TO EXCEED $15,246.00 FOR LEGAL SERVICES RENDERED THROUGH
DECEMBER 31, 2020 FOR RUDERMAN & ROTH, LLC FOR PROFESSIONAL
SERVICES AS LABOR/PERSONNEL COUNSEL
WHEREAS, the City Council by Resolution(s) R048-20, R192-20 and R303-20 adopted
January 21, 2020, June 8, 2020 and November 9, 2020 respectively, authorizing appropriation(s)
in an aggregate amount not to exceed $170,00.00 for payment of legal fees rendered by
RUDERMAN & ROTH, LLC, 150 Morris Avenue, Suite 303, Springfield, New Jersey 07081 as
Labor/Personnel Counsel; AND
WHEREAS, the services to be performed consist of professional services within the
definition of the Local Public Contracts Law of the State of New Jersey, which are within the
exceptions from competitive bidding provided for in the Local Public Contracts Law; AND
WHEREAS, unexpected and unusually extensive legal proceedings and intensive
negotiations have been required, an additional appropriation in an amount not to exceed Fifteen
Thousand two Hundred Forty-Six Dollars ($15,246.00) is needed to cover services rendered on
behalf of the City of Plainfield through December 31, 2020 by said vendor; AND
WHEREAS, there is sufficient funding for this appropriation from Corporation
Counsel’s Budget 0-01-04-155-001-278 ($15,246.00), as evidenced by the City Finance
Officer’s Certificate attached hereto; Now, therefore, be it
RESOLVED, by the City Council of the City of Plainfield, New Jersey that:
1. Resolutions R048-20, R192-20 and R303-20 are hereby amended to provide for a
final appropriation in an amount not to exceed ($15,246.00) for RUDERMAN &
ROTH, LLC, 150 Morris Avenue, Suite 303, Springfield, New Jersey 07081 and the
Agreement, be and the same are hereby amended accordingly.
2. Funding shall be paid from Corporation Counsel’s Budget 0-01-04-155-001-278.
3. A copy of this resolution shall be filed in the Office of the City Clerk with
Resolutions R048-20, R192-20 and R303-20 as one (1) document.

AGREEMENT PURSUANT TO PLAINFIELD MUNICIPAL CODE SECTION 2:10-18
TO WILENTZ, GOLDMAN & SPITZER, PA, AS BOND COUNSEL AND
REDEVELOPMENT COUNSEL FOR AN AMOUNT NOT TO EXCEED $25,000.00.
WHEREAS, the City of Plainfield has a need to retain special counsel to represent the City
in connection with the issuance of debt obligations and other matters of capital finance, and
redevelopment and other legal actions as may be assigned through the Office of Corporation Counsel
as more fully expressed and described in the contract(s) for services attached hereto and made a part
hereof; AND
WHEREAS, in accordance with Plainfield Municipal Code Section 2:10-18, the City of
Plainfield instituted a policy to negotiate agreements for Professional Services on the basis of
demonstrated confidence and qualifications for various types of Professional Services required by the
City; AND
WHEREAS, on January 6, 2021, the City Council of the City of Plainfield adopted
Resolution R033-21 approving WILENTZ, GOLDMAN & SPITZER, PA, among others as
qualified vendors and service providers in accordance with Plainfield Municipal Code Section 2:10-
18; AND
WHEREAS, pursuant to the list of approved qualified vendors and service providers, and
based upon a review of the qualifications and recommendations for legal services as Bond Counsel
and Redevelopment Counsel needed by the City of Plainfield; WILENTZ, GOLDMAN &
SPITZER, PA, 90 Woodbridge Center Drive, Suite 900, Woodbridge, New Jersey 07095-0958 has
been deemed appropriate and qualified to perform the professional services required; AND
WHEREAS, funding for legal services as Bond Counsel will be provided from various Bond
Ordinances in the General Capital Fund of the City; and legal services rendered as Redevelopment
Counsel in an amount not to exceed $25,000.00 shall be paid from Budget Account No. 1-01-04-
155-001-281; Now, therefore, be it
RESOLVED, by the City Council of the City of Plainfield, New Jersey as follows:
1. The Mayor and the City Clerk are hereby authorized and directed to execute a
professional service agreement as approved by the Office of Corporation Counsel
attached hereto and made a part hereof, between the City of Plainfield and WILENTZ,
GOLDMAN & SPITZER, PA, 90 Woodbridge Center Drive, Suite 900, Woodbridge,
New Jersey 07095-0958, effective as of January 1, 2021 through December 31, 2021, for
Bond Counsel services will be provided from various Bond Ordinances in the General
Capital Fund of the City; and legal services rendered as Redevelopment Counsel in an
amount not to exceed $25,000.00 shall be paid from Budget Account No. 1-01-04-155-
001-281 as evidenced by the City Finance Officer’s Certificate attached hereto, and any
additional amounts from any and all escrow accounts designated for professional fees;

3. A brief notice of this action shall be published within 20 days in the newspaper
authorized to publish legal notices on behalf of the City.
4. A copy of this resolution and the executed agreement shall be filed in the Office of the
City Clerk.

WHEREAS, in accordance with Plainfield Municipal Code Section 2:10-18, the City of Plainfield instituted a policy to negotiate agreements for Professional Services on the basis of demonstrated confidence and qualifications for various types of Professional Services required by the City; AND

Jersey, which are within the exceptions from competitive bidding provided for in

WHEREAS, there exists debt financing and numerous existing and new
redevelopment projects, requiring financial advisory services; and
WHEREAS, an appropriation in an amount not to exceed Twenty Five
Thousand Dollars ($25,000.00) is needed to cover the services anticipated to be
rendered on behalf of the City of Plainfield through December 31, 2021; and
WHEREAS, $10,000.00 will be charged to account 1-01-26-170-001-219
and there is sufficient funding for the balance of this appropriation from capital,

RESOLUTION ESTABLISHING DELINQUENT TAX AND ASSESSMENT INTEREST
RATES AND PENALTIES.
WHEREAS, N.J.S.A. 54:4-67 permits the governing body of each municipality to fix the rate of
interest to be charged for nonpayment of taxes or assessments subject to any abatement or discount for the
late payment of taxes as provided by law; and
WHEREAS, N.J.S.A. 54:4-67 permits the fixing of said rate up to 8% per annum on the first
$1,500.00 of the delinquency and up to 18% per annum on any amount in excess of $1,500.00; and
WHEREAS, N.J.S.A. 54:4-67 permits the governing body to fix a penalty up to
6% be charged on any property with a delinquency in excess of $10,000.00 at the end of the Fiscal Year
(inclusive of interest on said delinquency calculated to the end of the same Fiscal Year); said delinquency
to be for said fiscal year and not cumulative across years; and
WHEREAS, N.J.S.A. 54:5-26 requires that the tax sale be advertised once in each
of the four calendar weeks preceding the calendar week containing the day appointed for
the tax sale; and
WHEREAS, N.J.S.A. permits the Tax Collector of a municipality to, in lieu of up
to two publications, send a notice of the tax sale to the property owner and to any person or
entity entitled to notice of foreclosure, the cost of which shall be added to the cost of the
sale, not to exceed $25.00 for each notice sent on a particular property; Now
THEREFORE BE IT RESOLVED, by the City Council of the City of Plainfield, as follows:
. The Tax Collector is hereby authorized and directed to and charge 8% per annum on the
first $1,500.00 of taxes becoming delinquent after the due date and 18% per annum on
any amount in excess of $1,500.00, the same to
be calculated from the date the tax was payable until the date of actual payment.
. There will be a ten (10) day grace period of quarterly tax payments made by cash, check
or money order.
. Any payments made after the ten (10) day grace period will revert the interest charge
back to the original due date.
. The Tax Collector is directed to charge a 6% penalty on any delinquency in excess of
$10,000.00 (inclusive of interest, said delinquency is calculated to the end of the fiscal
year) that remains delinquent at the end of the fiscal year, for that fiscal year.
5. The Tax Collector is hereby authorized to charge a fee of $25.00 to cover all costs
associated with the mailing of each notice on a particular property, not to exceed two (2)
mailings per property.

WHEREAS, the City of Plainfield, pursuant to N.J.S.A. 40A:11-12a and N.J.A.C. 5:34-29(c), may by resolution and without advertising for bids, purchase any goods or services under the State of New Jersey Cooperative Purchasing Program for any State Contracts entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury; and
WHEREAS, the City of Plainfield has the need, in a timely manner to purchase goods or services utilizing State Contracts; and
WHEREAS, when appropriate and necessary, the City of Plainfield intends to enter into contracts with the attached State Contract Vendors for Public Safety Equipment and Services through this resolution and properly executed contracts, which shall be subject to all the conditions applicable to the current State Contracts; and
WHEREAS, the City Council of the City of Plainfield does hereby authorize the Purchasing Agent during CY21 to purchase certain goods or services from State Contract Vendors for Public Safety and Equipment as identified on the attached Schedule A , pursuant to the terms and conditions of such State Contracts; and

WEST THIRD STREET TO NEW JERSEY AMERICAN WATER AND PUBLIC
SERVICE ELECTRIC & GAS IN ACCORDANCE WITH THE CITY OF PLAINFIELD
MUNICIPAL CODE SECTION 13:4-2(G) (2) FOR OPENINGS WITHIN A ROADWAY
THAT ARE UNDER A FIVE (5) YEAR MORATORIUM
WHEREAS, a request was made regarding a street opening application for 714-16 West
Third Street on behalf of New Jersey American Water and PSE&G; and
WHEREAS, the proposed location of the road opening is at 714-16 West Third Street
which was paved within the last five years, (2017) and is currently under a five year
moratorium; and
WHEREAS, in accordance with the City of Plainfield Municipal Code Section 13:4-2
(g)(2)(a), for any applicant to open any paved or improved street surface which is less than
five (5) years, approval must be obtained from the City Council; and
WHEREAS, the property owner, Adriano Colleoni, is requesting consideration for the
street opening, in an email dated January 8, 2021. Permission is being sought for the
installation of a water line, as the owner has recently purchased and renovated the property.
According to the application, the work will be performed by NJAW for a new waterline
connection. PSE&G will be installing a new gas line; and
WHEREAS, the City of Plainfield, Department of Public Works, in accordance with the
Ordinance, presents this resolution for consideration by the City Council; and
WHEREAS, all requirements in accordance with the Ordinance must be met by the
applicant if approval to open the roadway is granted by the City Council; now therefore be it
RESOLVED, by the City Council of the City of Plainfield, that:
1. The applicant must meet all requirements in accordance with the Ordinance.
2. That a copy of this resolution be filed in the office of the City Clerk.

WHEREAS, in accordance with N.J.S.A. 40A:11-2(6) and N.J.S.A. 40A:11-5(1)(a)(i), the City of Plainfield instituted a policy to negotiate agreements for Professional Services on the basis of demonstrated confidence and qualifications for various types of Professional Services required by the City pursuant to a fair and open process in accordance with 19:44A-20.4; AND
WHEREAS, the City of Plainfield received in accordance with a published notice, sealed qualifications for various positions; AND
WHEREAS, the City of Plainfield by Resolution on January 6, 2021, approved resolution number 042-21 for qualified service providers; AND
WHEREAS, pursuant to the fair and open process, and based upon review of the qualifications and recommendations by City staff, for engineering consulting services as needed by the City of Plainfield, PENNONI ASSOCIATES was deemed appropriate and qualified to perform the professional services required therefor; AND
WHEREAS, PENNONI ASSOCIATES has submitted an agreement dated January 4, 2021, attached hereto and made a part hereof; AND
RESOLVED, by the City Council of the City of Plainfield, New Jersey as follows:
1. The Mayor and the City Clerk are hereby authorized to execute a professional services agreement to provide engineering consulting services to the City of Plainfield with PENNONI ASSOCIATES, having its principal offices located at 24 Commerce Street, Suite 300, Newark, New Jersey 07102, as approved by the Corporation Counsel for the time period of January 1, 2021 through December 31, 2021.
2. This contract is awarded in accordance with N.J.S.A. 40A:11-2(6) and N.J.S.A. 40A:11-5(1)(a)(i), and pursuant to the City of Plainfield’s policy to negotiate agreements for Professional Services on the basis of demonstrated confidence and qualifications for various types of Professional Services required by the City pursuant to a fair and open process in accordance with 19:44A-20.4
3. Funding in an amount not to exceed $90,000.00 shall be paid from Account # 1-01-26-165-001-219 as evidenced by the City Finance Officer’s Certificate; and
4. A notice of this action shall be published in the official newspaper authorized to publish legal notices for the City of Plainfield within 20 days as required by law.
5. A copy of this resolution and the executed agreement shall be filed in the Office of the City Clerk.

proposal to preform Floodplain Manager duties for the City of Plainfield; and
WHEREAS, in accordance with Plainfield Municipal Code Section 2:10-18, the
City of Plainfield instituted a policy to negotiate agreements for Professional Services on
the basis of demonstrated confidence and qualifications for various types of Professional
Services; and
WHEREAS, on January 6, 2021, the City Council of the City of Plainfield adopted
Resolution #042-21 approving Remington & Vernick Engineers, among others as
qualified vendors and service providers; and
WHEREAS, fees to provide professional engineering services for the Floodplain Management Services for the City of Plainfield would be in accordance with the Flood Damage Prevention Ordinance.; and
WHEREAS, Remington & Vernick Engineers has submitted a proposal dated
January 5, 2021 for Floodplain Manager Services; and
WHEREAS, funding is available contingent upon approval of the 2021 Municipal
Budget from account # 1-01-26-165-001-229 in an amount not to exceed $20,000.00; and
WHEREAS, it is the desire of the Department of Public Works to have Remington
& Vernick Engineers provide services for a period of one (1) year, from January 1, 2021 to
December 31, 2021, to carry out the duties of Floodplain Manager as outlined in the City’s
Flood Damage Prevention Ordinance; now therefore, be it

WHEREAS, on July 13, 2020, the City Council of the City of Plainfield authorized a
construction contract with Fischer Contracting, Inc., 10 Short Hills Lane, Scotch Plains, NJ
07076 for the St. Mary’s Ave Roadway Improvement Project; and
WHEREAS, the award contract R# 220-20 was approved by City Council in the
amount of $399,725.83. Change Order #1 is due to a decrease in as built quantities, in the
amount of $10,005.17 which reduces the total amount of the contract to $368,105.49; and
WHEREAS, the project is complete and City Council approval is necessary to
finalize the project for reimbursement of the CDBG grant award; and
WHEREAS, recommendation is being made by Remington &Vernick Engineers in a
letter dated December 8, 2020, attached hereto and made a part hereof, to release the
performance bond, accept the two year maintenance bond, and release the retainage and final
payment in the amount of $10,005.17; Now, therefore be it
RESOLVED, that the City Council of the City of Plainfield authorizes Change Order
#1 Final, reducing the original contract amount by $31, 620.34, and that the Mayor and the
City Clerk are authorized to release the performance bond, accept the two year maintenance
bond, and release the retainage and final payment in the amount of $10,005.17 for the St,
Mary’s Ave Roadway Improvement Project to Fischer Contracting Inc., 10 Short Hills Lane,
Scotch Plains, NJ 07076; be it

TURF FIELD AND PARK UPGRADES IN AN AMOUNT NOT TO EXCEED $9,650
WHEREAS, the City of Plainfield entered into a contract for professional engineering services for the Rushmore Playground Synthetic Turf Field and Park Upgrades with Remington & Vernick Engineers; and
WHEREAS, the resolution was approved by City Council at the October 15, 2019 City Council meeting in the amount of $137,450.00. The grantor has requested that additional duties be fulfilled in order to complete the project, attached hereto and made a part hereof; and
WHEREAS, Remington & Vernick Engineers has submitted a proposal dated December
9, 2020 to complete the additional task requested by the grantor, Green Acres; and WHEREAS, the Director of Public Works recommends that the City Council approve
this resolution in order to complete the additional required items necessary to close-out the project: and
WHEREAS, there is sufficient funding for this contract in an amount not to exceed
$9,650.00 from Budget Account # T-19-56-370-001-801, as evidenced by the City’s Finance Officer’s Certification of Funding attached hereto; Now, therefore, be it, RESOLVED, by the City Council of the City of Plainfield, that the Mayor and City Clerk is authorized to amend the professional service agreement with Remington & Vernick Engineers, 101 Route 130, Suite 600, Cinnaminson, NJ 08077 to provide additional engineering services for the Rushmore Playground Synthetic Turf Field and Park Upgrades; be it FURTHER RESOLVED, that a copy of this resolution and the executed agreement shall be filed in the Office of the City Clerk.

RESOLUTION AUTHORIZING APPROVAL TO AMEND RESOLUTION 316-20 TO
DELETE ONE (1) PROPERTY MAINTENANCE LIEN.
WHEREAS, on or about November 9, 2020, the City Council of the City of Plainfield adopted
resolution R316-20, which approved and authorized lien placement for the clean-up of sixteen
properties; and
WHEREAS, it was determined that the property known as 201-11 West 6th Street (Block
711 Lot 01) has been assessed maintenance code violations by the City of Plainfield leading to
an emergency abatement for corrective action of said violations. As such a lien was incorrectly
assessed to the property known as 201-11 West 6th Street (Block 711 Lot 01) and should be
deleted; and
WHEREAS, a lien should be placed on property known as 202-08 West 7th Street (Block
711 Lot 2) in the amount of $1,016.92; and
WHEREAS, it is in the best interest of the City of Plainfield to remove and otherwise
delete the said lien from Schedule A for (Block 711 Lot 01) and place lien on (Block 711 Lot 2)
of resolution R316-20; Now, therefore, be it
RESOLVED, by the City Council of the City of Plainfield, that R316-20 is hereby
amended to remove and add the following properties from Schedule A thereof:

RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION TO NEW
JERSEY TRANSIT UNDER THE FEDERAL TRANSIT ADMINISTRATION TO
OBTAIN VEHICLES TO TRANSPORT SENIOR CITIZENS.
WHEREAS, the City of Plainfield Senior Citizens Service Center will need new and reliable
vehicles to transport our members, and has met the criteria to apply for the 5310 Grant Program
under the Federal Transit Administration (FTA) section which is making funds available to the
State of New Jersey to assist the City of Plainfield Senior Citizens in meeting their transportation
needs; and
WHEREAS, the Director of Plainfield Senior Services: Sharron Peterson, is an active participant
in the County of Union coordination planning process which allows The City of Plainfield the
opportunity to be considered in the application process. Thus applying for vehicles/funding
under these grants.
WHEREAS, the City Council will not be responsible for matching funds, Under the Federal
Transit Administration (FTA) Section 5310 Program. Private non-profit corporations and certain
public bodies may apply for Federal capital assistance to pay 80% of the purchase cost of
vehicles and/or transportation related equipment used to provide needed transportation services
to elderly individuals and people with disabilities which cannot be reasonably provided by
existing transportation services. NJ TRANSIT provides the required 20% match; and
WHEREAS, Upon FTA approval and the completion of final notifications and certifications, the
successful applicant agency will be eligible for a vehicle purchased by NJ TRANSIT for the
purposes of transporting Plainfield Senior Citizens, as originally outlined in the application. The
City of Plainfield will be responsible for all operational costs including, but not limited to, annual
motor vehicle registration, fuel, maintenance, insurance, salary and benefits of drivers. From the
time of inclusion in a grant submission to actual vehicle delivery can range anywhere from 18 to
24 months from time of award letter. Therefore, be it
RESOLVED, by the City Council of the City of Plainfield, that the Mayor and the City Clerk
are hereby authorized to submit this application and execute any required documents to accept
said award as approved by the Corporation Counsel,

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINFIELD,
AUTHORIZING THE TRANSFER OF THAT CERTAIN FINANCIAL AGREEMENT
AND REDEVELOPMENT AGREEMENT BETWEEN THE CITY OF PLAINFIELD
AND 803 SOUTH URBAN RENEWAL, LLC TO NEW OWNERS AND AUTHORIZING
THE EXECUTION OF AN ASSIGNMENT AND ASSUMPTION AGREEMENT IN
CONNECTION THEREWITH
WHEREAS, the City of Plainfield (the “City”) and 803 South Urban Renewal, LLC (the
“Entity”) entered into a redevelopment agreement (the “Redevelopment Agreement”) and a
financial agreement (the “Financial Agreement”, together with the Redevelopment Agreement,
the “Agreements”) in connection with the redevelopment of and tax exemption for certain
property identified as Block 645, Lot 12 on the City tax maps (the “Property”); and
WHEREAS, pursuant to the Agreements, a transfer of the Agreements requires notice to
the City and approval of the City Council; and
WHEREAS, the Entity has notified the City of its intent to transfer, and the City Council
desires to accept and consent to the transfer, of the benefits and obligations of the Agreements,
from the Entity, which is currently owned and controlled by Dennis Cieri, Tyler Bennett and Ken
Segal (the “Existing Owners”), to the Entity, to be owned and controlled by Avi Gagin, Amir
Ben-Yohanan, and Eyal Gagin (the “Proposed Owners”), with the Proposed Owners accepting
all of the benefits and obligations of the Entity pursuant to the Agreements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainfield, New Jersey as follows:
Section 1. The City Council hereby consents to the proposed transfer of the benefits
and obligations set forth in the Agreements as it relates to the Property from the Existing Owners
to the Proposed Owners.
Section 2. The City Council hereby authorizes and directs the Mayor of the City to
execute the assignment and assumption agreement attached hereto as Exhibit A, which provides
the details of the transfer, along with any document or writing or to make such representations,
on behalf of the City, which may be necessary to further evidence or acknowledge the City’s
consent and to take all other necessary or desirable action to effectuate the transfer referred to
herein.
Section 3. This resolution shall take effect immediately.

STREET REDEVELOPMENT AREA IN THE CITY OF PLAINFIELD’S BROWN-
FIELD DEVELOPMENT AREA (BDA).
WHEREAS, in accordance with Municipal Codes Section 2:10-8, the City of Plainfield instituted
a policy to negotiate agreements for Professional Services on the basis of demonstrated confidence and
qualifications for specific types of Professional Services required by the City; and
WHEREAS, the City has received in accordance with the notice published December 2, 2020,
sealed qualifications for a brownfield environmental contractor to perform work related to United States
Environmental Protection Agency (USEPA) Hazardous and Petroleum Assessment Grants and New
Jersey Department of Environmental Protection (NJDEP) Hazardous Discharge Site Remediation Funds
(HDSRF) in the Brownfield Development Area (BDA) as well as other HDSRF sites identified within the
City; and
WHEREAS, pursuant to the fair and open process, and based upon the review of the
qualifications and recommendations therein, 11 professional firms were determined qualified to provide
brownfield environmental work as needed by the City of Plainfield for a period from January 1, 2021
through December 31, 2021; and
WHEREAS, Pennoni Engineers, was requested by the city to prepare proposals for additional
work on the following 4 sites: Carl’s Towing ($33,656.00) 412-414 E. 2nd Street, Block 307/Lot 20;
Contour Metal Shaping ($38,338.00) 419-421 Cottage Place, Block 306/Lot 28, PMUA ($46,724.00)
424-442 and 443 Cottage Place, Block 305/Lots 1 & 2.01; Block 306/Lots 20.01, 24.01, 26 & 27; Tree
Cycle ($37,738.00) 410-420 E. 3rd Street, Block 306/ Lot 19 for a total of $156.456.00; and
WHEREAS, proposals were prepared by Pennoni Engineers Inc. in September of 2020 and
approved by the NJDEP and;
WHEREAS, this additional RI/RAW must be completed by a Licensed Site Remediation
Professional (LSRP) and is required by the NJDEP for additional work; and
WHEREAS, sufficient funding for the additional RA/RAW work is available through grant
account number G-02-17-791-210-432 and setup as Contract C2000010.
NOW THEREFORE BE IT RESOLVED THAT,
1. The Plainfield City Council does hereby authorize a contract with Pennoni Engineers to
provide additional RA/RAW as requested by the NJDEP for work at 4 locations at the East 3rd
and Richmond Street Redevelopment Area in the BDA for a one year period beginning January 1,
2021 through December 31 2021;
2. The Mayor and the City Clerk are hereby authorized and directed to execute an agreement as
approved by the Office of Corporation Counsel, made with Pennoni Engineers, 24 Commerce
Street, Suite 300, Newark, NJ 07102, beginning January 1, 2021 through December 31, 2021;
3. A brief notice of this action shall be published within 20 days in the newspaper authorized to
publish legal notices on behalf of the City.
4. A copy of this resolution and the executed agreement shall be filed in the Office of the City

WHEREAS, in accordance with Municipal Codes Section 2:10-8, the City of Plainfield
instituted a policy to negotiate agreements for Professional Services on the basis of demonstrated
confidence and qualifications for specific types of Professional Services required by the City;
and
WHEREAS, the City has received in accordance with the December 02, 2020 published
notice and sealed qualifications for brownfield engineering contractor to perform work related to
the Brownfield Sites in the City; and
WHEREAS, based upon the review of the qualifications of the consulting firms that
submitted for Brownfield Engineering consultant services and review by the Department of
Economic Development one firm was selected; and
WHEREAS, the cost related to the SI work at these two sites is subject to approval by
EPA Region II and;
WHEREAS, no work will begin until such approval has been received by the City and;
WHEREAS, sufficient funding for the SI’s for the environmental engineering consultant
is available through budget account number G-02-16-791-310-432 and setup as Contract
C1900007.
NOW THEREFORE BE IT RESOLVED THAT,
1. The Plainfield City Council does hereby authorizes a contract to Remington & Vernick
Engineers to provide environmental engineering services to the City as needed and
recommended by the Department of Economic Development for a one year period beginning
January 1, 2021 through December 31 2021;
2. The Mayor and the City Clerk are hereby authorized and directed to execute an agreement as
approved by the Office of Corporation Council, made with Remington & Vernick, One

WHEREAS, the City of Plainfield has need to retain the services of a planning firm to review
land use board applications, prepare redevelopment studies and plans and undertake general
planning services throughout the City; and
WHEREAS, on December 2, 2020, the City posted a Request For Qualifications (RFQ)
notice in The Courier News for redevelopment and planning services and six firms submitted
qualifications for review to serve as the planning consultant for these services; and
WHEREAS, on January 19, 2021 city council adopted a resolution deeming all
respondents as qualified to undertake the professionals planning services related to
redevelopment planning; and
WHEREAS after review by the Department of Economic Development, CME
Associates of 1460 Route 9 South, Howell, NJ 07731, with Malvika Apte, P.P. as representative has
been selected as the best qualified to undertake this position for the City; and
WHEREAS, among other factors, CME Associates was chosen because they have
performed redevelopment services for the city in a responsible and professional manner for the
past two years; and
WHEREAS, CME Associates is to undertake all tasks directly related to the review of
land use board applications with charges to the appropriate escrow accounts, and preparation of
redevelopment studies and redevelopment plans as directed by the city and in consultation with
the Department of Economic Development; and
WHEREAS, the services to be performed consist of professional services which have
been procured in the manner set forth in the Plainfield Municipal Code 210-18; and
WHEREAS, the maximum amount of this contract is $25,000.00 and the funding for
CY2021 shall be paid through the anticipated CY 2021 budget account number 1-01-26-180-001-
219 and anticipated in an amount not to exceed $25,000.00 subject to the adoption of the 2021
annual budget; and
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of
Plainfield, New Jersey as follows:
. The Mayor and the City Clerk are hereby authorized to execute a professional services
agreement with CME Associates, of 1460 Route 9 South, Howell, NJ 07731 for a period
of one (1) year (12 consecutive months), from January 1, 2021 to December 31, 2021.
. This contract is awarded without competitive bidding as a “professional service” in
accordance with N.J.S.A. 40A: 11-5(1)(a)(i) of the Local Public Contracts Law because
the contract is for service performed by a person(s) authorized by law to practice a
recognized profession, whose practice is regulated by law, and the performance of which
services requires knowledge of an advanced type in a specialized field of learning.
. Funding shall be paid from account 1-01-26-180-001-219 as evidenced by the Chief
Financial Officer’s certificate attached hereto in an amount not to exceed $25,000.00,
subject to availability of funding in the 2021 budget.

FOR BROWNFIELD PROGRAMS IN THE CITY OF PLAINFIELD
WHEREAS, in accordance with Municipal Codes Section 2:10-8, the City of Plainfield
instituted a policy to negotiate agreements for Professional Services on the basis of demonstrated
confidence and qualifications for specific types of Professional Services required by the City;
and
WHEREAS, the City has received in accordance with the December 02, 2020 published
notice and sealed qualifications for a brownfield grant management contractor to perform work
related to the Brownfield Sites in the City; and
WHEREAS, the evolving state and federal regulations regarding management of
brownfield investigations and reporting has increased applicant and responsible party
accountability; and
WHEREAS, based upon the review of the qualifications of the 5 consulting firms that
submitted for Brownfield Management and review by the Director of Economic Development
one firm was selected; and
WHEREAS, sufficient funding for the management is available through budget account
number 1-01-26-180-001-219 ($15,000), G-02-16-791-310-432 ($8,000), and G-02-16-791-210-432 ($8,000) and subject to the adoption of the 2021 annual budget.
NOW THEREFORE BE IT RESOLVED THAT,
1. The Plainfield City Council does hereby authorizes a contract to Lewis Consulting Group to
provide brownfield management services to the City as needed and approved by the Director
of Department of Economic Development or Business Administrator for a one year period
beginning January 1, 2021 through December 31 2021;
2. The Mayor and the City Clerk are hereby authorized and directed to execute an agreement as
approved by the Office of Corporation Council, attached here to and made part hereof with
Louis Consulting Group, 2517 Highway 35, Suite P202, Manasquan NJ 08736, for a period
of one year January 1, 2021 through December 31, 2021;

WHEREAS, should the City of Plainfield be awarded the grant as hereinabove
described, the total amount of the award would be approximately $40,000. Any and all other
disbursements by the Union County Department of Human Services, Division of Individual &
Family Support Services pursuant to this grant program would be subject to availability of funds
through the end of the 2021 Fiscal Year; and
WHEREAS, the application and acceptance of said grant is in the best interest of Union
County and the City of Plainfield; and

other disbursement by the Union County Department of Human Services/Division of Planning

WHEREAS, the application to apply and accept said grant is in the best interest of the

such a grant; and, recognizes and accepts that the Union County Department of Human
Services/Division of Individual and Family Support Services, may offer a lesser or greater
amount and therefore, upon receipt of the grant agreement from the Union County Department of

RESOLUTION RECOGNIZING JANUARY AS NATIONAL SLAVERY AND HUMAN
TRAFFICKING PREVENTION MONTH
WHEREAS, during National Slavery and Human Trafficking Prevention Month, the City of
Plainfield reaffirms its unwavering commitment to the eradication of this horrific injustice.
WHEREAS, human trafficking erodes personal dignity and destroys the moral fabric of society.
It is an affront to humanity that tragically reaches all parts of the world, including communities
across our Nation. Each day, in cities, suburbs, rural areas, and tribal lands, people of every age,
gender, race, religion, and nationality are devastated by this grave offense.
WHEREAS, trafficking crimes are perpetrated by transnational criminal enterprises, gangs, and
cruel individuals. Through force, fraud, coercion, and sexual exploitation of minors, traffickers
rob countless individuals of their dignity and freedom, splinter families, and threaten the safety
of our communities. In all its forms, human trafficking is an intolerable blight on any society
dedicated to freedom, individual rights, and the rule of law.
WHEREAS, the United States took decisive steps in the global fight against human trafficking
by enacting the Trafficking Victims Protection Act of 2000 (TVPA) and the United Nations’
Palermo Protocol to Prevent, Suppress, and Punish Trafficking in Persons, Especially Women
and Children (Palermo Protocol).
WHEREAS, the TVPA and the Palermo Protocol established a comprehensive framework for
combating human trafficking by developing prevention programs, creating victim protections,
and advancing prosecutions under expanded criminal statutes to usher in the modern anti-
trafficking movement domestically and globally. These two measures illustrate a global
consensus on the issue, and yet as a Nation, we must continue to work proactively to foster a
culture of justice and accountability for this horrific crime.
WHEREAS, the City of Plainfield is committed to using every available resource, strengthening
strategic partnerships, collaborating with Federal, State and local, entities, and by introducing
innovative anti-trafficking strategies to bring the full force of our legal capabilities to help end
this barbaric practice once and for all.
WHEREAS, in January 2019, the Frederick Douglass Trafficking Victims Prevention and
Protection Reauthorization Act and the Trafficking Victims Protection Reauthorization Act
reaffirming the federal government's commitment to preventing trafficking in all forms.
BE IT RESOLVED, this month, we renew our resolve to redouble our efforts to deliver justice
to all who contribute to the cruelty of human trafficking, and we will tenaciously pursue the
promise of freedom for all victims of this terrible crime.
BE IT FURTHER RESOLVED, that January 2021 as National Slavery and Human Trafficking
Prevention Month, culminating in the annual observation of National Freedom Day on February
1, 2021. The City of Plainfield calls upon the State of New Jersey, the County of Union,
industry associations, law enforcement, private businesses, fraternal organizations, faith-based
and other organizations of civil society, schools, families, and all Americans to recognize our
vital roles in ending all forms of modern slavery.
