experience in Structural Auditing.
Details of the work are as under

Bid 1- Technical Bid
Sub: Structural Audit of Multistoried Building (Gr + 15 storied) at Colaba Bus Depot including Annexe Building (Gr + 3 storied) under Section 353-B of the MMC Act 1888 and issuing Structural Stability Certificate thereof.
1. Applications are invited for rendering ‘Consultancy Services and
submission of Structural Stability Certificate’ as required u/s 353-B of
MMC Act, 1888 from Licensed Structural Engineers registered with MCGM /
reputed firms specialized in the field of Structural Auditing and structural
repair / rehabilitation / retrofitting systems, having structural license for
Gr + 20 storied and above.
2. Under the „Scope of Contract‟, the Licensed Structural Engineer /
Firm has to carry out the Structural Auditing of the structurementioned
above. The scope mainly includes first stage of Structural Auditing
which shall include the following :-
a) Survey i.e. visual inspection of entire building from inside
and outside.
b) Taking photographs.
c) Carrying out non-destructive (ND) /semi-destructive tests on
structural members including making provision of
supporting arrangement to the structure for carrying out
tests and submitting the report.
d) Observation of distress, if any, and marking the same on
plans prepared for the purpose and preparation of structural
Audit Report.

e) Suggestions / recommendations, if any, as regards the
required structural repairs / strengthening alongwith
methodology / specification and estimated quantity / cost of
proposed work.
f) Submission of Structural Stability Certificate as required u/s
353-B of MMC Act, 1888 which shall be valid for 10 years
period.
NOTE : The report shall be submitted in the format given in
Annexure „A‟alongwith necessary supporting reports /
documents / photographs. The report shall be based on
theoretical analysis of building by preparing structural
drawings, if so required.Only Unconditional Tenders will
be considered.
3. On submission ofStructural Audit Report andStructural Stability
Certificate‟,100% payment as may be applicable as per conditions of
contract / offer shall be released by the Undertaking.
4. In case, the Structural Audit Reports suggest repairs / retrofitting
to particular part of structure prior to issue of Structural Stability
Certificate the Undertaking shall invite the tenders for such repairs /
retrofitting purpose incorporating therein necessary items as per
Undertaking’s Schedule Rates/Consultant’s suggestion for non-schedule
items. Tenders shall be invited after making budget provision for
proposed repair work/s and approving the budget by Competent
Authority. The work shall be carried out under the supervision of the
Licensed Structural Engineer/ Firm. On completion of such repairs /
retrofitting works,Licensed Structural Engineer / Firm shall submit the
„Structural Stability Certificate‟for the said structure as required u/s
Section 353-B of the MMC Act, 1888.

Under such circumstances, 75% of the total payment shall be
released after submission of report as detailed in „Clause No.2‟above and
balance 25% on submission of „Structural Stability Certificate‟. Further,
for supervision of structural repairs / retrofitting works being carried out
to the structure as per suggestions / recommendations of the successful
Licensed Structural Engineer / Firm fees at the fixed rate of 2%of the
cost of such repair / retrofitting works shall be paid separately as per the
Mode of Payment mentioned in the agreement for the purpose. The
acceptance of fees at the fixed rate of 2% of the structural repairs work is
binding and cannot be altered at later date once the offer of successful
Licensed Structural Engineer/Firm for first stage structural Auditing is
accepted by the Undertaking. The Licensed Structural Engineers / Firms
shall take this into account before submitting their offer under this
contract.
5. The successful Licensed Structural Engineer / Firm shall carry
out necessary non-destructive / semi-destructive tests necessary for
Structural Audit and the same shall be paid for separately at the fixed
rates as indicated below :-
i) Schmidt Hammer Test /Rebound Hammer Test

NOTICE : 1. The consolidated amount for ND/Semi-destructive tests
shall not exceed Rs. 2,15,000/-.
2.If any test other than those mentioned above are required
to be carried out, the payment for such test will be made as
per the rates decided by the Undertaking.
6. Remuneration :
The fees payable to the consultant for carrying out Structural
Audit and submission of 'Structural Stability Certificate' shall be
inclusive of cost of any other mobilization required such as erection of
scaffolding, labour, supporting arrangements to structure for carrying
out non-destructive tests (ND) /semi-destructive tests, submitting all
relevant documents with technical report including coloured photographs
and supervision of repair work, etc. The offer shall also be inclusive of
GSTetc. as may be applicable from time to time and shall be paid by the
successful Licensed Structural Engineer / Firm directly to the
authorities concerned.
Under Section 194 J of the Income Tax Act (Amended), Income
Tax (presently @ 10%) is deductable at source from any Professional
or Technical Fees at source from any Professional / Consultant and
the same shall be deducted through any payment due to the
Structural Engineer / Firm at the rate applicable at the time of
payment.
Based on above, the Undertaking has fixed estimated value of
structural audit work including supervision as mentioned below.The
built-up area of structures and estimated fees payable are indicative and
the Licensed Structural Engineer / Firm has to quote lumpsum fee.

The payment of lumpsum fees quoted in Bid 2 i.e. Financial Bid as
per terms & conditions put to para 3 and 4 hereinabove. Submission of
„Structural Stability Certificate‟as required u/s 353-B of the MMC Act,
1888 for the structure is mandatory for successful completion of the
assignment under this contract.
7. Earnest Money Deposit :
The Earnest Money Deposit / Initial Security Deposit shall be
accepted only in Cash or by Demand Draft drawn in favour of ‘The BEST
Undertaking’ from any Nationalised Bank or Schedule Bank in Mumbai.
Other deposits with the Undertaking will not be permitted to be set off
against the deposit of this tender.
The Earnest Money Deposit (EMD) shall be paid in Cash / Demand
Draft in the Cash Department of the Undertaking between 09.30 a.m.
and 12.30 p.m. or between 01.30 p.m. and 03.00 pm. on week days or
before 12.30 p.m. on the day of opening of tender. The xerox copy of
receipt of the Earnest Money Deposit (EMD) / Permanent Earnest Money
Deposit (PEMD) shall be enclosed with tender documents.
Tender will not be opened unless the EMD/ corresponding
PEMD is paid on or before the stipulated time.
8. Under Bid 2 i.e. Financial Bid, the Tenderer has to quote lumpsum
fees in figure and in words at appropriate place and shall sign the Form
of offer with Company’s Seal. The said offer shall be final and binding on
the bidders & the evaluation of the offers shall be based on the said offer.

9. The contract shall be governed by the conditions put to Notice and
the Agreement enclosed herewith. On acceptance of the offer, the
Licensed Structural Engineer / Firm shall enter into Agreement with the
Undertaking as per the Draft Agreement (enclosed). Conditions put to
Draft Agreement shall be taken into consideration while quoting the offer.

MEMORANDUM OF AGREEMENT made this ____________ day of
_________in the year 2019 BETWEEN THE B.E.S.& T. UNDERTAKING,
The Undertaking constituted by the Mumbai Municipal Corporation Act,
(hereinafter referred to as “Undertaking”of the First Part and
_____________________________hereinafter referred to as the Licensed
Structural Engineer / Firm in which expression also includes unless such
inclusion is inconsistent with the context or meaning thereof, his
successors and assignees, of the Second Part.
WHEREAS THE UNDERTAKING intends to undertake the work of
Structural Audit of its Gr + 15 storied structure including Annexe
Building (Gr + 3) storied located in Colaba Bus Depot and intends to have
‘Structural Stability Certificate’for submitting the same with the
MCGM as required under Section 353-B of MMC Act, 1888.
AND WHEREAS THE UNDERTAKING is desirous of engaging the
services of the eligible Licensed Structural Engineer / Firm for carrying
out engineering consultancy and for detailed survey of the said structure
and submit Structural Stability Certificate and Report, if structure is
found fit for human habitation without any major repairs OR to suggest
methodology of repair alongwith detailed report for carrying out structural
repairs to the structure and issue the Structural Stability Certificate after
completion of said repair works .
AND WHEREAS the Licensed Structural Engineer / Firm has
agreed to render above said services involving the engineering consultancy
services on the terms and conditions contained herein below for the
consideration of accepted lumpsump fees put to tender 'which is
excluding cost of testing and fixed fees @ 2% for supervision of structural
repairs, if any which is to be paid separately.

The details of payment are as under:

AND WHEREAS the General Manager in pursuance of the powers vested
to him by the MMC Act has accepted the above proposal of the Licensed
Structural Engineer / Firm.
NOW THE PRESENT WITNESSETH AND it is hereby declared and
agreed by and between the parties here to as follows :-
1.0 Duration and termination of the appointment.
1.1 The appointment of the Licensed Structural Engineer / Firm shall
be considered to have come into force from______________ i.e. the
date of issue of work order.
1.2 Should circumstances arise which call for modifications of this
agreement, these may be made by mutual consent given in writing.
Proposal in this respect from one party shall be given due
consideration by the other party.
1.3 This Agreement shall continue to be in force for an initial period of
one year from the date of its coming into force or until such time as
is required to complete the on-going project assigned under this
agreement unless it is terminated in accordance with Clause
No.1.7. Thereafter, it may be extended and continued for such
further period and on such terms and conditions as the parties
may mutually agree to in writing.
1.4 This Agreement shall not be dissolved by the supersession of the
General Manager. Its rights and obligations shall pass to his
successors.
1.5 Should the Licensed Structural Engineer / Firm, being an
individual, die or be prevented by illness or any other

circumstances beyond his control from performing his obligations
or having performed it entirely, the Agreement shall come to an end
without prejudice to the accrued rights of either party against the
other.
The B.E.S.& T. Undertaking shall in that case owe to Licensed
Structural Engineer / Firm or his successors against the
surrender of documents necessary for the continuance of the work
in so far as they are available, such part of the remuneration as
corresponding Agreement, including any reimbursable costs and
these costs (if any) ensuing for the Licensed Structural Engineer /
Firm or his successors or assignees from the contracts already
entered into the respect of the reference, in so far as they are not
yet reimbursed.
1.6 Should the Licensed Structural Engineer / Firm be a partnership or
a legal entity, the agreement shall not be dissolved by the death or
retirement of a member of partnership or a director of the legal
entity.
1.7 Should the Licensed Structural Engineer / Firm be unable to fulfill
his obligations under the Agreement owing to circumstances
beyond his control or owing to some unreasonable actions of THE
UNDERTAKING towards him or because The B.E.S.& T.
Undertaking does not meet its obligations under this Agreement.
The consultant is entitled to suspend his activities and /or to
cancel the Agreement in which case the provision referred to under
clause No.7 shall apply.
1.8 In the event of a whole or part of the work being postponed or
abandoned or if for any reason whatsoever, The B.E.S.& T.
Undertaking cancels the Agreement as a whole or part thereof,
Licensed Structural Engineer / Firm shall be entitled to full
payment for the work done upto the time of cancellation as per
clause No.5.
10 1.9 In the event of failure on the part of Licensed Structural Engineer /
Firm to render satisfactory services to The B.E.S.& T. Undertaking
as described in the Clause 7 and if The B.E.S.& T. Undertaking
cancels the agreement as a whole or part of it, Licensed Structural
Engineer / Firm will receive proportionate payment as per clause
No.7.
1.10 The Licensed Structural Engineer / Firm shall not have the right to
assign or transfer the benefits or obligations of this Agreement or
any part thereof, without the consent of The B.E.S.& T.
Undertaking.
However the Consulting Engineer/Firm shall seek prior approval of
The B.E.S.& T. Undertaking for accepting another partner or
partners (or directors) for inclusion in the expression ‘Licensed
Structural Engineer / Firm’.
2 The Obligations and Rights of the Licesnsed Structural Engineer/Firm.
2.1 The Licensed Structural Engineer / Firm shall in all professional
matters act as a faithful advisor to The B.E.S.& T. Undertaking. In
so far as any services which are of discretionary nature, he shall act
fairly between The B.E.S.& T. Undertaking and the contractor/s.
2.2 The Licensed Structural Engineer / Firm shall exercise all
reasonable skill, care and diligence in discharging his duties under
this Agreement.
2.3 The B.E.S.& T. Undertaking shall furnish all pertinent data and
information available with it and shall give such assistance as shall
reasonably be required by the Licensed Structural Engineer / Firm
for carrying out of his duties under this Agreement.
2.4 The compensation of the Licensed Structural Engineer / Firm
charged to The B.E.S.& T. Undertaking according to Clause No.5 of
the Agreement shall constitute his only compensation in connection
with this Agreement, which inter-alia, implies that he shall not

accept any trade commission discount, allowance or indirect
payment in connection with the Underlying work.
2.5 The Licensed Structural Engineer / Firm shall not have the benefit,
whether directly or indirectly, of any royalties on or of any gratuity
or commission in respect of any patented or protected product or
process used on or for the purpose of this Agreement, unless it is
mutually agreed to allow him to do so.
2.6 The Licensed Structural Engineer / Firm shall normally not make
any change in the repair / retrofitting proposal, once finalized
without the prior approval of the Undertaking. In the event of such
situation, however, which in the opinion of the Licensed Structural
Engineer / Firm requires immediate action in the interest of the
B.E.S.& T. Undertaking, the Licensed Structural Engineer / Firm
shall have requisite authority required on behalf of and at the
expense of the B.E.S.& T. Undertaking.
2.7 The Licensed Structural Engineer/Firm shall be required to perform
supervision of repair/retrofitting.
2.8 The Licensed Structural Engineer/Firm shall not be a medium of
payment on behalf of the B.E.S.&T. Undertaking to the contractor(s)
and/or supplier(s). He shall not be required to make measurements
of works for billing. However, he shall issue Quality Certificate for
the work done to enable the Undertaking to release payment to the
contractor(s)/supplier(s).
2.9 The B.E.S.& T. Undertaking shall give its decisions about all
sketches, drawing, reports, recommendations and quantity of the
work laid before it by the Licensed Structural Engineer / Firm in
such reasonable time as not to delay the work of the Licensed
Structural Engineer / Firm.
2.11 In rare case, the Licensed Structural Engineer/Firm may require
the assistance of other consultants or experts in certain specific
disciplines. In such a case, the Licensed Structural Engineer/Firm

may request the B.E.S.&T. Undertaking in writing for such
assistance giving complete justification for the same. He shall then
be entitled to charge ensuing cost to the B.E.S&T. Undertaking
when such prior approval in writing has been obtained.
2.11 Ownership of the documents and the copy rights: All documents prepared by the Licensed Structural Engineer /
Firm, in connection with this agreement including all reports, notes,
plans and drawings, design calculations, data prepared and
complied etc. and submitted to the Undertaking, copy rights in
connection with the above document will vest with the B.E.S.& T.
Undertaking.
2.12 The Licensed Structural Engineer / Firm shall have the right,
subject to the B.E.S.& T. Undertaking’s approval, which shall not
be withheld unduly, to publish descriptive clauses with or without
illustrations relevant to the underlying work either on his own
account or in conjunction with other parties.
3 Liabilities of the Licensed Structural Engineer/Firm.
3.1 The Licensed Structural Engineer / Firm shall be liable for the
consequence of errors and omissions on his part, or on the part of
his employees, in so far as specified in this agreement, and to the
extent and limitations mentioned hereunder.
3.2 The liability of the Licensed Structural Engineer / Firmdoes
not cover costs of consequential damages, if any which may
occur to structure during progress of structural repairs /
retrofitting work.
3.3 The liability of the Licensed Structural Engineer / Firm against
repair works shall expire after defect liability period of the Repairs /
Retrofitting (if any, carried out). If any defect is detected at the time
of inspection during the defect liability period, the Licensed
Structural Engineer/ Firm will suggest, remedial measures for the
same without any extra cost.
13 3.4 The Licensed Structural Engineer/Firm has no liability whatsoever for
any part of the work for which the liability rests with the
contractor(s) or supplier(s).
3.5 The Licensed Structural Engineer / Firm shall have no liability
whatsoever for any damage resulting from any act of the
contractor(s) or supplier(s) which is not in accordance with the
relevant contract document or the Licensed Structural Engineer’s /
Firm’s instructions and provided that he has brought out such acts
to the notice of the Engineer in time.
3.6 Licensed Structural Engineer / Firm shall be responsible for
the safety and stability of the scaffolding / staging or any
temporary structures or working platforms erected during the
progress of repairs / retrofitting work.
4 SCOPE OF WORK :
4.1 The scope of the services to be performed by the Licensed
Structural Engineer / Firm for the B.E.S.& T. Undertaking under
this agreement shall be as follows :
I) After carrying out preliminary survey / tests, the Licensed
Structural Engineer / Firm shall assess the condition of the
structure based on findings of N. D. Tests etc. and issue the
'Structural Stability Certificate and Report'indicating that the
structure is fit for human habitation ORshall consider the
various feasible alternatives of structural repair / retrofitting
if so required for the building /s entrusted to him and
choose/ work out the most cost effective repairs for
enhancing the service life of the structure as also considering
future maintenance aspects and prepare repair/retrofitting
methodology for the purpose of inviting bids from contractors
which shall include :-
i) Carrying out detailed survey / analysis of the entire
building.

ii) Preparing preliminary drawing for specialized repairs /
retrofitting and such other detailed drawings as are
necessary to strengthen weak structural elements.
Available structural drawings of the structure shall be
obtained from the Undertaking.
iii) Carrying out any other test required in connection with
works (cost of testing to be paid separately at fixed rate
mentioned in Clause No. 5 of Notice).
iv) Preparing plan for propping system to be provided to
ensure structural safety, if found necessary.
v) Preparing detailed measurement sheet and estimated
cost of various items necessary to carry out
repairs/retrofitting to the structure in consultation with
the Engineer and give specifications for repair
methodology. The documents and preliminary designs
shall be prepared in sufficient details within three
months from the date of issue of Acceptance letter or as
may be instructed by th Undertaking to enable it to
invite competitive tenders for the repair/retrofitting
work.
vi) Preparing Specifications and special conditions of
contract, if any applicable to the work.
vii) Preparing detailed structural analysis based on N.D.
Tests and other tests results and to evaluate the overall
structural condition of the building.
viii) Submission of report / documentation with coloured
photographs.
II) In the event of adoption of repair / retrofitting methodology
suggested by the Licensed Structural Engineer/Firm for
execution, the Licensed Structural Engineer / Firm shall

prepare all the required working drawings and details within
time limit, as stipulated to him so as to complete the work
within contract period.
III) The Licensed Structural Engineer / Firm shall provide
supervision by appointing Supervisor &by periodic visits by
experts/licensed Engineer for the work to guide, discuss and
solve difficulties experienced in the execution of work as may
be required by the B.E.S.& T. Undertaking.
IV) The Licensed Structural Engineer / Firm shall suggest
measures to enforce quality control standards in conformity
with the relevant IS Codes.
During the execution of the project, for any unavoidable
reason, should any extra item of work crop up, then the
Licensed Structural Engineer / Firm shall review the item and
recommend the same, provided no other suitable alternative
is found feasible in the circumstances. The Licensed Structural
Engineer / Firm shall also scrutinize contractor’s claims and
give its recommendations.
V) For the above services rendered by the Licensed Structural
Engineer / Firm no separate payment will be made by the
B.E.S.& T. Undertaking other than that provided in Clause
No. 5below. The frequency of meetings shall be as per the job
requirement.
VI) To submit Structural Stability Certificate of building
indicating that the structure is fit for human habitation on
Completion of Repair or Retrofitting(as the case may be).
EXCLUSIONS: The scope of the services described herein above exclude any type of actual execution of repair/retrofitting work.
5. COMPENSATION :
Compensation or fees payable to Licensed Structural
Engineer / Firm:

The payment shall be made based on lumpsum fees quoted
under Financial Bid and as per mode of payment mentioned under
‘Tender Notice’/ Technical Bid.
5.1 In case the Licensed Structural Engineer / Firm submits the
Structural Stability Certificate & Structural Audit Report as
required under Section 353-B of MMC Act, 1888, without any
structural repairs / retrofitting etc., the 100% fees against
individual structure as stipulated above shall be paid on
submission of ‘Structural Stability Certificate’(valid for 10 years
alongwith supporting detailed Structural Audit Report and N.D.
Tests results, etc. as per the requirement of MCGM.
5.2 In case the Licensed Structural Engineer / Firm suggest major
structural repairs / retrofitting to particular structure, the Mode of
Payment in such an eventuality shall be as under :-
i) 75% of quoted fees as stipulated above shall be paid on
submission of detailed reports including N.D. Tests Report /
estimated quantity of structural repairs / retrofitting work
required for the building / structure and accepted by the
Undertaking.
ii) Based on the structural repairs suggested, Undertaking shall
invite the tenders for said repair works based on
Undertaking’s ‘Schedule of Rates’. The said work shall be
carried out under supervision of the Licensed Structural
Engineer / Firm for which they shall be paid at fixed rate of
2% on cost of said repair work. For purpose of computation
of this fee, the cost of ‘Repair Works’ shall include the cost as

detailed in Clause 5.3 hereunder. On completion of said
repair works the Licensed Structural Engineer / Firm shall
submit Structural Stability Certificate (valid for 10 years) as
required under Section 353-B of MMC Act.
iii) Balance fees (25%) shall be paid on submission of Structural
Stability Certificate.
NOTE : Fees for various N. D. Tests / Semi-destructive Tests shall be paid
separately as per the Schedule Rates stipulated in NOTICE.
5.3 (a) For the purpose of computation of the fees (@ 2% of repair
work) under the Clause No.5.2(ii) the cost of work / project shall
include cost of the entire work (at quoted rates by succesful
tenderer), specified and carried out under general supervision of
Licensed Structural Engineer / Firm and shall include, the costs
of all material, labour, use of plant and equipment, overheads and
profits, escalations (if any) etc, payable to the contractor and
without deduction of any penalties, liquidated damages or any
other amounts that may be withheld from the contractor’s bills.
(b) For the purpose of computation of the fees (@ 2% of repair
work) payable to the Licensed Structural Engineer / Firm, the cost
of the work carried out by the contractor shall not
includefollowing :-
i) The fees payable/paid to the Licensed Structural
Engineer / Firm including payments for non destructive and
any other tests, fees payable to specialist consultants and
experts.
ii) Cost of technical and administrative supervision of the
work by the Undertaking.
iii) Costs incurred in relocation of underground utilities
and services unless any technical problem arising out of
this relocation work is referred to the Licensed

Structural Engineer / Firmfor advice, in which case, this
cost shall be included in the computation of fees.
iv) Water and Sewerage charges and any other charges of
Statutory Authorities as per the rules in force and any other
incidental charges.
6 Schedule of payments to the Licensed Structural Engineer /Firm under Clause No.5.2(ii).
(A) 95% of the amount of Consultancy fees (as stipulated under
Clause No. 5.2(ii) will be paid progressively during the execution of
the work. During this phase, the Licensed Structural Engineer /
Firm will perform the following duties:
i) Provide technical supervision for the work, make such
site visits, as Licensed Structural Engineer may consider
necessary to acquaint himself with technical performance and
progress of the work and also resolve any technical difficulties
experienced at the site in course of execution of work.
ii) Carry out tests at random to assess the quality of
repair works and advice rectification, if any.
iii) Advise the Undertaking on the need to vary any part of
the work with reason(s).
iv) Scrutinize and approve with or without modifications
Contractor’s construction procedures, design and details of
temporary works, handling and erection methods etc.
v) Scrutinize and approve Contractor’s proposals for
performance tests and inspect the work or parts thereof.
(B) The balance 5% of the amount of total fees payable under
Clause No.5.2(ii) shall be released at the end of defect liability
period (36 months after completion) of repair work carried
out by the contractor.

(C) The Licensed Structural Engineer / Firm shall for the
Undertaking’s record deliver one complete set of completion
drawings on reproducible tracing paper or mounted on
canvas. Bills submitted by Licensed Structural
Engineer/Firm shall be paid in full within 45 days of their
submission.
7. TERMINATION OF CONTRACT / PROPORTIONATE FEES : If the Licensed Structural Engineer / Firm fails or neglects duties
as stipulated in agreement, the Undertaking reserves the right to
terminate the contract by giving notice specifying reasons. In such
an eventuality, the said Licensed Structural Engineer / Firm shall
be blacklisted permanently from carrying out any work with the
Undertaking. In addition, Fees payable to the Licensed Structural
Engineer / Firm shall be liable to be reduced by THE
UNDERTAKING in such proportion as may be decided by the
competent authority in following cases :
i) Failure or negligence of the Licensed Structural Engineer /
Firm to carry out their duties as prescribed in this agreement.
ii) If the estimate for repairs prepared are found to be
unrealistic causing heavy financial burden on the Undertaking.
iii) Negligence in giving technical advise during periodical site
visits.
This action will be without prejudice to any other action which may
be taken as deemed fit by the Undertaking.
AND/OR
If the B.E.S.& T. Undertaking, does not meet its obligations under this
Agreement or the Licensed Structural Engineer / Firm is unable to fulfill
his obligation under the Agreement owing to circumstances beyond his
control, he is entitled to suspend his activities and /or cancel the
Agreement with due notice to B.E.S.& T. Undertaking.
20 Decision of the General Manager shall be final and binding on both the
parties in case of any dispute.
8. COMMUNICATION: All communications between the Undertaking and the Licensed
Structural Engineer / Firm to the project shall be addressed as
follows, unless otherwise notified in writing.
