2. Brief History The DECS was renamed to DepEd, abolishing the Bureau of Higher Education and transferring all rights to CHED by virtue of RA 7722 (Higher Education Act of 1994) CHED is attached to the Office of the President for administrative purposes only. CHED is composed of 5 full-time members. 1 chairperson and 4 commissioners. The members must be doctorate degree holders and must be active in an HEI for at least 10 yrs.

3. Content and Focus of the MORPHE The MORPHE shall apply to all private educational institutions, except otherwise provided by law. Its provisions shall be applied to attain the purposes of higher education, to give meaning to academic freedom, to institute reasonable supervision and regulation and to accelerate the development of HEIs.

4. Academic Freedom This is the freedom of the institution of HEI to determine their aims and objectives and how to best attain them without the threat of coercion or interference, except possibly when the overriding public interest calls for some restraint. This freedom includes the right to select who may teach, what may be taught, how shall it be taught and who may be admitted to study.

5. Coverage Tertiary Level education consists of the Formal Education and the Non-Formal Education FE- post-secondary education offering degree programs, baccalaureate degrees NFE Distance Education, ETEEAP, Ladderized Education, E-Learning, Open Learning

6. Commission on Higher Education Organization and General Powers Section 15. Supervision Over HEIs. All private HEIs shall be established in accordance with the law and shall be subject to reasonable supervision and regulation by CHED. NO private HEI shall be established and no higher education program shall be operated, whether formal or ALS (non-formal), except pursuant to law and in accordance with this MORPHE.

7. Organization and Management of CHED Section 13. Organization. The Commission is divided into the Central Office and the Regional Offices. The central office is composed of the chairperson, the commissioners and the secretariat. The regional offices is composed of the director, the Program Supervisors and the staff. The chairperson and the commissioners shall have the ranks of a secretary and asst. sec, respectively.

8. CHED organization The CHED central office consults at least once a year the board of advisers. This board includes the DepEd Sec, the Director-Gen of NEDA, the Sec of DOST, the Sec of DTI, the Sec of DOLE, the president of FAAP and the Pres. Of FAPE The CHED-RO is composed of the regional directors. There are 17 Regional directors.

9. Establishment of HEIs Section 21. Articles of Incorporation and By-Laws. Any person or group wishing to open a PHEI must first secure a permission from CHED by filing a petition setting forth the following: The name and location of the HEI The names and addresses of all officers, directors, governing boards and faculties Date of the organization and the intended operation The total amount of money actually invested and other information relative to finances

10. A description of the buildings occupied A list of required teachers and assistants showing their academic degrees, profession, experiences, qualifications and the subjects to be taught Complete information concerning the curriculum Full information relative to laboratories, equipment and libraries Other details CHED may require

11. The CHED, in turn, shall issue a favorable recommendation of the institution with the SEC upon substantial compliance of the foregoing requirements. However, the favorable recommendation shall not be construed as an authority to operate higher education institution or a permit to conduct higher education programs. An educational institution offering basic education may amend it articles of incorporation and by-laws to offer degree programs. No HEI shall call itself a University unless the Commission grants such to the school, upon compliance with the requirements of a University status.

12. Operation and Recognition of Programs Section 53. Establishment and Recognition Distinguished. The establishment of PHEI refers to the creation, founding or organization of an entity resulting in its legal existence as a HEI. Recognition presumes an existing institutions and refers to the authority granted by CHED for the institution to conduct or operate a degree program. Establishment precedes recognition.

13. Operation and Recognition of Programs Section 55. Nature of Permit or recognition. The permit or recognition shall be exclusive to the grantee and subject to the conditions set forth therein. The permit or recognition cannot in anyway be alienated or be subject to any contract. Section 56. The Permit Phase. The grant of authority to operate a degree program begins with the permit phase as follows: Petition (not later than June 30)- copy of incorporationa nd by-laws, feasibility study (QA), educational profile RO assesses the petition and other documents CHED shall dispatch RQAT to inspect/evaluatereinspect/re-evaluate

14. The initial permit shall be granted if all requirements are fully complied with. The initial permit to operate applies only to 1st and 2nd year levels. On the 2nd year of operation, the HEI must apply for permit to operate the 3rd year level or may apply for the recognition if the applicant has complied all the requirements for the continuous operation of the degree program. All institutions must post copies of new permits and recognition of their programs on bulletin boards inside their campuses.

15. A PHEI which attained Level II accreditation in the Arts and Sciences and for three other professional courses may open and operate a new degree program in any field without prior approval from CHED, provided; however, that the HEI meets all the necessary minimum requirements. As part of the deregulation policy of CHED, the CHED RO may waive the assessment visit for an HEI securing initial permit provided the HEI is at least LEVEL II and with 5 degree programs with government recognition.

16. The Recognition Phase Section 57. The Recognition Phase. At the start of the 3rd year of operation of the degree program under permit, the HEI must file an application to CHED for the recognition of such program. Upon such application, CHED shall conduct an assessment of compliance of the applicant institution, and if all the minimum requirements for the operation of the program are met. CHED shall issue the corresponding Certificate of Recognition. The GR shall be granted fully to the HEI at the start of the last curriculum year and there shall be no partial recognition. An HEI without GR cannot graduate its students. No SO shall be given.

17. COEs and CODs HEI must apply for identification of COE or COD in those programs where CHED declared the application for such status open. These HEIs may either be invited to apply or may apply on their own initiative. The criteria of selection include instructional quality (45%), research and publication (30%), outreach program and institutional linkages (20%) and institutional qualifications (5%).

19. Internal Organization of HEIS Governing Board Head the head (President, Rector) must be a filipino citizem, possess at least a masters degree, have managerial competence and of good moral character. Dean The dean must be masters degree, must have at least 5 years of very satisfactory teaching performance and 2 years managerial experience. The Dean for TEP licensed and a doctorate degree holder with 3 years of VS performance and with VS teaching in Basic Education. The Dean for Graduate Education must be a doctorate degree holder and with published works in refereed journals.

20. Faculty Qualifications Must be MA degree holder and must teach their field of specialization. Licensed teachers must handle the professional courses. ACADEMIC RANKING Professor Doctorate degree holder, has productive scholarship, has evidence of efficiency and at least 10 years of related working experiences. Associate Professor Doctors degree preferred, experience: 7-10 yrs. has evidence of efficiency and at least 10 years of related working experiences.

21. Assistant Professor- doctors degree preferred, experience: 5- 7 years, has evidence of efficiency and at least 10 years of related working experiences. Instructor Masters degree, experience: 3- 5 yeas, has evidence of efficiency and at least 10 years of related working experiences. Assistant Instructor- Applicants with lower qualifications.

22. School Calendar and Class Size The academic year is not less than 36 weeks or 18 weeks per sem. This is inclusive of legal and special holidays. The total number of days is 200 days or 100 days per semester exclusive of all holidays and registration days, and class days suspended due to natural or man-made causes. The summer term for collegiate courses shall consist of the number of hours per unit as prescribed by CHED. The class size shall be determined by the institution taking into account the total capacity of the school: facilities, teachers, etc.

23. Class Size For teacher- education, for lecture classes, ideal size is 35 and maximum is 50. For graduate education, the number of faculty shall vary with every enrollment in such a manner as to allow a ratio of a maximum of 5 student advisees per graduate faculty.

24. Institutional Facilities The institution should own its site and must see to it that facilities are suitable and adequate for its activities.

25. University Status Section 40. Policy. University status, being a distinctive honor, is reserved only for truly deserving HEI that has proven excellence in the areas of instruction, research and outreach. Requirements: Degree programs- Liberal arts, sciences, mathematics, social sciences, 3 professional degrees and 2 graduate programs Accreditation must have Level III accreditation Instruction Research Outreach program Faculty complement 50% faculty in LA and Sciences, 20% must be doctoral holders, 35% have MA, 70% of the faculty must be qualified and full-time and there must be provisions for reward of the specialized skills of the faculty. Site and Buildings

26. University System Like the UP, Ateneo, DMMMSU and MMMSU University System REVOCATION. When the HEI commits violations, proven by evidence, the CHED may revoke the University status or the university system status.

27. Higher Education Programs Section 8. Levels. Undergraduate and Graduate Level Section 66. Graduate Education. Graduate Education is the at the apex of the educational system. As such, it shall showcase the best of the academic and intellectual products and processes of the system. Section 67. Structure. Philippine education shall, if feasible, be vertically articulated by discipline.

28. The CHED recognizes that advanced degrees are of 2 types: practitioners graduate degrees and research degrees. Section 68. Standard Requirements. Level III accreditation shall be a major consideration in granting authority to offer graduate programs. COEs/CODs shall also be considered in granting government authority to offer graduate programs.
