiums and taxes and opposed this bill. The Assembly passed the bill on January 17, 2017 by a vote of 103-43.

3. A 3049 Making New York a Sanctuary State. This bill prohibits law enforcement from collecting or sharing immigration information with federal agencies, bans state and local resources from being used to aid federal immigration enforcement and provides taxpayer-funded legal counsel to illegal immigrants facing deportation. ACU supports the enforcement of federal immigration laws and opposed this bill. The Assembly passed the bill on February 6, 2017 by a vote of 77-61.

4. A 3039 Giving Government Benefits to Illegal Immigrants. This bill makes illegal immigrants eligible for a program called the “Dream Fund” that is not available to anyone who does not have at least one parent who is an illegal immigrant. Under the program, donations to the “Dream Fund” are tax deductible and the fund offers free tuition to those who qualify. ACU opposes special benefits for illegal immigrants and believes states should not preempt the federal government’s constitutional role in setting immigration laws and opposed this bill. The Assembly passed the bill on February 6, 2017 by a vote of 87-51.

5. A 2967 Increasing the Minimum Wage for Car Washers. This bill mandates a $15 per hour minimum wage for car washers in New York City rather than the lower minimum wage for tipped employees. Studies by the Congressional Budget Office have found increases in the minimum wage results in higher unemployment. High rates of unemployment hinder family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes these artificial wages that hurt those who need employment the most, such as students and inexperienced workers and opposed this bill. The Assembly passed the bill on February 6, 2017 by a vote of 113-30.

6. S 4158 Moratorium on Carryout Bags. This bill extends a moratorium on a New York City law requiring fees on carryout bags of any type for 270 days in order to consider other ways of decreasing the use of these bags and “managing the waste stream.” ACU opposes penalizing people for the use of carryout bags and supported this bill as a step in the right direction. The Assembly passed the bill on February 7, 2017 by a vote of 122-16.

7. A 3358 Expanding the Definition of “Hate Crimes.” This bill adds offenses regarding “gender identity” to the list of offenses subject to treatment as “hate crimes.” ACU believes this kind of legislation violates the “double jeopardy” clause of the U.S. Constitution and opposes attempts to determine people’s thoughts when they commit a crime and opposed this bill. The Assembly passed the bill on March 22, 2017 by a vote of 92-48.

8. S 2003-D Funding Abortion Clinics. This bill allocates $500 million in “Aid to Localities” that includes funding for clinics that perform abortions, such as Planned Parenthood. ACU believes abortion is a human tragedy, supports restrictions on the practice, opposes taxpayer funds that support Planned Parenthood (the nation’s largest abortion provider) and opposed this bill. The Assembly passed the bill on April 6, 2017 by a vote of 114-22.

9. A 7082 Extending the Moratorium on Liquified Natural and Petroleum Gas. This bill extends until April 1, 2019 the siting or transportation of liquefied or petroleum gas in New York City. ACU opposes this interference in the free market that drives up the cost to consumers and is based on an explosion of a liquefied natural gas facility in 1973 and opposed this bill. The Assembly passed the bill on May 15, 2017 by a vote of 106-37.

10. A 4738 Completing the Government Takeover of our Health Care System. This bill implements a single-payer health care system in which the government replaces private insurance companies and pays doctors and hospitals directly for health care the government deems appropriate. The estimated $100 billion per year cost would be covered by new income tax rates ranging from 9% for incomes between $25,000 and $50,000 to 16% for incomes over $200,000. ACU opposes this socialized medicine scheme which reduces patient health care options and lowers standards of care, as has been seen in other countries that have implemented such systems and opposed this bill. The Assembly passed the bill on May 16, 2017 by a vote of 94-46.

11. A 566 Prohibiting a Faith-Based Code of Conduct for Employees. This bill prohibits employers, including faith-based organizations, from taking action against an employee for having an abortion or having a child out of wedlock. ACU supports the right of faith-based organizations to abide by their religious convictions and opposed this bill. The Assembly passed the bill on June 12, 2017 by a vote of 103-39.

12. A 6285 Increasing Rent Control Regulations. This bill adds to the complex series of rent control regulations by prohibiting landlords from adjusting rents that are below the legal limit when a lease is renewed. This will only be allowed when the dwelling is vacant. ACU opposes all rent controls that create scarcity and drive up the cost of property not covered by rent control and opposed this bill. The Assembly passed the bill on June 14, 2017 by a vote of 94-47.

13. S 724 Legalizing Sparklers. This bill exempts sparklers from the definition of fireworks and allows people 18 years of age or older who live outside New York City to buy them. ACU supports expanding individual liberties and supported this bill as a step in the right direction. The Assembly passed the bill on June 15, 2017 by a vote of 108-26.

14. S 6768 Requiring College Degrees for Future Registered Nurses. This bill requires those nurses who become registered practical nurses after this bill is passed to obtain a baccalaureate in nursing within 10 years of being licensed while exempting all current licensed nurses and those students currently in nursing programs. ACU opposes the proliferation of license requirements that are primarily designed to restrict competition and opposed this bill. The Assembly passed the bill on June 19, 2017 by a vote of 118-27.

15. A 8270-A Implementing a Plan to Eliminate Greenhouse Gas Emissions by 2050. This bill creates a new bureaucracy, the New York State Climate Action Council, which will devise a plan to reduce greenhouse gas emissions to 50% below 1990 levels by the year 2030 and eliminate all greenhouse gas emissions by the year 2050. ACU opposes wasting taxpayers’ money on a new government agency to implement a politicized global warming agenda that will dramatically increase the cost of energy to consumers and opposed this bill. The Assembly passed the bill on June 19, 2017 by a vote of 103-41.

16. S 750 Banning E-Cigarettes on School Grounds. This bill expands the law banning tobacco on school grounds to e-cigarettes even though it contains no tobacco. ACU believes that use of tobacco and e-cigarettes is personal liberty issue, that government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The Assembly passed the bill on June 20, 2017 by a vote of 134-10.

17. S 5422 Mandating Content of Heating Oil. This bill requires that heating oil used in three suburban New York City Counties—Nassau, Suffolk and Westchester—contain 5 percent biodiesel and creates a new tax credit for the use of biodiesel. ACU supports all forms of energy, believes government should not favor one form of energy over another and opposed this bill. The Assembly passed the bill on June 21, 2017 by a vote of 114-23.

18. A 260 Expanding Tax Exemptions for Favored Energy Systems. This bill expands the real property tax exemptions for solar and wind energy systems to include micro-hydroelectric and fuel cell systems, among others. ACU supports all forms of energy, believes government should not favor one form of energy over another and opposed this bill. The Assembly passed the bill on June 21, 2017 by a vote of 142-0.

19. S 6089 Maintaining State Funding for Private and Religious Schools. This bill continues to allow private and religious schools to receive the level of state aid they have been receiving for the past 40 years by basing the funding formula on “instructional time” instead of a new formula that has resulted in a reduction in aid to non-public schools. ACU supports strengthening school choice and supported this bill. The Assembly passed the bill on June 21, 2017 by a vote of 133-6 but it was vetoed by the governor.
