The Developmental Disabilities Assistance andBill of Rights Act, as amended, Public Law101-496 (42 U.S.C. 6000 et seq)45 CFR, Parts 1385, 1386, 1387, and 1388,amended November 20, 1989 (54 FR 47982)

The information contained in this policyissuance reviews the legislative provisionsfor funding services in poverty areas andprovides a current list of the organizations,by State, which serve as data centers. Thisissuance supersedes ADD-IM-85-1, datedFebruary 21, 1985, Determination of PovertyArea.

The Developmental Disabilities Assistance andBill of Rights Act (the Act) makes provisionfor serving people who live in rural or urbanpoverty areas within a State. Section 103(a)permits Basic State Grant projects whoseactivities or products target poverty areasto receive as much as 90 percent in Federalsupport. similarly, Section 103(b) permitsUniversity Affiliated Programs whoseactivities or products target these Statepoverty areas also to receive as much as 90percent in Federal support. Moreover,Section 122(b) (5)(E) requires that agenciesor entities serving people with developmentaldisabilities residing in State poverty areasreceive special financial and technicaiassistance.

Each census tract ina state is designated as either a poverty ornon-poverty area. You may use theinformation provided by the data centers inyour state to identify the location of thesepoverty areas. To assist you in contacting adata center, we have attached the mostcurrent listing of the state Data Centers.
