RESOLUTION NO. 12 - 81 RESOLUTION ESTABLISHING SCHEDULE OF FEES FOR NON- PROPRIETARY DEPARTMENTS, THE AIRPORT AND DEPARTMENT OF ENVIRONMENT AND INFRASTRUCTURE-UTILITIES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Pinellas County, Florida is empowered to set fees relating to the provision of services provided by Non-Proprietary Departments, the Airport, and the Department of Environment and Infrastructure-Utilities; and WHEREAS, the Board of County Commissioners, through Chapter 14, Section 14-47, of the Pinellas County Code, is authorized to establish reasonable fees and charges related to licensing, adoption, impoundment, service fees and such other fees for animals as deemed necessary; and WHEREAS, the Board of County Commissioners is empowered by Chapter 26164, Laws of Florida, Special Acts of 1949, as amended by Chapter 57-1730, Laws of Florida, Special Acts of 1957, to fix and prescribe permit and inspection fees for building, electrical and other permits as deemed necessary; and WHEREAS, the Board of County Commissioners is empowered by a Memo of Understanding between the City of Safety Harbor and Pinellas County to set fees for environmental site plan reviews within the City of Safety Harbor; and WHEREAS, the Board of County Commissioners is empowered by Chapter 713, Section 713.135(4), Florida Statutes, to establish a fee for furnishing notice of commencement forms; and WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the broadcasting, recording and editing facilities located at the Production Studio to cover the administrative and operating costs associated with the rental of said areas; and WHEREAS, the Board of County Commissioners is empowered by Chapter 240, Section 240.505, Florida Statutes, to establish a fee schedule for chemical testing services provided by the County Extension; and WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the various gardens located at the Botanical Gardens to cover the administrative and operating costs associated with the rental of said areas; and WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the meeting facilities located at the County Extension to cover the administrative and operating costs associated with the rental of said areas; and WHEREAS, the Board of County Commissioners is empowered by Chapter 90, Section 90-177 of the Pinellas County Code to establish a fee(s) for the use of the County Extension facilities to cover the administrative and operating costs associated with the rental of said areas by commercial photographers; and WHEREAS, the Board of County Commissioners is empowered to set a fee for vendors of food and products on County property; and WHEREAS, the Board of County Commissioners is empowered to set a fee for cancellation of an event to cover the administrative and operating costs associated with reservation/setup of said event; and Page I of 5

RESOLUTION ESTABLISHING SCHEDULE OF FEES FOR NON­PROPRIETARY DEPARTMENTS, THE AIRPORT AND DEPARTMENT OF ENVIRONMENT AND INFRASTRUCTURE-UTILITIES; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Board of County Commissioners of Pinellas County, Florida is empowered to set fees relating to the provision of services provided by Non-Proprietary Departments, the Airport, and the Department of Environment and Infrastructure-Utilities; and

WHEREAS, the Board of County Commissioners, through Chapter 14, Section 14-47, of the Pinellas County Code, is authorized to establish reasonable fees and charges related to licensing, adoption, impoundment, service fees and such other fees for animals as deemed necessary; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 26164, Laws of Florida, Special Acts of 1949, as amended by Chapter 57-1730, Laws of Florida, Special Acts of 1957, to fix and prescribe permit and inspection fees for building, electrical and other permits as deemed necessary; and

WHEREAS, the Board of County Commissioners is empowered by a Memo of Understanding between the City of Safety Harbor and Pinellas County to set fees for environmental site plan reviews within the City of Safety Harbor; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 713, Section 713.135(4), Florida Statutes, to establish a fee for furnishing notice of commencement forms; and

WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the broadcasting, recording and editing facilities located at the Production Studio to cover the administrative and operating costs associated with the rental of said areas; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 240, Section 240.505, Florida Statutes, to establish a fee schedule for chemical testing services provided by the County Extension; and

WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the various gardens located at the Botanical Gardens to cover the administrative and operating costs associated with the rental of said areas; and

WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the meeting facilities located at the County Extension to cover the administrative and operating costs associated with the rental of said areas; and

WHEREAS, the Board of County Commissioners is empowered to set a fee for vendors of food and products on County property; and

WHEREAS, the Board of County Commissioners is empowered to set a fee for cancellation of an event to cover the administrative and operating costs associated with reservation/setup of said event; and

WHEREAS, the Board of County Commissioners is empowered to set a fee for the use of the facilities located at Heritage Village to help defray clean-up charges and to cover the administrative costs associated with the rental of said facilities; and

WHEREAS, the Board of County Commissioners is empowered to set a fee(s) for the use of the meeting facilities located at the Brooker Creek Preserve Environmental Education Center and the Weedon Island Preserve Cultural and Natural History Center to help defray clean-up costs and to cover the administrative costs associated with the rental of said facilities; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to establish parking and admission fees at County parks; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to designate areas for special events and establish fees for this purpose; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to establish a fee for the use of campground facilities; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to establish rental fees for public mooring and dry storage of vessels at public marinas as defined in Chapter 90, Section 90-2; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to establish fees related to the reservation and use of picnic shelters; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to allow other passive use activities by special permit if authorized by the county administrator; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to permit certain activities within environmental lands, including Shell Key Preserve, and to establish fees related to such activities;

WHEREAS, the Board of County Commissioners is empowered by Chapter 90 of the Pinellas County Code to permit certain activities within environmental lands, including the Brooker Creek Preserve Environmental Education Center and the Weedon Island Preserve Cultural and Natural History Center;

WHEREAS, the Board of County Commissioners is empowered to establish parking fees at County boat ramp launching facilities; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 26164, Laws of Florida, Special Acts of 1949, as amended by Chapter 57-1730, Laws of Florida, Special Acts of 1957, and converted into Ordinance by Chapter 78-596, Laws of Florida, Special Acts of 1978, to fix and prescribe permit and inspection fees for the administration and enforcement of its zoning regulations; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 26164, Laws of Florida, Special Acts of 1949, as amended by Chapter 57-1730, Laws of Florida, Special Acts of 1957, and Chapter 166, Section 166-46, et seq. of the Pinellas County Code to fix and prescribe permit and inspection fees for grubbing, tree removal and other permits as deemed necessary; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 380.06, Florida Statutes, and Chapters 134 and 138 of the Pinellas County Land Development Code, to fix and prescribe fees for review of annual ORI reports, developer agreements, administrative variances for street frontage, and non-conforming use reviews; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 252, Section 252.38(e), Florida Statutes, and the Florida Executive Office of the Governor, Division of Emergency Management, Rule Chapter 27P-20, to establish a fee for the review of emergency management plans; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 791, Florida Statutes, and Chapter 62 of the Pinellas County Code to permit the process of the sale of fireworks specified within these chapters; and

WHEREAS, in accordance with Section 54-64, Pinellas County Code, the Board of County Commissioners has established a fiscal policy that requires adjustment of the rates for ambulance services charged by Emergency Medical Services in accordance with the most currently published Medical Consumer Price Index, and the ambulance rates set out herein have been approved by the County Administrator in accordance with Section 54-64 of the Code; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 57-1734, Laws of Florida, Special Acts of 1957, as amended by Chapter 67-1927, Laws of Florida, Special Acts of 1967, as amended by Chapter 78-599, Laws of Florida, Special Acts of 1978, and Chapter 58, Section 58-326, et seq. of the Pinellas County Code to fix and prescribe permit and inspection fees for lot clearing; and

WHEREAS, the Board of County Commissioners is empowered by an Order of Delegation and Operating Agreement between the Florida Department of Environmental Protection and Pinellas County regarding the regulation of mangroves, executed on February 27, 1996, pursuant to Section 403.9321, et seq., Florida Statutes, and Chapter 166, Section 166-96, et seq. of the Pinellas County Code to fix and prescribe permit and inspection fees for mangrove trimming and alteration; and

WHEREAS, the Board of County Commissioners is empowered by the Pinellas County Charter and Chapter 166, Section 166-241, et seq. of the Pinellas County Code to fix and prescribe permit and inspection fees for water and navigation control purposes; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 58, Section 58-90(15) of the Pinellas County Code to establish fees and charges relating to administration and enforcement of air quality standards, including hazardous air pollution demolition and asbestos removal projects; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 42, Sections 42-77 and 42-81 of the Pinellas County Code to establish a fee to cover the administrative costs associated with adult use permits; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 10, Sections 10-67, 10-68, 10-69 and 10-78 of the Pinellas County Code to establish a fee to cover the administrative and investigative costs associated with bingo licenses; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 42, Sections 42-410, 42-411 and 42-412 of the Pinellas County Code to establish a fee to cover the administrative and direct costs associated with fees charged by the medical examiner's office for approval of cremations, dissections and burials at sea; and

WHEREAS, the Board of County Commissioners is empowered by Section 8 of Chapter 26153, Laws of Florida, Special Acts of 1949, as amended by Chapter 59-1738, Laws of Florida, Special Acts of 1959, to prescribe fees to cover the costs of examination and process of maps or plats submitted for approval; and

WHEREAS, the Board of County Commissioners is authorized by Chapter 337.401, Florida Statutes, to charge fees for the use of right-of-way for utilities subject to regulation; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 2, Section 2-156, of the Pinellas County Code to establish fees and charges relating to pre-qualification of contractors; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 154, Section 154.06, Florida Statutes; Chapter 381, Section 381.0016, Florida Statutes; and the contract between Pinellas County and the State of Florida Department of Health pursuant to Chapter 154, Section 154.01 (3), Florida Statutes to establish fees for personal health services; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 381, Section 381.0016, Florida Statutes; and Article 4.2.b of the contract between Pinellas County and the State of Florida Department of Health to establish fees for enforcement of health regulations; and

WHEREAS, the Board of County Commissioners is empowered by Chapter 66, Sections 66-38, 66-39, 66-40, and 66-68 of the Pinellas County Code to fix and prescribe permit and inspection fees for public swimming pools, public hydrotherapy pools, public whirlpools, and public spa pools; and

WHEREAS, the Board of County Commissioners, as the governing body of Pinellas County, is authorized by Chapters 125 and 832, Sections 125.0105 and 832.08(5), Florida Statutes, to charge a service fee for the collection of a dishonored check, draft or other order; and

WHEREAS, the Board of County Commissioners is authorized by Chapter 119, Section 119.07, Florida Statutes, to charge fees for research and duplications of public records; and

WHEREAS, the Board of County Commissioners is authorized by Charter of Pinellas County, the Florida Statutes, and Chapter 126, Article Ill of the Pinellas County Code to set fees for water system services; and

WHEREAS, the Board of County Commissioners is authorized by Charter of Pinellas County, the Florida Statutes, and Chapter 126, Article IV of the Pinellas County Code to set fees for sewer system equipment and maintenance; and

WHEREAS, the Board of County Commissioners is authorized by Charter of Pinellas County, the Florida Statutes, and Chapter 126, Article V of the Pinellas County Code to set fees for reclaimed water system equipment and maintenance; and

WHEREAS, the Board of County Commissioners is authorized by Charter of Pinellas County, the Florida Statutes, and Chapter 126, Article VI of the Pinellas County Code to set fees for grease waste management activities, and;

WHEREAS, the Board of County Commissioners is authorized by Chapter 18, Section 18-66(h) of the Pinellas County Code to establish and change all other airport fees not set forth in Sections 18-66(a)-(g) by resolution; and

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pinellas County, Florida, in regular session, duly assembled, this 6th day of September 2012, as follows:

The references to the statutes, ordinances, agreements, and other fee approval authority in the recitals above includes any amendments, revisions, or successor provisions thereto.

This Resolution shall take effect on October 1, 2012.
